RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1219 - HARVEY C. AND DOROTHY A. LONG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1219, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1219 was submitted by Harvey C. and Dorothy A. Long for property which is located in part of the W} SE} SW} and the W} E} SW* of Section 31 , Township 8 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 40 acres and 1 acre. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is subject to the following conditions: 1 . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within 60 days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Long. The parcel of land is described as the Wi SE} SW} and the W} E} SW} of Section 31, T8N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately 2.5 miles southeast of the Town of Pierce and approximately 2.5 miles northeast of the Town of Ault, north of Weld County Road 86 and east of Weld County Road 37. This request is to divide a 41 acre parcel, which is the total contiguous land holdings of the applicant, into two lots of 40 acres and 1 acre, more or less. The applicants propose using North Weld County Water District as the water source for both lots. Septic systems will provide sewage disposal. The Planning Commissions of the Towns of Ault and Pierce have reviewed this request and have no objections to the proposal. The staff has concerns that the proposed division will be inconsistent with efficient and orderly development. The parcel in question is one of six properties in this quarter section ranging from 2.5 acres to 41 acres. Four of these properties access onto Weld County Road 86. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. The staff also has concerns about the proposed access which would cross the proposed larger lot. They lost everything they owned. They would now like to buy a home and start over again. Harvey is retired. He received a medical discharge from the Rocky Mountain Arsenal in 1971 . This was due to back problems and bad knees. He now has a heart condition. We would like to see them come and live near us to help us out and be there if and when we need them. I 'm not capable of taking care of the place. 5. The parcel of ground we propose to set a home on is non-productive ground. It will be in the area we started a wind break but many of the trees did not live. We have the rest of our ground in grass hay. 6. We plan on the house only and it would be consistent with the intent of the zone district. We already have our barn and garages. 7. This house will be occupied by our son Patrick and his family. He will be there to help us with the up keep of our home and grounds. We are in an "A" zone and want to continue keeping a few head of cattle for grazing on the 40 acres. We have our hay cut once every year. 8. The uses are compatible with the surrounding area as I 'm sure the area will all remain in the "A" zone. 9.
