RESOLUTION
RE: APPROVE USE BY SPECIAL REVIEW FOR AN OVERNIGHT LODGING
SHELTER FOR HOMELESS PEOPLE - ARCHDIOCESE OF DENVER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 11th day of February, 1987 , at the hour of 2 : 00
p.m. in the Chambers of the Board for the purpose of hearing the
application of the Archdiocese of Denver, c/o St. Peter' s Parish,
915 12th Street , Greeley, Colorado 80631 , for a Use by Special
Review for an overnight lodging shelter for homeless people on the
following described real estate , to-wit :
Lots 9 , 10 , and 1 except the north 12 feet ,
Espanola Subdivision, Weld County, Colorado
WHEREAS , said applicant was represented by John Cordova and
Clifford DeLude , and
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
-of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :

a. The proposal is consistent with the Weld County
Comprehensive Plan in that the proposed use is
located in an urban growth boundary area. Land-use
development proposals within an urban growth
boundary area are encouraged so long as they
conform to the desires of the municipality as
Expressed in its Comprehensive Plan or its land-use
_decision making body and if the municipality has
agreed to provide services . The Greeley Planning
Commission has recommended no objection to the
proposal with two conditions . These conditions of
approval are addressed in the Development
Standards . The City of Greeley provides water and
sewer services to the property.
b. The proposed use is consistent with the intent of
the A (Agricultural) Zone District and is provided
for as a Use by Special Review permit in the -Zoning
Ordinance.
c. The proposed use will be compatible with the
existing surrounding land uses and the future
_development of the surrounding area. The existing
surrounding land uses are predominantly
residential. A church and neighborhood store are
located on adjacent lots . The development of the
surrounding area is anticipated to remain the same
in the future with little or no changes.
d. The property does not contain productive
agricultural land. -Espanola Subdivision existed
prior to the adoption of the County' s land-use
regulations . Weld County and the City of Greeley
recognize the subdivision as a nonconforming
subdivision.
e. The property is located in the A-P (Airport)
Overlay 1District . Structures at this location
would not be allowed over 502 feet in height. The
existing structure does not exceed this height . No
other overlay districts affect the site .

f. Use by Special Review Development Standards will
provide adequate protection of the health, -safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an overnight shelter for homeless people
on the hereinabove described parcel of land be, and hereby is ,
granted subject to the following -conditions :
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity shall not occur until
the following items have been accomplished:
a. The applicant obtains the required licenses and
approval for the food service facility. Evidence
of approval shall be provided to the Department of
Planning Services .
b. The Use by Special Review plat is amended to show
the off-street parking spaces end setbacks from
property lines . The plat shall also reflect the
twenty-five percent gross lot open space
requirement.
c. The east side of Lots 10 and 1 are fenced to
prevent access to the property from North 25th
Avenue.
d. -The following note shall be placed on the -Use by
Special Review plat : Before any food preparation
is undertaken on the premises , approval and any
required licenses will be obtained from the Weld
County Health Department . Evidence of this
approval will be provided to Weld County Department
of Planning Services .

DEVELOPMENT STANDARDS
Archdiocese of Denver

1 . The Use by Special Review permit is for an overnight lodging
shelter for homeless people as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein. The
facility is designed to provide sleeping quarters for twenty
people.
2 . A minimum of four off-street parking spaces shall be provided
on the property. The spaces shall be constructed in
accordance with Section 41 . 1 .2 of the Weld County Zoning
Ordinance. No parking shall occur within twenty-five feet
from the front property line (North 25th Avenue Court) ,
twenty feet from the east property line (North 25th Avenue)
and five feet from the north and south property lines.
3 . Ingress and egress to the property shall be restricted to
North 25th Avenue Court. The east side of Lots 10 and 1
shall be fenced to prevent vehicular traffic from entering
the property from North 25th Avenue.
4 . No parking shall be permitted on North 25th Avenue Court or
North 25th Avenue by persons employed at or using the shelter
facility.
5 . A minimum of twenty-five percent gross lot area shall be
maintained as open space on the property.
6 . The food service facility shall be constructed, licensed, and
operated in compliance with the rules and re-gulations
governing the -sanitation of food service establishments in
the State of Colorado.
7 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
8 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
9 . The property owner shall be responsible for complying with
the Operation Standards of Section 24 .6 of the Weld County
Zoning Ordinance.

