RE: APPROVAL OF RECORDED EXEMPTION NO. 763 - TRAILER SPECIALTIES,
INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 763 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 763 was
submitted by Trailer Specialties, Inc. for property which is
located in part of the Eh E1/2 , Section 19 , Township 6 North, Range
65 west of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 14 acres and 2 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Trailer Specialties,
Inc. The parcel of land on which this request is being made is described as
Pt. Ez Ek of Section 19, T6N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located south of Imcerne on Weld County Road 39. The parcel
of land under consideration is the total contiguous land holdings of the
applicant.
The request is to divide the property into parcels of 14 acres and 2 acres,
more or less.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the
requirements of Section 9-2 C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty (60) days from
the date of approval by the Board of County Commissioners.

Dear Planning Department:
Please find enclosed the following:
1. A completed Application form.
2. A Certificate of Conveyances.
3. A copy of the Deed by which Trailer Specialties, Inc. , took title.
4. A Sketch Plan showing the proposed Recorded Exemption prepared
by Freese Engineering.
5. My check in the amount of $125.00.
It is the intention of my client, Trailer Specialties, Inc., to sell
the southernmost two acres to a developer who plans to build an office,
truck storage and maintenance facility on the property which is shown
on the attached Sketch Plan. Assuming the property can be sold to
the developer in the near future, the plan to develop the property
should be accomplished in short order. I am advised that there are
tenants for several of the unit spaces who are ready to sign leases.
The remaining property, excluding the two-acre parcel to be severed,
will continue to be used by my client.
The parcel to be severed and its use as an office, truck storage and
maintenance facility is consistent with the Comprehensive Plan because
it is located near a major highway and will serve the needs of persons
who use the highway conveniently. The property is currently zoned
C-3 which permits this kind of use. Since the property is zoned C-3,
my clients believe that the proposed use will be compatible with the
surrounding land uses.
The proposed use is compatible with future development of the surrounding
area and future development as projected by the Comprehensive Plan
together with efficient and orderly development.

My clients intend, as part of the sale to the proposed developer,
to install a gas main to the severed parcel and will provide water
from the North Weld Water District. Both the gas main and the water
will be installed at my client's cost from the intersection of Highway
392 and Weld County Road 39. The severed parcel will be served by
septic sewer.
The property is not in a flood plain, geologic hazard, or the Weld
County Airport Overlay District.
