RE: APPROVAL OF SERVICE PLAN OF BEEBE DRAW FARMS METROPOLITAN
DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado; and
WHEREAS, pursuant to the provisions of the "Special District
Control Act" , Part 2 of Article 1 , Title 32 , C.R.S. , as amended,
the Petitioners, who represent one hundred percent of the property
owners within the proposed District, filed a Service Plan for the
proposed Beebe Draw Farms Metropolitan District ("District") in
Weld County, Colorado on April 11 , 1986; and
WHEREAS, pursuant to the provisions of Sections 32-1-202 (1)
and 32-1-204 (1) , C.R.S. , as amended , the Board of County
Commissioners of Weld County, Colorado, scheduled a public hearing
on the Service Plan to be held at 2: 00 p.m. on May 14 , 1986; and
WHEREAS, notice of the date, time and location and purpose of
said hearing was duly published in the Johnstown Breeze , a
newspaper of general circulation , on April 24 , May 1 and May 8 ,
1986; notice was provided to the Division of Local Government in
the Department of Local Affairs of the name and type of the
proposed District; and notice of the date , time and location of
the said hearing was provided to the Petitioners, to the governing
body of each municipality and of each special district which had
levied an ad valorem tax within the next preceding tax year and
which had boundaries within a radius of three (3) miles of the
District, and to said Division, as required by Sections
32-1-202 (1) and 32-1-204 (1) , C.R.S. , as amended, and to the Weld
County Planning Commission as required by Section 32-1-204 (2) ,
C.R.S. , as amended; and
WHEREAS, the Weld County Planning Commission studied and
considered the Service Plan at its meeting on May 6 , 1986 , at
which time said Commission adopted a Resolution recommending
approval of the Service Plan for various reasons as more
specifically stated therein, which recommendation was subsequently
presented to the Board of County Commissioners at its hearing on
this matter by a representative of said Commission, as required by
Section 32-1-204 (2) , C.R.S. , as amended; and
WHEREAS, this Board has , on May 14 , 1986 , conducted a full
public hearing on this matter , taking evidence establishing the
jurisdiction of the Board to hear this matter and further taking
evidence regarding the substantive issues set forth in Section
32-1-203 , C.R.S. , as amended, at which hearing all interested
parties were afforded an opportunity to be heard; and

WHEREAS, this Board has fully considered the Service Plan
and all testimony and other evidence presented to it in this
matter relating to the Service Plan, including the favorable
recommendation of the County Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that:
Section 1. The Board hereby determines that all of the
jurisdictional and other requirements of Sections 32-1-202 and
32-1-204, C.R.S. , as amended, have been fulfilled, including
those relating to the filing and form of the Service Plan, the
form and publication of the public notice of the hearing on the
Service Plan and the type of public hearing held herein. In
that respect, the Board hereby finds that the Petitioners were
not required to give postcard notification of the hearing
pursuant to Section 32-1-204 (1. 5) , C.R.S. , as amended, because
the Petitioners represent one hundred percent of the property
owners within the proposed District.
Section 2 . The Weld County Planning Commission has
considered this matter as required by law and has recommended
approval of the Service Plan without condition.
Section 3 . Based upon the information contained within the
Service Plan and evidence presented to the Board at the hearing,
the Board hereby finds and determines as follows:
a. There is sufficient existing and projected
need for organized services of the nature proposed in
the Service Plan in the area to be serviced by the
proposed District;
b. The existing services in the area to be
served by the proposed District are inadequate for
present and projected needs;
c. The proposed District is capable of providing
economical and sufficient services to the area within
its proposed boundaries;
d. The area to be included within the proposed
District will have the financial ability to discharge
the proposed indebtedness on a reasonable basis;
e. Adequate services are not and will not be
available to the area through Weld County, or other
municipal or quasi-municipal corporations, including
special districts, within a reasonable time and on a
comparable basis;

f. The facilities and service standards of the
proposed District are or will be compatible with the
facilities and service standards of Weld County and of
each municipality and special district which is an
interested party hereto;
g. The Service Plan is in substantial compliance
with the Weld County Master Plan; and
h. The creation of the proposed District will
be in the best interest of the area proposed to be
served.
Section 4. The Service Plan of the proposed District, to
include water, roads, storm drainage, safety protection, parks
and recreation at this time and television relay and translation,
transportation and mosquito control at some future time, be and
is hereby approved without condition.
Section 5. The Clerk to the Board is hereby directed to
advise the Petitioners in writing of this action and to attach a
certified copy of this Resolution for the purpose of filing the
same with the District Court of Weld County.
Section 6. All Resolutions, or parts thereof, in conflict
with the provisions hereof, are hereby repealed to the extent of
such conflict only.
Section 7 . This Resolution, immediately upon its passage,
shall be authenticated by the signatures of the Board of County
Commissioners and the County Clerk and Recorder and sealed with
the corporate seal of the County.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
May, 1986.

PETITION FOR APPROVAL OF SERVICE PLAN
IN RE THE ORGANIZATION OF BEEBE DRAW FARMS METROPOLITAN DISTRICT
To: The Board of County Commissioners of the County of Weld,
State of Colorado
Pursuant to the provisions of the Special District Act,
more particularly, Section 32-1-202, C.R.S. , as amended, the
persons proposing the organization of the Beebe Draw Farms
Metropolitan District in Weld County, Colorado, who represent
one hundred percent of the property owners, by their attorneys,
Collins and Cockrel, P.C. , submit the Service Plan of said
proposed District and respectfully petition the Board of County
Commissioners of the County of Weld for a Resolution of Approval,
and certain other preliminary actions relating thereto, for
said proposed District.
In support of this Petition, the Petitioners state:
1. That on April 14 , 1986, there was filed with the
County Clerk and Recorder for the Board of County Commissioners
of Weld County the Service Plan for the proposed Beebe Draw
Metropolitan District.
2 . That said Service Plan fully complies with all
provisions of Part 2 of the Special District Act, more particu-
larly, Section 32-1-202 (2) , C.R.S. , as amended.
3 . That the maximum processing fee required by law (i.e.
$200. 00) was filed with the Service Plan.
4 . That submittal of postcard notification pursuant to
the provisions of Section 32-1-204 (1. 5) , C.R.S. , as amended, is
not required because the Petitioners represent one hundred
percent of the property owners within the proposed District.

WHEREFORE, the Petitioners request the Board of County
Commissioners to enter such orders as may be necessary or

the hearing to all interested parties and making publication
of the hearing as required pursuant to Section 32-1-204 (1) ,
C.R.S. , as amended, and submitting the appropriate report to
the Division of Local Government in the Colorado Department of
Local Affairs pursuant to Section 32-1-202 (1) , C.R.S. , as
amended.

I.
SERVICE PLAN SUMMARY
A. Location and Development
The Beebe Draw Farms Metropolitan District (herein referred
to as the "District") will consist of approximately 4, 100 acres
of land located in southwest Weld County, Colorado, approximately
six miles east of Platteville and nine miles south of Greeley.
It is accessible from U.S. Highway 85 on the west via Weld County
Road 32 and from the north by either Weld County Road 39 or Road
43 . The District is centrally located between Denver,
thirty-five miles to the south, and Fort Collins, thirty-five
miles to the north. A location map of the District is shown in
Figure 1. A vicinity map of the District is shown in Figure 2 .
A boundary map of the District is shown in Figure 3 (inserted in
the pocket part hereto) . The legal description of the District
_ is set forth in Appendix A.
The District will provide various public services to a
population of 1, 750 permanent residents living in 700
single-family residences to be constructed in the planned unit
development known as Beebe Draw Farms and Equestrian Center
(herein referred to as the "Development") . The Development,
scheduled to be completed in three phases, will, in conjunction
with the District, offer residents a complete Olympic caliber
equestrian center, various water recreational facilities on
Milton Reservoir, and greenbelt areas with over forty miles of

hiking, riding and training trails.
Beebe Draw Farms and Equestrian Center includes approxi-
- mately 4, 100 acres in the planned unit development area. There
are also approximately 1, 389 deeded acres that will be maintained
as an operating farm by the owners thereof and an additional
2 ,285 acres that are leased from the Farmers Reservoir and
Irrigation Company, bringing the total Development area to 7 ,755
acres. The leased land contains Milton Reservoir (approximately
800 surface acres of water) and a buffer perimeter around it.
The Development is situated in an area just to the east of
the northern Front Range/U.S. Highway 287 corridor, which is
experiencing both rapid economic and population growth as a
result of expanding high technology industries locating nearby.
Currently, there are no other developments in the area offering
residents such amenities as those available at Beebe Draw Farms
and Equestrian Center. Major facilities and services provided by
the District will include the equestrian center with boarding
stables, boating facilities and fishing on Milton Reservoir, and
a clubhouse with tennis courts and outdoor swimming pool.
The owners of the Development, Beebe Draw Land Company,
Ltd. (herein referred to as the "Developer") , have taken substan-
tial measures to protect the natural features of the land
within the Development, and District facilities will be con-
structed to harmonize with the land and compliment its natural
features. Planned improvements within the Development and the
District represent a careful blend of residential and recrea-

tional uses which are compatible with the surrounding agricul-
tural land and are within the intent and guidelines of the Weld
County Comprehensive Plan concerning land use. The final PUD
Plan and Final Zoning Plat approved by Weld County designated
land within the District for mixed residential and recreational
use.
Total development of land within the District is expected to
take place over seven to ten years, with development phases
planned for the orderly absorption of population with the
economical construction of public improvements and the provision
of services by the District. Directors of the District will
authorize these improvements in a timely manner which assures
that the phased development of District facilities is consistent
with the phased development of the Beebe Draw Farms and
Equestrian Center PUD as demonstrated by the Final PUD Plan and
Final Zoning Plat already approved and on file with Weld County.
B. Need for Metropolitan District
The purpose of the District is to provide its estimated
1,750 residents and others within the District with certain
critical public services: namely, domestic water supply, road
construction and maintenance, storm drainage, safety protection,
parks and recreational facilities, television transmission and
relay, transportation, and mosquito control. Since the area
consists primarily of undeveloped land, centralized domestic
water and other proposed public services have not previously been
required and are not available within the District at this time.

As development occurs in the future, however, there clearly
emerges a need for these organized public services and for a
governmental authority to plan, coordinate, finance, construct
and maintain these necessary public services.
The State Legislature, as provided in Article 1, Title 32 ,
C.R.S. , as amended, has recognized that a metropolitan district
can promote the comprehensive planning of community needs,
provide a program of governmental debt financing to equitably
distribute the costs of public services within the benefitted
area over a longer period of time, and operate and maintain
public facilities for the long-term use of District residents.
Presently there is no municipal or quasi-municipal corporation,
including existing special districts, or other public or private
entity in the area, including the County, which could provide all
the services and facilities necessary to serve those persons who
will be residing or owning property within the Beebe Draw Farms
community within a reasonable time and on a comparable basis.
Additionally, through the financing arrangements described
in Section IV of this Service Plan, certain financial liabilities
associated with infrastructure financing will rest upon the
owners and Developers of the property within the District.
Developer guarantees of the financial integrity of District
bonded indebtedness, along with Developer contributions toward
infrastructure improvements constructed by the District, should
obviate any concern of unreasonable financial burdens on future
property owners.

