RE: APPROVE CONTINUANCE OF -SHOW CAUSE HEARING TO CONSIDER
REVOCATION OF USE BY SPECIAL REVIEW #686 -ISSUED TO BERNARD
AND CHERYL -HOOGLAND
WHEREAS, the -Board of County Commissioners of Weld County,
Colorado, pursuant to Color-ado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
-affairs of Weld County, Colorado, and
WHEREAS, on March 5 , 19136 , a Show Cause Hearing was conducted
to consider revocation of Use by Special Review #586 issued to
Bernard and Cheryl Hoogland, and
WHEREAS, the Board deems it advisable to continue said
hearing to April 16 , 1985 , to allow the Hooglands additional time
to comply with Development Standard #2 because wet and frozen soil
has interfered with the Hooglands ability to comply with the
Development Standards , -and
WHEREAS, the Board further deems it advisable as a condition
of this continuance that the -Hooglands place a ditch across the
lower corral to drain any _runoff away from the -area which has not
yet been completed.
NOW, THEREFORE, BE aT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Show Cause
Hearing to consider revocation of Use -by Special Review #626 be,
and hereby is , continued to April 16 , 1986 , at 2: 00 p.m.
BE IT FURTHER 12ESOLVED as a condition of continuance by the
Board that Bernard and Cheryl Hoogland be , and hereby are,
directed to place a ditch across the lower corral to drain any
runoff.

RE: SHOW CAUSE FOR REVOCATION OF USE BY SPECIAL REVIEW #686 ISSUED TO
BERNARD AND CHERYL HOOGLAND
A public hearing was conducted on March 5, 1986, at 2:00 P.M. , with the
following present:
Commissioner Jacqueline Johnson, Chairman
Commissioner Gordon E. Lacy, Pro-Tem
Commissioner Gene Brantner
Commissioner C.W. Kirby
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Keith Schuett
The following business was transacted:
I hereby certify that pursuant to a notice dated January 22, 1986, and
duly published February 13, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider revocation of Use by Special Review
#686 issued to Bernard and Cheryl Hoogland. Lee Morrison, Assistant
County Attorney, made this matter of record, and stated that this
hearing was continued from Febuary 26, 1986, when the Board found that
violations exist. This hearing is being conducted to consider the
ramifications of those violations and determine the action to be taken.
Keith Schuett, representing the Planning Department, submitted a report
concerning an inspection made today, which revealed that the berms are
not acceptable. Paul Gallegos, an employee of the Soil Conservation
Service, came forward to report on the work which has been completed
and the work which still must be completed. He stated that they have
recommended that work not continue due to existing soil conditions.
Mr. Hoogland requested that the Commissioners view the situation.
During discussion, Art Adler, a neighbor, came forward and made
comments regarding the placement of the ponds. After considerable
discussion, Commissioner Lacy moved to continue this hearing to April
16, 1986, with the stipulation that Mr. Hoogland place a ditch across
the lower corral to drain any runoff into the lower pond area.
Commissioner Kirby seconded the motion and requested that the Board
make an on-site inspection. Mr. Hoogland assured the Commissioners
that the stipulated ditch could be in place by tomorrow. The motion to
continue this hearing carried unanimously.
This Certification was approved on the 10th day of March, 1986.
