WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 18th day of June, 1986, at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Willie' s Grain, Inc. , 18302 State Highway 392, Greeley, Colorado 80631 , 'for a Use by Special Review for a trucking operation to service the agricultural industry on the following described real estate, to-wit: Part of the NW4 NWa, Section 19 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, linds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County -Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Comprehensive Plan encourages the development of agribusiness and agriculturally oriented industry, provided these enterprises do not adversely affect the local economy or environment. 860570 2 17, Page 2 RE: USR - WILLIE' S GRAIN, INC. b. The proposal is consistent with the intent of the Agricultural Zone District in that the proposed use does not interfere with other agricultural activities in the area or the County, and as a Use ty Special Review the activity can take place in the district. c. The Greeley Planning Commission has reviewed this proposal and recommends no objection to the request. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for -a Use ty Special Review for a trucking operation to service the agricultural industry on the -hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . She attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services ' office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The Use by Special Review permit is for a trucking operation to serve the agricultural industry as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Within sixty days from the date of approval by the Board of County Commissioners , the access shall be relocated seventy-five feet west of the existing access on Colorado State Highway 392, in accordance with State Highway Department sight distance requirements. 3 . The applicant shall obtain an access permit from the State Highway Department prior to relocating the access on Highway 392 . 4. Truck and trailer washing shall not be permitted on the Use by Special Review site unless a disposal facility approved by the Weld County Health Department is added to the operation. 5 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 7 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 8. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 860570 Page 2 DEVELOPMENT STANDARDS - WILLIE' S GRAIN, INC. 9 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . Commissioner Lacy asked why Development Standard #4, prohibiting truck and trailer washing, was included. Ms. Dunn stated that it was recommended by the Health Department. Michael Willets came forward to represent the applicant and answer questions of the Board. During the discussion, which centered around Development Standard #4, the Board suggested that this Development Standard be amended to provide that an approved facility for truck and trailer washing may be added to the operation, in accordance with Weld County Health Department regulations. Commissioner Lacy moved to amend Development Standard #4 as suggested. Seconded by Commissioner Brantner, the motion carried unanimously. No public testimony was offered concerning this request. Commissioner Lacy moved to approve the application of Willie's Grain, Inc. for a Use by Special Review, subject to the Conditions and amended Development Standards. They do some minor maintenance on this property. This is a family operation and they have sixteen trucks based here. Debbie deBesche explained that this property has a history of different types of commercial uses. The applicant has also applied for a recorded exemption which cannot be considered until the use is legal. The Chairman called for discussion from the members of the audience. James Milne, surrounding property owner, stated he does not oppose this request, but there is a traffic problem which they are working out with the State Highway Department. They have cleaned up the property and it looks better than is has for several years. The Chairman asked the applicant if they had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. Hellerich, Attorney, Dinner, Lazar and Hellerick, represented the applicant. He reported on the history of this request. The feedmill will be enclosed within a building so there should not be a lot of dust and the building should cut back on the amount of noise that will be heard. This request was originally approved by the Planning Commission for all four phases, but the Board of County Commissioners did not approve phases three and four. Therefore, the applicant is back requesting that only phases one and two be approved. The only new structure would be a building constructed to take care of the feedmill. They have a use by right which they are wanting to expand. The Chairman asked if they had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. Mr. Hellerich stated they had and they are not in agreement with Development Standard 63. B. He felt this was applicable to the original application, but not to this request. He does not see how manure and a grinding operation are related. Projected traffic on State Highway 392 indicates the need for a 150-foot total right of way, 75 feet each side of the highway centerline. Since the existing right of way width is 40 feet south of the centerline, an additional 35 feet should be provided by reservation or, preferably, dedication as permitted by County regulations. 2. It is our understanding that this Special Review application applies only to the 9.7 acre area identified as Lot B. The proposed Lot A is presently part of the same ownership as Lot B but is not being considered as part of this application. We strongly encourage that any future development on Lot A obtain its access from the driveway serving Lot B. 3. The access to this proposed trucking facility from S.H. 392 has been evaluated in relation to the State Highway Access Code. The sight distance to the west of this existing access location is approximately 800 feet, based on a 3?