_ C. District Policy and Operation
The District will be formed and operated pursuant to the
Special District Act of the State of Colorado, Article 1, Title
32 , C.R.S. , as amended. Rules, regulations, and operational
policies will be formulated by the Board of Directors in order to
promote the health and welfare of the District' s residents, to
accomplish the safe and economical operation of the District and
its facilities, and to assure the retirement of District bonded
indebtedness.
The District will construct, operate and maintain the public
water distribution system, roads, storm drainage facilities,
landscaped right of way improvements, parks, and recreational
facilities situate within its boundaries. Treated water,
supplied by Central Weld County Water District (hereinafter
referred to as the "Water District") , will be distributed to
users within the District and will conform to applicable stand-
ards of the Water District and the Colorado State Department of
Health. Roads within the District will be constructed to Weld
County standards and will be maintained by the District. In
accordance with the terms of that certain Road Maintenance and
Improvement Agreement, dated April 3, 1985, a copy of which is
attached as Appendix B, the District will also accept
responsibility for the temporary maintenance of eight miles of
Weld County Roads between U.S. Highway 85 at Platteville,
Colorado and the District' s boundaries and will upgrade these
roads to a County standard asphalt road when development within

the District has reached one hundred homes, at which time the
County will assume all maintenance responsibilities. Drainage
improvements within the District will be constructed to Weld
County standards where they are part of the road system and will
be maintained by the District.
D. Other Services
Other public services will be supplied by private and
governmental entities, already in existence, including the
following:
1. Electricity. Union Rural Electric Association
includes the Development within its certified service area
and will supply electrical service to the Development
pursuant to the rules of the Public Utilities Commission.
2 . Telephone. Mountain Bell Telephone Company
includes the Development within its certified service area
and will supply telephone service to the Development
pursuant to the rules of the Public Utilities Commission.
3 . Sewage Disposal. Sewage disposal within the
Development will be by individual septic systems installed
privately in accordance with regulations of the County and
State Health Departments.
4 . Fire Protection. Fire protection services
are presently being provided to the area by the LaSalle Fire
Protection District and will continue to be provided to the
area by this District.

5. Schools. The Weld County RE-1 School District
includes the Development within its boundaries.
6. Miscellaneous Services. Weld County will provide
law enforcement, building inspection, animal control and
other general services to the Development area. In the
event that the costs of law enforcement and safety protect-
ion services exceed the general property tax revenue
forthcoming to Weld County, the Beebe Draw Law Enforcement
Authority will pay for the difference in the cost of such
services on a per call basis.

II.
DISTRICT SERVICES AND FACILITIES
A. Water
The District will supply potable water to all properties
within the District. Treated water will be purchased from the
Water District in accordance with the terms of a written Agree-
ment for water service, which has been ratified by both the Water
District and the Developer, and furnished to users through a
District operated water distribution system. The Agreement with
the Water District may, by its terms, be assigned to the
District, which was anticipated by the parties at the time of
ratification thereof. Further, the Agreement recognizes that, at
a future date when financially and legally appropriate, water
service operations of the District may be consolidated with the
Water District. A copy of the Agreement with the Water District
is attached as Appendix C. A survey of the proposed water
distribution system is shown as Figure 4 (inserted in the pocket
part hereto) .
1. Treated Water Supply.
Treated water will be supplied to the District by the
Water District from its Storage Tank No. 2 , the contact
point for the water distribution system extension projected
to serve the District. Storage Tank No. 2 has a capacity of
750, 000 gallons and is located in the Southwest Quarter of
Section 32, Township 4 North, Range 66 West, which is

approximately one-quarter mile north of the northwest corner
of the District. Water facilities necessary to bring water
into the District include a booster pump station adjacent to
Storage Tank No. 2 and a twelve-inch diameter transmission
main. The internal water distribution system will be
looped with mains ranging in size from six inches to twelve
inches.
2 . Service Standards.
The estimated maximum day demand of all users, which is
not anticipated to occur prior to full development, has been
used by the District's engineer to size transmission and
distribution mains and to evaluate the adequacy of treated
water storage. The estimated annual demand of all users
has been used by the District's engineer to determine
water right requirements. The total number of dwelling
units anticipated within the District is 700 single-family
residential units with an estimated average of 3 .5 residents
per dwelling unit (for water planning purposes) . The
average usage per capita is estimated to be 100 gallons per
day, with maximum day residential usage estimated to be 200
gpd. The total maximum day usage is estimated to be 490, 000
gallons.
All water system improvements will be installed in
accordance with the construction standards of, and plans and
— specifications approved by the Water District. After
installation, the water distribution system will be operated

and maintained by the District in accordance with service
standards of the Water District
Under the Agreement with the Water District, the
Developer or the District (as assignee thereunder) will make
advance capital fee payments in the amount of $142 , 000 to
secure seventy-one 5/8" x 3/4" water taps for the first
phase of the Development. Plant Investment Fees in the
amount of $80, 000 will be paid for the first fifty water
taps. The Water District has contractually committed to
serve the entire First Filing of the Development (214
dwelling units) . The remainder of water demand within the
Development will be satisfied from water supplies available
in the Windy Gap or Colorado Big Thompson Projects, or other
raw water supply acceptable to and to be acquired by either
the District (as assignee) or the Water District, at the
cost of the District, as more specifically set forth in the
Agreement with the Water District.
3 . Costs of Water System.
The cost of constructing the entire water transmission
and distribution system to serve all users within the
District is estimated by the District's engineer to be
$2 , 370, 825. See Appendix D. The estimated cost of
constructing the water system in Phase I is $786,825. See
Appendix E for detailed construction costs. The estimated
cost of constructing the water system in Phase II is
$610,900. See Appendix F for detailed construction costs.

4 . Water Rights and Expansion.
Water rights needed to meet service demands can be
purchased by the District from various sources "as needed"
for transfer to the Water District. Pursuant to the terms
of the Agreement between the Water District and the
Developer, the Water District may also acquire water rights
for the District, which the District may then purchase by
payment of standard raw water fees as established by the
Water District.
The water distribution system within the District will
be owned and maintained by the District during the develop-
ment stages. As set forth in the Agreement with the Water
District, the District's water system may eventually be
consolidated with that of the Water District, once clear of
financial obligations.
It is the intent of the District to provide complete
and high quality domestic water service to users within the
District from a proven and adequate source, namely, the
Water District. As stated previously, all due attention
will be given to the adequacy of design and construction of
the water system, proper operating pressures, delivery
techniques, and protection from freezing.

B. Roads, Drainage and Safety Protection.
The District will construct, own and maintain roads and
storm drainage facilities within its boundaries unless the County
requests dedication thereof, in whole or in part. The District
will also have the power to install safety protection signs,
lights and related facilities to aid safe traffic movement as
necessary and required by the County. A survey of District road
improvements by phase is shown as Figure 3 (inserted in the
pocket part) .
The District will construct exterior County access roads and
interior District service roads in three phases as follows:
1. Phase I Road Construction. Phase I will consist
of construction within the First Filing of the Development
and is composed of Beebe Draw Farms Parkway from the
Development's Main Entrance to the Equestrian Center,
approximately 7 , 000 feet of major collector roadway,
approximately 35, 000 feet of minor collector roadways,
approximately 9,750 feet of cul-de-sac roadways and related
storm drainage improvements. The major collector road will
be of gravel construction, thirty-six feet in width, with
eight foot shoulders. Minor access roads will also be of
gravel construction with widths of twenty-four feet or
thirty-two feet. Cul-de-sacs will also be of gravel
construction, twenty-four feet in width. Drainage
structures will be corrugated metal pipe culverts ranging in
sizes from eighteen inch diameters to 66" x 51" in dimen-

sion. The estimated cost of constructing roadway and
related facilities in Phase I is $434, 200. See Appendix
H for detailed construction costs.
2 . Phase II Road Construction. Phase II will consist
of construction within the Second Filing of the Development
and is composed of approximately 5, 000 feet of major
collector roadway, approximately 32, 000 feet of minor
collector roadways, approximately 9, 000 feet of cul-de-sac
roadways and related storm drainage improvements. Also
included under Phase II is the rebuilding of approximately
eight miles of existing Weld County Roads 32 and 39 between
Platteville, Colorado and the Development in accordance
with the terms of the Road Maintenance and Improvement
Agreement, which may be assigned to the District for
performance of all obligations set forth therein.
The major collector road will be of gravel construc-
tion, thirty-six feet in width with eight foot shoulders.
Minor access roads will also be of gravel construction with
widths of twenty-four feet and thirty-two feet. Cul-de-sacs
will also be of gravel construction, twenty-four feet in
width. Drainage structures will be corrugated metal pipe

Phase II includes reconstruction work and upgrad-
ing of eight miles of existing Weld County Roads 32 and 39
in accordance with AASHTO and Colorado Department of Highway

standards in effect at the time plans for reconstruction are
prepared. The roads to be improved are approximately six
and one-half miles of Weld County Road 32 from the east
city limits of Platteville to the intersection of Weld
County Road 39 and approximately one and one-half miles of
Weld County Road 39 from the intersection of Weld County
Road 32 to the main entrance of the Development. Work to be
performed by the District will include roadway design,
construction of base and pavement, necessary utility
relocations, and inspections as specified in the Road
Maintenance and Improvement Agreement. This work does not
include reconstruction of drainage structures, utility
easements or relocations, right of ways or traffic control
devices.
The estimated cost of constructing roadways and related
facilities in Phase II is $1,750, 000 for Weld County Roads
and $485, 600 for District roads. See Appendix I for
detailed construction costs.
3 . Phase III Road Construction. Phase III will
consist of construction within the Third and Fourth Filings
of the Development and is composed of approximately 51, 000
feet of minor collection roadways and approximately 14 , 000
feet of cul-de-sac roadways, plus related storm drainage
improvements. All roadways will be of gravel construction.
Minor collectors will be twenty-four feet and thirty-two
feet in width. Drainage structures will be corrugated metal

boundary of the District and will provide the principal
roadway access to the District. The 200 square foot
Gatehouse structure will be approximately 9 ' x 22 ' and will
be constructed with covered porticos for one lane of the
entry and exit drives. The building structure will be wood
frame with moss rock veneer and wood shake roof.

