HomeMy WebLinkAbout850620.tiff RESOLUTION RE: APPROVAL OF AMENDMENTS TO USE BY SPECIAL REVIEW DEVELOPMENT STANDARDS - JAMES McDONALD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of May, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of James McDonald, 11940 West Independence , Golden, Colorado 80401 , for amendments of Use by Special Review Development Standards on the following described real estate, to-wit: Part of the E1/2 W1 SW4, Section 25 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, WHEREAS , only four Commissioners were present at this hearing, and the vote taken resulted in a tie; therefore, it was determined that the absent Commissioner, C.W. Kirby, would listen to the tapes concerning this hearing and cast the deciding vote on June 17 , 1985 , and WHEREAS, at the Board meeting of June 17 , 1985 , Commissioner Kirby cast a favorable vote and it was determined that this request be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: 41 Page 2 RE: AMEND DEVELOPMENT STANDARDS - McDONALD a. The proposal is consistent with the Comprehensive Plan and is consistent with the intent of the Agricultural Zone District. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The use is both compatible with existing agricultural activities and with any future agricultural use as identified in the Comprehensive Plan. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for amendment of Use by Special Review Development Standards on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The Use by Special Review plat shall be submitted to the Department of Planning Services within thirty days from the date of approval by the Board of County Commissioners. The plat shall be amended to include legal descriptions for the five property owners to the west of the Use by Special Review area who are requesting private access to the area. 3. Additional building or electrical permits shall not be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. McDonald Amended USR-537 :85 : 14 1 . The uses permitted shall be an airport for no more than twenty-five airworthy aircraft and an antique museum. Structures on the facility are limited to the following: Two hangars; one accessory mobile home used as an office and residence for security purposes; sixteen portable T hangars; one maintenance building; one shop and trailer used in conjunction with the parachute jump operation; three sheds; and one enclosed airplane salvage and equipment storage area. The uses are described in application materials filed with the Department of Planning Services. 2. The Use by Special Review Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3 . Separate toilets shall be installed for each sex at the rate of two for the first one hundred persons and one for each additional one hundred persons, or fraction thereof. 4 . Two public accesses for the airport from Weld County Road 16 to the site shall be maintained. Said accesses shall be clearly labeled on the property. 5 . The hangar shall be used strictly for the storage, maintenance, and repair of aircraft and aircraft equipment. Maintenance and repair of aircraft shall be permitted only between the hours of 8 : 00 a.m. and sunset for uses which create noise and/or vibration noticeable at, or beyond the property line. 6 . Hours of operation for the airport operation shall be from dawn to sunset, but no later than 8 : 00 p.m. 7 . Trash and refuse shall be removed from the property regularly. All trash not removed shall be stored inside a building or an enclosed container to prevent blowing of refuse onto surrounding properties. 8 . A four strand barbed wire fence shall be constructed along the entire west side of the property with five private access points for use by the following adjacent properties: 7352 Weld County Road 11 ; 7402 Weld County Road 11 ; 7462 Weld Page 2 OPERATION STANDARDS - McDONALD County Road 11; 5053 Weld County Road 16 ; and 5059 Weld County Road 16 . The accesses may be used for ingress and egress for aircraft and vehicles. The property owner(s) and/or operator (s) of the airstrip shall be responsible for maintaining the fence and keeping it in good repair and free from debris . The fence shall be constructed within sixty days of the date of approval by the Weld County Board of County Commissioners. 9 . A sign shall be posted on the property containing the limitations as to use, including hours of operation, and number of airworthy aircraft permitted. 10 . A parking area of sufficient size to park one hundred vehicles shall be located on the property. Other parking areas may be allocated for the use of the operators of the planes in storage in the hangars. The parking areas shall conform to the requirements of Section 41 . 1 . 3 of the Weld County Zoning Ordinance. No parking shall be allowed on Weld County Road 16 . All traffic shall be controlled within the confines of the property. 11 . The building and fuel storage plans shall conform with the Longmont Fire Protection District requirements. 