For consideration of establishing and revising numeric water quality
standards assigned to Standley Lake.
This is Segment 2 of Big Dry Creek and is listed on page 12 of the
tables of stream classifications and water quality standards
contained in sub-section 3.8.6 (2) of the Commission's current
regulation titled:
"Classifications and Numeric Standards - South Platte River
Basin, Laramie River Basin, Republican River Basin, Smoky Hill
River Basin" (the South Platte)
which is section 3.8.0 (5 CCR 1002-8) of Article 3, Water Quality
Standards and Classifications, of the Policies, Regulations, and
Guidelines of the Water Quality Control Commission.
NOTICE IS HEREBY GIVEN that the hearing scheduled for Monday, June 3,
1985, Room 150, Colorado Department of Health Building, Denver, Colorado,
HAS BEEN POSTPONED. At its meeting in Colorado Springs on Monday, May 6,
1985, the parties requested that the Commission postpone the hearing until
May, 1986. The Commission then postponed the hearing from June 3, 1985,
until May 5, 1986. The due date for party status requests is hereby
changed from Wednesday, February 6, 1985 to Monday, March 3, 1986, and the
prehearing conference from Thursday, April 18, 1985 to Tuesday, March 25,
1986. The original notice of hearing will be republished in the Colorado
Register on February 10, 1986.
Entities or individuals who have already applied for party status are not
required to reapply; however, the office of the Commission would
appreciate receiving reconfirmation of their request at the time party
status requests are due in 1986. Resubmittal of exhibits will not be

SUBJECT:
For consideration of adoption of amendments to the Clean Water Plan
(208) of the Denver Regional Council of Governments (DRCOG) which
address changes for treatment plants and/or service areas for the Towns
of Lochbuie, Barr Lake Metropolitan District, City of Thornton, and
South Adams County Water & Sanitation District.
PUBLIC PARTICIPATION ENCOURAGED:
The Commission encourages all interested persons to provide their
opinions or data concerning the proposed amendments orally or in
writing at the date, time and location indicated below:

PURPOSE OF HEARING:
The Federal Clean Water Act requires that areawide water quality
management plans be updated to reflect changes. At this hearing the
Commission shall approve, conditionally approve, or reject the plan
submitted by DRCOG.
On February 20, 1985, DRCOG adopted a number of amendments to its Clean
Water Plan (208) following a public hearing on January 16, 1985. These
amendments are described in the executive summary attached to this
Notice.
SPECIFIC STATUTORY AUTHORITY:
The provisions of Section 25-8-105; 25-8-202(1)(h) ; 25-8-401(1);
25-8-503(2); and 25-8-702(2)(a) , C.R.S. provide the specific statutory
authority for consideration of the plan updates proposed by this Notice.

A rulemaking hearing is not being held because the plan updates are
being considered only as a statement of policy, and are not intended to
be binding as regulations.
PROCEDURAL AUTHORITY FOR PUBLIC HEARING:
The provisions of Section 24-4-103, C.R.S.; the "Procedural Regulations
for all Proceedings before the Water Quality Control Commission and the
Water Quality Control Division" (the Procedural Regulations) (5 CCR
1002-1); and the Commission' s current "Regulations for State of
Colorado Continuing Planning Process" contained in Section 5.4.0 of
Article 5, Regulations of General Applicability, of the Regulations,
Policies and Guidelines of the Water Quality Control Commission (5 CCR
1002-14) provide the procedural authority for this hearing.
This hearing may be reconvened at such time and place as the Commission
may announce.
PARTY STATUS :
Since the purpose of this hearing is to consider non—rulemaking
amendments to a regional wastewater management plan in accordance with
25-8-105(3)(a) of C.R.S. , rather than as regulations, party status
requests will be neither required nor considered.
The purpose of this hearing is to provide opportunity for interested
persons to submit written and oral data, views and comments on the
plan. Written statements may be presented prior to and at the
hearing. It is proposed that no additional statements will be received
after the close of the hearing; however, if there is justifiable
reason, as determined by the Commission, the Commission may choose to
leave the record open for an additional period of time. The hearing
will remain open until all persons present and desiring to make
statements have been heard.
PROCEDURAL MATTERS:
The Commission, after notice and hearing, shall approve , conditionally
approve, or reject a plan or an amendment developed by a management or
planning agency within one hundred eighty (180) days after submittal of
the plan or amendment by the management or planning agency to the
Division. Only those portions of a regional wastewater management plan
which are adopted as a regulation by the Commission pursuant to Section
24-4-103, C.R.S. shall be binding on regulatory decisions, including,
but not limited to, site approvals , construction grants, point or
non-point source control decisions , or for purposes of any Federal law,
regulation, or action. No regulations are proposed at this time as
part of this hearing.

