RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A WOOD CUTTING AND PROCESSING OPERATION - JACK TATUM WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 20th day of August, 1986 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Jack Tatum, 10490 U.S. Highway 34 , Greeley, Colorado 80634 , for a Use by Special Review for wood cutting and processing operation on the following described real estate , to-wit: Part of the Nigh, Section 11 , Township 5 North , Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a wood cutting and processing operation on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for a wood cutting and processing operation as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Permanent disposal of wood product wastes, tree trimmings, or other related wastes shall not be permitted on the site. 3 . The applicant/operator shall implement and maintain a row of trees on the north boundary of the storage and work area as indicated on the Use by Special Review plat or as approved in a plat submitted to the Planning Department. 4 . Storage and work areas shall be maintained with good vegetative cover to prevent soil erosion as recommended by the Weld Greeley Soil Conservation District. 5 . When the City of Greeley Planning Department notifies the Weld County Planning Department that a final Planned Unit Development application has been submitted to the City of Greeley Planning Department within five hundred feet of the Use by Special Review area, the storage and work area shall be screened by a plan submitted to and approved by the Department of Planning Services. The intent of this standard is to review the compatibility of this use with the City of Greeley' s future plans. 6. The Use by Special Review permit shall not be transferable to any successor in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the wood cutting and processing operation. 7 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 9. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 860819 Page 2 DEVELOPMENT STANDARDS - TATUM 10. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 11. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 12. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. 860819 HEARING CERTIFICATION DOCKET NO. 86-62 RE: USE BY SPECIAL REVIEW FOR A WOOD CUTTING AND PROCESSING OPERATION - JACK TATUM A public hearing was conducted on August 20, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated July 28, 1986, and duly published July 31, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Jack Tatum for a Use by Special Review for a wood cutting and processing operation. Lee Morrison, Assistant County Attorney, made this matter of record. This hearing was continued from August 13, 1986, because the property had not been posted the required ten days prior to that hearing. Debbie de Besche, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. She said this recommendation is subject to two Conditions and twelve Development Standards. Commissioner Lacy had questions concerning Development Standard #5, which was written to alleviate concerns of the City of Greeley regarding the compatibility of the proposed operation and potential future development in the area. Jack Tatum, the applicant, came forward to answer questions of the Board. He said the city limit goes to his driveway, but he does not foresee a problem. Following considerable discussion, Commissioner Kirby moved to amend Development Standard #5 to provide that when the Greeley Planning Department notifies the Weld County Planning Department that a Planned Unit Development application has been submitted on property within five hundred feet of this Use by Special Review, the storage and work area shall be screened by a plan approved by the Department of Planning Services. Seconded by Commissioner Brantner, the motion carried unanimously. Mr. Tatum said the plat indicates that the screening referred to in Development Standard X13 includes Russian olive and pine trees. He would like to eliminate the requirement for planting Russian olive trees and be allowed to plant additional evergreens. After discussion, Commissioner Kirby moved to amend Development Standard #3 by adding, "or as approved in a plan submitted to the Planning Department." Commissioner Brantner seconded the motion and it carried unanimously. Commissioner Lacy moved to approve the Use by Special Review for a wood cutting and processing operation, subject to the Conditions as recommended by the Planning Commission and the Development Standards as amended. He owns both Lots A and B. The previous plat showed the business located on A instead of Lot B as it actually is. Gloria Dunn reported it would be better to leave the Use by Special Review request on both lots rather than trying to confine it to one lot. Access to the property is through Lot A, and the staff's recommendation and the Use by Special Review plat included the entire six acre site. The Chairman called for discussion from the members of the audience. There was none. She Chairman asked Mr. Tatum if he agreed with the recommendations, -conditions, and Development Standards as outlined by the Department of Planning Services staff. He stated he has no objections to anything stated. The application is for an existing wood cutting, processing, and delivery operation . This operation is located on 6. 1 acres of which one-half is in active use. 2 . The site accesses on U .S . 34 Business . Surrounding uses are mostly agricultural . There is a State Highway Department equipment yard to the northeast . 3. The site gets approximately 100 users per year according to the applicant . Peak time for the use is fall when vehicle traffic is four to five truck trips per day . 4 . The applicant has indicated that this use is compatible with area Comprehensive Plans because the operation is not permanent by its nature. PLANNING REVIEW COMMENTS : The application is reviewed for conformance with Greeley Comprehensive Plan goals . These goals address present and future situations. 1 . At present , U .S . 34 handles a large amount of traffic because it functions as part of the western entryway. This entryway provides people with their first impression of the City . As such , uses along this route can have a detrimental impact on perception. 2. This use functions as an industrial use primarily because: a ) processing takes place outdoors ; b ) there is a noise factor ; c ) outside storage is required to maintain the use ; and d ) the product is necessarily in bulk . Classified under the City Zoning Code, this is an industrial use and is incompatible with the entryway function of U .S . 34 3. Greeley 's westward expansion has extended beyond the map boundaries of the 1971 Comprehensive Plan . Future compatibility is measured against approved Conceptual PUD Plans for this area (Golden Triangle ) . 4 . Development in the Golden Triangle is intended to be light industrial. Such uses are enclosed ; process people and services more than products ; and do not have environmental impacts (noise, dust ) associated with more intense industrial uses. While many uses can be classified industrial , this does not necessarily make them compatible. 5. Mitigative steps could be taken. They include opaque fencing, landscape screening, berming, or relocating the use to an appropriately zoned location. It is the last alternative that would best put this use in conformance with comprehensive planning recommendations. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Water Department cautioned that there are two large transmission lines very close to this site . The applicant should contact the Department for the specific alignment of these lines. The site , Lot A ( as presented in the application ) , is made up of 100% Vona loamy sant , 3-5% slopes and is consistant with the proposed land use . The main concern , however , is maintenance of soil surface cover as this type of soil is very susceptable to wind erosion and blows easily without adequate surface cover . Storage ant work areas should be maintained with good vegetative cover to prevent soil erosion .
