RE: APPROVE REVOCATION OF SPECIAL USE PERMIT #427 , ISSUED TO 31
DISPOSAL, STAN RECH, OWNER AND OPERATOR
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on April 16 , 1986 , a Show Cause Hearing, continued
from January 8 , 1986 , and February 26 , 1986 , was conducted to
consider revocation of Special Use Permit #427 , issued to 31
Disposal , Stan Rech, Owner and Operator, and
WHEREAS , Stan Rech was neither present nor represented at
said hearing, nor was he present or represented at the two
previous hearings , and
WHEREAS, the Board heard all the testimony offered concerning
this matter , and having been fully informed, finds that the burden
of proof has been met as to violations of Development Standards 1,
3 , 7 , 11 and 14 of Special Use Permit #427 , and
WHEREAS, the Board deems it advisable to revoke Special Use
Permit #427 , issued to 31 Disposal , Stan Rech, Owner and Operator,
and
WHEREAS, the Board deems it advisable to proceed with
enforcement if, as of August 6 , 1986 , the reclamation of the site
has not been completed in accordance with the Closure and
Reclamation Plan filed by Stan Rech.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, the burden of proof has
been met as to violations of Development Standards 1 , 3 , 7 , 11 and
14 of Special Use Permit #427.
BE IT FURTHER RESOLVED by the Board that Special Use Permit
#427 , issued to 31 Disposal, Stan Rech, Owner and Operator, be,
and hereby is, revoked.
BE IT FURTHER RESOLVED by the Board that enforcement shall
proceed if, as of August 6 , 1986 , the reclamation of the site has
not been completed in accordance with the Closure and Reclamation
Plan as filed by Stan Rech.

The following business was transacted:
I hereby certify that pursuant to a notice dated November 27, 1985, and
duly published December 26, 1985, in the Johnstown Breeze, a public
hearing was _conducted to show cause for revocation of Special Use
Permit #427, issued to Stan Rech, dba 31 Disposal. Lee Morrison,
-Assistant County -Attorney, made this matter of record, and said this
hearing tad been continued from February 26, 1986. Keith Schuett,
representing the Planning Department, presented information regarding
Mr. -Rech's failure to comply min the Development Standards. He said
Mr. -tech informed the Planning Department that he would _cease
operations effective October 26, 1985, but has failed to _comply with
Development Standard 014, regarding procedures to be followed upon the
cessation of activities, and the Closure and teclamation flan submitted
by Mr. Rech to the Board on January 8, 1986. Mr. Schuett distributed
copies of photographs showing the current level of water in the ponds
to members of the Board. (Tape Change #86-28) -Wes -'otter, Health
Department representative, spoke concerning the present condition of
the facility, -which has been closed, and stated that the site is not
ready for the revegetation aspect of the Closure and Reclamation P1-an.
Mr. ;tech vas neither present nor represented. Following discusssion,
Commissioner Kirby moved to revoke Special Use Permit #427 And proceed
with enforcement if, as of August 6, 1986, reclamation has not been
completed in accordance with the Closure and Reclamation Plan filed by
Mr. Rech. Commissioner Brantner seconded the motion and it carried
unanimously.
This Certification was approved on the 21st day of April, 1986.

It is the opinion of the Department of Planning Services staff that on June
7, 1985, July 15, 1985, and November 7, 1985, Development Standards #1, 3,
7, 9, 12, 15, and 16 as approved for SUP-427:80:7 were not in compliance.
On October 15, 1985, the Department of Planning Services received a letter
from Mr. Stan Rech stating that 31 Disposal will voluntarily cease to accept
production water and frac gel effective October 26, 1985.
Development Standard #4 for SUP-427:80:7 states as follows:
"4. Upon cessation of operations at the site all structures shall
be removed to 30" below grade and all ponds or pits shall be
filled and graded so as to conform with the surrounding
terrain. The Special Use Permit area shall be reclaimed to a
farmable state upon completion of the operations. The
property shall be seeded in wheat or alfalfa or other
appropriate ground cover approved by the Soil Conservation
Service."
Based upon the information, the Department of Planning Services staff
requests that the Board of County Commissioners revoke SUP-427:80:7.