DRCOG 208 Plan
The Commission may take two separate actions on this update. The first
is to consider approving the update. That decision will be made after
this hearing. Commission approval constitutes State approval. In
making its approval decision, the Commission will consider all
recommended conditions and comments relating to the plan including
those from the public, DRCOG, and State agencies. The second action
that the Commission may take at some point in the future is adopting
part of the plan as control regulations. Such action shall be by
public hearing preceded by at least 60 days notice.
The approval may be conditioned so that only parts of the plan are
accepted; other parts may be accepted in the future; for example , if
certain changes are made. Any approval may also be subject to annual
review and update.
If the Commission makes an approval decision, the update will go to the
Governor for his determination of whether to certify it to the United
States Environmental Protection Agency and if the Governor certifies
the proposed extension of the Clean Water Plan for a State Planning and
Management Region he will submit it to the EPA and the EPA will make
the final decision as to whether the requirements of the Federal law
are met.

the Administrator, Water Quality Control Commission, Room 319, 4210
East 11th Avenue , Denver, Colorado, and in the offices of the Denver
Regional Council of Governments , 2480 West 26th Avenue, Suite 200B,

EXECUTIVE SURMARY
Town of Lochbuie Amendment Description:
Adams County submitted an application on behalf of the Town of Lochbuie
to amend the Clean Water Plan (CWP). The amendment requests an
increase in the existing service area to a total of 6,172 acres — 2,542
acres of which are in Adams County — an increse in the capacity of the
wastewater treatment facility to 1.3 mgd, designation as the service
agency for the expanded service area, and a participant in a management
agency structure which would include the City of Brighton and Adams
County.
The expanded service area is considered the ultimate service area for
the Town of Lochbuie. This service area parallels the Adams County
Land Use Plan which discourages growth in the Barr Lake Floodplain and
identifies the area west of Interstate 76 as mixed urban use.
Expansion of the currently defined ultimate service area is precluded
by both natural and man-made barriers. These barriers include a ridge
running north-south three miles west of the town boundary, the Bowles
and Beebe seep basins, and a railroad line and interstate highway to
the southeast.
The Town of Lochbuie has an agreement with the Farmers Reservoir and
Irrigation Company (FRICO) , which operates the Beebe Seep Canal, to
accept up to 1.29 mgd of the Town' s secondary treated effluent. The
existing facility is currently at 50 percent of its 0.18 mgd capacity
and serves about 900 residents. It is estimated the current capacity
can handle the needs of Lochwood PUD' s first phase of development.
Additional capacity would be required as additional development phases
of the Lochwood PUD occur and as the Bromley development begins.
The town has determined the current site of the treatment facility can
handle an expansion to 1.3 mgd using aerated lagoons. An increase in
capacity beyond 1.3 mgd would require the selection of a new site and
mechanical treatment (activated sludge) as well as an agreement with
FRICO or some other entity to accept the additional effluent.
The Town of Lochbuie is the logical service agency for the proposed
service area expansion because natural and man-made barriers preclude
other entities from servicing the area in a cost-effective manner. In
addition, estimates of growth by Larimer/Weld COG and Brighton indicate
a need for treatment capacity of 1.3 mgd. The management agency for
the service area is recommended to be established through a joint
agreement between the Town of Lochbuie, the City of Brighton and Adams
County.

DRCOG 208 Plan
Rancho Lorraine (Barr Lake Metropolitan District) Amendment Request:
This amendment designates a 0.2 mgd wastewater plant to serve a 320
acre urban development contiguous to the South Adams County Water and
Sanitation District amendment. The property is situated directly south
of Barr Lake State Park.
The development is proposed to contain 752 dwelling units along with 15
acres of support commercial uses. The formation of a metropolitan
district is being proposed to service these uses. In 1978, the Barr
Lake Village Water District was formed with their primary function
being that of water supply and distribution for the site. In January
1984, the District was given conditional approval by the County to
expand as a metro district to include nine additional functions.
Metropolitan district approval, however, was contingent upon approval
of the amendments to the DRCOG plans. Such amendments have been made
with adoption by the DRCOG Board of Directors of the Regional
Development Framework and this amendment to the Clean Water Plan.
This plant , like the South Adams Facility, is expected to meet the
immediate development needs of the service area. However, the basin
master plan is expected to determine the best long-term solution to
water quality management in this basin. Adams County is working with
DRCOG to prepare that plan. The County is the water quality management
agency designated for the area which includes the Barr Lake Village
Metropolitan District. Approval of the Rancho Lorraine amendment was
conditioned by the DRCOG Board on the inclusion by Adams County in the
platting of this service area of certain conditions on plant
performance to protect the City of Brighton' s water supply.
City of Thornton Amendment Request Description:
The amendment increases Thornton' s service area to include an area to
the north and east of Thornton' s city limits, in order to provide
wastewater service as the area develops. By providing wastewater
service to the proposed area, Thornton hopes to prevent the
proliferation of well-based independent districts which could become an
economic hardship to the citizens of Thornton should the City be forced
to take over such districts in the future.
Currently the wastewater flows generated in Thornton' s existing
municipal limits are part of the service area of the Metropolitan
Denver Sewage Disposal District No. One (MDSDD#l) . Thornton and
MDSDD#1 have an agreement whereby MDSDD#1 accepts and treats all
wastewater flows generated within Thornton. In the proposed service
area extension wastewater generated in the Big Dry Creek and the
Brantner/South Platte basins would be pumped to MDSDD#1 through the

