RE: APPROVAL OF AMENDED RECORDED EXEMPTION NO. 207 - EDWARD
FRITZLER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on May 3 , 1976 ,
approved Recorded Exemption No. 207 for Edward Fritzler concerning
property described as the NE4 of Section 31 , Township 4 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, Edward Fritzler is now requesting that Recorded
Exemption No. 207 be amended to add one-half acre to Lot B of said
Recorded Exemption, and
WHEREAS, after study and review, the Board of County
Commissioners deems it appropriate to approve the amendment to
Recorded Exemption No. 207 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the amendment to
Recorded Exemption No. 207 for Edward Fritzler be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions: 1) The applicant shall submit
a mylar plat to the Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners; and 2) The revised mylar plat
shall show a twenty foot wide access easement for the Farmers
Independent Ditch from Weld County Road 254.

Dear Commissioners:
The attached application and related items are in reference to a request
from Edward Fritzler for an amended recorded exemption. The parcel of land
on which this request is being made is described as NE's of Section 31, T4N,
R66W of the 6th P.M. , Weld County, Colorado.
Mr. Fritzler would like to add another one-half (1/2) acre to Lot B of
Recorded Exemption #207. Approval of the amended recorded exemption will
not create any additional residential building sites.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on surrounding agricultural land-uses does not
appear to be significantly different than the original
request approved on May 3, 1976.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within sixty (60) days from the date of
approval by the Board of County Commissioners.
2. The revised mylar plat shall show a twenty (20) foot wide access
easement for the Farmers Independent Ditch from Weld County Road 25`z.

parcel, Lot A. The proposed 1/2 acre addition to Lot B would be pasture
land and would include the site of a former mobile home. The former mobile
home site contains trash and debris. Both lots have access to Weld County
Road 251, a gravel road. ('�

To whom it may concern ,
In 1976 I sold this property ( lot 8) to my daughter and
son-in-law- Don Mitchell . they remodeled the old house that was
there. Since that time they replaced the domestic well that was
there and put in a new septic tank and leach line.
In october 1984 they sold this property to Mr & Mrs Scott
Meining. Now I am interested in selling some land that joins the
property because it would be more usful to them than me. It has
pasture grass in some of it an is no good to me as farm land. The
rest of it is an eye sore at the present time and I am sure the
Meinings will clean it up. Also there are no buildings on this
property at the present time. However there is a domestic well
there now which has been replaced since 1976.
This land lies east and south ( 1/2 acre more or less) of
the Meining property in the NE 1/4 if sec 31 twp 4w n ,range 66
p.m. lying west of the westerly right of way of the Farmers
Independent Ditch .
The total acreage will be about 2 acres.
