RE: APPROVE AGREEMENT FOR PLACEMENT OF SNOW FENCE WITH U. S . WEST
COMMUNICATIONS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an Agreement with
U. S . West Communications for the installation of snow fence along
20th Street, west of 83rd Avenue, and
WHEREAS, after review, the Board deems it advisable to
approve said Agreement, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement for
Placement of Snow Fence with U. S . West Communications be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 30th day of
November, A.D. , 1988 .

AGREEMENT FOR PLACEMENT OF SNOW FENCE
THIS AGREEMENT, made and entered into this day of
, 1988 , by and between WELD COUNTY, COLORADO, by
and through the Board of County Commissioners of Weld County,
hereinafter referred to as "County" and U. S. WEST COMMUNICATIONS,
hereinafter referred to as "U. S. West. "
WITNESSETH:
WHEREAS, U. S. West has asked for the installation of snow
fence along 20th Street, west of 83rd Avenue in Weld County,
Colorado, and
WHEREAS, County believes that it will be in the best
interests of both parties to erect said snow fence.
NOW, THEREFORE, in the mutual promises and covenants
hereinafter stated, the parties hereto agree as follows:
1 . The County shall provide all materials and the
installation of a snow fence along 20th Street, west of 83rd
Avenue, in Weld County, Colorado.
2. The U. S. West shall be responsible for the maintenance
of said snow fence after it is erected.
3 . That should County determine, after the first winter
season in which said snow fence is in place, that the fence is
incapable of performing in the manner needed, said snow fence
shall be removed and all materials will be returned to County.
IN WITNESS WHEREOF, the parties hereto have duly executed
the above-stated Agreement the date and year first written above.
