On July 1, 1985, the Board of County Commissioners approved revisions to the
Weld County Subdivision Regulations delegating the authority to approve
subdivision exemptions to the Department of Planning Services.
Your subdivision exemption application is complete and in order and will be
processed by our office on or before August 13, 1985. If it is determined
that the application meets the approval criteria of Section 9-3 E. of the
Weld County Subdivision Regulations, you will be notified that the
subdivision exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and
asked to appear before the Board of County Commissioners at a public
hearing. You will be informed of the hearing date at least a week prior to
the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the subdivision exemption.

RE: Myers Farm
This request brought before the Weld County Planning Commission for a
Subdivision Exemption concerns, the exemption of a small labor house together

with acres of dryland to be divided from a 204 acre parcel of agricultural
land. The reasons for this request are based on both economic hardship and
illness on my own behalf. I am presently under care of Dr. Jerry Crews,
Neurological Clinic, Greeley for seizure disorders. This condition disallows
me to fully carry on farming operations and places an undue financial burden
upon myself and my family.
Attempts to sell the entire farm over the past two years have proved
unsuccessful in light of the current depressed agricultural climate.
The dwelling to be subdivided is a small labor house of frame
1.25
construction with 540 sq. ft., situated on approximately * acres of dryland.
It is in fair to good state of repair with concrete footer foundation and
shingle roof. There are no outbuildings with house. Utilities include
electricity, telephone, NWCWD water supply and a septic system.
The present zoning for the property is A-D Agricultural District.
Since there is no irrigation water or irrigated land included with the
dwelling, the division of this 4 acre parcel would in no way effect the
continued operation of the irrigated farmland in the remaining larger tract.
The 4 acre parcel is within the boundaries of a flood plain as designated
by the County, however no flooding has occurred historically since the
dwelling was constructed in approximately 1905.
The remaining irrigated farmland would remain in production as it has in
the past, principal crops being corn, alfalfa and pinto beans.

It should be noted that the recent covenants on the entire tract of land
were (1) releases by Weld County of gravel easements through quit claim deeds
and (2) to establish by survey proper boundaries with adjoining property to
quiet title.
