Control Commission. The sections to be amended are
10.1.4(1)(a) , 10.1.4(2) and 10.1.4(2)(e) with a proposed new
sub—section (4) entitled "CBOD5 Parameter Limitations" to
be added to Section 10.1.4.
NOTE: Final adoption on this matter to be made on May 8,
1985 in Durango, Colorado.

SUMMARY OF PROCEEDINGS/MOTIONS
FEBRUARY 4, 1985
The meeting of the Water Quality Control Commission was called to order by
Chairman Baumgartner in Room 150, Colorado Department of Health Building,
4210 E. 11th Avenue, Denver, Colorado.
MEMBERS PRESENT:
Bruce Baumgartner, Linda Burger, Tad Foster, Cynthia Kahn, Robert
Pearson, Myrna Poticha, and Tom Smith. Commissioners Jeffrey Todd and
Ben Urbonas were absent.
STAFF PRESENT:
Gary Broetzman, Jon Scherschligt, Mark Gdovin, Dennis Anderson, Greg
Parsons, Melinda Kassen (Assistant Attorney General), Alan Stewart and
Marsha Smith.
APPROVAL OF AGENDA:
The agenda for the February 4th meeting was approved.
DENVER SOUTHEAST SUBURBAN WATER & SANITATION DISTRICT - WITHDRAWAL OF
ADJUDICATORY HEARING:
Commissioner Foster moved that the motion of the Denver Southeast
Suburban Water & Sanitation District to withdraw its appeal be
accepted. The motion was seconded by Commissioner Pearson. It was
unanimously adopted.
OAK CREEK RULEMAKING HEARING:
Commissioner Kahn moved for approval of a .05 mg/1 unionized ammonia
standard for Segment 7 of the Yampa River, which is the mainstem of Oak
Creek in Routt County. It was seconded by Commissioner Smith. The
motion was unanimously adopted.
Commissioner Poticha moved for adoption of the Statement of Basis and
Purpose as modified by the inclusion of a portion of the statement
submitted by Dennis Anderson and further information on the stocking of
rainbow trout and as found in the Water Quality Control Division' s
prehearing statement. The motion was seconded by Commissioner Kahn. It
was unanimously adopted.

Commissioner Kahn also moved for approval of the Fiscal Impact Statement
as proposed in the Division's prehearing statement. It was seconded by
Commissioner Poticha. The motion was adopted unanimously.
The Administrator was directed to notify the Environmental Protection
Agency that instead of the standard proposed in the Notice of Rulemaking
that the Commission adopted an alternate proposal.
PRESENTATION ON SEPTAGE AND SLUDGE TRANSPORT AND DISPOSAL:
A representative of the Waste Management Division briefed the Commission
on that division's regulations and program for control of septage and
sludge transport and disposal.
DRCOG BRIEFING ON CHERRY CREEK MASTER PLAN TASK FORCE:
The Commission was briefed by the Denver Regional Council of Governments
(DRCOG) on proposed changes to the scope of work of the Cherry Creek
Master Plan Task Force. The individual commissioners provided their
comments for transmittal to the Task Force. Comments were unanimously
in support of local planning efforts, which would lead to adoption of
the Master Plan as soon as possible. The Commission committed to
schedule toward public hearing in September or October, 1985.
INFORMATIONAL HEARING FOR TRIENNIAL REVIEW - REGULATIONS CONCERNING LIQUID
PETROLEUM PRODUCTS AND FOR CONTROL OF WATER POLLUTION FROM FEEDLOTS:
Commissioner Poticha moved that the Commission, having reviewed the
regulations concerning liquid petroleum products and the regulations for
control of water pollution from feedlots, has received no new evidence
on those regulations and is proposing no change at this time. The
motion was seconded by Commissioner Foster. It was unanimously adopted.
PETITION OF WHEATRIDGE SANITATION DISTRICT FOR RECONSIDERATION, VARIANCE,
HEARING AND ADJUDICATORY HEARING CONCERNING DISCHARGE PERMIT #0024121:
Commissioner Foster moved that the Commission table until its March,
1985, meeting the consideration of a Petition by the Wheatridge
Sanitation District concerning their discharge permit. The motion was
seconded by Commissioner Smith. It was unanimously adopted.
DISCUSSION OF EPA VARIANCE AUDIT:
After consideration of the Division's response to an EPA letter
regarding its variance audit, the Commission determined that the
Division had thoroughly addressed the issue and no action was required
by the Commission.

