HomeMy WebLinkAbout871484.tiff RESOLUTION RE: APPROVE ADOPTION OF BYLAWS FOR THE PRIVATE INDUSTRY COUNCIL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board did, by Resolution dated June 13 , 1983 , create the Weld County Private Industry Council , and WHEREAS, the Board has been presented with amended bylaws for the Private Industry Council , which change the name of "Employment Opportunities Delivery System" to "Employment Services of Weld County" and change certain language in the text of the bylaws , and WHEREAS , after review, the Board deems it advisable to approve said amended bylaws, a copy being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the amended bylaws of the Private Industry Council be , and hereby are, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 2nd day of December, A.D. , 1987 . Brantner Ja qu e ine Jo nson -27 / County Attorney ran / amaguchi /1/2 add/ 871484 BYLAWS PRIVATE INDUSTRY COUNCIL COMMITTEE ARTICLE I NAME The name of this Weld County Government Advisory Board shall be the "Private Industry Council." ARTICLE II PURPOSE The Private Industry Council , hereinafter referred to as PIC, is intended to increase the involvement of the business community, including small business, minority business enterprises, and labor organizations in employment and training activities, and to increase private sector employment opportunities in Weld County for economically disadvantaged persons and other job seeking individuals. ARTICLE III MEMBERSHIP Section 1 The PIC shall , through policy, determine the number of PIC members up to a maximum of twenty-one (21) voting members. Any number of associate members may be invited to the PIC. The only associate member with voting privilege will be the State Representative from the Colorado Division of Employment and Training (Job Service Representative). Section 2 The membership of the PIC shall be appointed by the Weld County Board of Commissioners subject to the following requirements: a. A majority of the PIC members shall be representatives of industry and business, including agricultural business. 871484 b. The membership shall conform to the requirements of the Job Training Partnership Act (JTPA) rules and regulations. c. The membership shall be representative geographically of Weld County. Section 3 PIC members shall be appointed according to the JTPA rules and regulations. Section 4 PIC members shall serve initial terms of either one (1), two (2) , or three (3) years. One-third (1/3) of the members shall be appointed to a one (1) year term, one-third (1/3) to a two (2) year term, and one-third (1/3) to three (3) year terms. The normal term of membership shall be three (3) years. No person shall serve more than two (2) consecutive three (3) year terms. Section 5 The position of any PIC member may be reappointed if that person misses three (3) consecutive PIC meetings or a total of four (4) regular PIC meetings during a one (1) year period. The Chairman of the PIC shall notify, in writing, any member who has missed either two (2) consecutive regular meetings or three (3) regular meetings in a calendar year. The correspondence shall also cite pertinent sections in the PIC Bylaws. In the event of a vacancy, a nominating committee from the PIC shall select a qualified individual pursuant to the requirements set forth in the JTPA rules and regulations. The Board of County Commissioners shall appoint the individual to the PIC. • 8'71484 Section 6 No member of the PIC may cast a vote on any matter which would involve a conflict of interest. ARTICLE IV THE PIC Section 1 The PIC shall elect from its members a Chairperson, who shall be representa- tive of business and industry. The Chairperson (elected officer) shall serve a one (1) year term beginning in August. No officer shall serve more than two (2) consecutive terms. Section 2 The time and place of the PIC meetings shall be determined by the PIC members. Section 3 Meetings of the PIC shall be open and accessible to the general public and minutes shall be maintained. Section 4 PIC meetings shall be monthly or as determined by the PIC unless there is no business to transact. Section 5 A quorum shall be deemed formed when more than half (1/2) of the presently constituted voting membership is present. Associate members will not be • considered for quorum. Section 6 • A majority vote of the members of a quorum shall be considered a favorable vote upon all motions or resolutions considered by the PIC. 371484 Section 7 An Executive Committee shall be comprised of the Chairperson and subcommittee chairpersons. The Chairperson shall appoint any other member(s) from the general membership to serve on the Executive Committee. This committee shall have the authority to act on matters between regular PIC meetings, but those actions must be ratified at the next PIC meeting. Section 8 The PIC may appoint subcommittees, any additional task forces, and technical advisory as deemed necessary. Section 9 _ Robert's Rules of Order as Revised shall govern the conduct of the PIC meetings. ARTICLE V DUTIES OF OFFICERS Section I The Chairperson shall preside at all meetings of the PIC and may call special meetings when needed. Notice to the members of special meetings shall be provided at least 48 hours before the meeting. Special meetings may also be called by one-third (1/3) of the PIC membership. Section 2 The Chairperson shall appoint from the PIC Membership a member to preside and perform the duties of the Chairperson in the Chairperson's absence and shall perform all other duties that may be assigned by the Chairperson. 811484 ARTICLE VI PIC FUNCTIONS Section 1 The PIC shall perform the following functions in an advisory capacity to the Division of Human Resources' Employment Services of Weld County (Employment Services): a. In partnership with the Weld County Board of Commissioners design and develop, in conjunction with Employment Services, the JTPA program, which will be described in a Job Training Plan as prescribed by JTPA rules and regulations. b. Analyze private sector job opportunities, including estimates by occupation, industry, and location. c. Survey employment demands in the -private sector and training possibilities , such as apprenticeship, in order to develop projec- tions of short and long range labor needs and to refine employment and training programming so that it becomes increasingly responsible to private sector labor needs. Assess and utilize information contained in economic development plans for Weld County and currently available labor market information. d. Develop, in conjunction with Employment Services, specific private sector employment and training projects. e. Develop, in conjunction with Employment Services, standards and specifications for training in particular occupations in order to meet current and expected job market demands. f. Ensure that the JTPA Plan is consistent with plans, funding applica- tions, and grants for programs related to private sector employment and training which are funded by other Federal/State agencies. For 1484 planning purposes and to coordinate with activities under other Federal/State programs, the PIC and Employment Services should, under JTPA authority, review and comment on such plans and funding applica- tions, especially regarding ways in which they affect employment and training, including apprenticeship, in the private sector. g. Actively solicit public and private support for Employment Services programs and activities designed to increase private sector employment and training opportunities for persons who are economically disadvantaged. h. Participate with Employment Services in oversight activities for employment and training programs under Employment Services. i. Serve as the voice of business and industry concerning local employment and training needs through the Employment Services Program of the Weld County Division of Human Resources, the Service Delivery Area Administrative Entity. j. Advise and provide direction to Employment Services in ways to make programs more responsive to local needs and increase private sector job placement. k. Review and comment on JTPA and other employment related plans discourag- ing duplication of existing community effort and encouraging program plans which will better serve the employer and applicant. Section 2 All action which results from the functions enumerated in this Article shall be submitted to the Weld County Board of Commissioners for final action. ?1A84 ARTICLE VII AMENDMENT OF BYLAWS Section 1 These Bylaws may be amended, subject to approval of the Board of Weld County Commissioners, after review and comment at a regular or special meeting of the PIC, provided that any proposed amendment to the Bylaws has been reviewed by the committee members at a previous meeting. Amendment of these Bylaws shall require an affirmative vote of 50% plus one (1) of the presently constituted voting membership. 371484 ITN r DWI Jrir Gordon E.