-foot height of the entering driver's eyes to a 4' -foot height of the oncoming vehicle. The Access Code requires 935 feet of sight distance for multi-unit trucks obtaining access to this 55 m.p.h. highway. The required sight distance to the west and east can be achieved if the present driveway is relocated about 75 feet to the west. This trucking facility constitutes a change in property use according to the Access Code; therefore, the relocation of this access is required. Beryl and Donna Willits have been the owners and operators of this small trucking firm and became incorporated by the State of Colorado in October of 1983. Now known as Willies Grain Incorporated with Beryl L. Willits (President), Donna D. Willits (Secretary-Treasurer) , and Michael B. Willits (Vice President) , this company now employs 20 people from in and near the Greeley area. Our company transports processed beef from the Monfort of Colorado packing plant in Greeley, Colorado and their plant in Grand Island, Nebraska. We also haul meat for Sterling Beef Company located in Sterling, Colorado and Fort Morgan, Colorado. Other commodities we haul are dairy products loaded at the Meadow Gold plants located in Greeley, Colorado and Englewood, Colorado. In addition Willies Grain Incorporated transports cattle hides from the Sterling Beef Company plant in Sterling, Colorado to Chilewich Corporation in Denver, Colo- rado. The company does not load, unload or store any commodities on the property. Our purpose for this property is to dispatch, service and maintain the trucks and trailers with which we conduct our business. We have 16 tractors and 26 trailers which are company owned, and 3 tractors leased to us. The size (9. 7 acres), shape, soil conditions, irrigation ditches, tree rows, changing elevation, and existing structures have kept this property from agricultural production. However, the property have a location that facilitates safe access to the main highways of State Highway 392, State Highway 85 and Interstate Highway 25. This feature is the -main criteria that enables us to utilize the property to its potential . Half a mile to the east of our company, adjacent to Highway 85, is a trucking firm, Booth Trucking. One mile due south of Willies Grain (2) Inc. is Monfort Transportation. Both of these companies are engaged in similar operations to our business. Our neighbors within 500 feet of the property lines are farmers. The surrounding property is crop- land. Our use of this proposed "special use by review" land would not adversely affect the preparation of the cropland; the cultivation of it nor the harvesting. In fact, our security lighting at night pro- vides light along the east border for irrigation, all summer long. None of our activities would require a compromise in our neighbors ' daily routines. Since our trucks haul farm commodities raised in Weld County, pro- motion of a good location to operate trucks which carry farm products to market is consistent with the agriculture district. Our hours of operation are 8:00 A.M. to 5:00 P.M. , Monday through Friday, and 8:00 A.M. to 1 :00 P.M. on Saturday. Michael Willits, Vice President of Willies Grain Inc. , and son of Beryl and Donna, lives in the house on the premises which was a part of the property purchase. Michael is able to provide security of the property along with his duties as Dispatcher and General Manager. Water and sewage facilities were in place when the property was pur- chased, with water supplied by North Weld Water District. There is leach field sewage which was also existent at time of property pur- chase for two restrooms in the office building. Trucks and trailers are washed and the water is then drained to the west of the irrigation canal which bisects the property. Used oil is saved in a 300 gallon tank buried below the ground. This oil is sold to and pumped out by a recycler monthly. There are no other unusual wastes or debris asso- ciated with our operations. Willies Grain Incorporated is in the Eaton Fire Protection District. In regard to the amount of traffic, 7--8 trucks will leave our yard on a Saturday anytime from 7:00 A.M. to 7 P.M. and be back the fol- lowing Wednesday or Thursday. Then I--2 trucks will leave the yard on Sunday and return on Thursday or Friday. During an average week from Monday through Friday, thre are usually 3 outbound trucks which would normally return in approximately six days. Periods of highest traf- fic are Wednesday 9 :00 P.M. to Thursday 6:00 A.M. Normally, on this day, five to six trucks return to our yard in Lucerne. The next highest day regarding traffic volume is Saturday from 3:00 P.M. to 6 P.M. , when five to six trucks normally leave our yard. Nearly all of the trailers are parked at the location of the shipper's, both loaded and empty. The tractors are stored at the facility in Lucerne; usually only over- night to receive maintenance. The tractors and/or trailers which are at the Lucerne yard are parked south of the office building and west of the shop building, which keeps them over 400 feet away from High- way 392, and obstructed to view from the highway. The employees park against the south wall of the office building, keeping their vehicles from view of the highway. Usually there are only ten--twelve personal (3) vehicles parked during the work week. Prior to Beryl Willits ' purchase of the property it was overgrown with weeds and basically lacking in all areas of upkeep. The cement block building (now offices) remained empty for four to five years. The property was used by transients and others for a meeting place for parties, campfires and other undesirable activities. The mobile home had several broken windows, unlocked doars and useless appli- ances. Use of the property began with the erection of a 50' by 90' pole metal building in April of 1982. Also the complete renovation of the mobile home and the cement block building began at that time. Many of the trees on the property were cut down and trimmed; then, in the summers of 1983 and 1984, over five hundred seedlings of cottonless Cottonwoods, Douglas Fir, Ponderosa Pine, Poplar, and other similar trees, were planted on the perimeters and in con- figurations throughout the property. This work was done mainly to protect the soil and property structures. Gravel was also brought in to maintain solid roads and passages for the trucks. The use of this property, as explained, with improvement of both surface conditions and property structures, shows without doubt the integrity of Willies Grain Inc. and the willingness to work with the Department of Planning Services. Our business use of this property would enhance the future of the agricultural community, and remain integral with the Weld County Comprehensive Plan.