10 . Personnel from the Weld County Health Department , Western
Hills Fire Frote-ction District , and Weld County Department of
Planning Services shall be granted access onto the property
at any reasonable time in order to insure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations .
11 . The Use by Special Review area shall be limted to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviation
from the plans or Standards -as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
12 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards . -Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .

A public hearing was conducted on February 11, 1987, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 28, 1987, and
duly published January 29, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the request of the Archdiocese of
Denver for a Use by Special Review for an overnight lodging shelter for
homeless people. Lee Morrison, Assistant County Attorney, made this
matter of record. He also advised the representatives of the applicant
that, only three Commissioners currently being present, and the hearing
requiring three affirmative votes for approval, they could proceed with
the hearing at this time or request that the hearing be continued to a
time when at least four Commissioners would be present. After a short
conference, John Cordova stated that the applicants wished to proceed
with this hearing. Keith Schuett, representing the Planning
Department, read the favorable recommendation of the Planning
Commission, subject to two Conditions and twelve Development Standards,
into the record. (Let the record reflect that Commissioner Johnson
arrived during the reading of the Planning Commission recommendation.)
Mr. Morrison stated that Commissioner Johnson, having arrived during
the reading of the Planning Commission recommendation, which she had
already reviewed, would be allowed to participate in the vote on this
request. Clifford Delude came forward to represent the applicant. He
said that a letter has been submitted to the Planning staff regarding
the food service, which indicates that no license is required at this
time. He also reported that the lot has been fenced and an amended
plat has been submitted. Mr. Schuett stated that the Planning staff
would like to recommend that a note regarding food preparation on the
premises be placed on the plat. No public testimony was offered
concerning this request. Commissioner Brantner moved to approve the
request for a Use by Special Review, subject to the recommendations of
the Planning Commissi-on and Planning staff. Seconded by Commissioner
Yamaguchi, the motion carried unanimously.

Re: Guadalupe Center--Food Service
Date: February 9, 1987
We have been working closely with Wes Potter, Director Health
Protection Services, Weld County Health Department regarding
food service at Guadalupe Center.
No food will be cooked or prepared at the Center. Only snacks,
not meals, will be available. At this time we do not have refrig-
eration facilities, but will obtain a NSF approved refrigerator.
Until that time no food will be stored at the Center. Snacks will
be brought in just prior to serving.
We will continue to work cooperatively with Wes Potter of the Weld
County Helath Department on all food service plans.

Before any food preparation is undertaken on the premises, approval
and any required licenses will be obtained from Weld County Health
Department. Evidence of this approval will be provided to Weld
County Department of Planning Services.

Planning Services staff. Mr. McRae stated they have no objections to any of
the staff's recommendations.

LEGAL DESCRIPTION: Lots 9, 10, and 1 except the north 12', Espanola
Subdivision.
LOCATION: 1516 North 25th Avenue Court, Greeley, Colorado.
APPEARANCE:
Cliff Delude, Volunteer Administrator for St. Peter's Parish. This building
is over fifty years old. It was once used as a social center, but has not
been used for anything for the past several years. There will be a
permanent live—in manager on site. The hours of operation are will be from
7:00 p.m. to 7:00 a.m. and the maximum length of stay for individuals using
the facility will be approximately one week. -There will be only two large
rooms used for the overnight shelter, but families will not be turned away.
Management will be under the Catholic Community Services, and they do not

plan to receive additional funding from other sources. This is strictly for
overnight lodging. No food or medical care will be provided. They may
bring in prepared snack foods, but no cooking will be done on site for the
overnight guests at this time. There will be kitchen facilities available
for the manager's own use.
The Chairman asked if they had reviewed the recommendations, conditions, and
Development Standards as outlined by the department of Planning Services.
He stated they have no objections to these recommendations and standards.
The Chairman called for discussion from the members of the audience.
Reverend Ramos, Spanish Assembly of God Church, Sterling, Colorado, reported
he is not against this request, but he is against the use of Lot 1. This
property belongs to him, and on Sunday Morning, Sunday Evening, and
Wednesday Evening they hold services in their church which is just across
the street. Lot 1 is used for parking. Reverend Ramos presented a quit
claim deed he felt gave him ownership of Lot 1.
Bruce Barker reviewed the deed presented by Reverend Ramos and the deed
submitted with the application materials from the Archdiocese of Denver.
Both deeds determined all but the north twelve feet of Lot 1 belonged to the
Archdiocese of Denver.

