RESOLUTION
RE: ACTION OF THE BOARD CONCERNING SHOW CAUSE HEARING TO CONSIDER
REVOCATION OF SPECIAL USE PERMIT #413 ISSUED TO PAUL E. AND
PEGGY PAGE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on May 7 , 1986 , a Show Cause Hearing was conducted
to consider revocation of Special Use Permit #413 issued to Paul
E. and Peggy Page , and
WHEREAS, at said hearing, the Planning staff advised the
Board that the property is now in compliance with the Development
Standards , and recommended that said Show Cause Hearing be
dismissed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Show Cause
Hearing to consider revocation of Special Use Permit #413 issued
to Paul E. and Peggy Page be , and hereby is, dismissed.

I hereby certify that pursuant to a notice dated August 21, 1985, and
duly published August 2z9, 1985, in the Johnstown Breeze, a public
hearing vas conducted to consider revocation of Special Use Permit
#413, issued to Paul E. and Peggy Page. Lee Morrison, Assistant County
Attorney, made this matter, continued from September 4, 1985, of
record. Debbie de Besche, representing the Manning Department, stated
that the Planning staff inspected the site yesterday and the property
was found to he in compliance; therefore, the matter can fie dismissed.

July 2, 1980 SUP-413:80:3 was approved by the Board of County
Commissioners.
June 13, 1985 The property was inspected. It was determined that
Development Standards #8, 10 11, and 13 are mot in
compliance.
June 17, 1985 Letter was mailed to Mr. Page requesting compliance
within 30 days.
July 18, 1985 The property was reinspected. Development Standard #10
is 1n compliance. Development Standards #8, 11 and 13
are still not in compliance.
July 19, 1985 Notice of the August 21 probable cause was mailed.
August 13, 1985 Had phone conversation with Mr. Page concerning the non-
compliance. Mailed a letter to Mr. Page 'outlining what
was needed to corsect the noncompliance. Also a letter
outlining the time needed to correct the noncompliance.
August 21, 1985 The Board determined that there was suffi-ci-ent probable
cause to schedul-e a show cause hearing.
August 22, 119$5 Received a letter from Mr. Page stating that he would
comply by spring 'of 1986.
August 23, 1983 Notice of the show case hearing was wailed.
August 27, 1985 The property was reinspected. Development Standard
number 11 is now in compliance. Development Standard
numbers 2 and 13 are still not in compliance.
DEVEL0P`ENT STANDARDS -

1. The uses permitted on the hereon described parcel shall be an aircraft, heavy
equipment and mobile home salvage and storage yard and structures as shown hereon
and all uses permitted by right in the Agricultural Zone District as listed in the
Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner so as to prevent
soil erosion, fugitive dust, and the growth of noxious weeds. The appearance of
the facility shall be maintained in a neat and orderly condition through periodic
painting and maintenance.
3. All phases of the operation shall comply with all Lounty and State Health Standards
and Regulations pertaining to air quality, water quality, noise emission, and
sanitary iiisposal systems.
4. All accesses shall have the approval of the
Weld County Engineering Department. All accesses shall be constructed in accordance
with the recommendations and/or requirements of the Weld County Engineering Departmeni
5. All refuse shall be disposed of at a designated landfill. Burning trash is
prohibited.
6. Fill material to elevate the property above the boundary of the 1-00 year flood
plain shall be stabilized to prevent erosion into Coal Creek in Compliance with
the Weld County Fload -Hazard Overlay District Regulations.
7. No bridge or -crossing shall be constructed across the Erie Coal _Creek Ditch and
Reservoir right of-wayon the hereon described property. No fencing or structure
shall obstruct the -ditch right-of—way in order that the ditch may be cleaned and
maintained in accordance with the right-of-way agreements.
8. The west Terimeter of the storage yard and building shall be screened by means of
appropriate landscaping. Said landscaping being a row of trees and shrubs consisting
of a mixture of lomhardi poplar, juniper, spruce and cottonwood planted six feet
apart. These trees shall be watered and maintained and dead ones replaced for
two years. trees in the area of the existing building will be planted within six
months of approval -of this Special Use Permit and trees in the area of the north
end of the storage yard and proposed building shall be planted within six months
of final grading.
9. The present office trailer will be removed within 30 days of completion of proposed
new office addition.
10. All salvage storage will be east of screening and north of the present building.
No storage or structure shall be within the 100 year flood plain boundaries unless
said storage or structure meets the -requirements of the Weld County Flood Hazard
Overlay District Regulations.
11. The culvert across Coal Creek shall be removed. The owners -may replace said culvert
with a bridge which shall meet with the approval of the Weld County Engineering
Department and the town of Erie. The bridge shall either be a low water crossing
or shall be -designed to pass the 100 year fload flow of 12,08-0 cfs.

12. The Special Use Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Re-
gulations. Any material deviations from the plans and/or Development Standards
as shown or stated above shall require the approval of an amendment to the Special
Use Permit by the Planning Commission and the Board of County Commissioners before
such changes from the plans and/or Development Standards shall be permitted.
Any other changes from the plans and/or Development Standards shall be filed in
the office of the Department of Planning Services.
13. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Noncompliance with
any of the above stated Development Standards may be reason for revocation of the
Special Use Permit by the Board of County Commissioners.

