RE: APPROVE LICENSE TO USE RIGHT-OF-WAY AND AUTHORIZE CHAIRMAN TO

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a License to Use
Right-of-Way between Weld County and Mark Kauffman, Lee E . r

The conditions by which said Second Parties may construct,
maintain, alter, repair, operate, and remove said waterway are as

1. Second Parties must construct, maintain, alter, repair,
operate and/or remove said waterway at their own expense and W

operate and/or remove said waterway in such a manner as to not o
interfere with the movement of traffic upon either Weld County
Road 14 or Weld County Road 71, from the intersection located at I-
the northwest corner of Section 1, Township 1 North , Range 63 West 0 0
of the 6th P.M. , Weld County, Colorado.

3 . Second Parties shall erect and maintain signs at the
intersection of the waterway with Colorado State Highway 52 and
the intersection of the waterway and Weld County Road 14. Said
signs shall say, "Not a Road. "
4. First Party retains the right to revoke this license at
any time for any reason. First Party shall give Second Parties
written notice of its intent to revoke this license at least
ninety (90) days prior to the date of revocation. Such notice
shall be sent to Second Parties by Certified Mail to his addresses
written above or served upon Second Parties in accordance with the
Colorado Rules of Civil Procedure. Second Parties shall have the
duty of informing First Party of Second Parties ' change in
addresses from their addresses written above. Upon such r
revocation, Second Parties must remove said waterway and leave the

right-of-way in substantially the same condition as it was prior
to the construction of the waterway. o r

5. Second Parties shall allow First Party the right to
place any and all natural drainage water from Weld County Road 71

used in any form or fashion for irrigation purposes or any „ rn
purposes other than the transport of natural drainage waters.

7 . Second Parties shall indemnify and save harmless First
Party, its successors, assigns, employees, and agents from any and \
all damage or loss sustained by them or any of them arising by H
reason of the construction , maintenance, repair, operation , or z

8 . Second Parties agree to protect First Party and save and
hold it harmless from any and all third party claims and damages Isz, ",

employees, and agents from any and all claims and damages of
whatsoever character to said waterway arising out of either the m

11 . The Agreement between Gene Andrews, individually and as

Lyle V. Cooksey, Vernon L. Cooksey, and William A. Sargent, Jr. ,
as personal representative of the estate of William A. Sargent,
