RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL) TO PUD (PLANNED
UNIT DEVELOPMENT) , FOR COUNTY GOVERNMENT FACILITIES AND C-3
(COMMERCIAL) AND I-2 (INDUSTRIAL) USES - WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 13th day of April,
1988 , at 2 :00 p.m. for the purpose of hearing the application of
Weld County, P.O. Box 758 , Greeley, Colorado 80632 , requesting a
Change of Zone from A (Agricultural) to PUD (Planned Unit
Development) , for County Government Facilities and C-3
(Commercial) and I-2 (Industrial) uses for a parcel of land
located on the following described real estate, to-wit :
The NE$ and part of the NW} , Section 31 ,
Township 6 North, Range 65 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, the applicant was represented by Don Warden, Weld
County Director of Finance and Administration, and
WHEREAS, Section 28 .8 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone , and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission, and, having been fully informed, finds that
this request shall be approved for the following reasons:
1 . The applicant has complied with all the application
requirements listed in Section 28 .5 et seq. , of the Weld
County Zoning Ordinance .
2. The request is in conformance with Section 28 . 8 of the
Weld County Zoning Ordinance as follows :
a. The proposed Planned Unit Development (PUD)
District is located within the urban growth
boundary area of the City of Greeley. The proposed
PUD District is in compliance with the Urban Growth
Boundary Goals and Policies listed in the Weld
County Comprehensive Plan. The Greeley Planning
Commission recommended no objection to the Change
of Zone request at its March 22nd meeting.

b. The uses allowed in the proposed PUD District will
conform with the Performance Standards of the PUD
District contained in Section 35 .3 of the Weld
County Zoning Ordinance.
c. The City of Greeley will provide water and sewer to
the proposed PUD District.
d. "O" Street and North 11th Avenue will provide
access to the property and the uses within the PUD
District.
e. The subject site is located in the Approach Zone
and Transitional Zone of the Greeley-Weld County
Airport Overlay District. Building height in the
district will not exceed approximately 4 ,700 feet
above mean sea level. The overlay district permits
a building height of approximately 5 ,000 feet above
mean sea level within the proposed PUD District.
f. The subject site is not located within a flood
plain or geological hazard overlay district. The
subject site does not contain any known commercial
mineral deposits.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Weld County for a Change of Zone from A (Agricultural) to PUD
(Planned Unit Development) for County Government Facilities and
C-3 (Commercial) and I-2 (Industrial) uses on the above referenced
parcel of land be, and hereby is , granted subject to the following
conditions:
1 . The proper permits shall be obtained from the Army Corps
of Engineers prior to any fill activities taking place
on wetland areas within the PUD District.
2 . Prior to recording the PUD District Plat, William Crews,
Attorney in Fact for Sunshine Valley Petroleum
Corporation, shall submit an addition to the application
regarding access to the three additional oil and gas
wells south and west of the site across the PUD
District. Also, access will be provided across the PUD
District to the existing oil well in the northeast
corner of the district. This addition to the
application will be approved by the Department of
Planning Services staff.

Plat:
NOTE: The existing oil and gas production facilities
located in the northeast corner of the PUD District are
considered a use by right.

A public hearing was conducted on April 13, 1988, at 2:00 P.M. , with
the following present:
Commissioner Gene Brantner, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Jacqueline Johnson
Commissioner Gordon E. Lacy
Commissioner Frank Yamaguchi
Also present:

The following business was transacted:
1 hereby certify that pursuant to a notice dated March 2, 1988, and
duly published March 10, 1988, in the Johnstown Breeze, a public
hearing was conducted to consider the application of Weld County for a
Change of Zone from A (Agricultural) to PUD (Planned Unit Development)
for County Government Facilities, C-3 and I-2 uses. Lee Morrison,
Assistant County Attorney, made this matter of record. Rod Allison,
representing the Planning Department, read the favorable recommendation
of the Planning Commission into the record. He said the Planning staff
recommends a change in the wording of Condition #1 and read the
recommended wording into the record. Don Warden, Weld County's
Director of Finance and Administration, explained this request.
William G. Crews, Attorney in Fact for Sunshine Valley Petroleum, said
the proposed annexation of this parcel into the City of Greeley may
cause problems for his company, due to the existing well on this
property. He requested that the County indemnify his company for the
possible cost of bringing this well into compliance with City
regulations if such is required. (Tape Change #88-18 during comments
by Mr. Crews.) After considerable discussion, at the request of
Commissioner Johnson, the Board recessed for an executive session to
obtain legal advice. Upon return from the executive session, Mr.
Morrison explained that discussion was held regarding the legal
obligation of Weld County to the mineral owner, possible alternatives
to the annexation process, and the impact of the Change of Zone to the
mineral owner. No further public comment was offered concerning this
request. Commissioner Lacy moved to approve this request for a Change
of Zone, subject to the Conditions as recommended by the Planning
staff. Seconded by Commissioner Johnson, the motion carried
unanimously.

