RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR A VEHICLE SALES , SERVICE, AND REPAIR FACILITY IN
THE A (AGRICULTURAL) ZONE DISTRICT - SAMAD AGHAJANI
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 7th day of September, 1988 , at the hour of 2 : 00
p.m. in the Chambers of the Board for the purpose of hearing the
application of Samad Aghajani, 3618 Elliott Court #2 , Evans,
Colorado 80620 , for a Site Specific Development Plan and Special
Review Permit for a vehicle sales, service, and repair facility in
the A (Agricultural) Zone District on the following described real
estate, to-wit:
Part of the SE* of Section 30 , and part of the
SW* of Section 29 , Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado
WHEREAS, said applicant was represented by Gerry McRae, and
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 .2 of the Weld County Zoning Ordinance as follows:
a. The proposed Special Review site is within the City
of Evans, the City of Greeley, and the Town of
La Salle ' s Urban Growth Boundary Area and is
consistent with the Weld County Comprehensive Plan
Urban Growth Boundary Goals and Policies . Urban
�1 Growth Boundary Goal 1 addresses a requirement that

urban development occur adjacent to an existing
municipality. The proposed use is located adjacent
to the City of Evans. Goal 2 explains that a
coordinated effort should be enhanced between the
municipalities and the County regarding plans,
policies , and standards relating to land uses. The
City of Evans, in a referral letter dated August
10 , 1988 , indicated that the proposal is consistent
with its future expected growth plan . The Town of
La Salle, in its referral letter dated August 5 ,
1988, indicated that it had no conflicts with its
interests. The City of Greeley Planning
Department, in a phone conversation dated August 8 ,
1988 , indicated no objections. The site is located
on 1 .3 acres, more or less, and is adjacent to
existing urban developments . The proximity of the
proposed site to the highway and to the City of
Evans deems it impractical for agricultural use.
h. The proposed use is consistent with the intent of
the Agricultural Zone District. The proposed use
is provided for as a Use by Special Review.
c. The proposed use is compatible with the existing
surrounding land uses which include automotive
repair establishments and commercial businesses.
The use will be compatible with the future
development of the surrounding area as permitted by
the Agricultural Zone District. Special Review
Permit Development Standards will ensure
compatibility with the surrounding land uses.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide
adequate protection of the health, safety, and
welfare of the neighborhood and County.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
vehicle sales, service, and repair facility in the A
(Agricultural) Zone District on the hereinabove described parcel
of land be, and hereby is , granted subject to the following
conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners .
2. The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until a Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3 . Within 30 days of approval by the Board of County
Commissioners, the applicant shall comply with the Weld
County Health Department ' s request by removing the
asphalt above the leach field and physically protecting
the absorption area from mechanical compaction from
vehicular traffic by a fence or barrier.
4 . Prior to the recording of the Use by Special Review
plat, the applicant, owner, or operator shall submit to
the Department of Planning Services the following:
a. Documentation establishing legal right to deliver
water from the City of Evans water tap.
b. A storm water retention facility shall be provided
on site which is designed to retain the storm water
runoff from a fully developed site from a 100-year
storm. Drainage of the facility shall be designed
to release the retained water quantity and rate for
a five-year storm falling on the undeveloped site.
All calculations shall be submitted to the
Department of Planning Services for verification.

1 . The Site Specific Development Plan and Special Review Permit
is for a vehicle sales, service, and repair facility in the A
(Agricultural) Zone District as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
4 . Trucks located on the site for the purpose of maintenance,
repair, or servicing shall not exceed two tons in weight.
5 . Any advertisement signs used on the proposed Use by Special
Review site shall be in compliance with Section 42 . 2 of the
Weld County Zoning Ordinance or obtain a variance from the
Weld County Board of Adjustment.
6. Any storage of derelict vehicles shall be totally enclosed
within a building or structure or visually screened from all
adjacent properties and public rights-of-way.
7 . Prior to any spray painting operation occurring on the
property, the owner or operator shall be in compliance with
the National Fire Protection Association Standards.
8 . The property owner or operator shall be responsible for
complying with Article 29 of the Uniform Fire Code, 1985
Edition, at all times.
9 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
10 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.

