RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR STORAGE FACILITIES IN THE A (AGRICULTURAL) ZONE DISTRICT - MEREL T. AND VIOLA MEYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 5th day of October, 1988 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Merel T. and Viola Meyer, c/o James A. Gustafson, 1010 9th Avenue, Greeley, Colorado 80631 , for a Site Specific Development Plan and Special Review Permit for storage facilities in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the E} SE* , Section 26 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by James A. Gustafson, Attorney at Law, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 880971 Page 2 RE: USR - MEYER 2 . at is the opinion of the Board of County -Commissioners that the applicant has shown compliance with -Section 24 .4.2 of the Weld County Zoning Ordinance as follows: a) The proposed Special Review permit area is located -within the urban growth boundary areas of the City of Ireeley, City of Evans, and the Town of to Salle. All three municipalities have recommended approval of this request with certain conditions. The location of the Special Review permit area and the attached Conditions and Development Standards make the proposed use consistent with the urban growth boundary goals of the Weld County Comprehensive Blan. b) The proposed use is consistent with the intent of the Agricultural Zone District and the proposed use is provided for as a Use by Special Review. c) The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. The applicant plans to use existing buildings on the site as the storage buildings. d) The use which would be permitted will be compatible with the existing surrounding land uses. Land uses surrounding the site include Weld county Road 35 , Weld County Road 52, crop production, oil and gas processing, rural residences, and a mobile home subdivision. e) The proposed use will be compatible with the future development of the surrounding -area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the county and master plans of the affected municipalities. f) No overlay districts affect the site. g) Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. 880971 Page 3 RE: USR - MEYER NOW, THERE-FORE, BE -IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special -Review Permit for storage facilities in the A (Agricultural) Zone District on the hereinabove described parcel o₹ land be, and hereby is, granted subject to the following conditions: 1 . The attached IDevelopment Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the -property until the Special _Review plat is ready to be recorded in the office of the Weld _County Clerk and Recorder. 3 . Prior to recording, the Special Review permit plat shall be amended to show -a 50-foot right-of-way reservation from the centerline of Weld County Road 35 (35th Avenue) and Weld County Road 52 (49th Avenue. ) 4 . Prior to operation of the storage facility: a) Any poultry, waste, manure, or associated materials shall be removed from tee site. b) An ISDS evaluation shall be performed on the existing septic system and a septic permit shall be obtained. c) Any materials constituting a non-commercial junk yard shall be removed from the site. 5 . The Special Review permit is for a Site Specific Development Plan and a Special Review permit for storage facilities in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . Any liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent siisposal of wastes shall be permitted at this site. 5 . Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. All items stored outside of the buildings shall be screened from public rights-of-way and adjacent properties. 7 . The buildings to be leased on the Special Review permit site shall not be divided _into mini-storage units. Partitions dividing the two larger buildings in half shall be allowed only with the proper permits. However, no entrance changes to the buildings shall be allowed. 8 . All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 880971 Page 2 RE: DEVELOPMENT STANDARDS - MEYER 11 . Personnel from the Weld County Health Department, La Salle Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards . Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 14 . Normal hours of operation shall be from 7 :00 a.m. to 7 :0_0 p.m. 15. AND VIOLA MEYER A public hearing was conducted on October 5, 1988, at 2:00 P.M. , with the following present: Commissioner Gene Brantner, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Lanell Curry The following business was transacted: I hereby certify that pursuant to a notice dated September 14, 1988, and duly published September 21, 1988, in the Platteville Herald, a public hearing was conducted to consider the request of Merel T. and Viola Meyer for a Site Specific Development Plan and Special Review Permit for storage facilities in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Curry, representing the Department of Planning Services, entered the favorable recommendation of the Planning Commission, subject to five Conditions and 14 Development Standards, into the record. Ms. Curry also made it of record that the location of the proposed facilities incorrectly states that it is west of Weld County Road 25, and it should read that it is west of Weld County Road 35. James A. Gustafson, Attorney representing the applicants, submitted the Certificate of Proper Posting and then gave his presentation. He said there are eleven buildings with each building to be leased to separate individuals. Cindy Hazier, a neighbor, requested that a restriction limiting the