12 . A storage tank of sufficient size to hold 3 ,500 gallons of water shall be maintained on the property for fire protection of the property. The storage tank shall have the approval of the Longmont Fire Protection District. 13 . The gas pumps shall be approved by the Longmont Fire Protection District. 14 . The owner/operator shall maintain a ditch for traffic control on the south side of the property. 15 . Aircraft designed to be used for the museum shall be displayed in the designated areas on the plat. 16 . Junk aircraft shall not be stored on the property except within the screened area provided by the solid security fence. The security fence shall also enclose all aircraft salvage parts and aircraft maintenance equipment kept on the site. Junk automobiles or other junk vehicles shall not be stored on the property. A junk car or vehicle shall be construed to be any dismantled, unlicensed or inoperative vehicle. Page 3 OPERATION STANDARDS - McDONALD 17 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. 18 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 19. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 20. Representatives or members of the Weld County Health Department, Longmont Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 21 . The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. HEARING CERTIFICATION DOCKET NO. 85-31 RE: AMENDMENT OF USE BY SPECIAL REVIEW DEVELOPMENT STANDARDS - JAMES M. McDONALD A public hearing was conducted on May 29, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby - Excused Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated May 15, 1985, and duly published May 16, 1985, in the Johnstown Breeze, a public hearing was conducted to consider amendment of Use by Special Review Development Standards 1, 5, 6 and 8 and the addition of new Development Standards for James M. McDonald. Chairman Johnson informed the applicant that only four Commissioners were present and, should this hearing end with a tie vote, the absent Commissioner would review the record and listen to the tapes of this hearing before casting the deciding vote. Lee Morrison, Assistant County Attorney, made this matter of record and stated that the only items being considered are the proposed changes and additional Development Standards. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. James McDonald, the applicant, came forward to answer questions of the Board. He requested that the word "unlicensed" be stricken from the definition of junk vehicles in Operation Standard #16. Mr. Morrison researched this matter and reported that the word "unlicensed" should remain. Commissioner Lacy reviewed items shown on the plat submitted with this application. Jim Westervelt, an adjacent property owner, came forward and asked questions concerning the proposed changes to the Operation Standards. Ms. Dunn read the current Operation Standards and the proposed changes into the record. Chuck Stewart, Helen Jubenville and Ed Berson made comments concerning this matter. Chairman Johnson asked for a review of the status of this application and Rod Allison, Planning Department representative, presented a summary of recent action concerning this Use by Special Review. Commissioner Lacy moved to approve the Amendments to the Use by Special Review, with the 21 Operation Standards as recommended by the Planning Commission. Commissioner Brantner seconded the motion. Chairman Johnson voiced concerns about the accesses and stated that she would vote against this motion. (Tape Change #85-41) On a roll call vote, Commissioners Brantner and Lacy voted aye and Chairman Johnson and Commissioner Yamaguchi voted nay. Commissioner Kirby will review the record and listen to the tapes of this hearing before casting his vote at the regular Board meeting on June 17, 1985. McDonald REQUEST: Amend Development Standards 1 , 5, 6, 8, and add Development Standard 17 for a Use by Special Review Permit for an airport. LEGAL DESCRIPTION: Part Els Wks SW'-a, Section 25, T2N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: 1/2 mile west of Frederick on Weld County Road 16. Gloria Dunn explained that the applicant is wanting to change the number of planes permanently based there from twelve to twenty—five; the structures on the property are now clearly defined; increase the accesses to the west to five, to allow the five property owners to the west private access from their property; change the hours of operation from sunup to sunset; and to repair aircraft commercially. APPEARANCE: James M. McDonald, applicant and property owner, reported the airport has been in existence for many years, but he obtained a Special Use Permit to operate the airport in 1968. The runway is quite short and therefore, limits the size of planes that can use it. Rod Allison reported the staff has received only one objection to this proposal. The use of the airport has been expanded and this is an attempt to bring what is actually going on there into conformance with the standards