ANDERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 26th day of March, 1986 , at a public meeting, the Board considered the request of Anders W. Anderson, P.O. Box 23006, Billings, Montana 59104, for the resubdivision of Lots 1 and 2 , St. Louis Western Colony which is located in part of the NE1 NWa, Section 25 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning Lots 1 and 2 , St. Louis Western Colony, shall be approved for the following reasons: 1 . The submitted materials are in compliance with application requirements of Section 6-4 D. of the Weld County Subdivision Regulations. 2. It is the opinion of the Board of County Commissioners that the resubdivision conforms with the requirements of Section 6-4 E. of the Weld County Subdivision Regulations. 3. The following referral entities have reviewed this request and set forth no objections: a. The Weld County Health Department b. The Weld County Engineering Department c. The City of Greeley Planning Commission d. The City of Evans e. The West Greeley Soil Conservation District f. The La Salle Fire Protection District g. The resubdivision proposal shall be reviewed and approved by the Weld County Utilities Coordinating Advisory Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the resubdivision of Lots 1 and 2, St. Louis Western Colony be, and hereby is, approved subject to the above listed conditions. Therefore, the staff recommends that Section 11, Improvements Agreement, of the Weld County Subdivision Regulations be waived by the Planning Commission and the Board of County Commissioners. The meeting was called to order by the vice-chairman, Brian Johnson, at 10:05 a.m. MEMBERS PRESENT: Brian Johnson Weld Fire Representative Steve Bagley City of Greeley Glenn Stokes Home Light and Power Company George Mai Mountain Bell Mike Erland Greeley Gas Company Also present: Debbie deBesche, Current Planner and Bobbie Good, Secretary. A quorum was present. The minutes of the last regular meeting of the Weld County Utilities Advisory Coordinating Committee held on February 27, 1986, were approved as distrubuted. LOCATION: .5 mile south of Greeley, south of Weld County Road 54 and east of Weld County Road 35. Debbie deBesche presented a plat that shows existing easements, both public and private, as well as proposed easements. The Utilities Coordinating Advisory Committee discussed the existing easements and the easements requested by the County. Most of the easements,are private easements, and while they may be able to be shared by the County, it would probably be a lengthy process to obtain the necessary permission. Bill Smith, tenant farmer, represented the applicant. While he would not like to see another easement allowed on the property, he would not object if another easement were required. 860a26 S • Minutes of the Weld County Utilities Coordinating Advisory Committee March 13, 1986 Page 2 MOTION: Mike Erland moved Case Number S-258:86:3 for Anders W. Anderson for a resubdivision of Lots 1 and 2, St. Louis Western Colony grant a fifteen foot easement around lots 1 and 2, inside the existing easements on the west side, and a thirty-one foot easement on the north side. And that this request be recommended favorably to the Planning Commission and the Board of County Commissioners. Motion seconded by George Mai. The Chairman called for discussion from the members of the Utilities Advisory Coordinating Committee. Discussion followed. AMENDMENT: Glenn Stokes moved the above motion be amended to read a fifteen foot peripheral easement be granted, but that the easements on the west and north sides, adjacent to the rights-of-way, be waived if possible, and a ten foot easement on both sides of the Central Weld Water District pipeline be included in the easements of record. Motion seconded by George Mai. The Chairman asked Mike Erland if he had any objections to having his motion amended. He had none. The Chairman called for further discussion from the members of the Committee. Further discussion followed. The Chairman asked the members of the Utilities Coordinating Advisory Committee for their decision. Motion, as amended, carried unanimously. The Secretary reported she had checked with Chuck Cunliffe, Director, Department of Planning Services. The Bylaws of the Weld County Utilities Coordinating Advisory Committee are in the process of being revised and until they have been rewritten and approved he would appreciate the members currently serving on this Committee to continue in their current capacity. Debbie deBesche reviewed the request of the applicant. This is a subdivision that was plated in 1873. While this is actually a farm it has nevertheless been plated. A resubdivision does not allow for any more lots than were already existing without first rezoning the property. There were previously two lots and there will still only be two lots. The Utilities Sign-Off Sheet and plats were distributed to the members of the Utilities Coordinating Committee. APPEARANCE: Bill Smith, tenant farmer, represented the applicant. He asked that the peripheral lot lines be changed to allow for a fifteen foot right-of-way instead of a twenty foot right-of-way as shown on the plat. The members of the Utilities Coordinating Advisory Committee discussed the property. They felt there are private easements that are not shown on the plat. It was felt a study should be made to see if an area beyond the road is intended to be developed so nobody would be landlocked by this vacation. Anderson for a resubdivision of Lots 1 and 2, St. Louis Western Colony be continued until the next regularly scheduled meeting of the Weld County Utilities Coordinating Advisory Committee to be held on March 13, 1986, to allow the applicant time to present a plat that shows existing easements, both public and private, as well proposed easements. Motion seconded by George Mai. The Chairman called for discussion from the members of the Utilities Coordinating Advisory Committee. Discussion followed regarding the size and location of possible easements on this property. Also, some easements can continue to be farmed while others must remain dormant. The Chairman asked the members of the Utilities Coordinating Advisory Committee for their decision. Motion carried unanimously. The Chairman reported he had been asked to conduct election of officers for 1986. Some of the members terms have expired and new appointments or reappointments have not been made. Therefore, the Committee decided they would prefer to wait until clarification of appointments has been made before appointing officers.