storage facility to current buildings in their present design so they cannot be made into mini-storage sheds be added to the Development Standards. She also asked that Condition No. 4, which states in part that any poultry shall be removed from the site, be amended to read that while the operation is in use for -storage facilities, no poultry will be returned to the premises. Ms. Curry said she feels these concerns are addressed in the Conditions and Development Standards. If any changes are to be made the applicants must aptly for an amendment to the Special Review Permit. Lillian Straight, the previous owner of this property, asked if this operation will change the zoning on the remainder of the farm. The Board responded in the negative. Mr. Gustafson again came forward and said he would like to be -assured that although there will only be eleven lessees, each of these individuals may sublet part of the building which he is leasing. He used as an example, a lessee subletting to members of a car club for storage of their antique cars in these buildings. Randy Meyer, son of the applicants, made comments concerning the subletting of the buildings and also making smaller units in some of the buildings. Ms. Curry read into the record a suggested Development Standard which addresses the matter -of dividing the larger buildings. Mr. Meyer did not agree with the Standard as stated. She said neither the staff nor the Planning Commission realized that the intent was to divide the buildings. Mr. Meyer said the only construction would be the partitions in the larger buildings. (TAPE CHANGE #88-49) Following discussion, Ms. Curry suggested that the Board adopt Development Standard No. 7, moving the current Standards down with the present No. 7 becoming No. 8, and so on. She said proposed Standard No. 7 would read as follows: "The buildings to be leased on the Special Review Permit site shall not be divided into mini-storage units. Partitions dividing the two larger buildings in half shall be allowed with the proper permits. However, no entrance changes to the buildings shall be allowed." Merel Meyer, the applicant, made further comments concerning the leasing of the buildings. Commissioner Lacy moved to approve this Use by Special Review permit for Merel T. and Viola Meyer subject to the recommended Conditions and Development Standards with the addition of Standard No. 7, moving the others down. Commissioner Kirby seconded the motion and it carried unanimously. This Certification was approved on the 10th day of October, 1988. Meyer and Viola Meyer In compliance with the Weld County Department of Planning Services staff's recommendations made during the meeting of the Weld County Planning Commission on September 6, 1988, applicants supplement their use by special review application to address the concerns about the estimated traffic that will take place to use the storage facilities and to set forth a plan for securing access to the storage facilities. It is the applicants' plan that the eight stucco buildings on the east side of the site, the stucco shed that is in the southwestern corner of the site with the dimensions of 24.7 feet by 60.4 feet, and the metal building in the northwesterly corner of the site with the dimensions of 199.8 feet by 40 feet, will be rented out to one individual or one entity and that the building will be locked and one key will be given to the person or entity who is renting the storage facility and one key will be kept by the applicant. At this time applicants estimate that the daily traffic to and from the storage site will be less than twenty trips. The normal hours of operation will be from 7:00 a.m. to 7:00 p.m. each and every day of the year with a condition set forth in each lessee's rental agreement that any other access necessitates advance notice be given to the applicants. Applicants will allow access to these storage facilities during hours other than the normal hours of operation when an exceptional circumstance requires it. The applicants do not see any need to install a chain link fence or gate at the entry of the storage site because applicants own agricultural land to the east and north of the storage sites that is being leased to a tenant that requires the tenant to travel through the same entryway that will be used for the storage sites to get to and from the farmland. A chain link fence and gate with a lock on it would unduly interfere with the tenant's farm operations. Applicants do not anticipate people who are not leasing these storage units or who are involved with the farming operations on their property will be traveling in and out of their property from the entryway on 49th Street. Access to the individual storage sites should be limited by the individual locks on each storage facility. If someone suspicious does enter the storage site area the person renting the stucco house on the premises will be instructed by the applicants to notify the appropriate authorities. It is the applicants' plan that the eight stucco buildings -on the east side of the site, the stucco shed that 'is in the southwestern corner of the site with the dimensions of 24.7 feet ±y 60.4 feet, and the metal wilding in the northwesterly corner of the site with the dimensions of 199.8 feet by 40 feet, will be rented out to one individual or one entity and that the building will be locked and one key gill be given to the -person or entity who is renting the storage facility and one key will be kept by the applicant. At this time applicants estimate that the daily traffic to and from the storage site will be less