cobblestone concrete installed at the drive through
entry/exit. The Developer' s estimated cost of constructing
the Gatehouse structure and concrete paving, including
fencing, signage and lighting, is $27,500.
Landscaping at the entrance will include moss rock,
bermed ground cover plantings, and a mix of evergreen and
deciduous trees covering an area of approximately five fully
landscaped acres. The Developer' s estimated cost of
landscaping, including irrigation, is $15, 000.
Other landscaping associated with both roadway and
recreation facilities includes plantings at strategic points
along parkways and landscaping at the clubhouse, marina,
beach and parks. The Developer's estimated cost of
additional landscaping within all three phases is $107,500.
C. Parks and Recreation.
1. Clubhouse, Swimming Pool and Tennis Courts.
The District clubhouse will be located at the crest
of a knoll at the northwest corner of the Milton Reservoir
and will be utilized for recreational programs and community
meetings. The proposed two-level clubhouse structure, as
presently planned, will have a vaulted ceiling with 2120
square feet of open area on the main floor and 2120 square
feet of game room space at the walk-out level to the pool
deck. The structure will be constructed of concrete
foundation walls, wood framing, combination moss rock/cedar
siding and a wood shake pitched roof. Two moss rock

fireplaces and a central skylight at the roof apex, galley
kitchen, small office and men's and women's restrooms
provide interior features.
Adjacent to the clubhouse site will be a 20 ' x 45 '
swimming pool, outdoor whirlpool/spa, outdoor sheltered
shower bays, and two tennis courts. All facilities will be
constructed in accordance with County code requirements.
A parking lot adjacent to the clubhouse will provide space
for thirty cars. The Developer's estimated cost of the
clubhouse, swimming pool and tennis courts is approximately
$250, 000.
2 . District Office Building.
A District office building will be located east of the
Gatehouse entry on the east-west main arterial drive, Beebe
Draw Farms Parkway. The office building, as currently
planned, will contain a garage bay for a fire truck (to be
housed there by the Developer to reduce response time by the
Fire Protection District) , an administrative office, three
maintenance equipment bays, and a second level residential
apartment unit for District personnel.
The building structure will be wood frame with a
combination of wood siding and moss rock similar to the
Gatehouse. The building has not yet been designed, but the
Developer' s estimated cost of constructing the office
building is $150, 000.

3 . Harbor and Small Boat Marina.
The natural tree lined harbor on Milton Reservoir below
the Clubhouse site is to be improved by cleaning and
dredging the south half of the approximately ten- acre cove.
The shoreline will be finished with boulder rip-rap. As
many standing trees will be retained as possible. A boat
launching ramp, ten floating small boat slips, and parking
area will be constructed in Phase I improvements. The
balance of the dredging and an additional ten slips will be
added in Phase II improvements. A covered shelter and
picnic area will be built on about five acres of the high
ground adjacent to the marina on the south, and the beach
will be improved. The Developer's estimated cost of
dredging the harbor and constructing the small boat marina
is $120, 000.
4 . Beach Recreation and Picnic Areas.
Approximately twenty acres of beach and park area on
Milton Reservoir will be improved for use by District
residents. Some sand dredging and filling at the beach will
be completed in Phase I improvements. A gravel parking area
will be built, picnic and barbecue stations will be
installed, and game areas for volleyball, horseshoes and
other beach activities will be installed in later phases.
The Developer' s estimated cost of constructing these beach
recreation and picnic areas is $25, 000.

- 5. Equestrian Center.
The Equestrian Center is planned as the focal point of
District recreational activities and to take advantage of
the growing demand for equestrian related activities in
northeast Colorado. The site provides ideal conditions in
terms of terrain, altitude, and climate for various
equestrian events of all types, including cross country,
steeple chase, and endurance events, where natural obstacles
become part of the course. Planned to meet the stringent
requirements of international equestrian associations,
portions of the Equestrian Center, including the four
two-mile cross country courses and the dressage and stadium
jumping arenas, will be completed by the Developer prior to
the formal organization of the District and will be acquired
and operated as a District facility. It is anticipated
that the Equestrian Center will host local, state, regional
and national events and will provide exceptional equestrian
facilities for those persons desiring to reside within the
Development or to utilize its unique facilities.
a. Indoor Arena. A 120 ' x 320 ' x 16 ' high steel
clear span building will provide an enclosed year-round
general activities center for the community. Uses of
the Arena include equestrian events, breed shows for
various societies, 4H and Pony Club activities, and
other community programs. The arena will be designed
to provide bleacher seating for two hundred people and

can be expanded. The west end of the arena building,
as currently planned, will be a 20' x 20 ' two-story,
conventional construction section containing the
entrance with space for concession facilities and
toilets on the ground floor. The second floor will
contain an office, classroom, and enclosed viewing area
of the arena. The Developer' s estimated cost of
constructing the indoor arena is $293, 000.
b. First Stable Area. The first stable area
will include two twenty-horse stable blocks, each 36 ' x
150 ' x 10' steel buildings, with twenty 12 ' x 12 ' horse
stalls inside and twenty 12 ' x 30' outside horse runs
on each side. Each stable will include a tack room,
storage area and feed room with outside delivery doors.
Initial indoor horse capacity will be forty and an
additional forty can be accommodated in the outside
runs. The Developer's estimated cost of constructing
the stable area is $140, 000.
c. General Purpose Outdoor Arena. A general
purpose outdoor arena will be provided for roping and
other Western events, English competition and training
events. This arena is located in a natural amphi-
theater so seating will be on the hillside. The
Developer' s estimated cost of constructing the outdoor
arena is $12 , 000.

d. Wash and Vet Facilities. One 20 ' x 50 ' steel
building will be constructed to accommodate two toilet
rooms, a 10 ' x 10 ' enclosed veterinary room, a roofed
and two-sided farrier shop, and a three-sided and
roofed area for multi-horse wash-rack. The Developer' s
estimated cost of constructing this facility is
$20, 000.
e. Hay Storage and Equipment Building. This
building will consist of a steel construction 80 ' x
100 ' area for hay and equipment storage. The
Developer' s estimated cost of constructing this
building is $30, 000.
The total estimated cost of constructing the Equestrian
Center is $495, 000. The District plans to operate the Equestrian
Center by contracting facilities and programs to a qualified
private operator, at least initially, until adequate programs
can be established. Some initial subsidy by the District may be
necessary to achieve the desired level of services. User fees
will be charged for use of these public facilities with prefer-
ential fees for property owners within the District. A survey
of District parks and recreational facilities is shown as Figure
5 (inserted in the pocket part) .
D. Television Relay and Translation.
The District shall have the power to install television
relay and translator facilities to beam signals to all properties
within the District and/or to assist as appropriate, in the

coordination of cable television services. Television relay and
translator facilities, if requested by District electors, would
increase property values within the District. Accordingly, the
District will be authorized to provide such service and the
financing of necessary facilities but does not plan to immed-
iately implement such service.
E. Transportation.
Metropolitan districts are granted statutory authority to
provide transportation services to their constituents. While no
specific plans have been presently formulated to provide trans-
portation services, it is anticipated that opportunities may
arise in the future to construct, in conjunction with other
transportation authorities, regional park and ride and related
transit facilities. Accordingly, the District will be authorized
to provide transportation services and the financing of necessary
facilities, with electoral approval, but does not plan to
immediately implement such services.
F. Mosquito Control.
If in the future mosquito control becomes a problem to the
public health, the District shall have the power to respond to
such problem as necessary. Accordingly, the District will be
authorized to provide mosquito control services but does not
plan to immediately implement such service.

IV.
Financial Plan
A. Revenue Projections and Policies.
1. Growth Projections and District Population.
The four-county region of Boulder, Larimer, Weld and
Adams, within a 35 mile radius of the District, grew 43% in
population during the 1970 's compared to Colorado' s 31% growth
during that same time period. Population growth in this area is
a direct result of new jobs provided by the many high tech
employers, such as Hewlet Packard, Eastman Kodak, Anheuser
Busch, NCR, Union Carbide and IBM, locating in the region. All
within a reasonable commuting distance from the Development via
Interstate 25 and Colorado Highway 85, these companies are
locating in the northern Front Range corridor because of the good
quality of life, bringing new money into the local economy, and
creating employment opportunities.
Table No. 3 represents geographic population changes by
distance from the District for the years 1970 and 1980. The
overall population growth rate for the area from 1970 to 1980 was
65% or 6. 5% per year. In terms of major cities, the rates of
growth for Greeley, Boulder, Fort Collins and Northglenn were
below average, and Longmont, Loveland, Broomfield, Thornton
and Westminster had rates of growth considerably above average.

Because of declining average household size, the rate of
increase for new households was higher than for population
growth. The growth of households from 1970 to 1980 increased
89% or 8.9% per year. Similarly, the percent of new households
in Greeley, Boulder, Fort Collins and Northglenn was below the
regional average, while Longmont, Loveland, Broomfield, Thornton
and Westminster showed higher rates of household growth. Using
past growth trends, regional building permits issued from
1980 to 1983 , and consequent population estimates with slightly
declining household sizes, Table No. 4 projects population
growth, household growth, and household size for the region from
1960 to 1980.

With these demonstrated and projected increases in popu-
lation regionally, there will be intensified demand for housing
-- within the Development and for organized public services and
facilities which do not currently exist, which the District can
economically provide, and which are not and will not be available
to the area through the County, other existing municipal or
quasi-municipal corporations, or private organizations within a
reasonable time and on a comparable basis. Utilizing the
Developer' s projections of new housing starts within the Develop-
ment and average household size from Table No. 4, Table No. 5
projects household and population growth within the District
through 1995, at which time it is anticipated that the Develop-
ment will be fully built out and that a maximum population of
1,750 permanent residents will have been attained.

2 . Assessed Valuations.
Valuations for assessment of taxable real property within
the general area of the District have steadily increased over
the last five years. Assessed valuations in Weld County in
particular have increased on the average approximately 5% per
year - with the exception of 1985 when valuations decreased due
to the depressed oil and gas industry. Table No. 6 shows
assessed valuations for various taxing agencies in Weld County
from 1981 to 1985.

With the population growth at 6. 5% year in the area of the
District, it is anticipated that assessed valuations will
continue to increase at about 5% per year, a conservative
projection for the Front Range area. Within the District,
valuations for assessment of taxable property have been calcu-
lated based upon the number of new housing starts per year as
projected by the Developer and the estimated actual market value
thereof (with assessed valuations established as 21% of actual
value in accordance with State law) as determined by the
Developer' s planning consultants. The estimated valuations for

in Table No. 7 .

