HomeMy WebLinkAbout860835.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 914 - RHINIE AND ALICE MILLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, on the 13th day of August held a public public meeting in the Chambers of the Board , considered whether a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 914 , comes within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 914 was submitted by Rhinie and Alice Miller for property which is located in part of the Nk NEa, Section 29 , Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded , and WHEREAS , this request is to divide the property into parcels estimated to be approximately 4 acres and 75 acres , and WHEREAS, the vote at the meeting of August 13 , resulted in a 2-2 tie, and it was determined that Commissioner Lacy, who was excused from said meeting, would listen to the tape, review the submitted application, and cast the deciding vote at the meeting of August 20 , and WHEREAS , at the meeting of August 20 , Commissioner Lacy, having reviewed the records , cast a vote in favor of approving Recorded Exemption #914 for Rhinie and Alice Miller; therefore, said request is approved on a vote of 3-2. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms, "subdivision" and "subdivided land" . 860835 Page 2 RE: RE #914 - MILLER BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The parcel of land on which this request is being made is described as part of the Ni NE} of Section 29, T6N, R64W of the 6th P.M. , Weld County, Colorado. The property is located approximately one mile west of Gill, south of Weld County Road 66 and west of Weld County Road 53. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 4 acres, more or less, and 74.5 acres, more or less. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be denied for the following reasons: The applicant has not demonstrated that the proposal is consistent with efficient and orderly development. The subject site is over four miles from an incorporated municipality and is surrounded by the majority of 80 acres or larger parcels of land. The Miller's originally owned 80 acres. In 1981, a recorded exemption was approved which created a 79 acre tract and a 1.14 acre tract. To date, the 1.14 acre tract has a residence located on it, and the 79 acres remains vacant. This recorded exemption application is for the purpose of dividing 4 acres off of the 79 acres the Millers retained. The further subdivision of this parcel in the agricultural zone district, outside of a projected town growth area, is not consistent with orderly development and evades the intent of the Weld County Subdivision Regulations. 860835 Board of County Commissioners August 13, 1986 Page 2 The Agricultural Zone district was established to maintain and promote agriculture as an essential feature of Weld County. It is intended to provide areas for the conduct of agricultural activities without the interference and encroachment of other more intensive land uses. The request, if approved, will allow for the potential of an additional residence not currently allowed under the existing land-use regulations. Scattered residential development in rural areas necessitates an increased demand for education facilities, roads and bridges, utilities, police and dire protection, and other services. Rural residential development, at some point in time, reaches a level where it begins to interfere with and encroach upon the agricultural activities in an area. The Department of Planning Services staff feels that this proposal is not consistent with the intent of the Agricultural Zone district, or the policies of the County. The four acres is located above the irrigation ditch which is the water source to irrigate the remaining 74-1/2 acres. The four acre parcel cannot be irrigated as there is no way to get water to it. It is dryland native pasture located on the corner of WCR 66 and 53. This proposal is consistent with the policies of the Weld County Comprehensive plan in that the uses and nature of the land will not be changed by this process. The land now in question is zoned agriculture and shall remain with primary agriculture use, thus insuring the proposal is consistent with the intent of the zone district in which the subject property is located. Uses that will be permitted are limited to those permitted by the County Agriculture Zoning Ordinance which includes crop, pasture, and limited animal husbandry. This is compatible with existing surround- ing land uses as these are presently engaged in the same uses. The uses permitted will be compatible with the future development of the surrounding area as permitted by the existing -zone and with future development as projected by the comprehensive plan of the County. The property in question is not located within a 3 mile radius of any municipality. This proposal will not be inconsistent with efficient and orderly development as possible development will involve only one, one-family residence being added to each parcel which will not increase the density of the surrounding area. Sewage disposal methods are septic systems in the area, which have been shown to be effective in the area. The North Weld Water District doss provide service to the area and will provide a tap for the parcel. The property under consideration is not located in a flood plain, geologic hazard, or Weld -County Airport overlay district. _This application complies with section fifty (50) , overlay district regulations as outlined in the Weld County Zoning Ordinance.