BRIEFING ON STORM SEWER REGULATORY CONCEPTS:
In response to its briefing on storm sewer regulatory concepts, the
Division was asked to take no action for the time being.
ROLE OF ARAPAHOE AND DOUGLAS COUNTIES IN PREPARATION OF CHERRY CREEK BASIN
MANAGEMENT PLAN:
The Administrator was asked to draft a letter for Chairman Baumgartner' s
signature to the County Commissioners of Arapahoe and Douglas Counties
and the Mayor of Castle Rock in response to their letter of January 4,
1985, concerning their role in preparation of the Cherry Creek Basin
Management Plan. The Chairman's position statement was to be used as
the framework of the reply.
APPROVAL OF NOTICE OF INFORMATIONAL HEARING FOR TRIENNIAL REVIEW - ARKANSAS,
SAN JUAN AND RIO GRANDE RIVER BASINS:
Commissioner Poticha moved for approval of the Notice of Public
Informational Hearings for Triennial Review of the classifications and
numeric standards of the Arkansas, San Juan, and Rio Grande River
Basins. The motion was seconded by Commissioner Pearson. It was
adopted unanimously.
APPROVAL OF NOTICE OF PUBLIC RULEMAKING HEARING - STORM SEWER REGULATIONS :
Commissioner Poticha moved for approval of the Notice of Public
Rulemaking for consideration of revising the Commission' s regulation
titled: Regulations Prohibiting the Discharge of Certain Wastewaters to
Storm Sewers and Prohibiting Certain Connections to Storm Sewers
(5.1.0) . The motion was seconded by Commissioner Pearson and
unanimously adopted.
SUMMARY OF PROCEEDINGS/MOTIONS FOR JANUARY 7, 1985:
Commissioner Smith moved for approval of the Summary of Proceedings/
Motions for January 7, 1985. The motion was seconded by Commissioner
Kahn and approved unanimously.
APPROVAL OF AGENDA FOR MARCH, 1985, MEETING:
The agenda for March 4 and 5, 1985, proposed by the Administrator, was
accepted by consensus of the Commission.
S .B. 83:
Commissioner Kahn moved that the Commission go into executive session to
discuss the settlement offer regarding litigation in its relation to
Senate Bill 83. The motion was seconded by Commissioner Smith. It was
adopted unanimously.

BASIC STANDARDS TASK FORCE:
Commissioner Foster moved that the Commission go into executive session
for purposes of discussion of selection of subcommittee members for the
Basic Standards Task Force. The motion was seconded by Commissioner
Poticha. Voting against the motion were Commissioners Kahn and
Baumgartner. The motion carried 5 to 2.

MARCH 4 & 5, 1985
The meeting of the Water Quality Control Commission was called to order by
Chairman Baumgartner in Room 150, Colorado Department of Health Building ,
4210 E. 11th Avenue, Denver, Colorado.
MEMBERS PRESENT:
On March 4: Bruce Baumgartner, Linda Burger, Tad Foster, Cynthia Kahn,

Jeffrey Todd was absent. On March 5: the foregoing Commissioners were
present except for Cynthia Kahn and Jeffrey Todd.

APPROVAL OF AGENDA:
The agenda for the March 4th & 5th meeting was approved, as amended.
APPROVAL OF NOTICE OF RULEMAKING, EFFLUENT LIMITATIONS (10.1.0) :
Approval of a Notice of Rulemaking Hearing to consider amendment to the
sampling provisions of the Commission' s regulations for Effluent
Limitations (10.1.0) (5 CCR 1002-3) failed for lack of a motion. To
provide guidance on this matter, the Water Quality Control Division was
directed to report back at the April , 1985 meeting on permit monitoring
for purposes of enforcement , and for discussion of whether an
informational or rulemaking hearing should be set; triennial review
requirements to be considered.
FEDERAL SECONDARY TREATMENT REGULATIONS AND THEIR EFFECT ON STATE EFFLUENT
LIMITATIONS (10.1.0) :
Commissioner Kahn moved that based on the recommendation of Water
Quality Control Division staff that the Commission make no changes in
the State' s Regulations for Effluent Limitations as a result of the
amended Federal treatment regulations. The motion was seconded by
Commissioner Poticha. It was unanimously approved.