year 2000. The long-term solution would be the construction of a 22
mgd wastewater treatment facility along the South Platte River. This
facility would treat wastewater generated from Big Dry Creek and Todd
Creek basins and discharge effuent to the Burlington Ditch. Wastewater
generated in the Brantner/South Platte basin would continue to be
pumped to MDSDD#1 for treatment and discharge.
Wastewater connection of the proposed service area to peripheral
interceptors in the existing service area would meet the short-term
needs of the proposed area. This extension of sewer lines would be at
a cost of 19.7 million dollars. Project costs for an additional
treatment facility and conveyance system would be 201.6 million dollars.
The amendment identifies Thornton as the service entity for the new
service area and indicates continued service at the MDSDD#1 facility
through the year 2000. Thornton and Adams County will jointly serve as
the management agency through an intergovernmental agreement.
Thornton is in the process of revising its comprehensive plan to
include this area. The DRCOG Board approved this amendment subject to
the approval of Thornton' s Planned Urbanization Area when Thornton
completes that planning.
The South Adams County Water and Sanitation District Amendment Request
Urban development is anticipated in the area north and east of the
existing service area of the South Adams County Water and Sanitation
District. This amendment changes the service area to provide
wastewater service to developments expected in the near future.
The amendment does not increase the capacity of the District' s
wastewater treatment facility. DRCOG is coordinating efforts of
governmental agencies to prepare a long-range master plan for the
First, Second and Third Creek Basins. That master plan will determine
the need for plant expansion and new facilities.
This amendment will meet the short-term treatment needs of development
until the master plan can be completed. The DRCOG Board approved this
amendment subject to the execution of the management agency agreement
between Adams County, the District and Commerce City. That agreement
is in the final stages of approval.

APRIL 1, 1985
The meeting of the Water Quality Control Commission was called to order by
Vice-Chairman Urbonas at 9:00 A.M. in Room 150, Colorado Department of Health
Building, 4210 E. 11th Avenue, Denver, Colorado.
MEMBERS PRESENT:
Linda Burger, Tad Foster, Cynthia Kahn, Robert Pearson, Myrna Poticha,
Tom Smith, Jeffrey Todd and Ben Urbonas. Commissioner Baumgartner was
absent.
STAFF PRESENT:
For the Water Quality Control Division - Gary Broetzman, Robert
McConnell, Jon Scherschligt, Dennis Anderson, and Greg Parsons. From
the Attorney General's office - Rick Griffith. From the Commission
office - Alan Stewart and Marsha Smith.
APPROVAL OF AGENDA:
After discussion of the sequence and timeframe of some of the items on
the agenda it was approved by consensus. No formal motion was made.
RULEMAKING HEARING - CACHE LA POUDRE RIVER:
After hearing and deliberation on this matter, Commissioner Foster moved
that the nitrite standard for Segments 11 and 12 of the Cache La Poudre
River be amended to 2.7 mg/1 with a footnote to the standard indicating
that the 2.7 is based on a 20 mg/l chloride value as a 30-day average.
The motion was seconded by Jeffrey Todd. There was lengthy discussion
by the Commissioners and Division staff of the chloride value and
whether or not it should be included in a footnote to the nitrite
standard, in the Statement of Basis and Purpose, or in both. After
further discussion, Commissioner Foster amended his original motion to
state that the nitrite standard NO2-N for Segments 11 and 12 of the
Cache La Poudre be 2.7 mg/1 as a 30-day average. He then added that the
rationale for this value be addressed in the Statement of Basis and
Purpose. This amended motion was seconded by Commissioner Todd. The
motion was unanimous. It was noted for the record that Commissioner
Burger sat in the audience so as not to participate in this hearing and
abstained from voting on this motion.