County Commissioners. This is a 130 acre -site and the County's development

before the new jail is built.

explained the grants available and methods of financing and developing this
project.
Dick Lamb, P.E. , Project -Engineer, -reported that nothing derogatory was
found in the soils tests.

William Crews, Attorney in Fact, Sunshine Valley Petroleum, asked that an
additional condition be added pertaining to access to their oil arid -gas
facilities.

by the Planning Commission, and the testimony heard by the members of the

PLANNING COMMISSION FUNCTION: To make a recommendation to the Board of

PROJECT OVERVIEW: This is a request for a Change of Zone from Agricultural
to Planned Unit Development (PUD) . The type of POD proposed would allow
County government facilities, C-3 (Commercial) uses, and I-2 (Industrial)
uses. The County government facilities include administrative offices,
shops, storage, motor pool, and jail facilities.
The parcel size is 130 acres, more or less. Approximately 60 acres of the
parcel is proposed to be used for county government facilities and 69 acres
for commercial and industrial uses. The number of proposed lots and average
lot size has not been determined at this time.

The Greeley Planning Commission reviewed the request from
Weld County for a change of zone from agriculture to P.U. D. at
its March 22 , 1988 meeting. Under separate cover a formal
recommendation from the City Planning Commission to the County
Planning Commission has been provided. This letter hopes to
outline some additional considerations that were reviewed with
the City Planning Commission, and, that the County may want
to include into its proposal . I must emphasize that with this
letter, as with the formal recommendation to the County Planning
Commission in regard to this issue, the City still reserves
the right to alter or change its opinion as this application is
reviewed in the public hearing process upon annexation into the
City.
he concerns and comments that the Planning Commission would like
to pass along to the County include the following:
1. In order to ensure the free flow of traffic on the
proposed collector roadways a general guideline should he
provided to govern access points.
2 . A traffic analysis should be provided to the City
addressing both interior and exterior traffic generation
and the review of the ability of these roadways to
accommodate this projected traffic. This report should
also address the traffic from the existing County shops on
2nd Street to the subject property.
J . Wetlands that are on the western edge of -Tract A should
either be avoided or mitigation measures should be taken
to ensure their replacement.

We have the following additional comments on the Weld County zone change
from Agricultural to P.U.D.
The traffic study of the "0" Street/State Highway 85 intersection will
address a range of solutions to the traffic conflicts at this location. One
'of the possible long-range solutions would be to elevate "0" Street and carry
it over S.H. 85 and 11th Avenue in order to provide for grade-separated
traffic movement. This type _of major structure would require right of way
from the northeast portion of this P.U.D. Although it is not possible -to
specify the extent of this right of way at this time, it would be wise to
defer development of the Tract "B" Industrial and Commercial area until the
traffic study is completed.
We appreciate your consideration of these comments in addition to those
in our 3/7/88 letter.

We have reviewed the application from Weld County for -a zone change _from
agricultural to P.U.D. The sketch plan for this P.U.D. was previously reviewed
and comments were provided to you in our letter of ijecember 21, 1987.
As we indicated in our letter, the City of Greeley, Weld County, and the
State Department of Highways are cooperating on a study of the "0" Street/
State Highway 85 intersection near this proposed P.U.D. The traffic impact
of this P.U.D. should be included in traffi-c projections used to analyze this
intersection.
Item No. 10 in the Change of Zoning Application Requirements refers to
the above study and also states that this intersection has been prioritized
as needing improvement within our five-year plan for highway construction.
We have not placed any:particular Priority on the improvement of this
intersection, and it is not in our current or proposed -Five-year Highway
Program of Projects.