11 . Personnel from the Weld County Health Department , the
La Salle Fire District, and the Weld County Department of
planning Services shall be granted access onto the property
-at any reasonable time in order to ensure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations .
12. The Special Review area _shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Major changes from the
plans or Development Standards as shown or stated shall
require approval of an amendment of the Permit by the Weld
County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
13 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners .

I -hereby _certify that -pursuant to a notice dated August 15, 1988, and
duly published August 24, 1988, in the Platteville Herald, a public
hearing -was conducted to consider the 'request of Samad Aghajani for a
Site specific Development flan and Special -Review Permit for a vehicle
sales, service, and repair facility in the A (Agricultural) Zone
District. Chairman Brantner said -he will abstain, due to a conflict of
interest, leaving only three Commissioners to hear this matter, which
requires three affirmative votes for approval. The applicant was asked
if he wished to proceed today or continue this hearing to another date.
Gerry McRae, representing the applicant, asked to proceed with this
hearing today. Chairman Brantner was -excused for the rest of this
hearing. Lee Morrison, Assistant County Attorney, -made this matter of
record. Rod Allison, Planning Department representative, entered the
favorable recommendation of the Planning Commission into the record.
Mr. McRae explained this request and stated that the Conditions
contained in the Planning Commission recommendation will the satisfied.
No public comment was made concerning this request. Commissioner Lacy
moved to approve the 'request of Samad Aghajani for a Site Specific
Development P1-an and Special Reveiw Permit, subject to the Conditions
and Development Standards recommended by the Planning Commission.
Commissioner Yamaguchi seconded the motion and it carried unanimously.
This Certification was approved on the 12th day of September, 1988.

The Chairman asked the applicant if he had reviewed the _recommendation,

LOCATION: Adjacent to the Town of -Evans, approximately 1 mile north of the
Town of La Sall-,end west of U.S. Highway 85.
APPEARANCE:
Jerry McRae, P.E. , represented the applicant. He explained the terrain and
current and intended uses of the properties on this Frontage Road. The
former use was similar to the proposed use, but because the land has been
vacant for some time now, the use was _considered abandoned. He also
discussed the Weld 'County Health -Department's comments regarding the
existing septic system.

Sam Aghajani, property owner, asked that a Development Standard be added to
limit trucks on the site for repair and maintenance to a two-ton limit.
Also, transport trucks will not be on the property very often, if at all.

follows:

REQUEST: A Site Specific Development Plan and an Amended Special Use Permit
for a major facility of a public utility (an open-cut gravel
mine) .
LEGAL DESCRIPTION: Part of the NEI NE} of Section 2, T2N, R68W and part of
the SEI SEI of Section 35, T3N, R68W of the 6th P.M.,
Weld County, Colorado
LOCATION: Approximatley 1 mile east and 3/4 mile north of Del Camino.
APPEARANCE:
Don Carroll, Weld County Engineering Department, represented the applicant.
This site will be used for gravel for the roads in the area and will only be
used three or four months at a time. This will be a wet pit and will be
mined in three phases. The reclamation of the Hokestra Pits #1 and 2 will

1. The Special Review permit is for a Site Specific Development Plan and a
Special -Review permit for a vehicle sales, service, and tspair facility
in the A (Agricultural) zone district as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated hereon.
2. Approval of this plan may -create a vested property right Pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
4. Any advertisement signs used on the proposed Use by Special Review site
shall be in compliance with Section 42.2 of the Weld county Zoning
Ordinance or obtain a variance from the Weld _County Board of
Adjustment.
-5. Any storage of derelict vehicles shall be totally enclosed within a
_building or structure or visually screened from all adjacent properties
and public rights-of-way.
6. Prior to any spray painting operation occurring on the property, the
owner or operator shall be in compliance with the National Fire
Protection Association Standards.
7. The property owner or operator shall be responsible for complying with
Article 29 of the Uniform Fire -Code, 1985 Edition, at all times.
8. The Property owner or operator shall be -responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
9. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
10. Personnel from the Weld County Health Department, the La Salle Fire
District, and the Weld County Department of Planning Services shall be
granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the
Development Standards stated hereon and all applicable Weld County
Regulations.