as outlined by the staff. The Chairman asked Mr. McDonald if he had read the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff. He stated he had and has no objections to anything as outlined. The Chairman called for discussion from the audience. Helen Jubenville, surrounding property owner, stated she objects to the change of hours the airport can be in operation. It was her feeling each persons interpretation of sundown are different, and she does not feel the hours should be expanded. Ed Verson, surrounding property owner, spoke in support of this request. He stated the runway does not have any lighting, therefore, hours of operation are limited to daylight hours. The Planning Commission discussed the definition of junk and inoperative vehicles. MOTION: Jack Holman moved the new proposed Operation Standard #6 be eliminated and that the hours of operation refer back to the old Operation Standards. Motion seconded by Sharon Linhart. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the Planning Commission for their decision. Motion carried unanimously. Rod Allison amended Operation Standard #16 to read as follows: 16. Junk aircraft shall not be stored on the property except within the screened area provided by the solid security fence. The security fence shall also enclose all aircraft salvage parts and aircraft maintenance equipment kept on the site. Junk automobiles or other junk vehicles shall not he stored on the property. A junk car or vehicle shall be construed to be any dismantled, unlicensed or inoperative vehicle. MOTION: Sharon Linhart moved Operation Standard 1/16 be amended to read as amended by the staff. McDonald to amend Operation Standards 1, 5, 8, and add a new Operation Standard #17 for a Use by Special Review Permit for an airport be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendations, conditions, and Operation Standards as outlined by the staff and amended by the Planning Commission, and the testimony heard by the Planning Commission. Motion seconded by Sharon Linhart. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Lydia Dunbar - No, because he wanted permission for a mobile home to be used as an office and living quarters to better control activities at the airport. It appeared that there would be someone on site to manage the airport. Now, at the hearing, the testimony of the applicant is not supporting this. Paulette Weaver - yes; Jack Holman - Yes, but we do need to continue to look at the Operation Standards and see that the applicant is abiding by them. Sharon Linhart — yes; Bob Ehrlich — no. The uses permitted shall be an airport for no more than twenty-five (25) airworthy aircraft and an antique museum. Structures on the facility are limited to the following: Two (2) hangars; one (1) accessory mobile home used as an office and residence for security purposes; sixteen (16) portable T hangars; one (1) maintenance building; one (1) shop and trailer used in conjunction with the parachute jump operation; three (3) sheds; and one (1) enclosed airplane salvage and equipment storage area. The uses are described in application materials filed with the Department of Planning Services. 2. The Use by Special Review Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. Separate toilets shall be installed for each sex at the rate of two (2) for the first one hundred (100) persons and one (1) for each additional one hundred (100) persons, or fraction thereof. 4. Two (2) public accesses for the airport from Weld County Road 16 to the site shall be maintained. Said accesses shall be clearly labeled on the property. 5. The hangar shall be used strictly for the storage , maintenance, and repair of aircraft and aircraft equipment. Maintenance and repair of aircraft shall be permitted only between the hours of 8:00 a.m. and sunset for uses which create noise and/or vibration noticeable at, or beyond the property line. 6. Hours of Operation for the airport operation shall be from dawn to sunset, but no later than 8:00 p.m. 7. Trash and refuse shall be removed from the property regularly. All trash not removed shall be stored inside a building or an enclosed container to prevent blowing of refuse onto surrounding properties. 8. A four (4) strand barbed wire fence shall be constructed along the entire west side of the property with five (5) private access points for use by the following adjacent properties: 7352 Weld County Road 11; 7402 Weld County Road 11; 7462 Weld County Road 11; 5053 Weld County Road 16; and 5059 Weld County Road 16. The accesses may be used for ingress and egress for aircraft and vehicles. The property owner(s) and/or operator(s) of the airstrip shall be responsible for maintaining the fence and keeping it in good repair and free from debris. The fence shall be constructed within sixty (60) days of the date of approval by the Weld County Board of County Commissioners. Operation Standards Amended SUP-537:85: 14 James M. McDonald Page 2 9. A sign shall be posted on the property containing the limitations as to use, including hours of operation, and number airworthy aircraft permitted. 