RE: WELD COUNTY BUSINESS -PARK PUD
We have reviewed the plat and attendant information for the proposed
subdivision. The geotechnical investigation prepared by Empire Laboratories,
Inc. , adequately addresses subsurface conditions -on the site. However, there
are additional concerns. Geologic conditions that may affect development
include potential flooding, shallow -ground water, locally steep and
potentially unstable slopes, erosion, -potentially swelling or collapsing
soils, and potential radon gas hazard.
The 1974 Army Corps of Engineers' flood plain study for the _Cache La Poudre
River indicates that the southeastern portion of the site is subject to
shallow flooding. Because this -area is less likely to flood than the 1O0-year
flood area, floodproofing buildings should provide adequate protection. This
is also an area of shallow ground water and foundations should be destined
accordingly. It shoul-d 31e noted that the actual boundaries of the 100-year
and shallow flooding areas may have changed since 1974 as a result of
additional development along the river. Usually, development increases the
area of flooding. A new flood study may be in order.
The application lists a number of uses that are permitted in the various
tracts. Uses permitted in tract -C included hospitals, nursing homes, and
physical and mental rehabilitation centers. We recommend that these
particular uses not be permitted. This is an area of shallow flooding, which
means that flooding would not occur except in an extreme event. It is in just
such an event that access to these types of facilities would be most needed.
In such flooding, the buildings would be isolated by the flood waters.
There is an area of steep bluffs on the property. This -area is susceptible to
slope failure and severe erosion. Buildings should be set well back from the
slope and additional slope stabilization measures implemented if necessary.
Slope grading and stabilization may substitute.

The geologic materials on the site are potential sources of radon gas. The
Empire report indicates that these materials were to be tested and the results
submitted in an addendum. We have not seen these results. Based on test
results, we would recommend that adequate radon reduction measures be built
into the proposed structures if necessary. This is of particular concern in
the case of the jail , where residence is continuous.
Because of the potential variation in soil properties across the site,
site specific soils tests should be conducted once building locations have
been selected.
We also recommend that a surface and subsurface drainage management plan be
designed and implemented. This will be necessary in order to reduce swelling
soil damage, erosion, and high ground water problems.
If our recommendations and those of Empire laboratories are followed, we have
no objection to the approval of this application.

To Whom It May Concern:
• The ;'vision has inspected the property in sluestion, and -has identified some poten-
tial conflicts between the needs of wildlife, and the proposed development.
The land in question is not in the riparian zone of the Cache La Poudre River.
However, it does lie immediately next to the wetland area, and is therefore greatly
influenced by this crucial wildlife habitat. During the last five winters the Lana
in question has been used by large Flocks of ducks (primarily mallards) and geese
as -a feeding area. I have seen as many 3,000 geese and 2,000 ducks using the
cornfields on this land. I have seen small groL,_ps of deer using these same areas.
I have seen re-d fox hunting these fields. I have also seen hawks, and the American
Bald eagle hunting this area. I have even seen a bald eagle feeding on a duck in
a gravel pond immediately west of this field.
If the land is developed the species mentioned would most certainly be displaced.
Animals continuing to use this area may find themselves in conflict with human needs.
To minimze the adverse impact to wildlife that this proposal would create, the Divi-
sion of Wildlife would recommend:
1. That the development would avoid using large expanses of blue-brass plantings
I for landscaping. large Clue-grass plantings tend to attract geese. Landowners
become upset with the geese, and want them moved. Hazing geese is a difficult
procedure, and the Division feels it would be the landowner's responsibility
to take the necessary steps. This reasoning is based on the fact that the
owner chose to build in a historical use area for geese.
As an alternative, plantings native grasses could be used where needed.
Examples of grasses that might work: buffalo grass, bluestem, or gramma gasses.
The landscaper could contact representatives of the S.C.S. or the Extension Ser.
to find the most suitable seed mixture. Once established, a planting of this
tyre may be less costly to maintain. It would also provide an excellent example
to the citizens of "veld County of xeric landscaping. Water conservation, of
course, is becoming more important all the time in Colorado. And it may be less
attractive to geese.
2. That -some form of buffer be established on the south west perimeter (the river
bottom portion) of the property. This would act to separate the industrial zone
from the wetland-gravel pond areas, that may ultimately oe incorporated into a

of thickets (plum thickets for example) could be used to provide this buffer.
At the same time it would provide protective cover, roosting habitat, and nesting
area for animals associated with the wetlands. It may also serve as a barrier
to keer people from entering the industrial area on foot.
In summary, the creation of this development will certainly result in the loss
of important wilalife habitat. Habitat loss will, most likely, result in a
loss to our wildlife resource, in both numbers of animals as well as in diversity.
We can however lessen the negative impact to wildlife while creating a more at-
tractive areu,for people.

