RE: COVERAGE OF THE NINETEENTH JUDICIAL DISTRICT ATTORNEY, THE
ASSISTANT NINETEENTH JUDICIAL DISTRICT ATTORNEY, ALL DEPUTY
DISTRICT ATTORNEYS , AND THE STAFF AND OFFICE OF THE
NINETEENTH JUDICIAL DISTRICT ATTORNEY BY WELD COUNTY' S
SELF-INSURANCE FUND
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado , and
WHEREAS, the Nineteenth Judicial District Attorney has asked
that the District Attorney, the Assistant District Attorney, all
Deputy District Attorneys , and the staff and Office of said
District Attorney be covered by the Weld County self-insurance
fund, and
WHEREAS, the Board of County Commissioners of Weld County
agree to the coverage of such persons by said insurance fund.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado:
1 . That to the extent coverage is not provided by the
Colorado Counties , Inc. , Casualty and Property Pool , of which Weld
County is a member, or the State of Colorado' s Risk Management
Fund, the Nineteenth Judicial District Attorney and his employees ,
including, but not limited to, the Assistant District Attorney;
all Deputy District Attorneys; all Special Investigators , Special
Prosecutors , Special Deputy District Attorneys and Investigators
employed by the said District Attorney' s Office; and all staff and
office personnel of said District Attorney' s Office are covered by
the Weld County self-insurance fund, on a fully self-insured
basis , for the performance of their duties within the scope of
their employment. Such activities include , but are not limited
to, investigations and the advising of law enforcement officers,
individuals , and other private and public entities .
2 . That any and all punitive damages incurred by such
persons or damages due to acts or omissions which are deemed
willful and wanton, may be covered by said self-insurance fund
only to the extent provided in Section 24-10-118 (5) , CRS .

3. That if a defense is not provided by the Colorado
Counties , Inc. , Casualty and Property Pool, of which Weld County
is a member, or the State of Colorado Risk Management Fund, the
Weld County Attorney' s Office or a Special Counsel appointed
pursuant to Section 5-4 of the Weld County Home Rule Charter shall
defend such persons in any suit brought against them while
performing their duties within the scope of their employment, as
provided in Section 24-10-110 (1 .5) , CRS.
4 . That in the event the Weld County self-insurance fund is
insufficient to pay a judgment or judgments rendered against any
or all of those persons mentioned in paragraph 1 above during the
fiscal year in which it becomes final, Weld County shall follow
the procedures pursuant to Section 24-10-113 (3) , CRS , to pay the
same.
5 . That the coverage provided herein shall not be intended
to increase the limits of recovery by any person above those
specified in Section 24-10-114 , CRS .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
July, A.D. , 1986 .
