HomeMy WebLinkAbout881375.tiff HEARING CERTIFICATION DOCKET NO. 88-44 RE: SERVICE PLAN OF PROPOSED FORT LUPTON PARK AND RECREATION DISTRICT A public hearing was conducted on August 24, 1988, at 2:00 P.M. , with the following present: Commissioner Gene Brantner, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett Certified Court Reporter, Joann M. Hansen The following business was transacted: I hereby certify that pursuant to a notice dated July 20, 1988, and duly published July 27, 1988, in the Platteville Herald, the County legal newspaper, and July 27, August 3, and August 10, 1988, in the Fort Lupton Press, a public hearing was held on August 17, 1988. Said hearing to consider the adequacy of the Service Plan of the proposed Fort Lupton Park and Recreation District and to form a basis for adopting a Resolution approving, conditionally approving, or disapproving the Service Plan was continued to August 24, 1988. Lee Morrison, Assistant County Attorney, made this matter of record and explained that this hearing was continued for the purpose of allowing final statements from Robert Tibbals, Attorney representing the proponents, and Richard Lyons, Attorney representing the Ft. Lupton Community Taxpayers Association. During his presentation, Mr. Tibbals submitted a letter to him from Mr. Lyons which states that, if the Service Plan for the proposed district is approved by the Board, the Ft. Lupton Community Taxpayers Association intends to nominate its own canditates for the initial board of directors; and he also submitted a supplement to the Service Plan. Commissioner Johnson questioned what, specifically, will be built, and said she feels the language in the Service Plan is not specific enough. She said some of the opponents have voiced concerns that the money will be used to build a golf course. John Dent, Attorney from Ft. Lupton, said the Service Plan can be amended to specifically state that a golf course will not be built. Mr. Lyons came forward and gave his final presentation. He requested that the Service Plan be rewritten. After Mr. Tibbals gave his rebuttal statements, Mr. Morrison advised the Board that a decision must be made concerning those requesting exclusion from the proposed district. Commissioner Johnson moved to deny said requests for exclusion. Commissioner Kirby seconded the motion. Mr. Morrison read the names of those requesting exclusion into the record. The motion carried unanimously. Don Warden, Director of Finance and Administration, after being sworn, explained how lottery funds will be distributed if the district is approved. He said the impact will be effective in two years. Commissioner Kirby commented on each item required by the criteria for approval, conditional approval, or disapproval of this Service Plan. Commissioner Johnson moved to conditionally approve the Service Plan for the proposed Ft. Lupton Park and Recreation District, subject to the incorporation of the supplement which was submitted at today's meeting, with said supplement to be more specific about the year in which the tax revenues will be received relating to the budget expenditures; and that the Plan contain language requiring that any amendment concerning major capital expenditures must be brought back before the Board as an Amendment to the Service Plan. The motion was seconded by Commissioner Lacy. On a roll call vote following discussion, the motion carried on a 4-1 vote with Commissioner Yamaguchi voting nay. 8.31375 Page 2 CERT - FT.