that there is one oil well in the NE1/4 of the NE1/4 of Section

the SE1/4 of the NE1/4 of that section. There are also oil
wells in the SE1/4 of the NW1/4 , the NE1/4 of the SW1/4, and
the center of the N1/2 of the SW1/4 of that section .
We would recommend that any approval of the
subject application should include "conditions of approval"
based on setbacks equivalent to the regulation in Section 600
of the rules and regulations of the Colorado Oil and Gas

1. Waste oil, waste paints, stains, treatments, spent drug containers,

stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. A spillage retention berm shall be maintained around the existing
tank battery. The volume retained by the spillage berm should be
greater than the volume of the largest tank inside the berm.
4. waste materials shall be handled, stored, disposed, in a manner
that controls fugitive dust, blowing debris, and other potential
nuisance conditions.
5. Fugitive dust must be confined on this site.
6. Maximum permissible noise level shall not exceed the industrial
limit of 80db(A) , as measured according to 25-12-102, Colorado
Revised Statues.
7. The Division requires that all facilities utilize the existing
municipal sewer treatment system.

The Weld County Planning Commission will conduct a public hearing on
Tuesday, April 5, 1988, at 1:30 p.m. to review a request for approval of a
Change of Zone from A (Agricultural) to Planned Unite Development (PUD) for
County Government Facilities (County Offices, Jail, Shops, and Storage) ,
C-3, and I-2) uses from Weld County. The parcel of land is described as the
NE} and part of the NW} of Section 31 , T6N, R65W of the 6th P.M., Weld
County, Colorado, containing 130 acres, more or less. The property is

Dear Don:
We have previously contacted you concerning the interest of our
clients, Sunshine Valley Petroleum Corporation, H & C Colton
Company, and MECO Operating Corporation, with respect to the
above referenced project. We have recently reviewed the P.U.D.
District Plat with respect to the project. It appears that the
County has done an excellent job in developing a plan which meets
its needs without interfering with oil and gas development plans
for adjacent areas. We do, however, have a few comments and
suggestions.
The proposed plat excludes areas which are needed for proposed
drill sites under current location requirements of the Oil and
Gas Conservation Commission. However, the P.U. D. overlays what
would be normal access routs to the drill site and associated
production facilities. There does not presently appear to be
reasonable access to these future sites and facilities except
through the P.U.D. Reasonable access around the P.U.D. may be
made available in the future. However, until and unless that is
provided our clients need to be assured that they will be allowed
access to these sites through the P.U. D. We therefore suggest
the addition of the following language within paragraph 5 of the
P.U.D. Application:

The area south of and contiguous to tracks A, B and D will
remain available for future oil and gas wells and
production facilities. To the extent reasonably necessary,
access to such wells and facilities through the P.U. D. will
not be inhibited.
Paragraph 5 of the P.U.D. application now states that "the
existing gas and oil well is situated 300 feet from the collector
streets to meet the oil and gas standards of the City of
Greeley. " The oil and gas standards of the City of Greeley also
require a 300 foot setback from tank batteries and other
production facilities. See, Greeley Ordinance, Section
18 . 16. 160 (1) . These setbacks apply to not only roads but to
buildings as well . A 100 foot setback is provided from utility
easements. It is my understanding that tank batteries associated
with the existing well are located approximately 75 feet from
11th Avenue and less than 300 feet from the intersection of 11th
Avenue and Collector Street as described on the P.U. D. District
Plat. This does not pose a problem for the oil and gas operator,
but may for the County which wishes to construct within the
established setback.
An additional problem is posed by the inclusion of the one
existing well and associated production facilities within the
P.U.D. and subsequently within the area annexed by the City of
Greeley. We are currently unaware of a "grandfather" clause
within the Greeley oil and gas ordinances. Assuming no
grandfather clause exists, the operator will be subject to the
requirements of the ordinance immediately upon annexation. The
ordinance imposes certain requirements upon the operator
including
- enclose the well and production facilities with a six
foot chain link fence with three strands of barbed wire;
- grade and surface access roads;
- landscape to the extent deemed necessary by the City;
- maintain fire fighting apparatus at the site as deemed
adequate by the City Fire Department;
- obtain an additional insurance rider; and
- install electric motors necessary for pumping operation.

