RESOLUTION RE: APPROVAL OF AMENDMENT OF USE BY SPECIAL REVIEW PERMIT TO ALLOW EXPANSION OF A GAS PROCESSING FACILITY - VESSELS OIL AND GAS COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of March, 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Vessels Oil and Gas Company, 600 South Cherry Street , #1220 , Denver, Colorado 80222 , for the amendment of a Use by Special Review permit to allow expansion of a gas processing facility on the following described real estate, to-wit: Part of the SE', Section 28 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that expansion of the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. 860287 Page 2 RE: AMEND USR - VESSELS b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. No overlay districts affect the site. d. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE TT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application to amend a Use by Special Review permit to allow expansion of a gas processing facility on the hereinabove described parcel of land be , and hereby is , granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to he recorded in the office of the Weld County Clerk and Recorder. 3. Within sixty days from the date of approval by the Board of County Commissioners, evidence of approval by the Division of Water Resources of the water source used in the expanded operation shall be provided to the Department of Planning Services. 4. Within forty five days from the date of approval by the Board of County Commissioners , a noise report prepared by a qualified engineer shall be submitted to the Department of Planning Services giving evidence of Vessels ' compliance with noise standards as set forth in CRS 25-12-103 et sea. and stated in Development Standard #6 . 5. Prior to recording the Use by Special Review plat, the gas processing facility shall be inspected by an independent fire safety expert pursuant to Article 2, Section 2 . 301 of the Uniform Fire Code. The amended Use by Special Review permit is for expansion of a gas processing facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Petroleum products and compressed flammable gases are hazardous substances per C.R.S. 29-22-107 (2) (a) . Within thirty days of the date of approval by the Board of County Commissioners , a list of the maximum quantities of hazardous substances on the site and emergency contact names and phone numbers shall be updated and provided to the Waste Management Division of the State Health Department, the Office of Emergency Management and the Brighton Fire Protection District. Evidence of the listing shall be provided to the Department of Planning Services . 3 . To assist the Brighton Fire Protection District, the following measures shall be followed: a. All valves carrying flammable liquids or gases and identified as required by the Brighton Fire Protection District shall be properly and readily visible. A map locating such valves shall be updated and provided to the Brighton Fire Protection District . b. All fire extinguishers shall be rated a minimum eighty (80) BC. The fire extinguishers shall be located at sites approved by the Brighton Fire Protection District. c. A property address sign shall be maintained on the property in a location which is visible from Weld County Road 4 . The address numbers shall be five (5) inches in height and three-quarters (3/4) inch in stroke. 4. All liquid storage vessels shall be adequately bermed in accordance with the Weld County Health Department and Brighton Fire Protection District requirements to contain all potential content in the event of spillage. 5 . On-site septic systems shall be designed in accordance with Weld County Individual Sewage Disposal Regulations for industrial facilities. 860287 Page 2 DEVELOPMENT STANDARDS - VESSELS 6. Sound levels at a distance of twenty-five (25) feet from the property shall not exceed: Seventy (70) db (A) between 7 : 00 a .m. and the next 7: 00 p.m. Sixty-five (65) db (A) between 7: 00 p.m. and the next 7: 00 a.m. During the period between 7: 00 a.m. and the next 7: 00 p.m. levels may reach eighty (80) db (A) for a period not to exceed fifteen (15) minutes in any one hour period. Periodic, impulsive or shrill noises may not exceed levels of 5 db (A) less than those listed above. Method of measurements shall be in accordance with standards under CRS 25-12-101 et seq. At such time that concentrated residential development occurs within one-half mile of the subject site , sound levels shall meet residential standards as set forth in CRS 25-12-102 (6) . 7. Within sixty days from the date of approval by the Board of County Commissioners, all traffic areas on the gas processing site shall be surfaced with gravel. Other areas not covered by tanks, concrete or buildings shall be planted with adapted grasses , as recommended by the West Adams Soil Conservation District. All newly-surfaced and newly-planted areas shall be maintained by the owner/operator to prevent wind and water erosion. 8. Should the developed area of Brighton approach one-half (1/2) mile of the subject site , landscaping shall be planted along all property boundaries visible from the developed areas. 9. All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 10. The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 11 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 860287 Page 3 DEVELOPMENT STANDARDS - VESSELS 12. Personnel from the Weld County Health Department, Weld County Department of Planning Services and Brighton Fire Protection District shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 13. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 14. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. 15. The owner/operator shall enter into a Road Maintenance and Improvements Agreement with Weld County prior to the issuance of future building permits. 