RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AGRICULTURAL SERVICE ESTABLISHMENT (CONTRACT TRUCKING BUSINESS) - DANIEL AND JOYCE TIETMEYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 8th day of January, 1986 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Daniel and Joyce Tietmeyer, 27500 Weld County Road 70 , Gill, Colorado 80624 , for a Use by Special Review for an agricultural service establishment (contract trucking business) on the following described real estate, to-wit: Part of the NE', Section 15 , Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Comprehensive Plan encourages the development of agribusiness and agriculturally oriented industry provided these enterprises do not adversely affect the local economy or environment. Page 2 RE: USR, TIETMEYER b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. No overlay districts affect the site. d. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special. Review for an agricultural service operation (contract trucking business) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for an agricultural service -establishment (contract trucking business) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . All construction lone on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 3 . The applicant shall comply with the design standards for the Use by Special -Review, Section 24 .5 of the Weld County Zoning Ordinance. 4 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 of the Weld County Zoning Ordinance. 5. Representatives or members of the Weld County -Health Department and Weld county Department of Planning Services shall be granted access -onto the property at any reasonable time in order to insure the operations carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 6 . The Use by Special -Review area shall be limited to the plans shown herein and -governed by the foregoing Standards and all applicable Weld County -Regulations. Any material -deviations from the plans and/or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such -changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7 . The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. APPEARANCE: Daniel Tietmeyer, property owner and applicant, stated this case was continued because the Development Standards, at his first hearing, only allowed him to have three tractor—trailer combinations on his property at any time. He has now revised his request for ten tractor—trailer combinations to be allowed on the property. The Chairman asked Mr. Teitmeyer if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. He stated he had no problem with anything as outlined except he is still confused with Development Standard #1. . ."The maximum number of vehicles used in the business shall not exceed ten tractor—trailer combinations." Tietmeyer for a Use by Special Review permit for Agricultural Related business be forwarded to the Board of County Commissioners with the Planning Commissions recommendation for approval based upon the recommendations and conditions as outlined by the Department of Planning Services staff, the Development Standards as amended as amended by the staff, and the testimony of the applicant. Motion seconded by Lynn Brown. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. They have one and one-half acres of land at this site. LEGAL DESCRIPTION: The NEZ, Section 15, T6N, R64W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 2 miles north of Gill; south of Weld County Road 70 and west of Weld County Road 57 - APPEARANCE: Daniel Tietmeyer, property owner and applicant, reported they live on this property and they own a trucking business which is agriculturally centered. They would like to operate the trucking business from this location. They do maintenance and small repairs at this site, but no major repairs. Tape 123 — Side 2 The main use of the building is for the storage of their tractors. They haul meat for Monfort and therefore, there are seldom trailers on the property. They would like to expand their business. and it would make it much easier to operate from this location. The Chairman asked Mr. Tietmeyer if he had reviewed the recommendations, conditions, and Development Standards as outlined by he Department of Planning Services staff. He stated he had and already owns more equipment than allowed for in the Use by Special Review application. I am a contract carrier for Monfort of Colorado as well as several local produce companies transporting farm products long distance. The trucks have a combined empty weight of 31 ,000 pounds and will very seldom be at this location when loaded. When loaded they will have a combined gross weight of 75,000 to 80,000 pounds. Since I am involved in long haul transportation each truck will normally be at this location once a week for one or two days. There are days during the week when all the trucks are gone. Access to the property is obtained by either WCR 55 or WCR 57 off of highway 392 and then WCR 70. My wife and I take care of all maintenance and record keeping and have three employees to drive the trucks. The surrounding properties are all agriculture raising corn and alfalfa. The distance to residential structures is approximately 2000 feet to the East, 1 mile to the North, 2000 feet to the West and 1 mile to the South, besides the house on the property in which my family and I live in. Our water source is Northern Weld Water tap and the sewage facilities for the house is a leach field. No other sewage facilities are required. The only waste involved is used engine oil which is stored in a 300 gallon steel tank and then sold. Disposal of other waste and trash will be hauled to an approved land fill when trash containers are filled. Fire protection measures will be water hydrants placed near the two buildings as well as fire extinguishers placed in proper locations. All trash, weeds and fire hazards are kept contained so as to prevent any possibility of fire. The property is in the Kersey fire district. Proposed landscaping plans call for trees , gravel driveways , proper slope of land for water runoff to control any possible erosion of any type as well as beautification of the property. Redamation procedures to be employed upon cessation of the use by special review activity will not really apply since the building used for trucks can also be used for any agriculture activity and the land or environment will not be changed or `,e different than most agriculture operations to much degree.