LEGAL DESCRIPTION: Part of the NEk SWk and N} SEk of Section 31, T6N, R65W
of the 6th P.M. , Weld County, Colorado.
LOCATION: North of Greeley and west of 11th Avenue.
APPEARANCE:
Don Carroll, Weld County Engineering Department, represented the applicant.
This facility is located at 911 North 11th Avenue. This is an existing
building used for offices and existing gravel pits. Since this is an
amendment to a current operation they have all permits necessary to operate
the gravel pits. There is a motorgrader test course at this site, and the
Department of Human Resources have been moved to facilities at this site.
They have been reclaiming the gravel pits as they go along. There is no
additional land being added to this site.
Bruce Barker stated Section 25.8 of the Weld County Zoning Ordinance defines
a major facility of a public utility. The Planning Commission's decision on
this request will be final unless the it recommends denial in which case the
applicant may then request a hearing with the Board of County Commissioners.
The Chairman asked the applicant if they had reviewed the recommendations,
conditions, and Development Standards as outlined by the Department of
Planning Services staff . Mr. Carroll stated they have no objections to any
of these recommendations.
The Chairman called for discussion from the members of the audience. There
was none.

Paulette Weaver moved Case Number Amended SUP-369:86:59 for Weld County For
a Use by Special Review permit for an open-cut gravel pit and office be
approved by the Planning Commission based upon the recommendations,

are predominantly residential. A church and
neighborhood store are located an adjacent lots. The
development of the surrounding area is anticipated to
remain the same in the future with little or no changes.
- The property does not contain productive agricultural
land. Espanola Subdivision existed prior to the
adoption of the County's land-use regulations. Weld
County and the City of Greeley recognize the subdivision
as a nonconforming -subdivision.
- The property is located in the A-P (Airport) Overlay
District. Structures at this location would not be
allowed over 502 feet in height. The existing structure
does not exceed this height. No other overlay districts
affect the site.
- Use by Special Review Development Standards will provide
adequate protection of the health, safety and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon

1. The Use by Special Review permit is for an overnight lodging shelter
for homeless people as submitted in the application materials on file
in the Department of Planning Services and subject to the Development
Standards stated hereon. The facility is designed to provide sleeping
quarters for twenty (20) people.
2. A minimum of four (4) offstreet parking spaces shall be provided on the
property. The spaces shall be constructed in accordance with Section
41.1.2 of the Weld County Zoning Ordinance. No parking shall occur
within twenty—five (25) feet from the front property line (North 25th
Avenue Court) , twenty (20) feet from the east property line (North 25th
Avenue) and five (5) feet from the north and south property lines.
3. Ingress and egress to the property shall be restricted to North 25th
Avenue Court. The east side of Lots 10 and 1 shall be fenced to
prevent vehicular traffic from entering the property from North 25th
Avenue.
4. No parking shall be permitted on North 25th Avenue Court or North 25th
Avenue by persons employed at or using the shelter facility.
5. A minimum of twenty-five (25) percent gross lot area shall be
maintained as open space on the property.
6. The food service facility shall be constructed, licensed, and operated
in compliance with the rules and regulations governing the sanitation
of food service establishments in the State of Colorado.
7. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
8. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
9. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
10. Personnel from the Weld County Health Department, Western Hill Fire
Protection District, and Weld County Department of Planning Services
shall be granted access onto the property at any reasonable time in
order to insure the activities carried out on the property comply with
the Development Standards stated hereon and all applicable Weld County
Regulations.

We, the undersigned, approve of the use of the old recreation hall , at 1516 N. 25th
Avenue Court, as an overnight shelter for homeless people. We live within 500 feet
of the hall . We understand that the shelter will be operated by Catholic Community
Services and rules will be strictly enforced that include: quiet hours , no use of
drugs or alcohol , and no checking into the shelter under the influence.

The -only improvement located on the property is the existing 'building

25th Avenue may not be an authorized access, but is being used for that
purpose. Portions of the property directly east of the 'building are paved.

