RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ONION PROCESSING AND
PACKAGING OPERATION - NOFFSINGER MANUFACTURING COMPANY, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 13th day of August, 1986 , at the hour of 2 :00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Noffsinger Manufacturing Company, Inc. , P.O. Box
488 , Greeley, Colorado 80631 , for a Use by Special Review for an
onion processing and packaging operation on the following
described real estate, to-wit:
Part of the SW1 , Section 10 , Township 7 North ,
Range 66 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendation of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4. 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan. The Comprehensive

Plan encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local
economy or environment.
b. The proposed use is an agricultural activity and
is , therefore, consistent with the intent of the
Agricultural Zone District.
c. The Towns of Ault and Pierce have reviewed this
proposal and have no objections.
-d. No overlay districts affect the site.
e. Use by Special Review Development Standards will
provide adequate protection of the health , safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an onion processing and packaging
operation on the hereinabove described parcel of land be , and
hereby is , granted subject to the following conditions:
1. The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special -Review plat prior to recording the plat.
2. The Use by Special -Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3 . Prior to recording, the Use by Special Review plat shall
be amended to show a seventy-five foot right-of-way
reservation north of the centerline of Highway 14.

1 . The Use by Special Review permit is for an onion processing
and packaging operation , as submitted in the application
materials on file in the "Department of Planning Services and
subject to the Development Standards stated herein.
2. Access shall be limited to the one driveway as indicated on
the Use by Special Review plat.
3. On-site disposal of produce shall not be allowed.
4 . Produce shall be handled and stored at the facility in such a
manner so that no nuisance is created by odor, blowing of
debris and fugitive dust, or spoiled produce on or around the
facility in accordance with Weld County Health Department
Regulations
5. The septic system shall be designed by a Colorado Registered
Professional Engineer as recommended by the Weld County
Health Department.
6. All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
7. The property owner or operator shall be responsible for
complying with the design standards of Section 24. 5 of the
Weld County Zoning Ordinance.
8. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24. 6 of the
Weld County Zoning Ordinance.
9 . Personnel from the Weld County -Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations
10 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall -require
the approval of amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners

permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
11. The property owner or operator shall be responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be xeason for

A public hearing was conducted on August 13th, 1986, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 28, 1986, and
duly published July 31, 1986, in the Johnstown Breeze, a public hearing
was conducted to consider a request submitted by Noffsinger
Manufacturing Company, Inc. for a Use by Special Review for an onion
processing and -packaging operation. Chairman Johnson informed the
applicant that since there were only four Commissioners present, if
this matter resulted in a tie vote, the absent Commissioner would
review the record and listen to the tapes and cast the deciding vote.
Lee Morrison, Assistant County Attorney, made this matter of record.
(TAPE CHANGE #86-61) Gloria Dunn, representative for the Planning
Department, read the favorable recommendation of the Planning
Commission into the record. _She said this recommendation is subject to
3 Conditions and 11 Development Standards. Pat McNear, of Scott
Realty, represented the applicant. He said there are no objections to
the Conditions and Development Standards as proposed. Ardell Leaf,
adjacent property owner, was -concerned about expansion of the existing
operation. Commissioner Kirby moved to approve the request of
Noffsinger Manufacturing Company, Inc. for a Use by Special Review,
subject to the recommended Conditions and Development Standards.
Commissioner Brantner seconded the motion. The motion carried by a
unanimous vote.
This Certification was approved -on the 18th day of August, 1986.

LOCATION: Approximately one mile west of Ault; west of Weld County Road 33
and north of Highway 14
APPEARANCE:
Pat McNear, Scott Realty Company, represented the applicant. The onion
processing and packaging plat is preexisting, but has never been approved
through the Use by Special Reivew permitting procedure. The applicant is
dividing this business off into a two acre parcel of land. The operator
lives on this site and the premises are kept neat and clean of debris.
The Chairman asked Mr. McNear if he had reviewed the recommendations,
conditions, and Development Standards as outlined by the Department of
Planning Services staff. He stated he had and has no objections to them.
The Chairman called for discussion from the audience. There was none.
The Chairman asked that reading of the recommendations, conditions, and
Development Standards as outlined by the Department of Planning Services
staff be dispensed with and that they be filed with the summary as a
permanent record of these proceedings.
MOTION:
Harlan Else moved Case Number USR-745:86:28 for Noffsinger Manufacturing
Company, Inc. , for a Use by Special Review permit for an onion processing
and packaging operation be forwarded to the Board of County Commissioners
with the Planning Commission's recommendation for approval based upon the
recommendation, conditions, and Development Standards as outlined by the
Department of Planning Services staff and the testimony of the applicant.
Motion seconded by Louis Rademacher.
The Chairman called for discussion from the members of Planning Commission.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not occur nor shall any
building or electrical permits be issued on the property until the
Use by Special Review plat has been delivered to the Department of
Planning Services' office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.