10. A parking area of sufficient size to park one hundred (100) vehicles shall be located on the property. Other parking areas may be allocated for the use of the operators of the planes in storage in the hangars. The parking areas shall conform to the requirements of Section 41 . 1.3 of the Weld County Zoning Ordinance. No parking shall be allowed on Weld County Road 16. All traffic shall be controlled within the confines of the property. 11. The building and fuel storage plans shall conform with the Longmont Fire Protection District requirements. 12. A storage tank of sufficient size to hold three-thousand-five-hundred (3,500) gallons of water shall be maintained on the property for fire protection of the property. The storage tank shall have the approval of the Longmont Fire Protection District. 13. The gas pumps shall be approved by the Longmont Fire Protection District. 14. The owner/operator shall maintain a ditch for traffic control on the south side of the property. 15. Aircraft designed to be used for the museum shall be displayed in the designated areas on the plat. 16. Junk aircraft shall not be stored on the property except within the screened area provided by the solid security fence. The security fence shall also enclose all aircraft salvage parts and aircraft maintenance equipment kept on the site. Junk automobiles or other junk vehicles shall not be stored on the property. A junk car or vehicle shall be construed to be any dismantled, unlicensed or inoperative vehicle. 17. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncomplinace with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. 18. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. Operation Standards Amended SUP-537:85: 14 James L. Representatives or members of the Weld County Health Department, Longmont Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 21. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any materials deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. ADDITIONAL COMMENTS The Department of Planning Services has not yet received a response from the Tri-Area Planning Commission regarding this request. They will review the application at their May 7, 1985, meeting and forward their recommendation to the Board of County Commissioners for its consideration. McDonald proposed land development. We have no conflicts or reservations with this plan although there are a few things that we should bring to your attention: 1. The soil is Olney fine sandy loam. It has a low shrink- swell potential and the pH is neutral to alkaline (6.6 8.4) . It has a low frost action potential and bedrock is greater than 60 inches deep. According to the Weld County soil survey, Olney soils are not located on a flood plain and the water table depth is more than 6 feet. 2. Building and construction limitations are slight and should pose no problems. However, this soil does have a rapid permeability rate which prohibits sewage lagoon construction due to water table pollution problems. Also, Olney soils tend to corrode steel rather quickly but pose no problems on concrete. Limitations are slight for shallow excavations, dwellings with and/or without basements, small commercial buildings, septic tanks and absorption fields. Renner,Chair In response to your letter of June 25, 1985, concerning an application of James McDonald, which you acted upon some 20 days previously, y our findings were unfavorable for several reasons and you wish to go on record. I, too would like to go on record. Let' s take it from the top. Since 1973 I have enjoyed the hospitality of Jim McDonald. Keeping my air- plane on or near his airport. I got my pilots license flying from this air- port. In 1977, prior to purchasing this property (7462 WCR 11) I made two trips to the Weld County Courthouse exploring zoning, use, covenances, easements, variances etc. Part of my findings were: Zoned Agriculture, with certain limits, No restrictions on vehicles, machinery, or equipment, Road easements North and South and East and West, (book 86 page 273) Pole line easements N&S And E&W (book 833 page 432). Also my title policy excludes among other things, ALL EXISTING ROADS, hiways, ditches, utilities etc. An aerial photograph of section 25 made in 1938, on record in the Weld County Clerk's office clearly shows this airport and my access to it. The purposes of my concern were to purchase this property and make my home on this airport. A place to keep my airplane, build a house and retire in 1988. Closure of, or over restrictive mandates will seriously devalue and totally destroy my retirement and my home. A flying community near Erie, Colo., saw land values go from $400. per acre to $18,000. in less than 10 year on the strength of a airport runway. How much tax has that generated? You mention in your letter to Chairman Johnson, Weld County Commissioners that: 1 . Additional information is needed--You are surrounded with information, - every fixed base operator will be happy to show you anything you wish. Air- craft Owners and Pilots Association publish the Airmans Information Manual and Airport Directory annually. These publications address every concievable question. You hav'nt done your homework. 