FIECHTNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of October, 1988 , at the hour of 1 :30 p.m. in the Chambers of the Board for the purpose of hearing the application of Douglas R. Fiechtner, 5585 Weld County Road 34 , Platteville, Colorado 80651 , for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (farm equipment repair and maintenance) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SEj of Section 12 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was present, and WHEREAS, Section 24 . 3 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .3 of the Weld County Zoning Ordinance as follows: a. The proposed Special Review Permit area is located within the urban growth boundary area of the Town of Mead. The location of the Special Review Permit area and the attached Conditions and Development 881000 Page 2 RE: USR - DOUGLAS R. FIECHTNER Standards make the proposed use consistent with the Urban Growth Boundary Goals of the Weld County Comprehensive Plan. The Town of Mead, in a letter dated September 8 , 1988 , stated that they have no objections to this proposal. b. The proposed use is consistent with the intent of the Agricultural Zone District in which the use would be located. The proposed use is an agricultural service establishment and is provided for as a Use by Special Review in the Agricultural zone district. c. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. The proposed site is not currently in productive farmground. d. The use which would be permitted will be compatible with the existing surrounding land use . Land uses surrounding the site include rural residences, pasture, and cropland. No objections have been received from surrounding property owners. e. The use which would be permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County. f. No overlay districts affect the site. g. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (farm equipment repair and maintenance) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and 881000 Page 3 RE: USR - DOUGLAS R. FIECHTNER be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the -Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . An ISDS evaluation on the existing septic system shall be performed prior to issuing the required septic permit an the existing system. 4 . Prior to recording: a. The area used for outside storage shall be screened from adjacent properties and public rights-of-way. A screening plan shall be submitted to and approved by the Department of Planning Services ' staff. b. The Special Review Permit plat shall be amended to -show the screening and outside storage areas. The Special Review -Permit is for an agricultural service establishment (farm equipment repair and maintenance) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. -repair and maintenance of vehicles other than farm equipment is prohibited. Vehicles owned by the applicant may be repaired and maintained by the applicant on the site. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S . , as amended. 3 . Waste oil, stains, treatments , anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . An individual sewage disposal system shall be installed for the facility shop and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations . 6 . Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions . 7 . "The screened storage area on the site shall be maintained according to the approved screening plan. 8 . Fugitive dust shall be confined on the site. 9 . The maximum permissible noise level shall not exceed the commercial limit of 60 dB (A) , as measured according to 25-12-102 , Colorado Revised Statutes. 10 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 8_8100D Page 2 RE: DEVELOPMENT STANDARDS - DOUGLAS P. FIECHTNER 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .B of the Weld County Zoning Ordinance. 13 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14 . 'Phe Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 15 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. DETAILS FOR THE FOLLOWING ITEMS, WHEN APPLICABLE, ARE REQUIRED. A. EXPLAIN PROPOSED USE: It is proposed to operate a farm equipment repair and maintenance shop. B. EXPLAIN NEED FOR USE: The surrounding farm community has both expressed and demonstrated the need for an equipment repair and maintenance shop that is readily accessible. 