The well is currently operated within an agricultural zone of the
County; none of the above stated restrictions apply. Absent a
grandfather provision in the Greeley ordinance, the County's
actions in changing the zoning to P.U.D. and causing the area to
be annexed to the City, will result in the operator being
subjected to significant additional costs and liabilities.
Though the operator wishes the County to be successful with this
project, it does not believe it should be expected to incur
significant additional costs in that regard.
At first blush there appear to be three ways in which this can be
avoided:
a. the County can agree to assume all costs associated
with compliance with the Greeley ordinances;
b. the existing well and production facilities can be
excluded from the proposed P.U.D. and from proposed
annexation; or
c. language could be installed within the P.U.D. and
annexation request which would mandate exclusion for the
existing well and production facilities from the
application of the Greeley oil and gas ordinance.
There may of course be other ways to solve this problem. We
welcome your suggestions.
We understand that the P.U. D. proposal will come before the Weld
County Planning Commission on Tuesday, April 5, 1988 . We hope
that we can work out some solution to the problem so that a
unified front can be presented at the Planning Commission
meeting. Please give me a call as soon as possible with your
comments and suggestions.

#4 Architectural compatability within the proj-ect will be accomplished
as follows:
The proposed site plan groups facilities of similar architectural type
together.
Design control of all county facilities will be by a single entity.
Continuity of architectural desi-gn will be controlled by provisions of
the PUD process (see specifics in Item 6)
Planning concepts featured by the proposed site plan include the
following:
Private sector (industrial sites) are located contiguously and separated
from public sector (county) facilities.
County warehouses and shops will act as a visual and -noise buffer
between private industrial facilities and gravel mining operations.
Private county roads will tend to separate service traffic from through
traffic.
County offices will provide a buffer between private industry and county
jail facilities.
#5 Conflicts between proposed land uses and land uses surrounding the
PUD will be mitigated as follows :
The proposed H street collector will -mini-size the need for access curb
cuts along 0 Street and 11th Avenue -arterials.
Green belt landscaping adjacent to public right-of-way is described
under item 7.
Service and open storage area shall be screened from public rights of
way by means of intense landscaping, terming, permitted fencing, or a
combination of these items. The final screening will completely
remove equipment and other stored items from view.
Fencing shall be of -the same or similar type throughout the project.
The existing gas and oil well is situated 31)0 feet from the collector
streets to -meet the oil and -gas standards of the City of 1)reeley.
The area south of Tract A will remain as a reclaimed gravel mining
operation.
The area south and west of Tract D will be mined of gravel and
reclaimed by the County.

including the housing of sentenced and pre-trial inmates, sheriff' s
department patrol functions, administration and other related
activities. Also contained in Tract -A will be an office complex for

Building floor area: a maximum of 45_0, 000 square feet.
Building height: a maximum of 36 feet from average finish grade
to top of roof line.
Type of structure: any materials allowed by applicable building

fenestration, facing public -right-of-way, shall be of concrete or

those described by the Weld County zoning ordinance for uses
allowed by -right and accessory uses in the C-3 and I-2 districts
along with open storage.
Number of buildings: A maximum of 22 industrial buildings.
Building floor area: a maximum of 450,D0D square feet.
Building height: a maximum of 36 feet from average finish grade
to top of roof line.
Type of structure: any materials allowed by applicable building
codes except that a minimum of S0% of exterior walls, exclusive
of fenestration, facing public right-of—way, shall be of concrete
or masonry.
Open storage areas: visual screening to be provided
Number of employees: estimate 1400 -maximum.
Tract C: Commercial and Industrial Uses - 24. 5 acres
Land Use Description: commercial and industrial uses limited to
those described by the Weld County zoning ordinance for uses
allowed by right and accessory uses in the D-3 and I-2 districts
and open storage.
Number of buildings: a maximum of 13 industrial buildings
Building floor area: a maximum of 250,000 square feet
Building height: a maximum of 3b feet from average finish grade
to top of roof line.
Type of structure: any materials allowed by applicable building
codes except that a minimum of 50% of exterior walls, exclusive
of fenestration, facing public right-of-way, shall be of concrete
or masonry

The following is a list of the Uses proposed to be permitted in
Tracts B and C:
Schools, churches, and public school extension classes, public
recreational facilities, community buildings, museums, libraries,

general public, restaurants including drive-in restaurants,
nightclubs, bars, lounges and taverns, establishments for the sale
and care of household pets, offices, private and commercial
recreational facilities, hospitals, nursing homes and mental or
physical rehabilitation centers, mortuaries and funeral homes,

Theatres, convention halls and other such facilities, gasoline

vehicles or equipment, vehicle rental establishments, wholesale
trade establishments for the -sale of merchandise or services at the
wholesale level, equipment or appliance repair shops, contractors
shops, headquarters or service facilities for ambulance services,

transportation of people, commercial or private parking lots.
Loading areas or structures so long as such areas or structures are
screened from adjacent properties. One single family dwelling unit
or one mobile home when used as living quarters for caretakers or
security personnel responsible for -maintaining or guarding the property.
Any use of a research, repairing, manufacturing, fabricating,
processing, assembling, or storage -nature. The uses identified may
be conducted outside of an enclosed building provided that the use
and/or operations of the use are screened from adjacent public
rights-of-way and adjacent properties.