Mr. Rech presented a closure and reclamation plan to the Board of County
Commissioners on January 8, 1986, as stated below:
1. The disposal ponds will set undistrubed so that the brine liquid can
evaporate totally from the pits. This will take approximately six
months or until August, 1986.
2. At such time as the pond beds are dry enough to allow equipment to
drive through, any excess salt and salt laden soil will be removed to a
designated landfill. Material to be removed will be tested for EPA
toxicity levels at Health Department Laboratory. At the completion of
this phase, the site will be inspected by the Health Department staff
to insure that no material is left that may possibly leach into the
groundwater table.
3. Upon approval from the Health Department, the remainder of the pond
structures will be pushed-in and the site graded to a farmable
condition.
4. The site will be seeded to what or rye as a cover-crop to control
fugitive dust.
5. The groundwater quality will be monitored for two (2) years after this
closure to evaluate imapct.

4-9-85 A complaint was received from the Weld County Health Department
stating that the Development Standards for SUP-427 were not in
compliance.
6-7-85 The property was inspected. It was determined that Development
Standards 1, 3, 7, 9, 13, and 14 for SUP-427 were not in
compliance.

6-11-8e A letter was mailed to Mr. James Taylor, Manager of 31 Disposal
stating that Development Standards #1, 3, 7, 9. 13, and 14 were
not in compliance.
6-19-85 Mr. Taylor inquired about the violation.
6-20-85 A letter was mailed to Mr. Taylor outlining the action that
needed to be taken to remedy the noncompliance. Copies were
mailed to Mr. Stan Rech and Mr. David Folkes.

7-15-8e The property was reinspected. Some progress is being made to
start repairs to the facility.
7-25-85 A notice of the August 7, 1985, Probable Cause Hearing was mailed.
7-30-85 A report was received from Hydro-Search, Inc. , on the technical
specifications for earthwork on Lagoons 1 and 2.
8-7-85 A Probable Cause hearing was held on SUP-427. It was determined
that this case should be continued to November 1, 1985, to allow
Mr. Rech time to bring the property into compliance.
10-15-85 A letter was received from Mr. Stan Rech. The letter states that
31 Disposal will voluntarily cease to accept production water and
frac gel effective October 16, 1985.
11-2-85 Notice of the November 27, 1985, Probable Cause hearing was
mailed.
11-7-85 A copy of a letter was reviewed from Mr. Rech. This letter was
addressed to the customers of 31 Disposal. The letter stated that
"due to the County Regulations and Specs, Weld County (31
Disposal) will be shut-down October 26, 1985, until further
notice.

11-7-85 The property was reinspected. The facility is still not in
compliance and production water is still being accepted.
11-27-86 The Board, after reviewing the evidence and testimony , found
that there is probable cause to schedule a Show Cause Hearing on
January 8, 1986.
12-26-86 Mr. Rech submitted a Use by Special Review application for a
crude oil reclamation facility at the same location as SUP-427.
1-8-86 A Show Cause Hearing was conducted on SUP-427. The Planning
Department recommended that this matter be continued to February
26, 1986, to allow enough time for the new Use by Special Review
application to be heard by the Board.
1-8-86 Mr. Rech submitted a closure and reclamation plan to the
Department of Planning Services.
2-18-86 USR-720 for the crude oil reclamation facility was reviewed by
the Planning Commission and sent to the Board with a
recommendation of denial.
2-27-86 A Show Cause hearing was conducted on USR-427. The Planning
Department requested that this matter be continued to April 16,
1986, to allow enough time for USR-720 to be heard by the Board.
X 26-86 The Board of County Commissioners denied USR-720:85:68 for a
crude oil reclamation facility.

