I"a/if e,l.__..... 00 /'1 00 RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (WELL PUMP AND SUPPLY BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT - RICHARD J_ AND RHONDA R. DREILING WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of November, 1-9843 , at the hour of 10 :00 a.m. in the Chambers of the Board for the purpose of hearing the application of Richard J. and Rhonda R. Dreiling, 617 Greenfield Court, Fort Collins, Colorado 8-0524 , for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (well pump and supply business) in the A (Agricultural) Zone District on the following described seal estate, to-wit: Part of the Ni , Section 9 , -Township 7 North, Range 67 West of the 6th B.M. , Weld County, Colorado WHEREAS, Rick Dreiling, one of said applicants, was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: 881098 Page 2 RE: USR - DREILING a. This proposal is consistent with the Agri-cultural goals and policies of the Weld County Comprehensive Plan. The location of the proposed business will not affect prime agricultural land and will snot affect any agricultural uses in the area. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The permitted use will be compatible with the existing surrounding land uses which include a Public Service Company microwave tower, pasture, two residences , and irrigated cropland. d. The permitted use will be compatible with the future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the Weld County Comprehensive Plan. This area is expected to remain agricultural. No objections have been received from surrounding property owners. e. The application materials demonstrate a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. f. No overlay districts affect the site. g. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special -Review Permit for an agricultural service establishment (well pump and supply business) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 881098 Page 3 RE: USR - DREILING 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to the issuance of building permits or the operation of the well pump and supply business , the applicant shall submit evidence to the Department of Planning Services ' staff that a temporary substitute water supply plan and new well permit showing the expanded permitted uses have been obtained from the State Engineer' s Office or shall submit evidence that a North Weld County Water District tap has been purchased and is available to serve the uses on the property. 4 . Prior to operation of the well pump and supply business, the area used for outside storage shall be screened from adjacent properties and public rights-of-way. A screening plan shall be submitted to and approved by the Department of Planning Services ' staff. 5 . Prior to recording, the Special Review Permit plat shall be amended to show the screening of the outside storage areas and a retaining wall along the north property line. 6 . Prior to recording the Special Review Permit plat, the applicant shall submit an access and maintenance agreement with adjacent property owners to the Department of Planning Services. The Site Specific Development Plan and Special Review Permit is for an agricultural service establishment (well pump and supply business) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein . 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.5. , as amended. 3 . Waste oil, waste paints, stains, treatments, antifreeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . The screened storage area on the site shall be maintained according to the approved screening plan. b . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 8. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 9. Personnel from the Weld County Health Department, Poudre Valley Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply -with the Development Standards stated herein and all applicable Weld County Regulations. 881098 Page 2 DEVELOPMENT STANDARDS - DREILING 10. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 11 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. He said he has no problem with the proposed Conditions and Development Standards. No public comment was offered concerning this request. Commissioner Lacy moved to approve the request of Richard J. & Rhonda R. Collins, CO 80524 Re: Dreiling Temporary Substitut-e Water Supply Plan N1/2, Sec. -9, T7N, R67W Dear Mr. Dreiling: We have reviewed the above referenced request for a temporary plan to allow an existing well (Permit No. 150478) to be used for up to 3 acre-feet of consumptive use associated with domestic and commercial purposes on a 2.94 acre tract. The well permit presently allows for use for household purposes only inside one single-family dwelling. You propose to replace your out-of—priority depletions with one unit of GASP. Based upon this -information, I can approve a temporary substitute water supply plan pursuant to Section 37-80-120, C.R.S. (1973) , for the water year ending April 30, 1989. This approval is subject to the following conditions: 1 . A totalizing meter must be installed on the applicant's well . Records of monthly pumping will be provided to our office before the plan can be renewed. 2. The applicant must submit a signed copy of a renewed contract with GASP for one unit of water each year prior to April 1 . 3. The uses of the well must be limited to 3 acre-feet per year. 4. If for any reason GASP cannot supply replacement water, the uses of this well shall revert back to household purposes inside one single-family dwelling. No outside uses for irrigation of lawns and gardens or the commercial tusiness would be allowed. 5.