Tract D: County Storage, Shops, and Motor Pool - 24 acres
Land use description: Weld County operational activities that can
generally be described as storage, shops, and motor pool functions.
Facilities In Tract D will include general warehouse buildings,
structures for the storage, repair, and maintenance of County
vehicles, maintenance shops, and related offices.
Number of buildings: a maximum of 10 principal buildings.
Building floor area: a maximum of 160, 000 square feet.
Building height: a maximum of 36 feet from average finish grade to
top of roof line.
Type of structure: any materials allowed by applicable building
codes.
**General Comment: The number of buildings permitted and square footage
is for informational purposes. They express the planning objectives
of the property. It is recognized that until a final PUD Plan is
approved by the City of Greeley, these numbers do not constitute any
zoning appoval.
*7 Proposed landscaping standards for Tracts A, B, C, shall be as
follows:
Upon development of a lot, at least fifteen percent of the -developed
area shall be landscaped.
Landscaping will be _required for a minimum distance of twenty five feet
back from any property line along any public right-of-way. This -area
shall be included in the fifteen percent described -above.
Lands abutting property lot lines between the curb and street and the
lot line shall be landscaped and maintained by the abutting lot owner.
Such lands shall not, however, be included within the percentage or
depth computations set forth above.
Proposed landscaping standards for Tract AD shall be as follows:

#10 The City of Greeley, Weld County, and the Colorado Department
of Highways have prioritized the 0 Street and US Hwy 85 intersecti-on
as needing improvement within the 5-year plan of the highway system,
and will all participate financially in the planning study to
determine the preferred improvement required as well as the timing
of this improvement. Weld County has an EDA Grant application
pending which will provide adequate funding for improvements of all
necessary site accesses. These accesses and perimeter roads will be
designed to the standards of the City of Greeley, including
acceleration and deceleration lanes. It is anticipated that two ( 2)
additional entrances will be needed for "0" Street for Tract A, and
two ( 2) or three ( 3) additional entrances for Tract B.

In response to your letter of November 5, 1987, questioning the ability
of the City of Greeley Water and Sewer Department to supply supporting
services to the referenced development site, I would like to state that
the City of Greeley is in the process of completing plans for the
expansion of the water treatment facilities at Boyd Lake which will
increase our capacity to produce treated water by ten million to 14
million gallons per day.
This would support an additional population equivalent of 13,333 to
18,666 based on a City of Greeley peak day demand.
The wastewater treatment plant is operating at approximately 58 percent
to 60 percent of design capacity, and has a remaining capacity to support
approximately a 37,000 population equivalent.
Based on the above information, you can see that it would be relatively
easy for the City of Greeley to provide support services to the develop-
ment site in question. I would like to point out that the City of
Greeley would require the property in question to be annexed to the city
in order for us to provide the water service required, -or the County
would have to request from the City -Council an exception to existing
policy.

Gentlemen:
At the request of Norton Underwood & Lamb, Inc. , Empire Laboratories,
Inc. has evaluated the first phase of the Weld County Business Park
P.U.D. as it pertains to economic deposits of sand and gravel.
Based on two preliminary investigations performed by Empir-e
Laboratories, Inc. on the property, it is our opinion that the majority of
the first phase lies outside the area of economic gravel extraction. The
majority of the first phase is in an area where the overburden exceeds
fifteen (15) feet. Gravel was encountered in the southwest portion of the
northwest part of the property. The overburden thickness in this area
varied from eight and one-half (8-1/2) to thirteen (13) feet. This is
considerably more than the overburden encountered in the southern
portion of the entire project area adjacent to the Cache La Poudre River.
Economic gravel deposits were encountered in the extreme southeast
corner of the first phase of the project; however, this portion of the site
is estimated to be a small percentage of the Phase I project area. Based
on our preliminary investigations prepared September 25, 1987 and
January 25, 1988, it is our opinion that the majority of the first phase of
the Weld County Business Park P.U.D. lies outside the area of economic
gravel deposits.