860287 HEARING CERTIFICATION DOCKET NO. 86-13 RE: AMEND USE BY SPECIAL REVIEW 3ERMIT TO ALLOW EXPANSION OF A GAS PROCESSING FACILITY - VESSELS OIL AND GAS COMPANY A public hearing was conducted on March 19, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Lacy, Tro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison -Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated February 12, 1986, and duly published February 13, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Vessels Oil and Gas Company to amend a Use by Special Review permit to allow expansion of a gas processing facility. Lee Morrison, Assistant County Attorney, made this matter of record. Debbie de Besche, representing the Planning Department, reminded the Board that, at the hearing of February 26, 1986, Condition #5 was added. She also stated that the previous hearing was continued to study the impact this request will have on County Roads. The Planning staff recommended the addition of Development Standard #15, requiring that a Road Improvements Agreement 3�e completed prior to the issuance of future building permits. Don Carroll, of the Engineering Department, stated that the haul route was inspected and he recommended that the following four issues be -addressed in the Agreement: the haul route shall be both north and south on WCR 19; the applicant should be responsible for damage to the haul route; the haul route should be upgraded to two inches of gravel; and the applicant should be responsible for dust control ou the haul route. Mike Boland came forward to represent Vessels Oil and Gas -Company. He presented information concerning the cost of the proposed steps, and the amount of taxes which Vessels pays annually to Weld County. (Tape Change #86-18) He said his company is willing to enter into a Road Improvements Agreement, however. No public testimony was offered regarding this request. Commissioner Kirby moved to approve Development Standard #15 as read into the record by Ms. de Besche. Commissioner Lacy seconded the motion which carried unanimously. Commissioner Lacy moved to amend the Use by Special Review permit to allow expansion of a gas processing facility as requested by Vessels Oil and Gas Company, subject to the amended Conditions and Development Standards. All valves carrying flammable liquids or gases shall be properly labeled and readily visible. A map locating such valves shall be updated and provided to the Brighton Fire Protection District. b. The purpose of the measurements was to establish the noise levels resulting from plant operation at the plant ' s boundaries and the position of the boundary at which noise levels were below Colorado State requirements. The Colorado Department of Health, Title 25 Article 12 (CRS 25-12- 103 ) states that the maximum permissible noise level at a distance of 25 feet or more from the property line shall be 55 dB (A) during the hours of 7am to 7 pm and 50 dB (A) from 7 pm to the next 7 am. As the gas plant operates continuously over a 24 hour period the 50 dB (A) figure was chosen as a worst case to be used in the analy- sis. NOISE SOURCES AT THE SITE: Noise measurements were performed ata selection of locations throughout the gas plant, using a General Radio 1933 sound level meter on slow response. The units of measurement were decibels on the A weighted scale. The results of these mea- surements accompany this report. . Page 2 50 dB (A) NOISE CONTOUR: The data was used to construct the 50 dB (A) contours around the plant. This 50 dB (A) noise contour is the line beyond which the noise never exceeds 50 decibels in still air conditions (no wind) and is shown for two cases. The contour enclosing the greater area is that which exists at the present time. The contour enclosing the smaller area represents the noise scenario as envisaged 2 - 3 months from the time of writing when the enclosures presently being constructed around the Superior and Worthington machines are completed and with the rolldown doors on the Cummins engine - Gardner Denver compressor enclosure . closed . As can be seen from Figure I both contours extend be- yond the property perimeter more than the 25 feet specified by the Colorado Dept of Health. However, at the present time no residence exists within either contour and at the nearest existing residential building the ambient noise is unaffected by the plant operations. 55 dB (A) NOISE CONTOUR: Figure II shows the 55 dB (A) noise contour - the criteria to be used during daylight hours of 7 am to 7 pm and represents the line beyond which the noise levels do not exceed 55 decibels on the A scale. The contour drawn is that which will exist after completion of the enclosures presently being built and as in the nighttime case extends beyond 25 feet from the plant property line. The area enclosed by the contour is however, significantly smaller than that for the nighttime case. The noise sources which generate the contours shown on Figures I and II continue to be those items of mechanical equipment which are not built into an enclosure. The only water discharged from this ecuipment will be in the form of steam from the unit that removes water from the natural gas . As some of the propane-butane product may be sold for direct resale to consumers a mercantan odorant infection system may be required. With the power installation and operation of such a unit there will be no objectionable odors coming from same. Some noise levels will be produced by the compre_sors and to a lessor extent by the process air exchangers using electric motor driven fans . As with any equipment handling flammable liquids and gases , there is a certain fire hazard inherent in this operation. Again , this can be minimized with proper installation of the equipment and its operation. As the natural gas processing equipment will initially produce approximately 40 , 000 gallons of liquid product per day , one can expect four tanker truck loadings per day. Additional traffic can be expected from operation and maintenance and from the plant personnel driving to . _ The housing units and separate office for the processing plant are considered necessary for the efficient operation of the plant. It is most important that there be at least four resident operators as they will contribute significantly to increased plant efficiency , safety and security. Necessary sewage facilities will be provided with septic tanks and leach fields capable of handling foreseeable effluent and will be approved by the County Health Department. The maintenance shop and area production office are necessary in order to maintain an efficient and economic operation of the Producing wells in the area. The personnel attendant to the operation will not live on the premises and will drive to and from these facilities during the day as their use becomes necessary . The purpose of these surveys was to quantify the existing noise levels near and around operating equipment at the plants. The three plants surveyed were the Fort Lupton, the