RE: APPROVE ACTION OF BOARD CONCERNING REQUEST FROM NORTHMOOR
ACRES HOMEOWNERS ASSOCIATION CONCERNING PAVING OF ACCESS
ROUTES
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board did receive a petition from Northmoor
Acres Homeowners Association requesting that the access routes to
and from Northmoor Acres be paved, and
WHEREAS , the Board deems it advisable to refer said petition
to the Weld County Engineering Department and the Director of
Finance for recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the petition from
Northmoor Acres Homeowners Association concerning paving of access
routes to and from Northmoor Acres be, and hereby is, referred to
the Weld County Engineering Department and the Director of Finance
for their recommendation.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
November, A.D. , 1987 .

We the Northmoor Acres Homeowners Association are presenting
the attaches petition to express the desire of the petitioners to
have the access routes to and from Northmoor Acres paved. The
following portions of County Road 44 starting at Interstate 25,
East to the junction of County Road 11, then county road 11 South
to County Road 42, then County Road 42 East to County Road 13 .
We feel that the increase in traffic warrants action to pave
the above routes . The roads are becoming hazardous due to their
rough condition as well as the problems that the dust creates .
In our checking around we find other access roads to newer
developments have already been paved.
Please advise us of your intended action concerning this
matter.
A copy of this has been sent to Mr. George Goodell, Director
of Roads & Bridges .

We, the undersigned petitioners, do hereby request that the
Weld County Road and Bridge Director and/or the Weld County
Commissioners approve and so order the paving of the following
described sections of roads located in Southwest Weld County:
That portion of County Road 44 starting
at Interstate 25, East to the Junction
of County Road 11. County Road 11 South
to County Road 42 to the junction of
County Road 13.
As a result of the development of this area, which previously
was used for agriculture, the County has enjoyed a tax base
growth for this tract of property in excess of Ten Million
Dollars. The amount of traffic carried on the above described
roads has increased to the point where we are forced to drive
on roads that are substandard and unsafe. - Within a few days
after the roads are graded, that portion from I-25 to Northmoor
Drive becomes ruts and washboard. This condition makes it
difficult to control a vehicle and creates a dangerous driving
situation. When the road is dry, the dust problem has reached .
the point where it is environmentally unacceptable. When the
road is wet, we are required to drive in mud.

It is our opinion that in view of the current low oil prices
and the high cost of properly maintaining this section of road,
it would be both cost effective and consistent with county
policy to provide services to areas which pay for them by
virtue of tax contribution.

Dear Mr. Rutt:
This letter is in response to your letter and petition dated
October 19, 1987 regarding the paving of three miles of Weld County
Roads in the Northmoor Acres area.
It has been the policy of the Board of Weld County Commissioners that
the expenses of paving roads that access subdivisions must be shared
by the lot owners within the subdivision and the county. Recently,
the access to Indianhead Subdivision on Weld County Road 15 was paved
in this manner. The direct cost of the asphalt and the labor cost to
lay down the asphalt was shared equally by each individual lot owner.
The cost to Weld County for the Indianhead project including lay down
was $21.30. If two inches of asphalt was laid on the three miles of
access requested by the petition, the cost for asphalt would be
$98,000.00. Spread over 121 lots in Northmoor Acres, the expense per
lot would be approximately $800.00. All preparatory work, such as
importing base course, grading, compaction, watering and shoulder
construction would not be charged to the lot owners.
Also, the Board of Weld County Commissioners has established a method
to spread the cost over a period of ten years. An interest rate of
10% simply compounded over a ten-year period would be charged. The
annual cost to repay $800 at 10% would be $130.20.
The formation of a local improvement district to accomplish such a
project follows specific legal steps. If you think homeowners in
Northmoor Acres would be willing to create a Special Improvement
District please contact Lee Morrison, Assistant County Attorney,

preparation of a petition.
, Unless there is participation by a local improvement district, the
Board of Weld County Commissioners will not pave existing gravel
roads.
