WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 20th day of August, 1986 , considered the request of Equus Farms, Inc. to place a dwelling on a parcel of land to be used as a third accessory to a farm, and WHEREAS, said accessory dwelling is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows: Part of Sections 15 , 16 , 17 , 18 , 23 , 25 , 27, and Sections 19 , 20 , 21 , 22 , 24 , and 29 , all in Township 4 North , Range 62 West, and Part of Section 19 , Township 4 North, Range 61 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony , finds that said request should be granted subject to the following conditions: 1) The applicant shall apply for a building permit for the accessory dwelling within sixty days from the date of approval by the Board of County Commissioners; 2) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; 3) Prior to the issuance of a building permit, the owner shall submit evidence that the well is supplying water in such a manner as to be adequate in quality, quantity and dependability for the proposed use; and 4) The accessory dwelling shall not be occupied until the hereinabove mentioned conditions have been complied with. Box 972 Fort Morgan, CO 80701 Dear Mr. Samples: SUBJECT: EQUUS FARMS ACCESSORY DWELLING PERMITS ARIX PROJECT NO. 86114.10 I have reviewed the letter from your attorney, Donald McClary, dated August 11, 1986 and have spoken with Mr. McClary and yourself, I feel that some additional information should remove any objections your company has to our proposed dwellings. 1. There are two (2) existing access roads indicated on the sketch plan. The east-west access road is an existing private road which lies to the north of the BiJou Canal and roughly parallels the canal, it should be noted that the canal is about five (5) to eight (8) feet higher than the existing road. This road has always been and shall continue to be the main access road through the ranch. We are not proposing to do any work to the road or south of the road. The second access road runs northerly from the first access road and has provided the access to our site, which in the past contained a bunkhouse, a trailer used as a clubhouse, corrals, a barn, and garage/workshop. All of these buildings have been removed. We plan to move this road about thirty (30) feet west and improve it. 2. Equus Farms, Inc. purchased Eagles Nest Ranch in January of 1986. The operation is and will continue to be farming and ranching. The site we have planned will be the mainranch headquarters. Several of the buildings are replacements for ones which have been removed. The building in Case No. zpad-27:86:5, now sits to the south of the BiJou Canal and access is over the canal . By moving this building we will o reduce but not eliminate the use of this access. 3. We appreciate the ditch company' s concern about liability, especially a s.2] since we understand the ditch company is unable to obtain liability k. insurance. My clients are very much concerned and would object to the proposed plan and zoning permit insofar as the same does or may affect the operation, use and maintenance of their canal, known as the Bijou Irrigation Canal , in the vicinity of the subject property. We have reviewed the data and information furnished and while it is not as complete as may be desired in this regard, it does raise some real questions to my clients concerning their canal, particularly as follows: A. The sketch plan indicates an access road" . The map and information is not clear as to the location of the "access road" , in relation to the Bijou Canal. Certainly if any of this access road either abuts or is part of the maintenance road and easement for my clients in the maintenance and operation of the Canal , they would certainly object to any use thereof by any other parties as my clients ' claim is an exclusive easement. This is important to my clients, both for the continued maintenance and operation of their Canal as well as the serious problem of liability or increased liability by virtue of the increased useages of the subject and adjacent properties by increased number of persons in the vicinity of the Canal which may suffer , either personal bodily or property injuries and damages due to the existing location of my clients ' Canal in relation to the subject property. The above is intended on behalf of my clients , to register with your office their sincere interest and concerns in this matter and their request that they be advised as to all hearings or other matters and papers filed in regard to this application. There appears to be some confusion as to the nature of the operation at Eagles Nest. Prior to January 7, 1986, Eagles Nest Ranch was owned by John F. Orr. Mr. Orr apparently was providing duck hunting privileges under the title of Eagles Nest Country. Mr. Orr also conveyed approxi- mately 250 acres to Eagles Nest Gun Club, lying in the northwest corner of the ranch. In January 1986 Equus Farms, Inc. purchased Eagles Nest Ranch from Mr. Orr. All hunting privileges issued by Mr. Orr were terminated at the end of the 1985-86 duck hunting season. It is the desire of the current owner to construct a new home, for his family, to utilize existing ranch facilities for employees, and to construct several new dwellings for full or part-time ranch employees, some of which will be replacement buildings for an existing bunkhouse, barn, and corrals, .which are in the process of being removed.