This is a proposal to remodel a 24' by 64' concrete and frame structure,
ocate-d at 1616 North 25th Avenue Court, -for use as -an overnight shelter for
people with no housing available.
The need for this type of shelter is critical because of the lack of
facilities for the homeless in the Greeley area. (See attached D.A.V. Letter) .
The existing use of properties to the West and South is single-family
residential , and agricultural to the North and East. There are residenti-al
ructures within 100 feet of -the subject property.
This shelter would be operat-ed by Catholic Community Services of Northern
Colorado and would provide sleeping quarters for about 20 people. Men and
women would be segregated in two dormitory rooms . Separate toilet and shower
facilities -for men and women would be provi-de-d. A jointly used dining/recreation
room would be available. Operating hours would be 7 :00 P.M. to 7 :00 A.M.
A live-in Manager would be responsible for operations. He, along with
his family, would live in separate but attached rooms. A relief person would be
available one night per week.
Catholic Community Services would interview and screen applicants for
shelter during regular office hours. Walk-ins would be screened by the Manager
and accepted up until 10:00 P.M. and referred to Catholic Community Services
on the next working day. A contract would be -signed by e-ach person staying at
the shelter agreeing to comply with rules and conditions.
The access route to the facility would be 0 Street. Automobiles would he
he the expected transportation for users of the shelter.
Water and sewer services are provided to the subject property by the City
of Greeley (letter attached).
Fire protection is provided by Western Hills Fire Protection District.
Smoke detectors and fire extinguishers woul-d be installed.
There would be no storage of waste, trash, debris, or junk on the property.
Commercial trash hauling service would be used for removal of same.
There is currently no provision for storm water retention on the property
and this proposal is for modification only of the interior of the existing
structure. Likewise there is no proposal for landscaping changes or erosion
control measures.
The time required for construction and start-up of the proposed usage
would -be 30 to 60 days.

open a shelter in the Spanish Colony for the homeless . The Disabled
American Veterans is strongly behind this proposal and encourages you
most urgently to favorably grant this request.
Weld County has a very chronic shortage of facilities for the
homeless . There is no true shelter within the confines of this county
for people in this catagory. At present , homeless people -are placed
in temporary lodgings by the Salvation Army or some other organization
for one or two nights , on a very randomized basis . Were this 2000
years ago, we would not be in any better position than the town
fathers in Bethlehem. We sincerely ask that you give due
consideration to approving the land usage change propesed by Catholic
Social Services .

This proposal is consistent with the Weld County Comprehensive Plan and
the intent of the district in which the proposed use is located that it
diverts no agricultural land to other usage. The proposed change is to the
interior of an existing structure located in a residential area.
The health, safety and welfare of the inhabitants of the neighborhood and
the county would be protected by strict enforcement of rules and regulations
that include: quiet hours , no use of drugs or alcohol , and no checking into
the shelter under the influence.
The subject property is located at the Northeast corner of Espanola
Subdivision, better known as "Spanish Colony" . A church is locatedidirectly
West, with residential property otherwise South and West. North, across 0
Street and East, across 25th Avenue are agricultural land usages. The use of
this property for an overnight lodging will be compatable with the residential
usage of the subdivision. Because this usage is within an existing residential
subdivision it is consistent with the comprehensive plan of the county and the
master plan of the City of Greeley.
The subject property is not located in any flood plain or geologic hazard
area. It is located in the Weld County Airport overlay district, however, there
are no violations of the districts requirements. The application complies with
section fifty (50) , overlay district regulations as outlined in the Weld County
Zoning Ordinance.
A copy of a letter from the City of Greeley verifying water and sewer service
to the subject property is attached.
A copy of the deed to the subject property is attached. The property is
deeded to the Archdiocese of Denver in the care of St. Peter' s Parish of Greeley.
A letter is attached granting power of attorney to the agent for this application
from the property owner.
A certified list of the names , addresses and corresponding parcel
identification number assigned by the Weld County Assessor of the owners of
property within five hundred (500) feet of the subject property is attached.
There were no records found of mineral owners on or under the parcel of
land in the application.
A copy of a soil report prepared by the Soil Conservation Service is
attached. There are no indications of the existence of any soil limitations
for the use proposed.