2. Mr. McDonald should have been present--Why dignify this absurbity with an acknowledgement? Surely you realize people have things to do besides being available at someones elses convenience. Why don't you take him a sandwich and jug of coffee, and just ask him what you need to know? 3. No of Airworthy Aircraft--What is next Ms Renner, boats, Campers, motorcycles, Lawnmowers, Weedeaters, Chainsaws, and what about that old Church, must you do it in too? An airworthy airplane is an investment by the owner, taxed by numerous agencies, insured'usually by locals, maintained by locals, Inspected 2. by Federally Licensed Inspectors. Very few private airplanes fly 200 hours a year, some very little. Thier purpose provide the owner with a means of recreation, a hobby, something to go pet Sunday afternoon and visit with the guys & gals, but the utility value defies description--It is 918 miles from Denver to Dallas--18 hours of hard driving, or 6 hours in just a very small airplane. Inagine San Diego and back--today. 4. 5. 7. & 8. --We go weeks at a time with no takeoffs or landings. You disagree with uncontrolled air traffic. The last time I checked, the state of Kansas had 1 (1 ) controlled airport--Salina. They are the home of Cessna and Beech Aircraft Companies, and they produce the most pilots of any state except Alaska. Colorado has 10 controlled airports. Buckley Air National Guard, Butts A.F.B., and Airforce Academy, military and generally avoided by general aviation. Jefferson County, Grand Junction, Aspen, Pueblo are part time under specified hours. This leaves 3 full time controlled airports in the state of Colorado. Stapleton, Arapahoe, and Peterson.--I submit you dont know what controlled-uncontrolled traffic means. You elude to safety and fire protection when you can't think of anything else but you fail to tell us where to go to have a fire or break a leg in complete comfort and safety. An airman from the first day is drilled and browbeat with procedure and technique. Prevention is the solution, but practice is the only known cure. Aircraft are required to have fuel shut-off, Master shut-off, Ignition Shut-off, all controlled independently by the pilot. Fire is bad news but there isn't an Airport in the world completely immune to fire or accident. What is your answer to banana skins on the sidewalk, roller skates at the top of the stairs or soap in the bathtub? 6. Hours of operation: Visible Flight Regulations as defined by the F.A.A. are practiced world wide. Maybe some day they will be as smart as Tri-Area Planning Commission. tr The F.A.A. has previously defined this airport. Thier reply to your inquiry will no doubt be short and firm. I consider the action of Tri-Area Planning Commission a serious threat to our community. The airport is NEEDED. It is not Tax Supported. It has provided many community services, and for a long,long time. I consider your actions and statements a flagrant violation of my rights under the 4th ammendment of the constitution. In looking at the application it nowhere states that Longmont Rural Fire Protection or the Ambulance District have been notified to make provisions in case of an emergency. It was suggested that Longmont Rural Fire Protection physically see the set up proposed by Mr . McDonald . 8 . We do not feel that this proposal provides adequate protection for the health, safety and welfare to the neighborhood and County. At the request of a member of the Tri-Area Planning Commission , the Chair , Iva Renner will be calling the regional FAA office to find out exactly what the rules and regulations are for this type of situation . Further discussion brought about this statement from George Snead , Councilman for the Town of Frederick . Mr . George Snead said , "as a member of the Frederick Town Board he is very much opposed to this request and legal action should be taken if this is pursued . After great discussion the Commission denied application and directed a letter to Mrs . Jacqueline Johnson , Chairman of the Board of County Commis- sioners , Weld County, explaining why we did not approve this application . A copy of this letter is enclosed for your informa- tion. During discussion of this application a point was made concerning the access road you would like to have on your property to the now existing airport. Have you considered what this type of situation would do to your insurance rates if it were approved? And , most importantly, have you taken into consideration the safety and welfare of your family and home should this pass? It is our job as a Planning Commission to take into consideration the safety and welfare of all in the community , as it also is , to look at expanding future growth.
