The Department of Planning Services' staff has reviewed the proposal of Rocky Mountain Railcar to relocate the access rail line and has determined that this proposal would not be a material deviation from the plans as approved. No amendment to USR-821 would be required. We will, however, require the following items: 1) A letter from Panhandle Eastern Pipeline stating they have no objection to the rail crossing their gas line easement. 2) A recorded deed showing Mr. Maynard's ownership of the new property. 3) As-built plans showing the actual location of the rail after the rail has been constructed. • Please call me if you have any questions. No. 821 _ Ms. Swanson; Attached please find a blue-line copy of the recorded plat for U.S.R. No. 821. On this plat, shown in red, is the location of possible new access rail lines to this parcel. We would request that the planning staff review the proposed access and comment on the best procedure for us to follow to have this approved. If the _ location of the new access rail, is approved, the existing rail line access shown on the recorded plat would not be constructed. At the time Of preparation of U.S.R. No. 821, Mr. Maynard of Rocky Mountain Railcar was in contact with the owners of the property to the east. At this time, they could not reach a mutual agreement to cross this land for rail line access. - Since this time, Mr. Maynard has purchased this entire parcel of land to the east, approximately 600 acres. It has been determined that with the location of the proposed access, it would save a tremendous amount of construction costs due to the fill material that would be needed for the rail bed. Contact has been made with Panhandle Eastern Pipeline and the crossing of the rail over their gas line would cause no problems. A letter of approval from Panhandle Eastern can 'be submitted if requested. Documents showing that Mr. Maynard now has title to this property can also be submitted. If staff can approve this without going through the public hearing process, a legal description will be prepared and submitted for that land where the proposed rail -lines will be located. It is hopeful that we can make an attachment to the now recorded plat showing this proposed change. To our understanding the only thing we need to obtain the grade permits, are the approved well permits . The application for the well permits has been submitted to the Division of Water Resources - Department of Natural Resources - 818 'Centennial Building - 1313 Sherman St. , Denver, Colorado 80203. Confirm- ation can be obtained from Mr. John W. Bilisoly, Engineering Technician, Division of Water Resources at' (303) 866-3581. I, Ron Maynard, is requesting the staff of the Weld County Planning Department to waive the requirement to have the well permits approved before I can obtain a grading permit. Please understand I am seeking grading permits only and am not re- questing any building permits. I will submit all required plans and documents, including the approved well permits, when I am ready to obtain building permits. Also, I will not hold • Weld County liable in case the well permits do not get approv- ' ed. Rocky Mountain Railcar, Inc. would like to begin excava- tion on the Hudson property as soon as possible. Box 795 15 N. 12th Avenue Brighton , CO 80601 RE: Rocky Mountain Railcar We have reviewed your erosion control plan for the above referenced project. With the sandy nature of the soils , we would again stress the importance of maximizing residues for erosion control . If it is decided to plant a permanent cover of native grasses , then a sorghum cover should be planted sometime in June with the grasses being planted in November. It would be highly recommended to seed the swales to permanent grasses in order to give them adequate protection from erosion . If your plan is followed , adequate erosion control should result.