3 . Property Taxes.
Property taxes will be the primary source of revenue for
the District. Property tax revenue will be used to defray
annual operational, administrative and debt service expenses
as required, including funding bond reserve funds for purposes of
leveling bond principal and interest payments. Like other local
governments, the District' s annual property tax increase will be
limited by State law. The maximum annual mill levy of the
District is estimated to be 35 mills.
4 . Water Tap Fee.
Water Tap Fees are one-time payments made by property owners
and builders to pay in part for the capital cost of constructing
water facilities within the District and acquiring a treated
water supply from the Water District. In theory, the Water
Tap Fee will pay that user's share of the water system infra-
structure cost, including capital fees assessed by the Water
District. Water Tap Fees are to be paid at the time connection
is made to the public water system.
The water transmission, distribution, supply and storage
system, as summarized in Section II.A. 3, is estimated to cost
$2 , 370, 825 and will serve approximately 700 equivalent units.
The projected Water Tap Fee per equivalent unit is $5, 800, which
includes a District system development fee of $2 , 000 and a cost
component for plant investment fees and treated water purchased
from the Water District of $3 , 800 (at current rates) . The net
Water Tap Fee revenue to be realized by the District is estimated

to be $2 , 000 per tap or $1, 400, 000 in total. In addition, the
District will realize another $142, 000 in fees for sale of the
first seventy-one water taps, which have been prepaid to the
Water District.
5. Developer Fee.
In accordance with a written agreement to be entered
into between the Developer and the District after the District' s
organization, the Developer will agree to pay Developer Fees for
use of other public facilities constructed by the District, such
as roads, parks and recreation facilities. Developer Fees are
intended to generate a secure source of additional revenue to
the District for purposes of defraying debt service expenses.
Developer Fees are to be paid in accordance with an annual
payment schedule.
The projected Developer Fee per dwelling unit is $5, 000.
Additional Developer Fees in the amount of $8, 000 per dwelling
unit will be assessed on the first 310 dwelling units to fund
the Series 1986A General Obligation Bond Issue discussed
hereinafter, unless varied by bonding requirements. The total
Developer Fee revenue to be realized by the District is estimated
to be $5, 980, 000.
6. Water Service Charges.
The base Water Service Charge will be established from time
to time by the Water District in accordance with the terms of
the Agreement, as detailed in Appendix C, and will essentially
be the Water District's outside - district uniform charge,

discounted by 15%. In addition, a monthly surcharge of
approximately 15% per equivalent unit (making the District' s
total Water Service Charge equal to the Water District's outside
- district uniform charge) will be assessed by the District for
purposes of funding annual expenses of operating the public water
system and District adminstration.
7 . User Fees.
User fees will be established by the Board of Directors
of the District, as will other rates, fees and charges, for use
of District parks and recreational facilities, including the
Equestrian Center. It is anticipated that rental and other
income will be generated from various sources, such as the
Homeowners' Association, for use of District parks and recrea-
tional facilities. The District will also make available to the
public a limited number of memberships permitting the use of
District parks and recreational facilities. All user fee revenue
will be used to defray annual operational, administrative or debt
service expenses of the District.
B. Operational Expenses.
The District will operate and maintain the public water
system, roads, storm drainage facilities, landscaped right of
way improvements, parks, and recreational facilities within its
boundaries. There will be operational expenses and general
administrative costs associated therewith. Certain expenses
will be fully funded by user fee revenues, such as water service
charges which will generate net revenue to the District beyond

the wholesale cost of water supplied by the Water District.
Other expenses will not be incurred by the District directly,
such as certain operating costs of the Equestrian Center which
are anticipated to be the liability of a private contractor.
Although operation and maintenance costs have been projected
through 2010 in the Financial Plan (see Appendix N) ,
realistically the actual operational and administrative expenses
are likely to vary somewhat by category over time; such variance
should not be significant and will be accounted for in the
District ' s budgetary process. The estimated operational,
maintenance and administrative expenses (for net expenditure
items) for the first five fiscal years are set forth in Table No.
8.

C. Indebtedness.
1. Issuance of Bonds.
Construction of the proposed public improvements for the
District will be financed with monies derived from the issuance of
general obligation bonds or revenue bonds to be authorized and
issued in accordance with Section 32-1-1101, C.R.S. , as amended.
It is estimated that the bonds, when issued, will mature in not
more than twenty years from the date of issuance. The proposed
maximum interest rate will be 18 . 0%, and the maximum discount will
be 4 . 0%. The exact interest rate and discount will be established
at the time the bonds are sold by the District and will reflect
market conditions at the time of sale. The bonds will contain
adequate call provisions to allow the prior redemption or
refinancing of the bonds sold by the District.
The actual principal amount of the bonds sold will be based
upon final design estimates, actual construction costs and current
capitalized interest requirements, less projected interest income
on bond proceeds earned during construction. It is anticipated
that the bonds will be issued in three series, coinciding with the
Development phases, with the estimated projected principal amount
of each series to be: Bond Series 1986 and 1986A $5, 710, 000;
Bond Series 1988 $4 , 135, 000; Bond Series 1990 $2 , 325, 000; and with
an aggregate principal amount for all Series of $12 , 170, 000.

2 . Debt Service.
The District will have as its primary source of revenue a
mill levy of approximately 35 mills for debt service purposes.
Interest on bond principal may be capitalized from bond proceeds
to permit prompt payment of interest to bondholders during the
time between development of taxable properties and certification
of assessed valuations for this development on property tax rolls.
The Financial Plan as detailed in Appendix N reflects that
assessed valuation and property tax revenue normally lag behind
actual construction and further that, as provided by State law,
assessed valuation will be determined on the basis of 21% of
actual market value for residential property and of 29% of actual
market value for commercial property. Additional revenues for
debt retirement may be derived from Water Tap Fees and Developer
Fees as more fully explained in Section IV.A. , as well as interest
income earned on the bond redemption fund and other surplus funds
of the District as set forth in Appendix N (projected at 5% per
annum) .
3 . Schedule of Bonded Indebtedness.
Table No. 9 summarizes the various expenses associated with
each series of District bonds, including the costs of land
acquisition, consulting engineering and legal services, bond
counsel and administrative expenses, underwriter discounts, and
other major expenses. For purposes of calculating such expenses,
a theoretical interest rate on the bonds (consist with current
market rates for this type of bond issue) has been estimated at

10% with an estimated discount rate of 3 .9%. It is understood
that market conditions may result in higher or lower interest and
discount rates. All expenses set forth in Table No. 9 have been
estimated by the financial advisor based upon current market
conditions and may be subject to change at the time of bond
issuance. See Appendix L.
An initial Series 1986 and 1986A Bond Issue of $5,710, 000 is
anticipated by the District based upon current estimates of
facilities construction costs. Additional bonds for District
improvements will be issued subsequently by the District as Series
1988 and Series 1990 as estimated in Table No. 9. Source and use
of bond funds, annual bond principal and interest payment
schedules and construction draw-down schedules for all Series are
set forth in Appendix M. A survey of proposed bond projects by
phase/series is shown in Figure 6 (inserted in the pocket part
hereto) . Interest income on bond proceeds earned during construc-
tion (projected at 7% per annum) has been used to reduce the
District's debt requirements.

D. Financial Plan.
The Financial Plan, which is a full summary of financing
capabilities of the District, is set forth in Appendix N. The
Financial Plan confirms the balanced relations between the total
proposed expenditures, including debt service, and the total
anticipated revenue from all sources of District fiscal opera-
tions. The District will be capable of providing economical and
sufficient service to all areas within its boundaries. The
principal source of financing for capital facilities of the
District is tax-exempt municipal bonds, perhaps utilizing the

Developer guarantees as the market requires to assure that debt
service obligations are met on a timely basis. Bond counsel
opinion relating to tax-exemption will be delivered prior to
bond issuance. Property within the Development has, or will
have, the financial ability to discharge the proposed
indebtedness on a reasonable basis as more fully illustrated in
Appendix N.
The proponents believe that the facilities construction cost
figures are conservative and that the Financial Plan reflects
realistic revenue projections with any potential gaps to be made
up through Developer Fees as required. The Board of Directors of
the District, once organized, is delegated the power to establish
rates, fees, and charges for all purposes and to levy property
taxes pursuant to statutory procedures as necessary to satisfy
the fiscal needs of the District. Any estimate of rates, fees
and charges or property tax levies set forth herein may be
adjusted, from time to time, by such Board as required for such
purposes. Any revenue surpluses accumulated over time will be
applied either to (i) early redemption of outstanding bonds, (ii)
lowering of the property tax levy, (iii) funding costs of new
or replacement capital facilities, (iv) paying for increased
operational expenses, or (v) a combination of these alternatives.

V.
Conclusion
The Service Plan of Beebe Draw Farms Metropolitan District
is in compliance with Section 32-1-203, C.R.S. , as amended, and
should be approved for the following reasons:
1. There is sufficient existing and projected need
for organized services of the nature proposed in the area to
be serviced by the District;
2 . The existing services in the area to be served by
the District are inadequate for present and projected needs;
3 . The District is capable of providing economical
and sufficient services to the area within its proposed
boundaries;
4. The area to be included within the District will
have the financial ability to discharge the proposed
indebtedness on a reasonable basis;
5. Adequate services are not and will not be availa-
ble to the area through the County, other municipal or
quasi-municipal corporations, including special districts,
within a reasonable time and on a comparable basis;
6. The facilities and service standards of the
District as proposed are compatible with the facilities and
service standards of the County and each municipality
and special district which is an interested party hereto;
7 . The Service Plan is in substantial compliance
with the County Master Plan;

FARMS AND EQUESTRIAN CENTER PROPERTY OWNERS ASSOCIATION, a

"Owner, " and BEEBE DRAW LAND COMPANY, LTD. , a Colorado
Partnership, hereinafter called "Developer, "
WITNESSETH:
WHEREAS, Developer has applied to the County for approval of
a Planned Unit Development, Case No. Z - 412 :84 : 13 , for
recreational, residential and oil and gas development uses on land
located on parts of Sections 3 , 4 , 5 , and 10 , and all of Sections
8 , 9 , 16 , and 17 , all in Township 3 North, Range 65 West of the
6th Principal Meridian, Weld County, Colorado, and
WHEREAS, the Planned Unit Development will generate
additional traffic on the access road and other nearby roads , and
WHEREAS, the existing County roads which provide access to
the Planned Unit Development will require increased maintenance
and improvements to adequately serve traffic, and
WHEREAS , Developer has offered to accept certain road
maintenance and improvement actions.
NOW, THEREFORE, in consideration of the mutual covenants and
conditions set forth herein, the County, the Developer, and the
Owner mutually agree as follows:

adequate road surface . Owner represents that he is an independent

maintenance functions under this agreement. County will notify
the responsible individual by telephone, with written follow-up,
concerning any observed deficiencies in the maintenance program.
4 . Owner agrees to provide an adequate dust abatement
program on the approximately 8 .0 miles of unpaved road for which
he provides maintenance. Water, asphaltic emulsions, waste oil or
commercially available chemicals may be used to control dust.
Owner is responsible for using materials and methods not inconsist
with any federal , state, or local laws , rules or regulations
pertaining to hazardous materials , health or environmental
protection.
5 . Owner agrees to provide snow removal adequate to allow
two lanes of passage for passenger cars on the approximately 8 .0
miles of unpaved road for which he provides maintenance.
6 . County agrees to furnish, at designated sources,
suitable material for gravel replacement on the approximately 8 . 0
miles of unpaved road for which Owner provides maintenance. Owner
shall be responsible for delivery of material to the work
location. County will load material if loading equipment is
reasonably available. Owner can use his own equipment, at his
expense, to load material.
7 . Indemnator, Owner, hereby agrees to indemnify
Indemnitee , County, from any and all liability, loss , or damage