Space City and the Irondale plants. ' Mea- surements were performed with a Gen Rad Model 1933 Precision Sound Level Meter under current calibration. All measurements were per- formed at a height of approximately 4 feet from the ground and at a distance of 4 to 6 feet from the perimeter of the equipment under test. Before the results of the survey are presented, a brief introduction to noise exposure criteria may be in order. Presently, the Occu- pational Health and Safety Administration (OSHA) is enforcing a maximum time weighted average (TWA) of 90 dB (A) for an 8 hour period with a 5 dB exchange rate. This means that an employee exposed to a continuous sound level of 90 dB (A) for an 8 hour period would be considered to have a 100% exposure. The 5 dB (A) exchange rate is used to determine the exposure time for progressively higher sound pressure levels. The sound pressure level data compiled at the three Vessels ' , ranged from 77 dB (A) to 104 dB (A) . Figures 1 through 9 show tthents • measurement location along with the measurement results and the time for 100% exposure according to the OSHA regulation for the three facilities. The Space City Plant has large openings in the exterior skin of the compressor building. If the openings were eliminated the sound pressure levels in the compressor building would be ex- pected to increase about 3 to 6 dB ( ) . As can be seen from the measurement results many locations at the three plants experience relatively high sound pressure levels. This fact is mitigated by the low occupancy time of employees in these areas, which minimizes the noise exposure for a given area. However, employees should, as a matter of safety, be aware of the potential health risks in these areas. One way of accomplishing this is the posting of signs at the entrances of these buildings stating that the area is a high noise area and ear protecting de- vices are recommended for prolonged exposure. The results of this investigation indicate that light to moderately loaded structures may be founded on shallow spread footings and should experience tolerable settlements. Heavily loaded foundations or settlement sensitive structures should be supported by drilled piers founded in the claystone bedrock. Estimated settlements for large storace tanks have been developed assuming a normal ring wall foundation system. If the magnitude of these settlements is beyond what is tolerable by the structures, additional studies will be required to develop suitable alternate foundation systems . The surficial soils are moisture sensitive and tend to rut easily. Therefore, rock or gravel base for roadways and floor slabs will be required. E:;G:.,E_ ,_ ;S PROPERTIES A series of laboratory tests were performed to determine the engineerinc properties of the various strata encountered. This testing consisted of determining the natural moisture content, dry density, plasticity, and swell/- _ consolidat ionproperties of representative samples. The results of these tests are presented on Figures 3 throe:h 7. an:, Table 1 . The results of the swell/consolidation tests indicate that the overburden soils are normally consolidated and will tend to compress with the addition of loads. In addition, they exhibited a 0.5 to 2. 0 percent consolidation under constant pressure due to saturation. The swell/consolidation tests on the bedrock samples indicated a tendency to swell under light loads. The results of California Sarre] Penetration tests performed in the field indicate the clayey soils are stiff to very stiff and the sandy soils are medium dense to dense in consistency. however, despite the relatively high shear strengths measured in the field, foundation design ( i .e. allowable bearing pressures) will be governed by the compressibility of the subsoils. _%r:I iEERTh',, 1N LYs:5 ?';D =C0". Spread Footings Spread footings may be designed for an allowable gross bearing pressure of 3,000 pounds per square foot and should be founded at leas: three feet below final outside grade. They should have a minimum width of 24 inches and a maximum width of 10 feet. Larger footings should be designed as mat foundations. Footings designed in this manner should experience settlements of about 1 inch or less. It is cn LiLi;JaLed that some disturbance of the bearing soils will occur during excavation. The loosened soils should be removed or carefully recompacted before pouring the footing. If loose soils are allowed to remain in the foundation excavation, significant additional settlement could occur. All footing excava- tions should be checked by a soil engineer prior to placing concrete to verify that the proper bearing soilc have been encountered the that footing has been properly prepared. The piers should have a minimum diameter of 18 inches, a minimum shaft length of 2D feet and shoHIH, penetrate at least four feet into bedrock. All pier foundation excavations should be inspected by a soils engineer to verify that the proper bearing stratum has been reached, and that the pier bottom has been properly cleaned. The piers may be designed for a maximum end bearing pressure of 15,000 pounds per square foot and site shear of 1, 500 psf, for the portion of the pier . in firm bedrock . Reinforcing for the piers should be designed for any uplift or lateral loads the piers may be required to carry. Valor and caving soils will be encountered while drilling most of the pier holes. This will require that temporary steel casing be used during pier construction to properly deco and de-water the holes. All pier holes should be filled with low slump concrete immediately after the completion of drilling, cleaning and inspection. Concrete should be available on the site during the pier drilling operations. Concrete should rot be placed when there e e is more than six inches of water in the pier excavation. ROADWAYS/FLOOR SLAES The surficial soils present at the site are subject to rutting upon satura- tion and would not provide a suitable surface for even light vehicle traffic . Similarly, they would not provide a good suborade for floor slabs. We recommend that a six inch laver of gravel be used as a roadway surface and beneath floor slabs. Grading should be desicned to transport water away from the edges of roadways and slabs to minimize infiltration into the native suborade, Some locally poor roadway areas may continue to rut and will require additional travel to stabilize them.