PROCEDURE FOR STANDLEY LAKE STANDARD SETTING HEARING:
Commissioner Poticha moved that the hearing date regarding the
classifications and numeric standards of Segment 2 of Big Dry Creek,
Standley Lake, be changed to June 3, 4 and 5, 1985, and that a schedule
be set up with the Commission office to determine the date of the
prehearing conference, with the original instructions on written
testimony from parties to be adhered to but that written rebuttal not be
required before the hearing. The motion was seconded by Tom Smith. The
motion carried on a vote of 5 to 2, with Commissioners Pearson and
Urbonas voting against it.
PETITION AND REQUEST FOR RECONSIDERATION, VARIANCE, HEARING AND ADJUDICATORY
HEARING - WHEATRIDGE SANITATION DISTRICT DISCHARGE PERMIT #0024121:
Commissioner Smith moved and Myrna Poticha seconded a motion to table
this matter until the May, 1985 meeting of the Commission, at the
request of Wheatridge Sanitation District. The motion was unanimously
approved. When it was pointed out that the Commission would not be
meeting in Denver in May, Commissioner Smith moved to rescind his
original motion. Myrna Poticha seconded that motion. It passed
unanimously. Commissioner Foster then moved to table this matter until
the June, 1985 meeting. This motion was seconded by Commissioner
Poticha and was unanimously approved.
RULEMAKING HEARING - IOWA GULCH:
After hearing and deliberation of this matter, Commissioner Smith moved
for the preliminary adoption of a two—year temporary modification for
copper of .05 mg/1 and lead of .05 mg/1 , on Segment 8a , Iowa Gulch,
Arkansas River Basin; all other use classifications and water quality
standards to remain the same and the underlying standards to remain the
same as contained in the present regulation. The motion was seconded by
Commissioner Pearson. It was adopted on a vote of 5 to 2 , with
Commissioners Baumgartner, Burger, Pearson, Smith and Urbonas voting for
the motion and Commissioners Poticha and Foster voting against it.
APPROVAL OF NOTICE OF PUBLIC INFORMATIONAL HEARINGS FOR PACOG, PPACOG AND
REGION 10 208 PLAN UPDATES:
Commissioner Poticha moved for approval of the Notice of Public
Informational Hearings before the Colorado Water Quality Control
Commission for adoption of the 1984 Updates to the Pueblo Area Council
of Governments , Pikes Peak Area Council of Governments , and the District

REQUEST FOR ECONOMIC REASONABLENESS HEARING - METROPOLITAN DENVER SEWAGE
DISPOSAL DISTRICT NO. 1:
Commissioner Pearson moved to table to the Commission's April, 1985
meeting the request for an economic reasonableness hearing submitted by
the Metropolitan Denver Sewage Disposal District No. 1. The motion was
seconded by Commissioner Poticha. It was unanimously adopted. The
Administrator was directed to mail a copy of the Commission' s policy
concerning hearings re permits requiring treatment beyond secondary to
the District.
CLASSIFICATIONS AND NUMERIC STANDARDS FOR RALSTON CREEK, SEGMENT 17 OF CLEAR
CREEK, SOUTH PLATTE RIVER:
Commissioner Pearson moved and Commissioner Burger seconded a motion
granting the request of Marilyn Alkire, counsel for the Cotter
Corporation, for an extension of time from March 11, 1985 to July 1,
1985, within which to submit to the Commission its results and
recommendations concerning appropriate classifications and numeric
standards for Ralston Creek, Segment 17 of Clear Creek, South Platte
River Basin.