Indemnitee may suffer as a result of claims , demands , costs , or
judgments against it arising out of maintenance work performed by
the Owner pursuant to this Agreement . Owner will provide
performance guarantees as more fully set forth in a separate
_ document which will set forth the requirements for financial
guarantees for improvements to be made by Developer and work to be
performed by Owner. Owner will provide insurance against personal
injury and property claims covering County and Owner for claims
arising out of the terms and conditions for road maintenance in
this Agreement in the amount of $1 ,000 ,000 .00 and require similar
insurance from any subcontractor, provided that such coverage
shall indemnify County only to the extent of County' s liability
under this agreement and not in excess of Colorado statutory
limits on governmental liability. Performance guarantees for both
the maintenance and construction of this project will be provided
in a manner not inconsistent with the Weld County policy regarding
collateral for improvement prior to the first filing of the final
PUD plat.
8 . County agrees to maintain, repair or replace culverts,
signs , markers, and other roadway appurtenances on the
approximately 8 . 0 miles of unpaved road ' for which Owner provides
maintenance , except for repairs required as a result of Owner' s
maintenance operation for which Owner will be responsible.
9 . Developer agrees to pave the access road to the Planned
Unit Development, as defined in paragraph 1 above. The project
shall include necessary earthwork, base work, utility relocation,
right-of-way acquisition, drainage structures rehabilitation, and
surfacing to provide a paved roadway 24 feet in width, with gravel
shoulders 8 feet in width. Design standards shall reflect the
AASHTO and Colorado Department of Highways standards in effect at
the time of the project, with horizontal and vertical alignment
based on a design speed of 55 m.p.h. and pavement sections based
on an average daily traffic volume of 5 ,300 vehicles consisting of
53% passenger cars , 36% pickup trucks, 8% single unit trucks , and
3% combination trucks , and a directional split of 60% in the peak
direction with a regional adjustment factor of 1 .5 .
10 . Developer agrees to initiate action to accomplish paving
of the access road at such time as there are 100 dwelling units
with Certificates of Occupancy in the Planned Unit Development.
Paving, including engineering, construction, and opening for
traffic, shall be completed within 360 days from date of
initiation.

11 . All construction and materials shall be in accordance
with the Standard Specifications for Road and Bridge Construction
of the Colorado Department of Highways , with reference to the
edition current at the time project is initiated. County shall
review and approve the construction plans prior to construction
and shall have the same authority as the Engineer, as defined in
the specifications for the project, to inspect construction.
12 . Costs of the paving project shall be apportioned between
Developer and County as follows :

Developer agrees to bid and contract for the work. Costs of work
items , which are the responsibility of County which have not been
separately contracted for or performed by the County, will be
billed by Developer to County and County will pay Developer.
County shall be responsible for payment of costs due in future
fiscal years only if funds are appropriated and are otherwise
available for the services and functions which are described
herein. If construction and financing is to be performed through
a statutory district, work shall be done in accordance with the
1Developer shall bear the cost of this item only to the
extent that it might have to extend or relocate a culvert due to
road width and to the extent that it is necessary to maintain
current flow capacity. Any enlargement or new construction shall
be at thetotal expense of the County.
Developer shall be responsible for cost of acquisition of
right-of-way only if it is not possible to meet minimum design
standards within the existing 60-foot right-of-way.

statute, provisions of this paragraph to the contrary
notwithstanding.
13 . Upon completion and acceptance of paving of the access
road , Owner shall be relieved of all road maintenance, dust
abatement, and snow removal responsibilities defined in paragraphs
3 , 4 , and 5 above with the sole exception of Weld County Road 38
from Weld County Road 39 to Weld County Road 43 . Owner will enter
into a separate agreement with County for maintenance of Weld
County Road 38 . Upon completion and acceptance of paving of the
access road and execution of an agreement for maintenance of Weld
County Road 38 , this Agreement shall be void.
14 . If , prior to the completion of the construction of the
access road pavement, Weld County issues zoning or U.S.R. approval
for any other residential , commercial , or industrial development,
or any expansion of any agri-businesses, that will be using as
access any of the approximate 8 miles of County roads paved at the
- expense of the Developer, the County, to the extent permitted by
law, agrees to seek contributions to the cost of the road, pro
rata as the projected use of the roads involved compares to the
- Beebe Draw Farms and Equestrian Center PUD ' s projected use of the
roads.
15 . It is the intent of the parties that this Agreement
remain in full force and effect until it terminates according to
its own terms and that it be binding upon the Owner and Developer
and their heirs , successors , and assigns , and on this Board and
- future Boards to the fullest extent permitted by law. Should this
Agreement, or any portion thereof, be found to be void or voidable
for the reason that it binds the Board of County Commissioners for
more than a one year period of time, this contract shall be
construed as one-year contract with automatic annual renewals.

AGREEMENT
BETWEEN CENTRAL WELD COUNTY WATER DISTRICT
- AND BEEBE DRAW LAND COMPANY, LTD.
Concerning Domestic Potable Water Service
,' This Agreement made and entered into this 3 0'C;E day of
1 (/:?/2.47- c22 , 1985, by and between the CENTRAL WELD
COUNTY WATER DISTRICT, a statutory water district organized
under the laws of the State of Colorado, hereinafter called
DISTRICT, and BEEBE DRAW LAND COMPANY, LTD. , a Colorado
corporation, hereinafter_ called COMPANY, witnesseth:
WHEREAS, DISTRICT owns, maintains and operates a system for
the diversion, supply, storage, and distribution of potable
water to members and customers of the DISTRICT for domestic
purposes in the County of Weld, State of Colorado, and
WHEREAS, the COMPANY has a need for domestic water service
within its residential development, known as Beebe Draw Farms,
hereinafter called DEVELOPMENT, and desires that the DISTRICT
furnish treated water for domestic purposes within the
DEVELOPMENT, and
WHEREAS, the COMPANY intends to organize a metropolitan
district to distribute water to residents of the DEVELOPMENT,
and for other purposes, and to assign this Agreement to said
district once so organized in accordance with statutory
procedures.
NOW THEREFORE, DISTRICT and COMPANY agree to the following:
1. DISTRICT will treat and deliver water to the
DEVELOPMENT from its system of waterworks as hereinafter set
forth. The water shall be delivered through the pipelines and
appurtenances of DISTRICT; said pipelines and appurtenances to
be owned, operated and maintained by DISTRICT to the master meter
location near or on property of the COMPANY. The DEVELOPMENT is
more particularly situate in Sections 3 , 4 , 5, 8, 9, 10, 16 and
17 of Township 3N, Range 65W in Weld County, Colorado.
2 . DISTRICT will provide domestic water service to the
DEVELOPMENT of the COMPANY in said Sections 3, 4, 5, 8 , 9,
10, 16 and 17 . DISTRICT shall make available reasonable and
adequate capacity which shall be delivered to users in the
DEVELOPMENT based on the pressures available through the storage
facilities at the "LaSalle" storage tank and thereafter gravity
flowed to such users or supplemented by a booster station as may
be required to provide for adequate pressure. COMPANY shall pay
for all costs for water main, booster pumps, and appurtenances
including valves, connections, and master meter station, and for
any necessary master meter stations relative to expansion,

relocation, or new master meter installations beyond the
DISTRICT'S existing -12-inch watermain and "LaSalle" storage
tank to service COMPANY 'S DEVELOPMENT. New master meter
installations and location are subject to approval of the
DISTRICT. Said installations and materials may be furnished
and installed by the DISTRICT, but COMPANY shall pay for all
costs related thereto; provided that the DISTRICT shall first
inform COMPANY of such costs, and the COMPANY shall provide
written authorization to incur such expenses. DISTRICT shall
own, operate and maintain all water main facilities up to and
including master meter installations. Additionally, all water
system facilities and appurtenances within the DEVELOPMENT shall
be installed at the sole cost of COMPANY, unless specifically
excluded by written agreement or as otherwise noted herein.
3 . DISTRICT assumes no - responsibility of any kind
whatsoever beyond master meter connections. The responsibility
for maintenance of pipelines, pressure valves, size of pipe,
quality of pipe, accidental breakage, and all other facilities
beyond master meter connections shall be the sole responsibility
of the COMPANY.
DISTRICT shall at all times make good faith efforts to
comply fully with obligations herein assumed, and to provide
water to the DEVELOPMENT on a continuous basis. Notwithstanding
any other provisions of this Agreement, however, DISTRICT shall
not be held responsible for damages caused by delay or failure to
perform hereunder, when such delay or failure is due to acts of
God, acts of public authorities, strikes, accidents affecting
DISTRICT ' S pipelines or other property or other causes
unavoidable or beyond DISTRICT'S reasonable control. Should an
interruption in water delivery occur, DISTRICT shall restore
water as quickly as possible.
4 . The DEVELOPMENT shall not at this time be included in
District. COMPANY shall own onsite water improvements until such
time as improvements are fully paid and no liabilities exist for
said water system improvements. At such time DISTRICT may, at
its sole discretion, -have said system transferred to DISTRICT,
subject to any necessary intergovernmental arrangements with the
metropolitan district to be organized to furnish water service
within the DEVELOPMENT.
5. By this Agreement, DISTRICT commits to serve the first
filing of the DEVELOPMENT to the extent it does not exceed
approximately 214 residential meters. DISTRICT will provide
for additional service to DEVELOPMENT in the future to a
projected maximum of 700 residential taps, subject to COMPANY
meeting additional specific requirements of DISTRICT as set
forth hereinafter. To assist DISTRICT in advance planning,