Zoning Ordinance, a public hearing will be held in the Chambers of the Board
of County Commissioners of Weld County, Colorado, Weld County Centennial
Center, 915 10th Street, First Floor, Greeley, Colorado, at the time
specified. All persons in any manner interested in the matter are requested
to attend and may be heard.
Should any interested party desire the presence of a court reporter to make
a record of the proceedings, in addition to the taped record which will be
kept during the hearing, the Clerk to the Board's Office can be contacted
for a list of court reporters in the area. If a court reporter is obtained,

In •order to comply with the requirement of Development Standard #4 of the
Special Use Permit, 31 Disposal will accomplish the following:
1. The disposal ponds will sit undisturbed so that the brine liquid can
evaporate totally from the pits. This will take approximately 6
months or until August, 1986.
2. At such time as the pond beds are dry enough to allow equipment to

On December 27, 1985 Mr. Stanley Rech submitted a complete USR #720:85:68.
This USR is to be presented to the Planning Commission on February 4, 1986.
The Board of County Commissioners would then hear the case on February 26,
1986.
Due to this new application the show cause public hearing scheduled for
January 8, 1986 for USR-427:80:80 should be continued until February 26,
1986.

/ 1. The water and oil fluids recycling and disposal site granted by this Special
Use Permit on the hereon described parcel is limited to the facilities shown
hereon. Said facilities shall be:
a. Emergency Lagoon - lined with bentonite with dimensions as shown hereon;
b. Main Lagoon #1 - lined with bentonite with dimensions as shown hereon;
c. One 200 barrel tank for use by Amoco Oil Company;
d. Five 400 barrel tanks for use by Amoco Oil Company;
e. Three 300 barrel tanks;
f. Parking area with dimensions as shown hereon;
g. Skim Pit (Pit #2) with dimensions as shown hereon;
h. Settling Pit (Pit #1) with dimensions as shown hereon;
i. One circulating pump and motor;
j . One 8' x 10' structure for use by operator.
Additionally, all uses permitted by right in Section 3.3 of the Weld County Zoning
Resolution are allowed within the Special Use Prmit area.
're-iv-Access to the Special Use Permit area is limited to one access point shown
:hereon. The access shall have the approval of the Weld County Engineering
Department. The access shall be constructed in accordance with the recom-
mendations and/or requirements of the Weld County Engineering Department.
All private interior roads shall be graveled. Any damage caused to Weld County
roads due to seepage created by this request shall be cause for immediate re-
vocation of this permit and repairs shall be the financial responsibility of
the owner and/or operator.
, 3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems. Representatives or members of the
Weld County Health Department, Weld County Department of Planning Services
Zoning Inspectors and/or Colorado Department of Health shall be granted access
onto the site at any reasonable time in order to insure the operations car-
ried out on the site comply with all applicable Weld County and State Health
Regulations.
4. Upon cessation of operations at the site all structures shall be removed to
30" below grade and all ponds or pits shall be filled and graded so as to
conform with the surrounding terrain. The Special Use Permit area shall be
reclaimed to a farmable state upon completion of the operations. The property
shall be seeded in wheat or alfalfa or other appropriate ground cover approved
by the Soil Conservation Service.
5. Storage of oil field drilling and associated equipment shall not be permitted
within the Special Use Permit area.
6. Parking on County Roads 18 and 31 will be prohibited. Parking will only be
allowed within the property described hereon. 3