We are -owners of -properties located within 500 feet of the vehicle sales,
service, and repair facility proposed by Samad Aghajani as USR-846. Two of
our houses are positioned 20 feet and 100 feet respectively from the site.
We are very concerned about the noise and air pollution which -will be caused
by the repair and servicing of large trucks at the facility. A former owner
of the property repaired trash trucks. The noise and odor produced by the
trash trucks was unbearable.
Therefore, we respectfully 'request that the Planning Commission consider
limiting Mr. Aghajani to repair and servicing of vehicles two tons or less. U
A condition or development standard to this effect will ensure t a
other large trucks will not be repaired :r serviced at the site. The noise
and air pollution will then be tolerable for residents like us located
within 500 feet.

regarding the location of, size of and adequacy of the sewage disposal
system for this facility. He certifies that the system is adequate
for the use intended.
Due to the fact that the entire I.S.D.S. is located under the asphalt
parking lot; we require, that the asphalt be removed from the area
above the leachfield and that absorption area be physically protected
from mechanical compaction from vehicular traffic by a fence or barrier.
The Division recommends approval if the above alteration is accomplished.

I have reviewed the plot plan submitted by Samad Aghajani, concerning the
vehicle sales establishment and vehicle service/repair establishment, at
44O5 West service road in Evans. I have the following recommendations
based on the Uniform Fire Code (U. F. C. ) National Fire Protection
Association (N. F. P. A. ) Standards.
1 ) I have included a copy of Article 29 of the U. F. C. which addresses the
repair garage portion of the business. Of particular importance in this
article are the sections dealing with the floor drains and the ignition
sources from fixed appliances.
2) The application does not mention anything about spray painting of
vehicles however if there is going to be any type _of spot (touch up)
painting of vehicles there are several N. F. P. A. Standards which must be
met prior to any painting operations being conducted. I will be glad to
supply Mr. Aghajani with a copy of the Standards if in fact he plans on
spray painting vehicles.

Gentlemen,
I purchased this 1 .356 Acres tract of land in December of 1987. The site was
previously improved and operated as a used car let.. It is my desire to re-open
this site as a Vehicle Sales Establishment to handle retail and wholesale, new
and used auto, trucks, RV's and boats , to handle rental and leased vehicles,
and to provide parts and a repair garage. The improvements provide for these
operations with an office, other buildings and indoor and fenced outdoor storage.
I have been in this business for several years and feel there is a need for this
type of business. The site is ready for the proposed use.
The four businesses to the North of this site, along the Service Road, provide
similar vehicle services. An agricultural tract lies to the West, the residence
being about 250 feet to the Northwest of the site. Pastuneand the South Platte
River are to the South and U.S. 85 Highway is to the East.
Maximum number of patrons will vary, but 3 to 4 per hour would be normal . Ad-
equate parking space is available along the 290 feet of adjoining service road.
Normal business hours would be from 7:00 A.M. to 8:00 P.M. Monday through Sat-
urday. Three to four people would be employed.
Access is off U.S. 85 at 42nd Street and thence South along the service road.
This site is the last business on this road. Normal traffic will be autos and
service trucks. Auto transport trucks will be used ocassionally.

