RESOLUTION RE: DENY MOBILE HOME PERMIT NO. 1391 - KIMMEL STOCK HORSES, INCORPORATED, C/O JAMES AND DONNA KIMMEL WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on March 1 , 1988 , a zoning permit for a mobile home to be used as a principal dwelling was administratively approved by the Department of Planning Services staff for Kimmel Stock Horses, Inc. , c/o James and Donna Kimmel, and WHEREAS, on February 10 , 1989 , said permit was invalidated because it was determined that there were not enough signatures obtained on the petition which was circulated by the Kimmels in 1988 , and WHEREAS, because of said invalidation of the permit, the Board, on the 15th day of February, 1989, considered the request of Kimmel Stock Horses, Incorporated, c/o James and Donna Kimmel for a mobile home to be used as a principal dwelling, and WHEREAS, the request was to occupy said mobile home in the A-Agricultural Zone District on a parcel of land being more particularly described as follows: Lot A of RE-518 , part of the SEI , Section 8 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners, after hearing the testimony of those present and reviewing the submitted materials, finds that said request should be denied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Kimmel Stock Horses , Incorporated, c/o James and Donna. I am equally concerned about the appearance of the property, about the precedence potential of letting this type of housing into the area, not to mention the fact that there are already two units on this property, and about how adjoining property values will be affected by this type of housing. As a matter of fact, I visited with the planning commission in September, 1988 regarding this property and was told that it would be investigated and the proper action taken. I never followed up, which is my fault, but, I assumed that things would take their natural slow course and that it would be taken of without further action on my part until I was recently visited by my concerned neighbors-hence this letter. Last year I watched my neighbor to the east very painstakingly remodel a very old, beat-up farm house and grounds into a very attractive country property. I think it's a crying shame to allow this man's efforts to be diminished by permitting trailer-type housing into the area on a permanent basis; interim, short-term housing during construction is understandable but, not for the long term. Kimmel, Mr. Kimmel's property borders my northern and eastern property borders. Mr. Kimmel approached me on February 21,1988. He statedhe would like to move a mobile trailer onto his property as temporary living quarters while he built a permanent house. He also said he would like a second mobile home as a storage building while he built the house. Both mobile homes were to be temporary buildings for use while constructing a permanent house. I agreed there would not be any problem with use of a mobile home as living quarters on a temporary basis and signed his petician. I did not realize the petition I signed read "principal dwelling", but signed on the basis of what Mr. Kimmel told me verbally. I feel, his explanation of the petitionwas misleading. Due to the fact that a permanent mobile dwelling would depreciate our property value, my wife and I are against any permanent dwelling mobile home bordering our property. To this date I have not witnessed any consruction on a permanent dwelling on Mr. Kimmel's mentioned property. It appears, to me, that not only the first mobile home is being occupied, but the second mobile home is also being occupied, rather than "being used for storage". On February 13th, 1988, I was approached by Mrs. Donna Kimmel. Mrs. Kimmel asked me if I would sign a petition for her, giving them permission to place a temporary mobile home on their property at the intersection of Weld County Roads 10 & 29. She explained that the purpose of the mobile home would be for them to live in while they built a new home. She also said that they would like to place another temporary mobile home on the property to store building materials in until completion of their new house at which time both mobile homes would be removed. I also noticed that no where was there mention of a date to remove either mobile home. I expressed to Mrs. Kimmel my reservations as to the wording of the petition. ' She stated that she did not word the petition, that was done by Weld County, and that it meanTwhat she had just explained to me, that it was strictly for a temporary construction trailer. At this point I declined to sign the petition as I felt uneasy about its validity. The Kimmel 's I found out later had asked all nieghbors within 500 feet of their property to sign this petition with the same deceptive statements or statements similar all with the wording "temporary mobile home" for construction purposes. 890173 • My property runs the entire north boundary of theirs, and under no circumstances do I want permanent mobile homes depreciating my property value! The Department of Planning Services' staff administratively approved the application in accordance with Section 43.2.6 and 43.4 of the Weld County Zoning Ordinance on March 1, 1988. A review of this application was initiated after receiving fourteen surrounding property owner's letters indicating a concern regarding the circulation of the mobile home petition by the Kimmels on February 10, 1989. The staff determined that an insufficient number of surrounding property owners were identified in the submitted application. The submitted application material identified 9 surrounding property owners within 500 feet of the property. This list was accompanied by a mobile home petition signed by 7, or 77% of those surrounding property owners. Further review by staff of the Assessor's parcel identification map identified fifteen surrounding property owners within 500 feet of the property. The 7 signatures on the mobile home petition, out of a possible fifteen, represents only 46% of the surrounding property owners instead of the required 702. Because of this discrepancy, the staff considers the administrative review approval of this mobile home _permit invalid. The claim is based on an assertion recently made by Roger L. Mace and Diana M. Mace that they own the mineral rights to the property covered by the policy. The Maces' claim is apparently based on two documents of record: the Deed by which the Maces conveyed the subject property to the Tiltons and an Affidavit recorded May 19, 1988 signed by the Tiltons in which the Tiltons state they did not intend to receive any mineral rights from the Maces, that they did not intend to convey mineral rights to you and that it was their "understanding that [youl did not intend to receive anv -mineral rights" . Amoco has not changed their records to reflect that you own the minerals and are entitled to royalty payments. Amoco also apparently has based its opinion on the Mace to Tilton Deed and the Affidavit. • As discussed in my letter to you of May 25, 1988, the mace to Tilton Deed clearly did not reserve minerals. The Affidavit would not appear to have any legal effect on your interests since it was recorded after you bought the property. However, if you bought the property with knowledge of the Maces' claim or did not intend to purchase the minerals, both your right to the minerals and coverage under your policy would be affected. In addition, the effect of the Affidavit upon your title, if any, is not a matter insured against by the policy since it was recorded after the date of your policy. Under the terms of your policy, Transamerica has a right to take any action we think is necessary or desirable to establish your title to the minerals, whether or not we are liable under the policy. Not only are the mobile homes incompatible with surrounding homes, but there is an unsightly accumulation along the east property line. In the past I had always felt Weld County would not allow such activity, and hereby acknowledge I am against this type of housing in our rural area of well kept homes. I noticed on the petition the written words principal dwelling, and was apprehensive to whether or not principal dwelling meant they could keep the mobile homes on the property perm- anent. I also noticed that no where was there mention of a date to remove either mobile home. I expressed to Mrs. Kimmel my reservations as to the wording of the petition. She st-ated that -she did not ward the petition, that was 'lone by Weld County, and that it -mean what she had just -explained to me, that it was strictly for a temporary construction trailer.
