Y' ..r. . rn « ..�.r USR 797=87=23 • 4,.•1 • '• 7A:41 i s> U .. u+rte RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR A HOME BUSINESS, HIGH PRECISION OPTICS, IN THE A (AGRICULTURAL) ZONE DISTRICT - THOMAS BAUR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of August, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the ..application of Thomas Baur, 7460 East County Line Road, Longmont, Colorado 80501 , for a Use by Special Review for a home business , high precision optics , in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW* SW} , Section 30 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed , finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan as outlined in the Agricultural Policies Section #4 . This particular policy addresses the location of an industrial development on non-prime agricultural land outside of an Urban Growth Boundary Area. In this policy it explicitly requires the applicant to demonstrate that the 871139 Page 2 RE: USR - BAUR proposed use cannot reasonably locate within a municipality, Urban Growth Boundary Area, or the 1-25 Mixed-Use Development Corridor. It is the Board' s opinion that the applicant has demonstrated this as outlined on page 2 of the application materials . In the fall of 1986 , the applicant approached four individual financial institutions for funding for such an urban location. Each of the institutions strongly advised the applicant to stay at the present proposed location until a stronger financial base could be established. In addition to this criteria , the applicant must demonstrate how adjoining agricultural uses will not be adversely impact. This particular quarter section is made up of ten separate parcels having an average acreage size of 15 . 1 acres , more or less . Mr. Baur ' s property being the largest at 23 acres , more or less , and the smallest equaling 5 .6 acres, more or less. The applicant further indicated , on page 6 of the application materials , that the land use in the area, as well as his own, is for small grazing facilties and crop production. The proposed use will not hinder or depreciate the existing agricultural uses now or in the future. b. The proposed use is consistent with the intent of the Agricultural district and is provided for as a Use by Special Review. The proposed use will not interfere with the agricultural activities or other activities related to agriculture . c. The area is not affected by an overlay district. d. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use . e. Use by Special Review Development Standards and conditions of approval will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a home business, high precision optics , in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions : 871139 Page 3 RE: USR - BAUR 1 . Prior to the issuance of any building permits, a plan shall be submitted by the applicant and approved by the Longmont Fire Protection District showing adequate water supply sufficient for fire protection in compliance with the 1985 Uniform Fire Code. 2 . Prior to the recording of the Use by Special Review plat, a copy of the Hazardous Material Safety Data Sheets for all hazardous substances used in the operation of the Use by Special Review shall be submitted both to the Department of Planning Services and the Longmont Fire Protection District. 3 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 4 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for a home business (high precision optics) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Chemical wastes and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and ground water contamination. 3 . Ingress and egress to the Use by Special Review site shall be restricted to the use of Weld County Road 16i . 4 . The Use by Special Review septic system shall be approved by the Weld County Health Department in accordance with the Weld County Individual Sewage Disposal Requirements. 5 . The applicant shall provide and maintain approved chemical fire extinguishers and an adequate source of available water for fire protection on the property as approved by the Longmont Fire District. 6 . The applicant shall provide on the outside of both Use by -Special Review structures a Hazardous Materials Identification sign approved by the Longmont Fire Protection District as outlined in the Uniform Fire Code 80 . 103 . f. , 1985 Edition. 7 . The applicant shall provide and maintain a lightening control device to be installed onto the chemical storage shed. 8 . The applicant shall keep all chemicals locked inside of the chemical storage cabinet. The cabinet shall be locked at all times other than for removal and replacement of chemicals . 9 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 10 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 871139 Page 2 DEVELOPMENT STANDARDS - BAUR 11 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance . 12 . Personnel from the Weld County Health Department, Longmont Fire District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 13 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. There is an -existing septic system that was previously used for a mobile home prior to their purchasing the property. The Health Department has inspected this and feels it is adequate for the business. Water on inorganic solvents would probably just spread the fire if there were one. Hal-on would probably be the most effective fire fighter. Meadowlark Optics is a small company which caters to the needs of users of high precision optics. The services we offer include optical, mechanical and electronic design for electro—optic systems; optical coating; and fabrication of custom electro—optical systems. We also design, coat, assemble, test and sell -a line of standard and custom precision polarization optics components. We do not make eyeglasses are any other opthalmological products. Me reach our customer through advertisements in national trade journals and in national directories of the precision optics industry. Orders are received by telephone and by mail. Customers very seldom visit us; we see one every few months. Most items we sell are small and expensive, usually shipped by UPS from Longmont. Our average order size is roughly $500 and an average weight of the ordered item is a few ounces. We usually ship five to ten packages per week. Our customers are located throughout the United States and Europe. Our customers include NASA, major defense contractors, many universities, national research institutions, optical disk memory manufacturers and manufacturers of lasers and laser surgery -equipment. There are presently two full—time production employees at our