than twenty trips. The normal hours of operation will ire from 7:00 a.m. to 7:00 p.m. each and every day of the year with a condition set forth in each lessee's rental agreement that any other access necessitates advance notice _be given to the applicants. Applicants will allow access to these storage facilities during hours other than the normal hours of operation when an exceptional circumstance requires it. The applicants do not see any need to install a chain link fence or gate at the entry of the storage site because applicants own agricultural land to the east and north of the -storage sites that i-s being leased to a tenant that requires the tenant to travel through the same entryway that will be used for the storage sites to get to and from the farmland. A chain link fence and gate with a lock on it would unduly interfere with the tenant's -farm operations. A detailed description of proposed operation and use: (a) There are nine existing poultry buildings, a dugout building, a residence and a shed southwest of the residence that is approximately 80 feet by 20 feet that will be buildings associated with this general storage use. The majority of these items will be stored inside the buildings to protect them from the elements. If outside storage is utilized between the eight northerly buildings then fences will be installed between the ends of the buildings to keep the items stored enclosed within the area between the buildings. It should further be noted that only the roofs of these eight northerly buildings are visible from 49th Street. If this use is granted then the poultry business that was previously conducted in these buildings will be discontinued. (b) The proposed storage use is requested by the applicants so that the poultry business can be discontinued. This change of use of the buildings will result in a use that is quieter and less malodorous. The proposed use will also supplement the applicant's income. (c) The types of existing uses on surrounding properties are as follows: (i) To the north of the subject property there is an agricultural use. (ii ) To the south of the subject property there are four existing single family residences and agriculture. (iii) To the west of the subject property there is Hill-N-Park mobile home park. (iv) To the east of the subject property there are radio towers and a separator for Associated Natural Gas, Inc. 8863 71 APPLICATION Page 2 (d) The distance of the proposed use to residential structures are as follows : (i) The distance of the proposed use to residential structures to the north is approximately + 2000 feet. (ii) The distance of the proposed use to residential structures to the south is approximately 150 feet. (iii ) The distance of the proposed use to residential structures to the west is approximately 650 to 700 feet. (iv) The distance of the proposed use to residential structures to the east is approximately + 260D feet. (e) At the present time the only employees needed to operate this proposed use will be the applicants Merel T. Meyer and Viola Meyer. There may be times when the applicants request their son, Randy Meyer, to assist them. There may be a slight possibility in future years that the tenant of the residence located on this parcel may be employed to assist the applicants to operate this proposed use. At the present the tenant of this residence will not be in any way associated with the storage facilities. There will not be any shifts and people using these storage facilities will have access to them whenever they find a need for such access. This proposed use will require no type of water even though the residence previously mentioned has City of Greeley water available if it is needed. (f) The access routes for ingress and egress to be utilized for the proposed use will be 49th Street. (g) The types, size, weight and frequency of vehicular traffic associated with the proposed use will be vehicles that range from the size of semi-tractor trailers of approximately 70 ,000 gross vehicular weight to 2-3 axle farm trucks of approximately 50 ,000 gross vehicular weight to light trucks pulling trailers and boats of approximately 8 ,000 gross vehicular weight to motor vehicles carrying personal property. It is anticipated that normal frequency of vehicular travel to and from these storage units will be once per week per user, however, applicants will allow users of such storage facility, unlimited access. The diversity and nature of the uses for these storage facilities make it necessary to allow the users of such facilities unlimited access to them. 880971 APPLICATION Page 3 (h) There should be no necessity for any sewage facilities for this proposed use, however, if it is needed, there is a septic system in the residence located on this parcel. (i ) There are no additional fire protection measures being considered for the proposed use. These storage facilities are located within the LaSalle Fire Department and it has a response time of approximately 5 1/2 to 6 minutes. The eight buildings located in the northerly part of this parcel have, at the minimum, 25 feet _ between the structures and the other buildings have 100 feet between them. This distance between the structures also lends some fire protection. ( j ) There will be no animals that will be associated with the proposed use. (k) There should be no waste stockpile associated with the proposed use. The eleven buildings that will be used as storage areas are fully enclosed. There are seven other buildings located upon the parcel for the proposed use that will not be used for commercial purposes by the