HomeMy WebLinkAbout880526.tiff RESOLUTION RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 697 - STANLEY FURROW WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, by Resolution dated July 18 , 1984 , approved Recorded Exemption No. 697 concerning property described as part of the Si , Section 18, Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Stanley Furrow is now requesting that Recorded Exemption No. 697 be amended by excluding 36 acres from Lot B, resulting in three parcels , and WHEREAS, the Board of County Commissioners has studied said request to amend Recorded Exemption No. 697 and deems it advisable to approve same. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the amendment to Recorded Exemption No. 697 as requested by Stanley Furrow be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners; 2) An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems; 3) A Weld County Septic Permit is required for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations; 4) A flood hazard development permit shall be applied for, and obtained from, the Department of Planning Services' staff prior to the construction of any new structures or substantial improvement of any structures in the flood plain area; and 5) The mylar plat submitted by the applicant shall show a right-of-way reservation of 75 feet from the centerline of State Highway 392 along the north side of the highway. The Parcel of land on which this request is being made is described as the SW} of Section 18, T6N, R64W of the 6th P.M., Weld County, Colorado. The property is located approximately 3.5 miles northwest of the Town of Gill; north of Highway 392, and east of Weld County Road 49. The parcel of land under consideration is not the total contiguous land holdings of the applicant. The request is to amend Recorded Exemption #697 by excluding 36 acres from Lot B resulting in three parcels. A new 36 acre parcel, Lot B's new acreage of 79 acres, and Lot A's acreage of 10 acres. The 36 acre parcel and Lot A have existing residences located on them. Based upon the submitted information and policies of the County, the Department of Planning Services' staff recommends this request be denied for the following reasons: 1. The applicant has not shown that this application is consistent with efficient and orderly development. The southwest quarter of this section has been subdivided by the following recorded exemptions: - In August of 1978, RE-332 was approved creating parcels of 125 acres and 10 acres, more or less. - In June of 1982, RE-550 was approved creating parcels of 5.7 acres and 4.6 acres, more or less. 880526 Board of County Commissioners Amended RE-697 Page 2 In August of 1984, RE-697 was approved creating parcels of 115 acres and 10 acres, more or less, which were part of the 125 acre tract created by RE-332. The applicant has consistently used the Recorded Exemption process to create lots in this quarter section which has resulted in piece meal development. It is the staff's opinion that the property in the immediate area has reached a level of development that will increase demands for road maintenance, police and fire protection, educational services, utilities, and other services. 2. The applicant has failed to show how the request is in compliance with the Weld County Comprehensive Plan. Weld County has adopted policies for regulating urban growth areas where services are available. This application is located outside of a municipality's urban growth boundary area. The approval of this application, as well as the existing surrounding properties, has the potential to interfere and encroach upon the agricultural activities of this area. The Agricultural zone district was established to maintain and promote agriculture as an essential feature of Weld County. It is intended to provide areas for the conduct of agricultural activities without encroachment of more intensive land uses. 3. The applicant has failed to show why the request does not evade the requirements and statement of purposes of the Weld County Subdivision Regulations. Separating the 36 acres from the Recorded Exemption property is above the required 35 acre requirement for subdivision purposes, but below the minimum lot size requirement in the Weld County Zoning Ordinance. The 36 acre parcel has an existing residence located on it and therefore, would not be required to obtain a Special Review Permit for a dwelling on a parcel of land less than the minimum lot size. If approved, this request would allow another set of improvements to be built on the 79 acre parcel (Lot B) . The staff requests that the Board of County Commissioners consider the application and determine if the standards of Section 9-2 E. (1) (a) through (m) have been met. Projected traffic on S.H. 392 indicates the need for a 150-foot total right of way, 75 feet each side of the highway centerline. Since the existing width along this property is 3o- feet north of the centerline, additional width to meet the projected need should be protected by reservation or, preferably, dedication, as permitted by regulations. 2. It is our understanding that this amended exemption would create a separate 36-acre± parcel from the west end of this property. Access to this parcel is available from County Road 49, and no direct access to S.H. 392 is permitted.