'The location of the proposed shop will meet the need of the numerous surrounding farm operations. The ability of surrounding farmers to utilize such a facility willwill naturally increase the productivity of their farms by saving both costs and time associated with equipment repairs. C. EXPLAIN THE TYPES OF EXISTING USES ON SURROUNDING PROPERTIES: As is noted on the attached site and plot plans the properties immediately to the -east and west of this parcel are zoned agricultural and consist of approximate 3 acre lots with a single residence on each lot. The property to the south of this parcel is zoned agricultural and the site is utilized in a farming operation. The property to the north is also zoned agricultural and is a farming operation. D. THE DISTANCE OF THE PROPOSED USE TO RESIDENTIAL STRUCTURES IN EACH DIRECTION: Approximately 500 feet the residence to the east; approximately 500 feet to the residence to the west; approximately 2640 feet tot he residence to the north; and approximately 100 feet the residence to the south (Owner' s residence) . EXPLAIN THE ACCESS ROUTE( S) TO BE UTILIZED FOR THE PROPOSED USE: The access to the site will be from Weld County Road 34 . I . EXPLAIN THE TYPE, SIZE, WEIGHT, AND FREQUENCY IF VEHICULAR -TRAFFIC ASSOCIATED WITH THE PROPOSED USE: The vehicular traffic to the site will -generally consist farm tractors -and trucks needing repair as well as standard automotive vehicles require to retrieve repaired machinery and trucks from the facility. The frequency of the traffic to the site was previously addressed in item E above, whereby is was estimated that 4-to five customers would utilize the services of the facility on a daily basis. J. THE TYPE OF SEWAGE FACILITIES FOR THE PROPOSED USE: No sewage facilities will be required for the proposed facility. The private residence on the site is currently being served by a septic tank/leach field system. No alterations are anticipated to this system. K. A DESCRIPTION OF THE PROPOSED -FIRE PROTECTION MEASURES ASSOCIATED WITH THE PROPOSED -USE: The property is currently within the boundaries of the Longmont Rural Fire Protection District. Standard fire extinguishers will be utilized within the facility for use in case of a lire. L. THE TYPES AND _ MAXIMUM NUMBER OF ANIMALS TO BE CONCENTRATED ON THE USE SY SPECIAL REVIEW AREA AT ANY ONE _TIME: No animals will be concentrated on the property other than one to two pet dogs. M. THE TYPE AND SIZE OF ANY WASTE, STOCKPILE OR STORAGE AREAS ASSOCIATED WITH THE PROPOSED USE: An inventory of spare parts will be maintained along the western boundary of the property in the rear area of the proposed facility. TYPE OF STORM WATER RETENTION FACILITIES ASSOCIATED WITH THE PROPOSED USE: The proposed facility improvements will not have any significant impact upon the historic storm water runoff from the property due to the slope, ground cover, and extent of the property surrounding the site. THE TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTES ASSOCIATED WITH THE PROPOSED USE: Equipment and facilities are currently owned to transport any debris, junk or other wastes to the Longmont land fill. P. EXPLAIN PROPOSED LANDSCAPING PLANS AND EROSION CONTROL MEASURES ASSOCIATED WITH THE PROPOSED USE: The property is currently, and will remain to be, vegetated with pasture grass which will very effectively prevent any significant erosion from occurring on the site. No addition disturbance is anticipated to the ground cover with the proposed use. Efforts are being made to effectively buffer both the eastern and western property lines with deciduous trees. Any comment from the Planning Staff concerning the preferred species of tree will be greatly appreciated. Q. RECLAMATION PROCEDURES -TO -BE EMPLOYED UPON CESSATION OF THE USE BY SPECIAL REVIEW ACTIVITY: The proposed spare parts stock pile would be completely _removed from the site, and the entire ground area would to maintained with a pasture type of grass mixture which would be compatible with the historic ground cover for the property. The existing building would continue to be maintained and utilized for private use only. R. This facility will in turn increase the productivity of the agricultural industry by providing local, -easily accessible repair services thereby reducing the "down- time" experienced when equipment or machinery fails. Due to the low intensity of the proposed facility (Owner operated) , little or no negative impacts will be realized by surrounding }property owners. C. IF APPLICABLE, A STATEMENT EXPLAINING WHAT EFFORTS HAVE BEEN MADE, IN THE LOCATION DECISION FOR THE PROPOSED USE, TO CONSERVE PRODUCTIVE AGRICULTURAL LAND IN THE AGRICULTURAL ZONE DISTRICT: The proposed facility will be located on land which was previously removed from agricultural production several years ago following the subdivision of a larger parcel into several small acreages . D- A STATEMENT EXPLAINING THERE -IS ADEQUATE PROVISION FOR THE PROTECTION OF THE HEALTH, SAFETY AND WELFARE OF THE INHABITANTS OF THE NEIGHBORHOOD AND THE COUNTY: The proposed facility will not in any way effect the general health, safety and welfare of either the neighborhood or the county due to the low intensity and overall nature of the work.