business. In addition, there are two FTEs to provide administrative support and one engineer hired on a temporary project basis to develop a new product for the 871139 Page 2 company. The exact number of employees varies to some extent with the work load. We also frequently contract with other engineers and sales people who work entirely off the premises. Hours of operation are• approximately 7:00 AM until 6:00 PM Monday through Friday. I usually work alone on the weekends. The maximum number of employees presently working for me is five. I plan to add two more employees in the coming year. A guess regarding future hiring is that I will add two employees in each subsequent year. Twelve people including myself is the maximum number that will ever by employed while the business is located on the farm. At our projected growth rate we will reach this limit in about three years and we will then need to move the business to grow further. My present plans are to grow to 20 employees in five years. Our business is owned and run by myself and my wife Jeanne. I am the president and treasurer and Jeanne is the secretary of the corporation. Together we own 88.4% of the stock, with the remainder owned by employees and close friends. I work full time for the business (an average of 80 hours per week over the past year) and Jeanne helps me with market research and planning activities evenings and weekends. She also has a full-time job outside the company to support us both until the corporation can afford to pay me and to hire her. Meadowlark Optics is the recipient of a State of Colorado QIC loan. This loan program is intended to encourage development of promising small businesses in Colorado. Our sales have increased at a rate of more than 100% per year since our incorporation in 1981. However, we are still not strong enough financially to move into a complete, integrated industrially—zoned facility. We made an attempt to do so last fall, but all four banks that we approached for funding strongly advised us to stay at our present location. 871139 Page 3 The surrounding properties are primarily used for agriculture. Some of the land is cropland and some is grazing land for cattle and sheep. One neighbor, pr. Ken Neuens, operates a veterinary facility for horses on his property. The water source is Left Hand Water Supply. We have one optical coating machine which uses 30 gallons of water per hour when it is operating (about 40 hours per week). We use an average of less than 10,000 gallons of water per month including water for livestock and domestic use. Access routes to the business are provided by a driveway connecting to both Road 1 and to Road 16 1/2. Vehicular traffic associated with the business is primarily from the automobiles of the employees. A United Parcel Service truck stops by most days and approximately once every month another parcel delivery truck will stop by. As explained earlier, we almost never have customers visit the premises. The sewage facilities consist of a septic tank and leach field for the house and another septic tank and leach field for the barn. Fire protection measures will include fire extinguishers located in all buildings and smoke alarms in the barn and the house. We use small quantities of flammable organic solvents in the business. These are stored and used in a small (100 square foot) shed separated from other buildings to reduce the risk of fire to the main buildings and to the employees. Our optics business does not involve animals, although I usually graze about 10 cattle on the land. I will continue to use my land for grazing cattle in the future. The optics business will not reduce the level of ranching activity of the land. 871139 Page 4 There are no industrial wastes disposed of on the farm. We have a trash pickup weekly by Western Disposal and it is usually three trash cans, including domestic trash. We use small quantities of organic solvents and some acids and bases in our business. The complete list of chemicals that are of potential interest is attached. Waste solvents are being stored until the quantity becomes large enough to warrant hiring a licensed chemical waste disposal company to dispose of it off site. We have accumulated less than 20 gallons of these waste solvents. Waste acids and bases are diluted and neutralized using standard chemical procedures, and the resulting water and salts are then poured out. This amounts to less than two gallons per year of water with probably less than eight ounces of dissolved salts, some of which are actually quite good fertilizers. I have a strong personal as well as professional interest in maintaining a safe and unpolluted environment. I served actively for several years on the Weld County Board of Health and worked primarily on environmental issues. I also chaired the Public Health Needs Committee for Weld County, which addressed chemical pollution issues. There are no storm water retention facilities associated with the proposed use. We plan to plant some grass for a small lawn to the south of the barn and to add some gravel to the driveway when money is available. We also plan to add a privacy fence around the parking area to reduce visibility of parked cars. We expect to complete the first phase of construction in one month after County approval. This phase is to finish construction on the first floor of the barn. The second phase, which is remodelling of the second floor of the 871139 Page 5 barn will probably be completed in twelve months. The pace of this work will depend on the financial fortunes of the business. The third phase which is to remodel about 200 square feet in an attached loafing barn and about 200 square feet in the silo, is optional again depending on financial circumstances. If this is done the earliest the work is likely to be completed in 2 years. There are no plans for reclamation procedures at the time the business leaves the ranch. In fact the proposed construction for the business is a major reclamation of a run down old barn. The proposal is consistent with the Weld County Comprehensive Plan because it does not disturb the rural nature of our surroundings. It does not remove any land from agricultural use and still leaves me with an adequate amount of barn space for my cattle and feed. We are remodelling an existing, previously unused, barn And therefore are not using up any farm land at all. The area used for parking cars was formerly a lot for a mobile home which I have removed from the property. The work we do poses no threat to the health, safety and welfare of the inhabitants of the neighborhood and the county. We have therefore made no provisions to protect these things.
