WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of December, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Monfort of Colorado, Inc. , P.O. Box G, Greeley, Colorado 80632 , to amend a Special Review permit for expansion of an agricultural service establishment on the following described real estate, to-wit: Part of the N+ , Section 30 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Kay Norton, Attorney, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is located within the urban growth boundary area of the City of Greeley and is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Area Goals and Policies . The Greeley Planning Commission reviewed P/ , , 871514 " 1) • Page 2 RE: AMENDED SPECIAL REVIEW PERMIT - MONFORT this proposal on November 24, 1987 , and recommended approval. b. The proposed use is consistent with the intent of the A (Agricultural) Zone District. Land within the existing Monfort Headquarters area is being utilized for the proposal. The Comprehensive Plan supports the location of agricultural service establishments in agricultural districts on non-prime farmland. c. The proposed use is compatible with the surrounding land uses and with future development of the surrounding area as permitted by the A (Agricultural) Zone District. The surrounding land uses include the Monfort Corporate Headquarters, shops , grain bins , and storage areas . The subject site is located approximately one mile north of Greeley' s long-range expected growth area. Currently, there are no plans to provide the surrounding area with urban level services or facilities. d. The site is not located in a flood hazard or geological hazard overlay district. The site is located in the transitional zone of the Greeley-Weld County Airport Overlay District. The height of the proposed building will be approximately 4 ,775 feet above sea level. The overlay district permits a building height of approximately 5 , 640 feet above sea level at this site. e. Special Review Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application to amend a Special Review permit for expansion of an agricultural service establishment on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions : 1 . The amended Special Review permit is for an agricultural service establishment (expansion of the Monfort Corporate Complex) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . All septic system facilities shall meet Weld County Health Department Regulations . 3 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 5 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 6 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 7 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . The office addition was completed in 1986. The laboratory has not teen constructed. Both facilities are located just south of AA Street in the N1 of the NE4 of NWa and NA of NWa of NE4 -of Section 30, T6N, R6iW. This amended application for a use by special review is for the construction of a new office building in the existing Monfort of Colorado headquarters complex which is a non-conforming use in the a zone. The-existing coip rate headquarters includes the former Monfort hare (now an office building) , an office building to the east, and various associated structures of both residential and commercial use. All are located in and around the former site of the Monfort feedlots north of Greeley. The new building is required due to the relocation of Swi-ft Independent Packing Company's (SIPCO) coipurate staff from Dallas, Texas on February 1, 1988. The total number of employees at the Corporate Headquarters will now range from 230 to 260. I. _OFFICE ADDITION: The new office building will -total 20,832 SF (11,856 SF on the lacer level and 8,97_6 SF on the upper level) . It is planned to house 70-10D sales and marketing_personnel, and to provide additional general storage space. It will be located 500 feet south of AA Street, the closest public right of way, and directly south of the two existing office buildings. The new office building will sot result in a significant increase in the current number of patrons or visitors who will visit the existing office eamplex. The new _employees will work a single shift but the work hours will be staggered with starting tines ranging from 6 - 8 a.m. and closing tines varying from 4 - 6 p.m. There are no residences near this office complex. There will be no animals present in the expansion. There will be an increase in vehicular traffic due to the additional employee-s but the public impact should be negligible for the following reasons: 1. We are served by AA Street, an adequate, well maintained, paved county highway; 2. The Monfort office staff will be working staggered hours as noted above; and 071.n4 3. We intend to relocate the main entrance to the office couple-: to a safer location; and to close off the existing west entrance except to emergency vehicles. The existing facilities are served and the new building will be served by North Weld County Water District. There is adequate water capacity. The existing septic system will be enlarged to serve the needs of the new office building. The sewage system has been designed by a professional engineer, and an application has been submitted to the Weld County Health Department. The soil conditions on the site -are excellent for construction (See attached -SCS aerial photo and soils descriptions) . The land to be occupied has not been -cultivated in many years. The location of the new building is ±ixed by the existing facilities. The negligible additional debris or wastes generated by the new building will be disposed of in the same fashion as for the existing facilities. The only applicable overlay district is the transitional zone of the airport overlay distri-ct. The new office is one story high and therefore complies with the restrictions of that overlay zone. The Monfort Headquarters facility is served by the Eaton Fire Yrotectivn District. A hydrant is located within fifty (SD) feet of the new office building. The new building does not require storm water detention facilities because most storm water run-off is absorbed by the extensive grassed areas surrounding all the buildings. Any storm water run-off that escapes beyond the grassed areas is quickly absorbed by the surrounding open spaces that surround the office ecrplex. All parking is provided on site. Additional parking will be provided in a new parking area to the east of the new building. Anew access to the office complex will be constructed to the north and east of Coiprate East as shown on the attached site plan. The new -access will be a safer and wider entry. The set backs for the new office building far exceed the county's minimum twenty foot setback and offset standards. Landscaping of the new office will be consistent with existing installations, and maintained by an independent contractor. Monfort will comply with all applicable noise, air quality, water quality and weed control standards. Site work commenced for the new office October 24, 1987. II. COMPATIBILITY: This amended proposal for-expansion of Monfort's coiturate facilities is consistent with the Weld County Comprehensive Plan. The plan encourages the expansion of agri-business and industry. Monfort'-s business includes crop production, cattle feeding, slaughter and distribution. 871514 Industrial business and commercial development is encouraged to locate near existing towns. It will have a negligible traffic impact. Adjacent residences are fairly remote and are owned by the applicant. Surrounding properties are used for crop production or Monfort of Colorado business uses (not including any retail activity) .
