RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A GREYHOUND KENNEL - CHARLES AND MARIAN MORRIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of August, 1986 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Charles and Marian Morris , 9158 Weld County Road 49 , Hudson, Colorado 80642, for a Use by Special Review for a greyhound kennel on the following described real estate, to-wit : Nh 5' SWa, Section 18 , Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. 860775 Page 2 RE: USR, MORRIS c. The activities proposed will be compatible with existing agricultural uses as well as with the future projected development in the immediate area. The future _uses are intended to remain agricultural in nature. The intended proposal will not have any significant traffic or noise impacts. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate -protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the -Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a greyhound kennel on the hereinabove described parcel of land be, and -hereby is , granted subject to the following conditions: 1 . The attached Standards for the Use by Special Review be adopted and placed on the Use by Special -Review plat prior to recording. 2. The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the lgeld County Clerk and Recorder. 3. The applicant shall reclassify the existing well, permit No. 75970 , for a commercial use and present a copy of the new well classification to the Department of Planning Services. The applicant shall submit evidence to the Department of Planning Services that water is available in adequate quantity and quality for the proposed use. 4 . The uses permitted shall be a kennel facility for a maximum of one hundred fifty (150) greyhounds as submitted in the application materials on file in the Department of Planning Services. 2. The greyhound kennel shall comply with the Colorado Racing Commission' s Greyhound Racing Rule Book, Section 17, if racing is to be conducted at the Use by Special Review facility. 3. The applicant shall implement the approved revegetation and soil erosion control plan prior to starting the greyhound kennel operation. 4 . A separate septic system shall be installed for the kennel facility per the requirements of the Weld County Environmental Health Department. 5 . The applicant shall comply with the design standards for the Use by special Review, Section 24. 5 et seq. , of the Weld County Zoning Ordinance. 6 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24. 6 et seq. , of the Weld County Zoning Ordinance. 7 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated herein and all applicable Weld County Regulations . 8 . The Use by Special Review area -shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall -require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of -Planning Services. 9 . The property owner and/or operator of this operation shall to responsible for complying with all of the above stated Standards . The kennel area shall be entirely enclosed by a five-foot fence with a two-foot addition and three-strand wire top. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated July 21, 1986, and duly published July 24, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request for a Use by Special Review for a greyhound kennel from Charles and Marian Morris. Lee Morrison, Assistant County Attorney, made this matter of record. Chairman Pro-Tem Lacy informed the applicants that, since only three Commissioners were present, they could request that this matter be continued until a full Board is present. The applicants chose to proceed today. Gloria Dunn, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record, saying that there are four Conditions and ten Operation Standards associated with this request, which was originally heard by the Planning Commission in October, 1984. Charles Morris, one of the applicants, came forward to answer questions of the Board. Mr. Morris said he has no problem with the Condtions and Standards as proposed. Considerable discussion was held on proposed Operation Standard 1110 concerning the design of the fence surrounding the kennel area. Commissioner Brantner moved to amend Operation Standard #10 to read, "The kennel area shall be entirely enclosed by a five-foot fence with a two-foot addition and three-strand wire top. The exercise area shall be enclosed by a six-foot fence." Commissioner Kirby seconded the motion which carried unanimously. Commissioner Kirby moved to approve the request of Charles and Marian Morris for a Use by Special Review for a greyhound kennel, with the Conditions and Operation Standards as amended. Commissioner Brantner seconded the motion and it carried unanimously. This Certification was approved on the 11th day of August, 1986. The water is adequate to serve this request, but they will need to have the well reclassified to commercial use. The property is currently seeded to grass and he intends to leave it in grass to keep the soil from blowing. He will only raise and train greyhounds on this property; no dogs will be raced from the property. Therefore, they did not think this operation would fall under the greyhound racing guidelines. The Chairman asked Rod Allison to read the recommendations, conditions, and operation standards into the record. The Chairman called for discussion from the audience. James Sloan and Susie Bratrsovsky, surrounding property owners, appeared in opposition to this request. Rod Allison amended Condition #3 to read as follows: 3. Care should be used to keep any bare -area small . Should the exercise area be extensively used, trampling could eliminate existing vegetation. A wind barrier is effective for about ten times their height. Such a barrier may be needed on the north and west side of the dog runs and exercise field. Also if some vegetation could be maintained inside the ex- ercise field it would help to reduce any possible wind erosion. A Laramie-Fox Hills domestic well exists on site, permit no. 75970. This permit does not allow_for the commercial use in a kennel operation. Also, the permit limits use to one acre—foot per year which is not sufficient for the watering of 250 animals, household use, and irrigation. The applicant could, however, obtain either a new permit for the existing well or a permit for a new well which would allow sufficient water for the proposed expanded use. My wife and I would like to build a greyhound kennel for a maximum of 250 animals. This includes males,. females and puppies, which is all our own stock which we raise, train and race in Colorado and surrounding states. The surrounding properties bordering our property is zoned agricultural and is dry land. The distance from the proposed kennel property to any residential house to the south is approximately one quarter mile; to the west, approximat-ely one half mile; to the north, approximately one quarter mile. We plan to kennel our own dogs only and not to employ any outside help. We have a domestic well that was drilled Auugst 28, 1976. The well was logged 690' deep and has a water level of 280' . The number on the well is 1-62-075970 and the annual appropriation is one acre foot. The present access drive would be used to enter and exit the property which connects Weld County Road 49. The view to the south and north when entering Road 49 from the property is approximately one half mile and Road 49 is blacktopped. A pickup would be used to transport the dogs. A septic system is now installed on the property and the waste from the dogs would be hauled off in a dumpster. The kennel would meet all Weld , County and State fire codes plus the fire codes of the Colorado Racing Commission and other requirements the Commission requires. The Hudson Fire Department would handle this location. There would not be enough change in the land, such as cement or asphalt to warrant installing any storm water retention facility. This ground is not being used to any advantage at present. This home and kennel would improve and enhance this fory acres. Since the manure would be disposed of daily and the dogs kept in the i1 kennel or a fenced run, there would be no health or safety problems to the inhabitants of the neighborhood. This ground is not located in a Flood Plan geologic hazard or Weld County Airport overlay district area.
