RE: APPROVAL OF RECORDED EXEMPTION NO. 720 - POLOHASKE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 720 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 720 was
submitted by Ralph and Eleanore Polohaske for property which is
located in the NW4 SW4, Section 22 , Township 6 North, Range 62
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 4 acres and 37 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Ralph and Eleonore
Polohaske. The parcel of land on which this request is being made is
described as the NWT SW1;, Section 22, T6N, R62W of the 6th P.M. , Weld
County, Colorado. The property is located 9 miles east of Barnesville;
south of Weld County Road 68. The parcel of land under consideration is the
total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 4 acres and 36.9
acres, more or less. Mr. and Mrs. Polohaske propose to divide a parcel of
land that was created by a land contract dated January 4, 1973 (Book 683,
Reception #1604753 in the Weld County Clerk and Recorder's Office) . This
property is a legal lot located in the High Country Farms Subdivision.
Subdivision of this land into 40 acre lots occurred prior to the adoption of
the zoning regulations requiring minimum lot size of 80 acres for irrigated
land and 160 acres for dryland (December 16, 1973) .
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be denied for
the following reasons:
- The request does not comply with Section 9-2 E. the
Standards and conditions for approval of a recorded
exemption. Tt is the responsibility of the applicant to
demonstrate that the proposal is consistent with the
intent of the district in which the use is located.

- The subject site is located in an Agricultural Zone
District outside of a projected town growth area. The
minimum lot size in the Agricultural Zone District is
eighty (80) acres for irrigated land and one hundred
sixty (160) acres for dryland. The further subdivision
of a 40.9 acre parcel into two (2) lots is inconsistent
with efficient and orderly development in the
agricultural zone district outside of a projected town
growth area.
- It is the responsibility of the applicant to demonstrate
that the proposed use will be compatible with the future
development of the surrounding area as permitted by the
existing zone and with future development as projected
by the Comprehensive Plan of the County.
- The Weld County Future Land-Use Map indicates the type
of development at the subject location is intended to
remain agricultural and the zone district is intended to
remain agricultural.
As explained in the Comprehensive Plan on page forty-four (44) , "scattered
development in rural areas has other implications. Residential development
in rural areas necessitates an increase of public service to that area.
More people in the area places additional strain on expenditures for road
maintenance, police protection, fire protection, and educational services.
It has not been demonstrated that the increased revenues generated by
development will pay for the required new facilities and services.
The creation of an additional building site through the recorded exemption
process will have little impact on the need for services; however, if the
recorded exemption becomes the norm and numerous similar proposals are
granted, the above impacts can be expected to develop.
Tn this regard, the cost of County services can be reduced if development is
encouraged around existing population centers and future town growth areas.
Development in town growth areas reduces the conflict that arises between
rural and urban land-uses.

or modify which would make the request more palatable to the Planning

The requested Recorded Exemption is to divide a 40.91 acre parcel into
two lots of 4 acres and 36.91 acres. The purpose is to divide the current
residential portion of the property from the larger, unoccupied portion.
Mrs. Polohaske, the co-owner of the proposed Recorded Exemption property,
suffers from chronic obstructed pulmonary disease and diabetes. Because of
this, she and her husband cannot profitably use the entire 40.91 acre parcel and
can use the income from the sale of the proposed 36.91 acre lot for health-
related costs and fixed living expenses.
The land included in the proposed Recorded Exemption is located in the
A-Agricultural Zoning District. The 32 Sections in which the proposed
Recorded Exemption property is located were divided into seventy-two 40 acre
parcels in 1973 and sold as exurban residential lots. The land, according to
the General Topographical Map of Weld County, is range land, and, according to
the Land Use Map of Colorado, the land ranges from range land to sage brush;
therefore, the division of this parcel will not take prime agricultural land
from production or break up a large block of agricultural land or degrade the
agricultural economy of Weld County. The existing uses surrounding the proposed
Recorded Exemption include residential , grazing, and some farming. The proposed
Recorded Exemption would not affect these surrounding uses, nor would it interfere
with orderly development in the area. The area is marginal land for agriculture,
and little or no development is foreseen in the near future other than the ex-
urban residential use now in existence.
The proposed Recorded Exemption is not located within an Overlay District
Area.
Well water is available on both parcels. A septic system exists on the
proposed 4 acre parcel , and the 36.91 acre parcel will support a septic
system. Both parcels have access to a County-maintained road.

261338 Thallium Scan of the Myocardium
This 49 year old female was admitted for evaluation of arrhythmia .
She is a diabetic . There are no current cardiac medications .
Resting EKG suggests an inferior wall myocardial infarction of
indeterminate age . The stress echocardiogram demonstrates 1 to
1 . 5 mm. ST wave depression in horizontal leads . There were no
ectopics . BP response was adequate .
Thallium Scan : Following intravenous injection of 2 mcs . of
Thallium 201 without apparent reaction , there is a slight decrease
in activity in the area of inferoapical distribution . This is
approximately equal between rest and stress and would suggest an
area of scar . There is nothing to indicate an area of ischemia
at this time . The differential between stress aid rest is best
a-preciated through the computerized counts rather than purely
by observation .
IMPRESSION: ABNORMAL THALLIUM MYOCARDIAL SCAN SUGGESTING
INFARCT IN THE INFEROAPICAL AREA .
NO APPARENT AREA OF ISCHEMIA IS IDENTIFIED .
