RE: RESCIND RESOLUTION APPROVING MAINTENANCE OF SECOND AVENUE
COURT IN LA SALLE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on April 27 , 1988 , the Board did, by Resolution,
approve the maintenance of Second Avenue Court, a street outside
the boundaries of the Town of La Salle, and
WHEREAS , said Resolution also approved the inclusion of said
road in the annual road report which is submitted to the State,
and
WHEREAS, on May 16 , 1988 , the Board received information
showing that in 1980 , Weld County deeded any and all interest in
the right-of-way of Second Avenue Court to the Town of La Salle,
with the legal description being as stated in the Quit Claim Deed,
a copy of which is attached hereto and incorporated herein by
reference, and
WHEREAS, after due consideration, the Board deems it
advisable to rescind the Resolution of April 27 , and advise the
Town of La Salle of said action.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Resolution of
April 27 , 1988 , concerning the maintenance of Second Avenue Court
in La Salle, and the inclusion of said road in the annual road
report, be, and hereby is, rescinded.
BE IT FURTHER RESOLVED by the Board that the Town of La Salle
be notified of said action.

Subject, Ownership of Second Avenue Court in La Salle,
Colorado
On Wednesday, April 27, 1988 , the Board of County Commissioners
considered a request from the Town of La Salle for the
maintainence of Second Avenue Court. The question arose as to
whether the street is a private easement or a County-owned
right-of-way. I had previously found no records in the Clerk to
the Board' s office concerning the street. The Board decided, at
the April 27th meeting, to proceed with maintenance on Second
Avenue Court and to explore the possibility of securing the
right-of-way through Quit Claim Deed from the individuals who live
on the street.
I asked Margaret of TransAmerica Title Insurance Company to do a
title search on Second Avenue Court. I received the information
from her on May 12 , 1988 . Attached you will find copies of the
following:
a. The map of the Town of La Salle showing Second Avenue Court
in the top right-hand corner.
b. A Quit Claim Deed from Weld County to the Town of La Salle
for that stretch of Second Avenue Court from the town
boundary to approximately the mid-point of the curve.
c. A Recorded Exemption for David and Kathryn Seiler which
includes that portion of Second Avenue Court from the curve
southwesterly to its terminus.
d. Perpetual easements for ingress and egress over the portion
of Second Avenue Court which is included within the area of
the Recorded Exemption.
From the above materials, I conclude that Weld County has no
interest in Second Avenue Court. The issue concerning maintenance
of the street must have come up back in 1980 . The County resolved
the matter by Quit Claim Deeding any and all interest in the
right-of-way to the Town of La Salle. The result is that the Town
of La Salle now owns Second Avenue Court to the mid-point of the
curve, and from that curve going towards the southwest is a
private easement which apparently serves two houses.
I therefore recommend that the Board order the Road and Bridge
Department to refrain from maintaining Second Avenue Court . The
Board does have the option, however, to enter into an agreement

RE: Maintenance of 2nd Avenue Court
Dear Mayor Karst:
It is our duty to inform you that the Board of Weld County
Commissioners has rescinded its previous resolution of April 27, 1988,
approving maintenance of the street in your town known as "2nd Avenue
Court". Weld County will no longer perform maintenance here.
Originally it was thought that Weld County had right-of-way for the
road. However, in 1980 Weld County deeded any and all interest to the
Town of LaSalle. Please find enclosed a copy of the Resolution
rescinding the April 27th Resolution and a copy of the Quit Claim
Deed.
I hope this clears up any confusion concerning the responsibility of
maintenance for 2nd Avenue Court.
