USR-642:83:38.
Dear Mr. Siegrist:
Thank you for your letter of May 7, 1987. In that letter you expressed an
interest in modifying the December 10, 1984, road maintenance agreement
between Varra Company and Weld County for hauling east on Weld County Road
26 to Weld County Road 13. To initiate discussions on modifying the road
maintenance agreement, please telephone Mr. Don Carroll at the Weld County
Engineering Department. Mr. Carroll's phone number is 356-4000, extension
4750.
If you are interested in changing the county road haul route as explained in
Development Standard 4 of Amended USR-642:84:38, this would require an
Amendment of the Use by Special Review permit. An amendment of the Use by
Special Review permit would not be required to haul materials through your
property to the west. Please call or write if you have any questions.

RE: V1 Property Permit
Dear Rod:
Thank you for your letter of April 30, 1987. For your information I am
sending a copy of my letter to Weld County dated January 24, 1986. This
letter addresses the succession of operations from the Varra Companies and
also relates to the acceptance of the "Road Maintenance and Improvement
Agreement".
I am also enclosing a copy of a letter addressed to Ms. Gloria Dunn dated
February 3, 1986. This letter relates to our certificate of insurance and
hauling procedures. We, therefore, hope the above information will satisfy
your concerns stated in your April 30th letter.
It should be noted that the original permitee, Varra Companies, had
primarily intended to haul the sand and gravel product in an easterly
direction on Weld County Road 26. Siegrist Construction Co. , however,
prefers to haul material in a westerly direction and, consequently, a river
crossing has been installed on the St. Vrain River which allows us to haul
the majority of the materials through our property to the west, connecting
with the I-25 service road. This procedure works out very well and it
elminates any truck traffic on the County Roads.
The problem which we are running into, however, is that our river crossing
is of a temporary nature and during high water we are forced to haul to the
east on County Road 26. We, therefore, are finding that some of the
restrictions placed on the original Varra Companies' application are not
really compatible with our hauling operation. I am wondering, therefore, if
we could modify the resolution to allow us to haul to the east during
r-� a time where high water precludes us from hauling to the west.

We' have a little problem with the Road Maintenance Agreement in that the
intent behind the agreement was to pave County Road 26 if we used the road
for a longer duration of time. We, however, feel that the time restriction
is not realistic in that it does not address our current method of
operation. It think it should also be noted that our present method of
hauling is much more satisfactory, not only for the residents, but also the
County road system. I wonder if we should reconsider the hauling road
alternatives.

Dear Mr. Siegrist:
The Department of Planning Services staff has been advised Siegrest
Construction Company is now the operator of Use by Special Review permit
#642:83:38 for an open-cut gravel pit located in part of the Ei SWi of
Section 36, T3N, R68W of the 6th P.M. , Weld County, Colorado. Please be
advised that Use by Special Review #642 includes a Road Maintenance and
Improvement Agreement for Weld County Road 26. I have attached a copy of
the agreement to this letter for your records. Since a change in operators
has occurred, it is necessary to update this agreement.
This can be accomplished by sending a letter to the Weld County Department
of Planning Services acknowledging your willingness to perform the mutual
covenants and conditions set forth in the agreement. If you have any
questions regarding this matter, please call or write.
