RE: DECLARE CERTAIN EQUIPMENT AS SURPLUS AND ACCEPT BID
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Administrative
Manual require that all items disposed of be declared surplus by
the Board of County Commissioners, and
WHEREAS, the County has identifed that a 1981 65D Bucyrus
Erie Dragline, Serial No. 140219 , County Fixed Asset No. 15870004,
is no longer needed by Weld County, and
WHEREAS, bid requests were sent out concerning said dragline,
with bids being returned by three companies, and
WHEREAS, the bids were opened at the Board meeting of April
29 , 1987 , and the high bid, in the amount of $95 ,000. 00 , was
received from Gollaway Equipment, Inc. , 5555 Dahlia, Commerce
City, Colorado, and
WHEREAS, pursuant to the bid policies, an oral bid was
conducted, but the representatives declined to participate, and
WHEREAS, the Board deems it advisable to declare said
dragline as surplus property, and
WHEREAS, the Board further deems it advisable to accept the
high bid submitted by Gollaway Equipment, Inc.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described dragline be, and hereby is, declared surplus property.
BE IT FURTHER RESOLVED by the Board that the bid submitted by
Gollaway Equipment, Inc. , in the amount of $95 , 000 . 00 , for said
dragline be, and hereby is, accepted.

The undersigned having become familiar with the Instruction to Bidders for
the Sale of the 65D Bucyrus Erie dragline, hereby proposes to purchase from
Weld County the equipment as follows:
Description:
65D Bucyrus Erie Dragline
Serial No. 140219, 80 Foot boom and two 3} yard buckets
Amount of bid $ 95.000.00
The undersigned has enclosed certified funds in the amount of $ 9 500 00
which is 10% of the bid price. If the successful bidder, the remainder of
the purchase price shall be paid within seven days of bid award. Purchaser
is responsible for all costs for removal and shipping of equipment. Title
transfer will take place at time of receipt of full payment.
It is understood that the Board of Weld County Commissioners reserves the
right to reject any or all bids, to waive any informalities in bids, and to
accept the bid that, in the opinion of the Board, is to the best interests
of the Board and of the County of Weld, State of Colorado.
It is also understood that this bid form is legal and binding and no other
contract submitted by the bidder for signature shall override any of the
content of this contract.