Dear Mr. Page:
The purpose of this letter is to summarize the different points which were
discussed during our conversation on August 13, 1985.
At this meeting we mutually agreed that the actions which need to be taken
to correct this violation are:
1. The west perimeter of the storage yard and building needs to
be screened by the appropriate landscaping that is more
clearly defined in Development Standard #8;
2. The submittal of a letter before August 16, 1985, stating the
time that would be needed to complete the planting.

thereafter as the agenda of the Board of County Commissioners permits, the
Board of County Commissioners of Weld County will hold a Probable Cause
public hearing pursuant to Section 81 of the Weld County Zoning Ordinance.
This meeting will take place in the Commissioners' Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado.
The purpose of this public hearing will be to review case number SUP-413 for
compliance with the Development Standards as approved by the Board of County

Personnel from the Department of Planning Services conducted an on-site
inspection of your property on June 13, 1985, to determine whether you were
in compliance with the Development Standards placed on your property at the
time SUP-413 was approved. The inspection revealed several violations of
Development Standards #8, 10, 11, and 13. I have enclosed a summary of the
items that appear to be in violation of the foregoing Development Standards.
You are hereby requested to comply with the requirements of the Development
Standards within thirty (30) days from the date of this letter. Failure to
comply will result in our office scheduling a Probable Cause Hearing before
the Board of County Commissioners. If the Board determines that there is

The following business was transacted:
I hereby certify that pursuant to a notice dated August 21, 1-985, and
duly published August 29, 1985, in the Johnstown Breeze, a public
hearing was conducted to consider revocation of Special Use Permit #413
issued to Paul E. and Peggy Page. Assist-ant County Attorney, Lee
Morrison, made this matter of record. Keith Schuett, Planning
Department representative, read information regarding this case into
the record and stated that the Pages are now in compliance -with
Operation Standard #11; therefore, only Operation Standards #8 and #13
are to be considered. Mr. Schuett said that Operation Standard #8
requires the planting of trees, which has not been done, and Operation
Standard #13 states that noncompliance with any of the Standards may be
cause for revocation of the Special Use Permit. Mr. Page stated that
he thought he had six months after the final grading for the Rlanting
of all the trees, and the final grading has not been completed. Mr.
Page requested that the Board allow him until next spring to plant the
trees. Mr. Morrison advised the Board of their options regarding
findings in this matter, after which Commissioner Lacy moved to
continue this hearing to May 7, 1986, at 2:00 P.M. Seconded by
Commissioner Kirby, the motion carried unanimously.

1. The uses permitted on the hereon described parcel shall be an aircraft, heavy
equipment and mobile home salvage and storage yard and structures as shown hereon
and all uses permitted by right in the Agricultural Zone District as listed in the
Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner so as to prevent
soil erosion, fugitive dust, and the growth of noxious weeds. The appearance of
the facility shall be maintained in a neat and orderly condition through periodic
painting and maintenance.
3. All phases of the operation shall comply with all County and State Health Standards
and Regulations pertaining to air quality, water quality, noise emission, and
sanitary disposal systems.
4. All accesses shall have the approval of the
Weld County Engineering Department. All accesses shall be constructed in accordance
with the recommendations and/or requirements of the Weld County Engineering Department.
5. All refuse shall be disposed of at a designated landfill. Burning trash is
prohibited.
6. Fill material to elevate the property above the boundary of the 100 year flood
plain shall be stabilized to prevent erosion into Coal Creek in compliance with
the Weld County Flood Hazard Overlay District Regulations.
7. No bridge or crossing shall be constructed across the Erie Coal Creek Ditch and
Reservoir right-of-way on the hereon described property. No fencing or structure
shall obstruct the ditch right-of-way in order that the ditch may be cleaned and
maintained in accordance with the right-of-way agreements.
8. The west perimeter of the storage yard and building shall be screened by means of
appropriate landscaping. Said landscaping being a row of trees and shrubs consisting
of a mixture of lombardi poplar, juniper, spruce and cottonwood planted six feet
apart. These trees shall be watered and maintained and dead ones replaced for
two years. Trees in the area of the existing building will be planted within six
months of approval of this Special Use Permit and trees in the area of the north
end of the storage yard and proposed building shall be planted within six months
of final grading.
9. The present office trailer will be removed within 30 days of completion of proposed
new office addition.
10. All salvage storage will be east of screening and north of the present building.
No storage or structure shall be within the 100 year flood plain boundaries unless
said storage or structure meets the requirements of the Weld County Flood Hazard
Overlay District Regulations.
11. The culvert across Coal Creek shall be removed. The owners may replace said culvert
with a bridge which shall meet with the approval of the Weld County Engineering
Department and the town of Erie. The bridge shall either be a low water crossing
or shall be designed to pass the 100 year flood flow of 12,080 cfs.

12. The Special Use Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Re-
gulations. Any material deviations from the plans and/or Development Standards
as shown or stated above shall require the approval of an amendment to the Special
Use Permit by the Planning Commission and the Board of County Commissioners before
such changes from the plans and/or Development Standards shall be permitted.
Any other changes from the plans and/or Development Standards shall be filed in
the office of the Department of Planning Services.
13. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Noncompliance with
any of the above stated Development Standards may be reason for revocation of the
Special Use Permit by the Board of County Commissioners.

August 13, 1985 Had phone conversation with Mr. Page concerning the non-

August 21, 1985 The Board determined that there was sufficient probable
cause to schedule a show cause hearing.
August 22, 1985 Received a letter from Mr. Page stating that he would
comply by spring of 1386.
August 23, 1985 Notice of the show case hearing was mailed.
