Re: Concerns about potential drainage and storm water runoff into the Harry
Lateral Ditch Company.
Dear Mr. Nelson:
Thank you for your letter of November 26. Use by Special Review permit for
Gerrit and Henrietta Hoagland was approved by Weld County in 1983 for a
1,000 cow dairy. A recent inspection of the property revealed that the
dairy has not yet started operation; however, some dirt moving and grading
have occurred on the property.
Eleven development standards were approved with the permit. Development
standards are specific items that the property owner agrees to comply with
when the permit is approved by the County. Two development standards
specifically address your concerns. These two development standards state:
- The lagoon, as identified on the Use by Special Review Plat, for
waste water retention, shall be installed as per Rules and Guide-
lines for Water Pollution Control at Livestock Confinement Areas
as issued by the Colorado Department of Health, May, 1978. The
Owner and/or operator shall be responsible for any additional
applicable directives or guidelines issued by the Colorado
Department of Health.
-- All stock pen runoff shall be controlled and confined within the
boundaries of the subject property as identified in the submitted
application and materials.

Our department is responsible for ensuring that the property owner and dairy
operator complys with all the development standards that were approved with
the permit. Noncompliance with any of the standards will result in a
violation notice being issued by our department requesting compliance within
30 days.
A copy of your letter, along with a copy of this letter, will be sent to Mr.
and Mrs. Hoagland to advise them of your concerns and our response. If you
have any questions, please call me.

Dear Sirs ;
I enclose a letter written 4 October 1923 by this
Company , regarding subject Hoagland Dairy , and expressing
the concerns of the Harry Lateral Ditch Company with respect
to anticipated runoff , both from the corrals and from storm
water runoff , wh i ch , in passing from and through the corral
areas , wi11 eventually end up in said canal . The canal is
adjacent to the proposed location of the dairy set--up . It is
further understood that the dairy might build up to a 100')
to 2000 cow herd , which , if true , could produce a tremendous
amount of materials , which eventually will + ind its way into
the canal .
Directors and Stockholders of the Harry Lateral Ditch
Company , at their duly called Annual Meeting held 24
November 1956 , expressed concern over the prospect of such
an occurrence . Further . in view of Colorado Water Qual i ty
requirements and standards , it is hoped that Hoaol a.nd Dairy
will be required to strictly adhere to the letter of the law
governing this type of ac t i v i ty and that you , in your
position of authority , can and will demand adherence to
those standards .and restrictions .