COMPANY shall submit to DISTRICT, for review and comment, all
plans for development of COMPANY property which will be
considered for potable domestic water supply service.
In order to provide for expansion of the DISTRICT water
system to serve the DEVELOPMENT, the COMPANY shall pay a fee to
the DISTRICT for each connection or increase in meter size within
the DEVELOPMENT. Each fee shall be equal to the amount of the
Capital Improvement Fee in effect (at the time connection or
increase in meter size is made) under the DISTRICT'S Regulations
and Rates, less $200 per connection or increase in meter size.
No connection costs shall be incurred by DISTRICT. This fee
shall be a one-time charge paid to the DISTRICT for each meter,
tap, or meter size increase added to the system. Payment of fees
shall be made to DISTRICT by COMPANY within 60 days following
receipt of such fee from the user by COMPANY, but in no event
later than 30 days following receipt of water by the user.
6. The DISTRICT shall have exclusive rights to supply
water to the DEVELOPMENT so long as the DISTRICT provides water
service to the DEVELOPMENT in compliance with the terms of this
Agreement. The COMPANY shall not provide water service or expand
service to users outside COMPANY property.
If the DISTRICT is unable to furnish adequate water to
the DEVELOPMENT in accordance with the terms of this Agreement,
then the COMPANY shall have the right to secure additional water
from an independent source to provide water supplies to the
DEVELOPMENT, providing: (1) that the COMPANY first makes written
request to the DISTRICT for such water service; (2) that advance
Capital Improvement Fees are paid to DISTRICT, if requested, as
provided in Paragraph 7 hereof; (3) that advance Raw Water Fees
(as set forth in District Regulations and Rates) are paid to the
DISTRICT for the amount of taps required for such service, and;
(4) that DISTRICT does not provide for such water service within
one year after receipt of such written request and advance
payments. In the event COMPANY so utilizes another source of
water supply to the DEVELOPMENT, then the DISTRICT and COMPANY
shall cooperate fully to facilitate the service of water to all
areas of the DEVELOPMENT. The terms of this paragraph shall be
applicable notwithstanding any provision in this Agreement that
the DISTRICT shall have the right to exclusively serve the
DEVELOPMENT and that DISTRICT shall not be obligated to provide
and purchase additional raw water to the DEVELOPMENT.
7. Upon the request of DISTRICT and to assist DISTRICT in
advance planning and to fund DISTRICT system improvements,
COMPANY shall pay to DISTRICT advance Capital Improvement Fees.
Said advanced Capital Improvement Fees shall be for fifty 5/8" x
3/4" size meters. Said advance Capital Improvement Fees shall be
paid to DISTRICT for DISTRICT'S use at its sole discretion.

Advance Capital Improvement Fees shall be used by DISTRICT to
apply to specific taps within the DEVELOPMENT when COMPANY has
purchased all taps necessary for the DEVELOPMENT except for the
last 50 taps. Said advance Capital Improvement Fees shall then
be credited by DISTRICT to such remaining 50 taps at such time as
requested by COMPANY.
DISTRICT shall have the right to request additional advance
Capital Improvement Fees from COMPANY in order for DISTRICT to
expand its facilities to meet needs for adequate service, as may
be caused or projected to , be needed, for servicing of the
DEVELOPMENT; provided that the DISTRICT has committed to supply
water service thereto.
8. Service by DISTRICT shall be subject to acquiring
adequate water rights by DISTRICT and/or COMPANY to provide for
development in accordance with DISTRICT'S standard requirements
for water rights.
DISTRICT shall make available 50 acre-feet of Windy Gap
water to COMPANY for use for the first phase of the filing,
subject to the COMPANY providing and fulfilling its requirements
under this Agreement. Said . 50 acre-feet of Windy Gap water
shall be applied to the first 71 users to request taps within
the DEVELOPMENT, based on 5/8 x 3/4 inch meter services.
Thereafter, COMPANY may, from time to time, acquire and/or make
available to DISTRICT sufficient water rights to provide for
COMPANY'S DEVELOPMENT or any part thereof. DISTRICT shall not be
obligated to provide water to the DEVELOPMENT except for said
Windy Gap water and those water rights which have been acquired
by COMPANY and made available to DISTRICT. Said water rights
shall be from sources being used by the DISTRICT or other water
rights as approved by DISTRICT, to the extent that said water
rights may be legally used to service the DEVELOPMENT.
In the event the DISTRICT, in its discretion, acquires
water rights for the DEVELOPMENT, then COMPANY shall pay for
such water rights by payment of standard Raw Water Fees
established by DISTRICT sufficient to compensate the DISTRICT
for the costs of such water rights. Payment shall be made to
DISTRICT for said Raw Water Fees in accordance with the terms of
this Agreement and the Regulations and Rates of the DISTRICT.
DISTRICT shall have the option to purchase such water rights for
the DEVELOPMENT directly or to have the COMPANY purchase such
water rights and convey the same to the DISTRICT for meeting the
domestic water requirements for the DEVELOPMENT. The COMPANY,
after written notice of all costs and terms of such acquisition
have been provided to COMPANY by the DISTRICT, shall provide the
DISTRICT with prior authorization to contract directly for the
acquisition of any water rights, at option of DISTRICT, and the

use of such water rights within the DEVELOPMENT. COMPANY, after
authorization has been provided to the DISTRICT, shall pay
advance Raw Water Fees to the DISTRICT to allow the DISTRICT to
purchase the required raw water, as may be needed for COMPANY'S
DEVELOPMENT. Credits shall be provided to COMPANY for said Raw
Water Fees in accordance with the terms of this Agreement.
COMPANY shall pay in advance equivalent Raw Water Fees for
taps to be served by the first 50 acre-feet of Windy Gap water,
being acquired and committed to the DEVELOPMENT as more fully
set forth in paragraph 16 hereof. Said Raw Water Fees for said
50 acre-feet of Windy Gap water shall entitle COMPANY to 71
standard residential 5/8" -x 3/4" meter service connections. Said
funds shall be used by DISTRICT for payment of obligations on
said 50 acre-feet of Windy Gap water being purchased and
committed. As additional users are connected to the water system
within the DEVELOPMENT, COMPANY shall pay a Raw Water Fee to
DISTRICT in accordance with the Regulations and standard Rates of
the DISTRICT. Said Raw Water Fee shall be maintained or used by
DISTRICT for payment of raw water, acquiring additional Windy
Gap water, and/or other equivalent usable raw water for COMPANY'S
DEVELOPMENT by DISTRICT. When all water rights have been
acquired sufficient to provide for full service to the DEVELOP-
MENT, any surplus funds from such advance Raw Water Fees shall be
credited by DISTRICT against any fees due on other lots when
requested for activation of water service by COMPANY or refunded
to COMPANY, if no such fees are due.
9. As a credit for raw water provided by the COMPANY,
DISTRICT shall provide to COMPANY a 15% credit on the monthly
Water User Charge under the DISTRICT'S Regulations and Rates,
based on water metered to COMPANY, to the extent that credit does
not decrease charges below Monthly Minimum Charges established
elsewhere herein.
10. The DISTRICT will treat and deliver water to the
DEVELOPMENT for the price as established by the DISTRICT'S
standard Water Rate Schedule in effect as established from time
to time by the DISTRICT, or the Monthly Minimum Charge described
herein, whichever is greater, and surcharges for mill levy
applicable to outside DISTRICT users in accordance with paragraph
11 of this Agreement.
The total Monthly Minimum Charge, which the COMPANY agrees
to pay, is the sum of amounts for each meter size. Said amount
for each meter size shall be equal to 40% of the DISTRICT'S
Monthly Minimum Charge for each meter size multiplied by the
total number of meters of said meter size within the DEVELOPMENT.
All water users within the DEVELOPMENT shall be individually
metered. Quarterly, or at billing periods as determined by the
DISTRICT, the size and number of taps connected to the water

system within the DEVELOPMENT shall be provided in writing to the
DISTRICT by the COMPANY. The Monthly Minimum Charge for the next
billing period shall be based on said size and number of taps
except that the total Monthly Minimum Charge to the COMPANY shall
not be decreased at any time.
In the event that there is a change in standard rates
throughout DISTRICT'S system, then the rates charged the COMPANY
will be increased or decreased correspondingly to said change.
However, because the DEVELOPMENT is being served, in whole or at
least in part, with Windy Gap water by DISTRICT, DISTRICT may
impose surcharges and assess rates and fees different from
regular DISTRICT customers located within the Northern Colorado
Water Conservancy District, except that said special rates and
fees will be consistent where applicable with other DISTRICT
customers served with Windy Gap water and located outside of the
Northern Colorado Water Conservancy District. Payment for water
supplied to the DEVELOPMENT shall be made in accordance with the
procedures established by the DISTRICT, and in the event of
failure by COMPANY to make payment within 30 days after said
payment is due, DISTRICT shall, after written notice to COMPANY
in accordance with DISTRICT policy for delinquent customers, have
the right to shut off water to the COMPANY, its grantees and
assigns, and all further service shall be discontinued until all
sums in arrears are fully paid.
11. As an outside DISTRICT user, COMPANY shall pay to
DISTRICT a 15% surcharge on all monthly usage charges. In
addition to the 15% surcharge, COMPANY shall pay an additional
5% surcharge per each mill levied against DISTRICT users greater
than 2 mills.
12. DISTRICT, after prior written notice to COMPANY, shall
have the right to connect to COMPANY'S system and carry water
through COMPANY'S system to other DISTRICT customers, subject to
(a) maintaining adequate flows and pressures to all potential
users within the DEVELOPMENT, (b) master metering, at the
DISTRICT'S expense, at any necessary connection points to credit
master meter reading of COMPANY for any non-COMPANY water use,
and (c) payment of appropriate costs of installing over-sized
mains necessary to accommodate DISTRICT'S use of COMPANY'S
system and related maintenance and replacement expenses.
13 . The DEVELOPMENT shall be included within the Municipal
Subdistrict in order to be eligible for use of Windy Gap water.
COMPANY shall complete petitions for inclusion in said
subdistrict and receive approval by DISTRICT for service prior to
service to any user in DEVELOPMENT.

