HomeMy WebLinkAbout880160.tiff RESOLUTION RE: APPROVE RESUBDIVISION, ARISTOCRAT RANCHETTES SUBDIVISION, SECOND FILING - ARISTOCRAT RANCHETTES WATER PROJECT, INCORPORATED WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 2nd day of March, 1988 , in a public meeting, the Board considered the request of Aristocrat Ranchettes Water Project, Incorporated, for the resubdivision of Lot 1 , Block 62 , and Lot 2 , Block 33 , Aristocrat Ranchettes Subdivision, Second Filing, Weld County, Colorado, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning the aforementioned lots of the Aristocrat Ranchettes Subdivision, Second Filing, shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 6-4 B. of the Weld County Subdivision Regulations. 2 . It is the opinion of the Weld County Board of Commissioners that the applicant has shown compliance with Section 6-4 E. of the Weld County Subdivision Regulations as follows : a. On September 11 , 1987 , the Board of Adjustment approved a variance to waive the minimum lot size requirement in the A (Agricultural) Zone District for the proposed lots. b. Drainage easements or rights-of-way reserved for drainage will not be changed. c. He is concerned this project may cause land values to decline in the area. The Chairman asked Lanell Swanson to read the recommendation, conditions, and Development Standards as outlined by the Department of Planning Services' staff into the record. MOTION: LeAnn Reid moved Case Number USA-821 for Rocky Mountain Railcar for a Special Review permit for uses similar to those listed as uses by special review (Maintenance Repair Shop for Railroad Cars) in the Agricultural zone district be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendations, conditions, and Development Standards as presented by the Department of Planning Services' staff and amended by the Planning Commission and the testimony heard by the members of the Planning Commission. Motion seconded by Ivan Gosnell. The Chairman called for discussion from the members of the Planning Commission. LeAnn Reid reported on the on-site inspection she had conducted and on the uniqueness of this property. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. REQUEST: A Resubdivision of two lots in the A (Agricultural) zone district LEGAL DESCRIPTION: Lot 1, Block 62, and Lot 2, Block 33, Aristocrat Ranchettes Subdivision, Second Filing, Weld County, Colorado LOCATION: Approximately one mile north of Fort Lupton APPEARANCE: Bill Nitzelfeld, P.E. , WRC Engineering, Denver, Colorado, reported they want to make improvements to the Aristocrat Ranchettes Water Project to increase the quantity and quality of water. These wells and storage area will supplement the water that is already being used in the subdivision. They are taking a corner of two separate existing lots to complete this project. This will make four lots, but the two smaller lots will not be eligible for residential building permits. The size of the storage tank is proposed at 250,000 gallons, but they would like the option of obtaining a tank between 270,000 and 300,000 gallons. 8801.60 Summary of the Weld County Planning Commission Meeting February 16, 1988 Page 6 Lanell Swanson asked the applicant to submit a letter asking for this possible expansion of the tank size on the property. Mr. Mitzelfeld stated they will reseed native grasses around the water tank, but they will not landscape the area. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked Mr. Mitzelfeld if he had reviewed the recommendations and conditions as outlined by the Department of Planning Services' staff. He has and has no objections other than to the size of the tank as previously mentioned. The Chairman asked that reading the staff's comments into the record be dispensed with and that they be filed with the summary as a permanent record of these proceedings.
