RE: GRANT TRANSFER OF USE BY SPECIAL REVIEW #400 TO LAIDLAW WASTE
SYSTEMS (COLORADO) , INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 9th day of
December, 1987 , at 2 : 00 p.m. for the purpose of hearing the
request of Laidlaw Waste Systems (Colorado) , Inc. for the transfer
of Use by Special Review #400 , granted to Colorado Landfill , Inc.
in 1979 , to Laidlaw Waste Systems (Colorado) , Inc. for the
operation of the Erie Landfill located on the following described
real estate, to-wit:
Part of Section 29 , Township 1 North, Range 68
West of the 6th P.M. , Weld County, Colorado
WHEREAS, the applicant was represented by James Dancy,
regional vice-president, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the State and Weld
County Health Departments and the Weld County Planning Department,
and, having been fully informed, finds that this request shall be
approved for the following reasons :
1 . The Colorado Department of Health, has submitted
recommendations which are favorable with certain
conditions.
2 . Evidence has been submitted which indicates that the
applicant is capable of meeting and accepts the
obligation of operating the landfill in accordance with
the Solid Waste Disposal Sites and Facilities Act and
regulations promulgated thereunder, the Operations Plan
for the site as it exists and as it may be amended, and
County regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Laidlaw Waste Systems (Colorado) , Inc. for the transfer of Use by
Special Review #400 to Laidlaw Waste Systems (Colorado) , Inc. on
the above referenced parcel of land be, and hereby is, granted,
effective January 1 , 1988 , subject to the following condition:

1 . The applicant shall comply with the conditions and
requirements of the Colorado Department of Health, as
explained in its letters of November 10 and 12 , 1987 ,
and shall implement all the actions identified in
Exhibits A and B of its own letter of October 28 , 1987 .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