14 . COMPANY shall furnish to DISTRICT complete "as built"
plans and specifications of all water system improvements
installed in DEVELOPMENT. All installations, materials, and
plans and specifications for water system improvements shall be
in accordance with DISTRICT'S regulations and subject to review
and approval by the DISTRICT.
15. Water service shall not be provided to the DEVELOPMENT
until the DISTRICT receives written confirmation of purchase of
Windy Gap water from the Municipal Subdistrict and/or Northern
Colorado Water Conservancy District offices and the receipt of
the advance Raw Water Fees and Capital Improvement Fees provided
for in paragraph 16 hereof.
16. Within sixty days after execution of this Agreement,
COMPANY shall pay to DISTRICT, by certified funds or cashier's
check, the amounts required under this Agreement for advance Raw
Water Fees and Capital Improvement Fees. Said amounts shall be
in the sum of $2,000 x 71 taps or $142, 000 for Raw Water Fees and
50 taps x $1,800 or $90, 000 for 5/8" x 3/4" meter size Capital
Improvement Fees (based on fees effective January 1, 1986 in
accordance with the attached "Tap Fees and Supplemental Service
Policy") . If said payment is not received by DISTRICT within
such time period, this Agreement shall be terminated and of no
further force or effect, unless provided otherwise by the parties
hereto.
17 . The term of this Agreement shall be 30 years, and
thereafter this Agreement shall be automatically renewed for
successive 10-year terms unless cancelled as provided below.
The DISTRICT and COMPANY each has the right to cancel this
Agreement at the end of any of the above specified terms by
giving three years prior written notice of its intent to cancel
to the other party and making appropriate arrangements for the
transfer and use of water rights paid for or provided by COMPANY
for supplying water service within the DEVELOPMENT.
18 . COMPANY shall be bound by all rules and regulations
uniformly adopted from time to time by DISTRICT concerning the
administration, use and cost of water from said system of
waterworks, except as otherwise expressly provided for herein.
19 . COMPANY and DISTRICT agree that, if a metropolitan
district or other governmental or water provider entity is
organized, this Agreement may be assigned to such district or
entity, after written notice thereof is provided to DISTRICT, but
that if any other transfer of ownership of the water system
occurs, approval of the DISTRICT shall be first obtained. This
Agreement shall be binding on any grantees and assigns of the
parties hereto, if such assignment is made in accordance with the
terms hereof.

20. The parties hereto acknowledge that, if duly organized,
the proposed metropolitan district or other such water provider
entity will install, operate and maintain the water system
within the DEVELOPMENT for so long as is reasonably required by
law or financing considerations. Thereafter, or if no such
district or entity is organized within three years after com-
mencement of water service to the DEVELOPMENT, each party hereto
shall cooperate to merge and consolidate all operations and
responsibilities for the provision of water service to the
DEVELOPMENT within one agency, namely the DISTRICT, by means of
inclusion, consolidation or other such procedures available by
law to accomplish this intention of the parties; provided that
nothing contained herein shall be construed to obligate the
DISTRICT to any specific course of action or to any action at
all, and the Board of Directors of DISTRICT may act in its
discretion in this regard.
21. This Agreement may be amended from time to time by
agreement between the parties hereto. No amendment, modification
or alteration of this Agreement shall be binding upon the
parties hereto unless the same is in writing and approved by the
duly authorized representatives of each party hereto.
22 . If any term, section or other provision of this
Agreement shall, for any reason, be held to be invalid or
unenforceable, the invalidity or unenforceability of such term,
section or other provision shall not affect any of the remaining
provisions of this Agreement.
23 . No waiver by either party of any right, term or .
condition of this Agreement shall be deemed or construed as a
waiver of any other right, term or condition, nor shall a waiver
of any breach hereof be deemed to constitute a waiver of any
subsequent breach, whether of the same or of a different
provision of this Agreement.
24. In the event COMPANY objects to any action taken
hereunder or disputes any decision made by the DISTRICT
hereunder, COMPANY shall be entitled to a hearing before the
Board of Directors of DISTRICT concerning such action or
decision. COMPANY shall be afforded a full opportunity to
present information regarding the disputed action or decision at
such hearing.
25. None of the remedies provided to either party under
this Agreement shall be required to be exhausted, or exercised,
as a prerequisite to resort to any further relief to which it
may then be entitled. Every obligation assumed by, or imposed
upon, either party hereto shall be enforceable by any appropriate

action, petition or proceeding at law or in equity. In addition
to any other remedies provided by law, this Agreement shall be

26. All notices required under this Agreement shall be in
writing and shall be hand delivered or sent by certified mail,
return receipt requested, to the following addresses:

Either party by notice so provided may change the address to
which future notices shall be sent. All notices so' given shall

27. This Agreement may be executed in multiple

all of which shall constitute one and the same document.
28 . This Agreement constitutes the entire contract between
the parties hereto concerning the subject matter herein, and all
prior negotiations, representations, contracts, understandings
or agreements pertaining to such matters are merged into, and
superseded by, this Agreement.

Dear Morris:
Pursuant to consultation with the Beebe Draw Land Company and
Collins and Cockrel, Attorneys at Law, it has been determined
that the construction of certain public improvements for the
Beebe Draw Farms Metropolitan District will be financed with
funds provided by the issuance of General Obligation Bonds to be
authorized and issued in accordance with the authorizing act of
the Colorado State Legislation. It has been determined that the
bonds will be issued in four series, namely Series 1986, Series
1986A, Series 1988 and Series 1990. Furthermore, it is estimated
that the bonds, when issued, will mature within a period not to
exceed 20 years from the date of issuance.
The proposed maximum interest rate for the bonds will be 18% and
the maximum discount shall not exceed 4%. The interest rate is
estimated at 10% and a discount of 3 .9% for the attached financ-
ing plan. The exact interest rate and discount will be estab-
lished at the time the bonds are sold by the District and will
reflect market conditions at such time.
The source of revenue to the District for the repayment of the
bonded indebtedness will be a mill levy estimated to be 35 mills,
income from water tap fees estimated to be $2000 per new tap and
a development fee of $5000 per lot. Additionally, a secondary
development fee of $8000 per lot is required to repay the Series
1986A short term debt issuance you have proposed. Finally, it is
anticipated that the bonds will be sold on a non-rated basis with
the exception of the Series 1986A issue. It has been determined
that the 1986A issue will need some type of credit enhancement as
security for the entire principal amount of the bond issue.

Recorder of Weld County, Colorado, a Service Plan and related documents for
the proposed Beebe Draw Farms Metropolitan District. The Service Plan and
related documents are now on file in the office of the Clerk and Recorder
and the Board of County Commissioners and are available for public
inspection.
NOTICE IS FURTHER GIVEN, that, by Order of the County Commissioners of Weld
County, Colorado, a public hearing on said Service Plan and related
documents will be held in the Chambers of the Board, First Floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado, at 2:00 p.m. ,
on Wednesday, the 14th day of May, 1986.
The purpose of the hearing shall be to consider the adequacy of the Service
Plan of the proposed Beebe Draw Farms Metropolitan District and form a basis
for adopting a Resolution approving, conditionally approving, or
disapproving the Service Plan.
The proposed district is located entirely within the unincoporated area of
Weld County, Colorado. A general description of the land contained within
the boundaries of the proposed district is the Rezoning Plat of Beebe Draw
Farms and Equestrian Center, A Planned Unit Development, according to the
recorded plat thereof, Reception No. R1992773, with the County Clerk and
Recorder of Weld County, Colorado, located in Sections 3, 4, 5, 8, 9 and 10,
Township 3 North, Range 65 West of the 6th Principal Meridian, Weld County,
Colorado, as more specifically set forth in the Service Plan and related
documents which are on file with the County Clerk and Recorder.
Notice is further given that any time after the filing of the petition for
the organization of the proposed district in the District Court for the
County of Weld, but no later than ten (10) days before the hearing on the
Petition, in accordance with the provisions of the statute, the owner of any
real property within the proposed district may petition the District Court
to exclude his property and the District Court, not the Board of County
Commissioners, shall determine whether said property should be excluded.

LEGAL DESCRIPTION: A tract of land in Sections 3, 4, 5, 8, 9, 10, 16, and

LOCATION: Approximately 6.5 miles east of Platteville; south of Weld County
Road 38 and east of Weld County Road 39.
Be recommended favorably to the Board of County Commissioners for the
following reasons:
Based upon the review criteria set forth in Section 32-1-203 (2) , C.R.S. ,
the Weld County Planning Commission recommends approval of the metropolitan
district.
There is sufficient projected need for organized service in the
area to be served by the proposed special district. The Weld
County Board of Commissioners approved the Beebe Draw Farms
Planned Unit Development for 700 single-family residences in
December 1985.
The existing service in the area to be served by the proposed
metropolitan district is inadequate for projected needs. Domestic
water service, internal roads, storm drainage, safety protection,
parks and recreational facilities, television transmission, and
insect control would be provided by the metropolitan district in a
location where these services are presently unavailable.
Adequate service is not, and will not be, available to the area
through the County, other existing municipal or quasi-municipal
corporations, including existing special districts, within a
reasonable time and on a comparable basis.
The facility and service standards of the proposed metropolitan
district can be made compatible with the facility and service
standards of Weld County.
The proposed metropolitan district appears to be in substantial
compliance with the Weld County Comprehensive Plan.

The policies set forth on pages 91 and 92 of the Weld County
Comprehensive Plan for review of special districts were used to
evaluate if the proposal was in substantial compliance. It is the
opinion of the Department of Planning Services staff that the
Beebe Draw Farms Metropolitan District Service Plan proposal
complies with those policies, which are:
1. Any development that will create an undue burden on
existing public facilities and will diminish the
capacity of public agencies to maintain the
existing level of service shall be discouraged;
2. All new development shall have complete and
adequate utilities and public services. Tap fees,
service charges, and tax revenues from all new
developments shall be sufficiently high to properly
protect the existing users from an increased cost
due to the added demands upon the system;
3. Proliferation of service districts shall be opposed
while consolidation of existing service districts
shall be encouraged when it tends to improve the
efficiency and economy of the service; and
4. Regionalization of services and facilities shall be
opposed if it will lead to growth which is not
compatible with the desires of the towns involved.
The proposed metropolitan district appears capable of providing
economical and sufficient service to the area within its proposed
boundaries.
It appears that the area to be included in the proposed
metropolitan district will have the financial ability to discharge
the proposed indebtedness on a reasonable basis.
The creation of the proposed metropolitan district, as submitted,
will be in the best interests of the future residents of Beebe
Draw Farms Planned Unit Development.

BEEBE DRAW LAND COMPANY, LTD.
The Beebe Draw Metropolitan District Service Plan is not subject to review
by the Larimer-Weld Regional Council of Governments 208 Water Quality
Advisory Committee. Mr. David Dubois, Water Resources Manager for the
Council of Governments, stated that the proposed use of individual septic
disposal systems would not be subject to compliance with the 208 Water
Quality Management Plan.
In a letter dated April 21, 1986, the La Salle Fire Protection District
Board of Directors requests deletion of a statement in the service plan,
implying that the proposed on-site fire truck will reduce response time by
the Fire Protection District.

APPEARANCE:
Robert L. Tibbals, Jr. , Attorney, Collins and Cockrel, P.C. , stated this
project contains four thousand one hundred acres of land. Except for some
early development structures the site is undeveloped. This request is to
allow a metropolitan district to provide public services: domestic water,
road construction and maintenance, storm drainage, safety protection, parks
and recreation facilities, television transmission and relay, transportation
and mosquito control. The request does not cover sanitation requirements as
each separate lot will have its own septic system. However, if at some
future time a sanitation district is needed it could be provided by the
District.