RE: SPECIAL USE PERMIT

The City of Evans provides water service to the site. Sanitary waste is
handled by an existing individual sewage disposal system.
Fire protection will be by an adequate number and location of fire extinguishers.
The site is located in the La Salle Fire Protection District.
There are no farm animals involved.
Disposal of waste will be by individual removal or by commercial dumpster service.
The site is covered with buildings or asphalt storage area. A North to South
drainage swale exists in the Westerly portion of the site. This provides site
drainage as well as providing for the offsite drainage of the commercial pro-
perties to the North. The field road adjoining the South property line provides
a berm and detention area on the subject property. An existing 9" 0 culvert
carries storm runoff under the road into the pasture area. The pasture is about
115 feet in width. The surface water would then enter the river channel .
No landscape areas exist and none are proposed. The operation will not require
a reclamation plan or process.

The proposed use would be consistant with policies of the Weld County Com-
prehensive Plan in that the site is not in agricultural use and has the needed
services. The site is developed with an office building, and a paved and
fenced outside storage area. The area was divided into small parcels in 1972.
Even though the site is in an agricultural district, it has not been used for
agricultural purposes since divided.
The site presents no health, safety or welfare problems as the site is not in
the Flood Plain. The Highway Department has provided a Service Road for access
and the proposed use is not a high impact use.
The site is situated with U.S. 85 and Service Road to the East, four other exist-
ing commercial uses to the North, a strip of pasture land in the Flood Plain and
the South Platte River to the South, with a mixeG use agricultural tract to the
West. No additional traffic will be created except along the Service Road. The
proposed use appears compatible with the probable future use of the area con-
sidering the highway frontage location, the size of the parcels and the present
uses. The site is near the City of Evans and has future potential to be annexed.

75—Vona sandy loam, 0 to 1 percent elopes. This is a
deep, well drained soil on high terraces at elevations of
4,650 to 4,950 feet. It formed in alluvial deposits. Included
in mapping are some leveled areas and small areas of
soils tint have a loamy substratum.
Typically the surface layer of this Vona soil is grayish
brown sandy loam about 10 inches thick. The subsoil is
brown fine sandy loam about 20 inches thick. The sub-
stratum to a depth of 60 inches is sandy loam.
Permeability is moderately rapid. Available water
capacity is moderate. The effective rooting depth is 60
inches or more. Surface runoff is slow, and the erosion
hazard is low.
This soil is used almost entirely for irrigated crops. It
is suited to all crops commonly grown in the area, includ-
ing corn, sugar beets, beans, alfalfa (fig. 7), small grain,
potatoes, and onions. An example of a suitable cropping
system is 3 Lo 4 years of alfalfa followed by corn, corn for
silage, sugar beets, small grain, or beans. The rapidly
permeable substratum slightly restricts some crops.
All methods of irrigation are suitable, but furrow ir-
rigation is the most common. Proper irrigation manage-
ment is essential. Rarnynrrl manure and commercial fertil-
izer are needed for top yields.
Windbreaks and environmental plantings are generally
suited to this-soil. Soil blowing, the principal hazard in
establishing trees and shrubs, can be controlled by cul-
tivating only in the tree row and by leaving a strip of
vegetation between the rows. Supplemental irrigation
may be necessary at the time of planting and during the
dry periods. 'frees that are best suited and have good
survival are Rocky Mountain juniper, eastern redcedar,
ponderosa pine, Siberian elm, Russian-olive, and hackber-
ry. The shrubs best suited are skunkbush sumac, lilac, and
Siberian peashrub.
Wildlife is an important secondary use of this soil.
Ring-necked pheasant, mourning dove, and many non-
game species can be attracted by establishing areas for
nesting and escape cover. For pheasants, undisturbed
nesting cover is essential and should be included in plans
for habitat development, especially in areas of intensive
agriculture.
This soil has good potential for urban and recreational
development. Lawns, shrubs, and trees grow well. The
only limiting feature is the rapid permeability in the sub-
stratum, which causes a hazard of ground water con-
tamination from sewage lagoons. Capability subclass Its