Commissioner Urbonas asked the Water Quality Control Division to present
to the Commission for their consideration in the afternoon session a
revised Statement of Basis and Purpose which incorporated the original
Basis and Purpose recommended in the Division's prehearing statement and
the changes agreed upon in the morning session. This was done. After
lengthy discussion Commissioner Kahn moved that the revised, amended
Statement of Basis and Purpose specifying a standard of 2.7 mg/1 N02-N
for Segments 11 & 12 of the Cache La Poudre River be adopted. This
motion was seconded by Commissioner Pearson. The motion was unanimously
adopted. The fiscal impact statement contained in the original Notice
of Hearing was not changed.
FINAL ADOPTION OF TWO-YEAR TEMPORARY MODIFICATION FOR COPPER AND LEAD -
SEGMENT 8a, IOWA GULCH, ARKANSAS RIVER BASIN:
Commissioner Pearson moved for approval of the Statement of Basis and
Purpose as contained in the original Notice of Hearing in this matter.
The motion was seconded by Commissioner Smith. Several Commissioners
indicated that there were changes they still wanted to make to the
Statement of Basis and Purpose. The Commission agreed to a recess so
that a subcommittee could formulate changes for incorporation into the
Basis & Purpose statement. Consequently, no vote on this motion was
taken.
After the Commission reconvened and the changes suggested were
discussed, Commissioner Pearson amended his prior motion to be that the
Commission adopt the proposed Statement of Basis & Purpose and Fiscal
Impact Statement for Segment 8a, Iowa Gulch, Arkansas River Basin, as
amended. This motion was seconded by Commissioner Smith. The motion
carried on a vote of 5 to 1, with Commissioners Burger, Foster, Pearson,
Smith and Urbonas voting in favor and Commissioner Poticha voting
against the motion. Commissioners Kahn and Todd abstained.
Commissioner Smith further moved for final adoption of the two-year
temporary modification for copper of .05 mg/l and for lead of .05 mg/1
for Segment 8a, Iowa Gulch, Arkansas River Basin, and that all the use
classifications and water quality standards remain the same and the
underlying standards to remain the same as contained in the present
regulation. The motion was seconded by Commissioner Pearson. The
initial vote was Commissioners Burger, Pearson, Smith and Urbonas in
favor of the motion, Commissioners Foster and Poticha against it and
Commissioners Kahn and Todd abstaining. When it was recognized there
was not a majority of the quorum to carry this motion, Commissioner
Foster changed his vote from a No to a Yes, and the motion passed on a
final count of 5 to 1 (with 2 abstentions).

LUNCHEON EXECUTIVE SESSION:
Commissioner Kahn moved for an executive session over the lunch period
to discuss personnel matters relating to the Commission. The motion was
seconded by Commissioner Poticha. It was unanimously approved.
SEGMENT 15 SOUTH PLATTE STANDARDS REEXAMINATION:
Commissioner Foster moved that an October 1985, hearing date be
established to consider whether or not to retain or revise the numeric
stream standards for Segment 15 of the mainstem of the South Platte
River, that the Division propose a Notice of Public Rulemaking for the
Commission's consideration at the June meeting, and that the Commission
evaluate in August whether it was timely to proceed to hearing in light
of the Basic Standards Task Force effort toward revision of the basic
standards regulation. The motion was seconded by Commissioner Poticha.
It was unanimously approved.
DRCOG CLEAN WATER PLAN AMENDMENTS FOR TOWN OF LOCHBUIE, BARR LAKE METROPOLITAN
DISTRICT, CITY OF THORNTON, AND SOUTH ADAMS COUNTY WATER & SANITATION DISTRICT:
Commissioner Poticha moved to schedule the DRCOG proposed amendments in
this matter for hearing in July, 1985. The motion was seconded by
Commissioner Pearson. The motion was unanimous.
SUMMARY OF PROCEEDINGS/MOTIONS FOR FEBRUARY AND MARCH, 1985:
After the Commission discussed some minor changes, Tom Smith moved for
approval of the Summary of Proceedings/Motions for February, as amended,
and for March, 1985. The motion was seconded by Commissioner Poticha.
It was unanimously adopted.
APPROVAL OF MAY 1985 AGENDA:
The agenda items for the May meeting were approved by consensus of the
Commission. No formal vote was made. However, there was lengthy
discussion on the amount of time the matters would require for hearing
in Colorado Springs and Durango and whether or not the hearings could be
wrapped up sooner than originally anticipated. After much discussion,
it was unanimously agreed that the hearings scheduled in Durango for