Morris Burk, General Partner, Beebe Land Company, Ltd. , stated there are no
changes from their former plans with the exception that the proposed third
filing will now be the fourth filing, and the fourth filing will be the
third filing. The first filing will be one hundred and ninety-five lots.
They would like to begin working on the first filing within sixty days and
have the improvements listed in phase one done in three years. Some phases
may overlap, but it does not seem possible to finish all three phases any
sooner than seven years.
David Bell, Assistant Vice-President, Prudential-Bache Securities, Inc. ,
reviewed the issuance of general obligation bonds which will probably be
issued in four series and run for a term of twenty years.
The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked if they have reviewed the recommendations of the
Department of Planning Services Staff. He stated they have and have no
objections to anything as stated. Page 17 of the service plan which makes
reference to the fire truck to be kept on the property will be changed to
conform to the request of the La Salle Fire Department.
The Chairman asked that reading of the recommendations of the Department of
Planning Services staff be dispensed with and that they be filed with the
summary as a permanent record of these proceedings.
MOTION:
Doug Graff moved the Beebe Draw Land Company, Ltd. , Metropolitan District
Service Plan be forwarded to the Board of County Commissioners with the
Planning Commission's recommendation for approval based upon the
recommendations of the Department of Planning Services staff and the
testimony heard by the members of the Planning Commission.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Lydia Dunbar - yes; Doug Graff - yes; Don

LEGAL DESCRIPTION: A tract of land in Sections 3, 4, 5, 8, 9, 10, 16, and
17 all in T3N, R65W of the 6th P.M. , Weld County,
Colorado
LOCATION: Approximately 6.5 miles east of Platteville; south of Weld County
Road 38 and east of Weld County Road 39.
Based upon the review criteria set forth in Section 32-1-203 (2) , C.R.S.
the Department of Planning Services recommends approval of the metropolitan
district.
There is sufficient projected need for organized service in the
area to be served by the proposed special district. The Weld
County Board of Commissioners approved the Beebe Draw Farms
Planned Unit Development for 700 single-family residences in
December 1985.
The existing service in the area to be served by the proposed
metropolitan district is inadequate for projected needs . Domestic
water service, internal roads, storm drainage, safety protection,
parks and recreational facilities, television transmission, and
insect control would be provided by the metropolitan district in a
location where these services are presently unavailable.
Adequate service is not, and will not be, available to the area
through the County, other existing municipal or quasi-municipal
corporations, including existing special districts, within a
reasonable time and on a comparable basis.
The facility and service standards of the proposed metropolitan
district can be made compatible with the facility and service
standards of Weld County.
The proposed metropolitan district appears to be in substantial
compliance with the Weld County Comprehensive Plan.
The policies set forth on pages 91 and 92 of the Weld County
Comprehensive Plan for review of special districts were used to
evaluate if the proposal was in substantial compliance. It is the
opinion of the Department of Planning Services staff that the
Beebe Draw Farms Metropolitan District Service Plan proposal
complies with those policies, which are:
1. Any development that will create an undue burden on
existing public facilities and will diminish the
capacity of public agencies to maintain the
existing level of service shall be discouraged; . ., s �

2. All new development shall have complete and
adequate utilities and public services. Tap fees,
service charges, and tax revenues from all new
developments shall be sufficiently high to properly
protect the existing users from an increased cost
due to the added demands upon the system;
3. Proliferation of service districts shall be opposed
while consolidation of existing service districts
shall be encouraged when it tends to improve the
efficiency and economy of the service; and
4. Regionalization of services and facilities shall be
opposed if it will lead to growth which is not
compatible with the desires of the towns involved.
The proposed metropolitan district appears capable of providing
economical and sufficient service to the area within its proposed
boundaries.
It appears that the area to be included in the proposed
metropolitan district will have the financial ability to discharge
the proposed indebtedness on a reasonable basis.
The creation of the proposed metropolitan district, as submitted,
will be in the best interests of the future residents of Beebe
Draw Farms Planned Unit Development.

ADDITIONAL COMMENTS
BEEBE DRAW LAND COMPANY, LTD.
The Beebe Draw Metropolitan District Service Plan is not subject to review
by the Lorimer-Weld Regional Council of Governments 208 Water Quality
Advisory Committee. Mr. David Dubois, Water Resources Manager for the
Council of Governments, stated that the proposed use of individual septic
disposal systems would not be subject to compliance with the 208 Water
Quality Management Plan.
In a letter dated April 21, 1986, the La Salle Fire Protection District
Board of Directors requests deletion of a statement in the service plan,
implying that the proposed on-site fire truck will reduce response time by
the Fire Protection District.

The purpose of the Metropolitan District is to provide domestic water
service, internal roads, external road improvements, storm drainage, safety
protection, parks and recreational facilities, television transmission, and
mosquito control to the Beebe Draw Planned Unit Development, which was
approved by the Board of County Commissioners in December 1985.
Referral agencies contacted have no objections to the service plan as
submitted. In a letter dated April 21, 1986, Gary Sandau, Fire Chief of the
La Salle Fire Protection District, did offer one comment regarding fire
department response time; a copy of the letter is attached.

METROPOLITAN DISTRICT SERVICE PLAN
32-1-203. Action on service plan - criteria;
(1) The board of county commissioners of each county which has
territory included within the proposed special district, OTHER
THAN A PROPOSED SPECIAL DISTRICT WHICH IS CONTAINED ENTIRELY
WITHIN THE BOUNDARIES OF A MUNICIPALITY, shall constitute the
approving authority under this part 2 and shall review any service
plan filed by the petitioners of any proposed special district.
With reference to the review of any service plan, the board of
county commissioners has the following authority:
(a) To approve without condition or modification the service
plan submitted;
(b) To disapprove the service plan submitted;
(c) To conditionally approve the service plan submitted
subject to the submission of additional information
relating to or the modification of the proposed service
plan.
32-1-203 Action on service plan - criteria.
(2) The board of county commissioners shall disapprove the service
plan unless evidence satisfactory to the board of each of the
following is presented.
(a) There is sufficient existing and projected need for
organized service in the area to be serviced by the
proposed special district;
(b) The existing service in the area to be served by the
proposed special district is inadequate for present and
projected needs;
(c) The proposed special district is capable of providing
economical and sufficient service to the area within its
proposed boundaries;
(d) The area to be included in the proposed special district
has, or will have, the financial ability to discharge
the proposed indebtedness on a reasonable basis.
(2.5) The Board of county commissioners may disapprove the service
plan if evidence satisfactory to the board of any of the following, at
the discretion of the board, is not presented.

(a) Adequate service is not, or will not, be available
to the area through the county, other existing municipal
or quasi-municipal corporations, including existing
special districts , within a reasonable time and on a
comparable basis;
(b) The facility and service standards of the proposed
special district are compatible with the facility and
service standards of each county within which the
proposed special district is to be located and each
municipality which is an interested party under section
32-1-204 (1) ;
(c) The proposal is in substantial compliance with a
master plan adopted pursuant to Section 30-28-106,
C.R.S. ;
(d) The proposal is in compliance with any duly adopted
county, regional, or state long-range water quality
management plan in for the area;
(e) The creation of the proposed special district will
be in the best interests of the area proposed to be
served.
(3) The board of county commissioners may conditionally approve the
service plan of a proposed special district upon satisfactory
evidence that it does not comply with one or more of the criteria
enumerated in subsection (2) of this section. Final approval
shall be contingent upon modification of the service plan to
include such changes or additional information as shall be
specifically stated in the finding of the board of county
commissioners.
32-1-203. Action on service plan - criteria.
(3.5)The board of county commissioners may exclude territory
from a proposed special district prior to approval of the
service plan submitted by the petitioners of a proposed
special district. The petitioners shall have the burden of
proving that the exclusion of such property is not in the
best interest of the proposed special district. Any person
owning property in the proposed special district who requests
that his property be excluded from the special district prior
to approval of the service plan shall submit such request to
the board of county commissioners no later than ten days
prior to the hearing held under section 32-1-204, but the
board of county commissioners shall not be limited in its
action with respect to exclusion of territory based upon such
request. Any request for exclusion shall be acted upon
before final action of the county commissioners under section
32-1-205.

(4) The findings of the board of County commissioners shall be
based solely upon the service plan and evidence presented at
the hearing by the petitioners, planning commission, and any
interested party.
(5) In the case of a proposed hospital district, submission to
the board of county commissioners by the petitioners of a
certified copy of an approved certificate of public necessity
issued by the health facilities review council of the
department of health shall constitute compliance with
subsection$ (2) and (2.5) of this section.

Recorder of Weld County, Colorado, a Service Plan and related documents for
the proposed Beebe Draw Farms Metropolitan District. The Service Plan and
related documents are now on file in the office of the Clerk and Recorder
and the Board of County Commissioners and are available for public
inspection.
NOTICE IS FURTHER GIVEN, that, by Order of the County Commissioners of Weld
County, Colorado, a public hearing on said Service Plan and related
documents will be held in the Chambers of the Board, First Floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado, at 2:00 p.m. ,
on Wednesday, the 14th day of May, 1986.
The purpose of the hearing shall be to consider the adequacy of the Service
Plan of the proposed Beebe Draw Farms Metropolitan District and form a basis
for adopting a Resolution approving, conditionally approving, or
disapproving the Service Plan.
The proposed district is located entirely within the unincoporated area of
Weld County, Colorado. A general description of the land contained within
the boundaries of the proposed district is the Rezoning Plat of Beebe Draw
Farms and Equestrian Center, A Planned Unit Development, according to the
recorded plat thereof, Reception No. R1992773, with the County Clerk and
Recorder of Weld County, Colorado, located in Sections 3, 4, 5, 8, 9 and 10,
Township 3 North, Range 65 West of the 6th Principal Meridian, Weld County,
Colorado, as more specifically set forth in the Service Plan and related
documents which are on file with the County Clerk and Recorder.
Notice is further given that any time after the filing of the petition for
the organization of the proposed district in the District Court for the
County of Weld, but no later than ten (10) days before the hearing on the
Petition, in accordance with the provisions of the statute, the owner of any
real property within the proposed district may petition the District Court
to exclude his property and the District Court, not the Board of County
Commissioners, shall determine whether said property should be excluded.

The La Salle Fire Protection District Board of Directors has
reviewed the Proposed Service Plan presented by Beebe Draw Land
Company, Ltd. . The Board of Directors found no real problems
with the proposed plan, however there is one area in which the
wording should be changed. The area of concern is on page 17 of
the proposed Service Plan under the heading of District Office
Building, in the first paragraph. Concerning the fire truck
the statement is made "to reduce response time by the Fire Pro-
tection District". The Directors feel that this statement should
be removed from the plan because of the implication that our
response time will definately be reduced.
