RE: APPROVE REQUEST UNDER SECTION 13 C. OF THE WELD COUNTY
SUBDIVISION REGULATIONS - FRANCES SOLANO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , Frances Solano submitted a request that she be
allowed to obtain a zoning and building permit for a mobile home
on a parcel of land which was previously divided illegally, and
WHEREAS, said parcel of land is described as part of the SW;
SE' of Section 25 , Township 5 North, Range 66W of the 6th P.M. ,
Weld County, Colorado, and
WHEREAS , the Board, after hearing the testimony and
statements of those present, having studied the request of the
applicant, and being fully informed, finds that this request shall
be approved for the following reasons:
1 . The parcel is accessible from an existing public road.
2. The request is for a mobile home to be used as temporary
storage which does not require adequate water and sewer.
3 . There is one existing single family dwelling, and a
garage on the property. The granting of this request
for a mobile home to be stored on the site for six
months will not change the essential character of the
neighborhood.
4 . The procedure defined in Section 13 C. is not being
utilized for the purpose of evading the requirements and
intent of the Weld County Subdivision Regulations.
5 . The owner does not own a parcel of land adjacent to the
subject parcel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Frances Solano be,
and hereby is, granted rights for a zoning and building permit for
a mobile home to be used for temporary storage.

Re: A request under Section 13 C. of the Weld County Subdivision
Regulations from Francis Salono.
Dear Commissioners:
The attached materials are in reference to a request from Francis Salono to
obtain a zoning and building permit for a mobile home to be used for
temporary storage. The subject parcel of land was divided illegally on
October 14, 1975, making it a violation of Section 1-2 (C) of the Weld
County Subdivision Regulations. The parcel of land on which the request is
being made is described as Pt. of SW} SE} of Section 25, T5N, R66W, located
approximately .75 miles south of Greeley City limits, north of Weld County
Road 52 and east of Weld County Road 35.
Ms. Salono has submitted a letter dated April 7, 1986, explaining the reason
for making this request. A copy of Section 13 C. of the Weld County
Subdivision Regulations is included in the attached materials.
Based upon the submitted information and policies of the County the
Department of Planning Services staff recommends that the request be
approved for the following reasons:
s - The parcel is accessible from an existing public road;
- The request is for -a mobile home to be used as temporary
storage which does not require adequate water and sewer;
There is one existing single family dwelling, and a
garage on the property. The staff feels that the
granting of this request for a mobile home to be stored
on the site for 6 months will not change the essential
character of the neighborhood.

The staff has suggested to the applicant that she
consider using the Recorded Exemption procedure to
legalize the property. Ms. Salono has indicated the
lack of funds on her part to file a Recorded Exemptio❑
and the need to obtain a zoning and building permit for
the mobile home to correct a current violation. Under
the existing circumstances it is felt that the procedure
defined in Section 13 C. is not being utilized for the
purpose of evading the requirements and intent of the
Weld County Subdivision Regulations; and
The owner does not own a parcel of land adjacent to the
subject parcel.

SECTION 13 VIOLATIONS AND PENALTIES
A. Any subdivider, or agent of a subdivider, who transfers or sells 3
or agrees to sell or offers to sell any subdivided land before a final plat for such subdivided land has been approved by the Board
of County Commissioners and recorded or filed in the office of the
County Clerk and Recorder shall be guilty of a misdemeanor -and
shall be subject to a fine not to exceed five hundred dollars for each parcel or interest in subdivided land which is sold or
offered for sale. All fines collected under this paragraph (A)
shall be credited to the general fund of the county.
B. The Board of County Commissioners of the -county in which the
subdivided land is located shall have the power to bring an action
to enjoin any subdivider from selling, agreeing to sell, or 4
offering to sell subdivided land before a final plat for such
subdivided land has been approved by the Board of County
Commissioners.
C. Building Permits
t (1) Building permits, for construction on land divided in an illegal
manner subsequent to the adoption of these Regulations, shall not
be issued unless reviewed and approved by the Board of County
Commissioners. No building permit shall be approved by the Board
of County Commissioners unless all of the following can be shown:

(a) The parcel shall be accessible from an existing public road.

(b) The parcel will have access to an adequate water supply;

(c) The parcel will have access to an adequate means for the
disposal of sewage;
(d) The issuance -of the building permit will not change the
} essential character of the neighborhood; ;-
(e) The procedure defined in this Section is not being utilized I j
for the purpose of evading the requirements and intent of the
Weld County Subdivision Regulations; and
(f) The owner does not own a parcel of land adjacent to the
subject parcel.