APPROVED FOR THE TOLLOWING REASONS:
1. She submitted materials are 1n compliance zlith application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of -Planning Services staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
- The proposal is consistent with the intent of the Weld
County Comprehensive Plan. The Comprehensive Plan
encourages the development -of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local economy or
environment.
- She proposed use is an agricultural activity and is,
therefore, consistent with the intent of the
Agricultural Zone district.
- The towns of Ault and Tierce have reviewed this proposal
and have no objections.
- No overlay districts affect the site.
- Use by Special Review Development Standards will _provide
adequate protection of the health, safety and welfare of
the neighborhood and County.
_This recommendation is lased, in _part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the _referral entities which have reviewed this request.

The Department of 3lanning _Services staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not £ccur nor shall any
building or electrical permits be issued on the property until the
Use by Special Review plat has been delivered to the -Department of
Planning Services' office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.
3. Prior to recording, the Use by Special Review plat shall be
amended so show a seventy-five (75) foot sight-of-way reservation
north of the centerline of Highway 14.
DEVELOPMENT STANDARDS

1. The Use by Special Review permit is for an onion processing and
packaging operation, as submitted in the application materials on file
in the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Access shall be limited to the one driveway as indicated on the Use by
Special Review plat.
3. On-site disposal of produce shall not be allowed.
4. Produce shall be handled and stored at the facility in such a manner so
that no nuisance is created by odor, blowing of debris and fugitive
dust, or spoiled produce on or around the facility in accordance with
Weld County Health Department Regulations.
5. The septic system shall be designed by a Colorado Registered
Professional Engineer as recommended by the Weld County Health
Department.
6. All Construction done on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
7. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
8. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning

1 . Projected traffic on State Highway 14 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. Addi-
tional width to meet this need should be protected by reservation or,
preferably, dedication as permitted by local regulations.
2. Access to this property is to continue to be obtained through an existing
driveway to S.H. 14. Since no change in property use is proposed in
conjunction with this Special Review, no Access Permit is required.

Gentlemen:
Noffsinger Manufacturing Company Inc. , a family controlled corporation, owns
the SW 1/4 of Section 10, Township 7 North, Range 66 West of the 6th P.M.
Located in the southeast corner of this parcel is an onion processing
facility, which we currently have leased to an individual proprietor.
We now are making an application for a Special Review Permit in accordance
with Section 24 of the Weld County Zoning Ordinance. We shall also submit an
application for a Recorded Exemption to provide for the severance of two
acres, more or less, from the above described parcel. Said two acres is the
site on which the onion facility is located. We 'intend to operate this
facility exactly as we have in the past.
The surrounding properties are used for agricultural crop production. The
nearest residential structure is over 400 feet away, and currently we are the
owners. The next nearest is over 2000 feet away. As indicated in the first
paragraph, the number of patrons is an individual proprietor who runs a
seasonal operation with 15 employees working 10 hours daily on 1 shift from
the month of August until January. Access is off of Hwy 14 , and the
vehicular traffic are farm trucks in, 18,000 lbs gross weight, 9,000 lbs net
weight, and produce trucks with diesel tractors out, 80,000 lbs gross weight,
40,000 lbs net weight. The frequency is 900 loads in, during the months of
August and September and 100 loads out, during the months of August through
January. The sewage facility is septic and the fire district is Ault. All
waste from the user is immediately disposed of to neighboring feedlots or
croplands.
This proposal is consistant with the Weld County Comprehensive Plan and with
the intent of the district as it is an agribusiness located within an
unincorporated agriculturally zoned area which provides a local market for
crops grown in the area as well as employment and tax revenues for the
district and takes no cropland out of production. The operation complies with
all health and safety regulations and is in no way harmful to the inhabitants
of the neighborhood or county.
The use is compatible with any future development of the area and is located
at 4945 feet above sealevel and is not on a flood plain; it is located in the
Ault Overlay district.