applicants. The applicants will, however, use these seven structures to store their own personal property. (1) There is no proposed type of storm water retention facilities associated with the proposed use because eight of the storage units are located upon a ridge. Any storm water would gravity flow away from these storage facilities and flow to the Ashcroft draw. (m) Applicants plan of removing and disposing of debris, junk and other waste associated with the proposed use by personally taking it to the Weld County Landfill or by having a commercial trash company remove or dispose of it. (n) There is no proposed change in the landscaping plans or erosion control measures associated with the proposed use because the facilities are located upon and in the area of irrigated natural grass. There are also trees located in the area of the proposed use. The present landscaping is appealing enough to the casual observer that no changes in the landscaping should be necessary. (o) There should be required no reclamation procedures to employ with this use because the proposed use will in no way, damage or change the property. 880.1971 APPLICATION Page 4 (p) There should be no time table showing periods of time required for construction of the building facilities because said units are already in place. The applicants anticipate starting up the proposed use as soon as it is approved. 3. Materials and supporting documents submitted as a part of this application: (a) The proposed use of turning nine poultry buildings, the dugout building and the storage shed into eleven commercial storage facilities is consistent with Weld County Comprehensive Plan because the type of travel associated with the proposed use will not be any greater in frequency than its previous travel associated with the poultry business ; the closeness of this proposed use to Hill-N-Park will offer a quieter and less malodorous use than poultry business ; and no new construction will be necessary to implement the proposed storage facility use. (b) In preliminary discussions with city officials for the City of Evans, it has been indicated that the proposed use is consistent with the intent of the plans for this area for the City of Evans because the proposed use is a quieter and less malodorous use than the poultry business which was previously conducted on this property. The parcel in question is also outside the long-range growth area of the City of Evans at the present time but it is within its' review area. The city manager of Evans stated on a preliminary basis, with the facts he had in front of him, that the proposed use does not appear to be incompatible with the future growth or land uses even through this proposed use is not a low density residential use.In preliminary discussions with employees of the Planning Department for the City of Greeley, it has been said that the parcel in question is outside the long-range growth area, however, it is within the three mile review area. The Planning Department for the City of Greeley is not encouraging service commercial use or light industrial use in this area, but because the distance of the proposed use from the City of Greeley, the Planning Department is not indicating an opinion against the service commercial use that is being requested herein. (c) Since the proposed use actually has less noise and less odor involved with it compared to the previous poultry business that was conducted on this parcel, it is the applicants' belief that this proposed use will better serve the health, safety and welfare of the inhabitants of the neighborhood and Weld County. 880971 APPLICATION Page 5 (d) The proposed storage use for these eleven buildings will be compatible with the existing surrounding land uses because the present land uses are as follows : (i ) To the north of the subject property there is an agricultural use. (ii ) To the south of the subject property there are four existing family residences and agriculture. (iii ) To the west of the subject property there is Mill-N-Park mobile home park. (iv) To the east of the subject property there are radio towers and a separator for Associated Natural Gas, Inc. (e) The proposed storage use will be compatible with future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of Weld County and the adopted master plan of the City of Evans because the structures are already in existence and the new use will not create any visible increase of traffic on 49th Street. The proposed use will also be quieter and create less odor than the previous poultry business. See number 3. (b) for more information. (f) The use by special review are is not located in a flood plain, geological hazard or the Weld County Airport overlay district area. (g) Attached hereto marked as Exhibit A and made a part hereof by reference is a letter from the City of Greeley evidencing that the water supply will be available which is adequate in terms of quality, quantity and dependability for the proposed use. (h) Attached hereto marked as Exhibit B is a deed identifying the applicants' interest in the property under consideration. (i ) The proposed storage use does not require a noise report by the Department of Planning Services and, therefore, one is not submitted herewith. ( j ) A soil report of the site for the proposed use is incorporated in the plot plan and vicinity map prepared by Jasper Freese. There are also soil survey attachments compiled by the United States Department of Agriculture, Soil Conservation Service, marked as Exhibit C which should be incorporated herein and made a part hereof by reference.