-7. Construction of the lagoons and bentonite blanket embankment shall be in
--- accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the Chen and Associates Subsoil Investigation
Report, Job No. 19,083, dated August 29, 1979. Capacity of the pond shall be
constrained by the designed capacity and actual size of the ponds as constructed
in accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the above report #19083 by Chen and Associates.
8. The settling pit, skim pit, and lagoons as shown hereon, shall be screened -
with a one-inch wire mesh to prevent wildlife gaining access to the pit. -
r9. There shall be a groundwater well to monitor possible leakage from the evapora-
\,.�tion ponds and other pits on the property. The Weld County Health Department
and the State Health Department shall have access to this well at all times
to determine possible contamination of the groundwater. This well shall be
installed as per Weld County Health Department guidelines for depth to ground-
water table. -
10. The Weld County Health Department shall be given notice wi-tfiin a 24 hour period
of use of the emergency lagoon by the operator of the site. Such use must be
a true emergency and not for normal storage of water or normal operations of
the site. This provision does not exclude the operator from keeping 12 to 18
inches of water in the emergency lagoon to prevent the bentonite lining from
drying out.
11: The freeboard allowance for all dikes designed to retain water or other fluids
shall be as specified by the Weld County Health Department.
12. All pits, lagoons, and other excavations containing water at any time shall
be lined with bentonite or other impervious material as per State and County
Health Department guidelines to prevent seepage to the groundwater.
13. The operator shall provide measuring devices in all lagoons which will not damage
the bentonite lining. Said device shall be easily accessible and easily visible
to the Colorado Department of Health and Weld County Health Department.
The lagoons may be fenced with a barbed wire security fence which shall be placed

no closer than 30 feet to the lagoon.
iltPThe Special Use Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Regula-
tions. Any material deviations from the plans and/or Development Standards
as shown or stated above shall require the approval of an amendment to the
Special Use Permit by the Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Development Standards shall be per-
mitted. Any other changes from the plans and/or Development Standards shall
be filed in the office of the Department of Planning Services.
16 The property owner and/or operator of this operation shall be responsible for
0 complying with all of the above stated Development Standards. Noncompliance
with any of the above stated Development Standards shall be reason for revocation
of the Special Use Permit by the Board of County Commissioners.

Subject: 31 Disposal SUP 402 amended to SUP 427:80: 17
Recent field inspections and sampling at the disposal site and
along WCR 31 to the west of the site indicate that the evaporation
ponds may be leaking. An inspection of the facility revealed that
the operators of the disposal site are in violation of development
standards 1, 3, 7, 9, 13, and 14, as listed on the special use permit.
I am, therefore, requesting that the department of planning staff
evaluate these problems and consider scheduling a show-cause
hearing before the Weld County Commissioners.

6th P.M. , Weld County, Colorado.

After reviewing the operation standards for 31 Disposal, I conducted an
on—site inspection.
Upon entering 31 Disposal, I met Mr. Jim Taylor, the operations manager who
showed me around the premises.
31 Disposal is in need of an overhaul of the entire premises. After looking
at the tanks I observed the settling ponds, Mr. Taylor admitted the settling
ponds needed to be cleaned and I agreed. The netting protecting the
settling ponds from wildlife, were actually touching the pond and had gaping
holes in them. Mr. Taylor then showed me the evaporating ponds and the
emergency pond. All of the ponds were very questionable as far as the
quality of the bentonite and the protection it is supposed to serve.
Hydro Search, Inc. is doing a study on the property as far as effectiveness
of the evaporation ponds. There are 7 new ground water testing wells on the
property. The result of the tests show that there is brine water in the
ground water. There may be a question of the integrity of the bentonite
liner in the evaporation ponds. This information was confirmed by the Weld
County Health Department.
In summing up my report, I determined that 31 disposal is in violation of
development standards 1, 3, 7, 9, 13, and 14. I would highly recommend a
total evaluation of the special use permit.

LOCATION: Approximately 1.5 miles northeast of Ft. Lupton on Weld
County Road 18 and 31.
It is the opinion of the Department of Planning Services staff, that the
following Standards as approved for SUP-427:80:17 are not in compliance:
The Special Use Permit site was inspected on November 7, 1985. The
inspection indicated that the brine water disposal is in violation of
Development Standards 1, 3, 7, 11, and 14 of SUP-427:80: 17. The Special Use
Permit standards in violation along with the staff comments are listed
below.
1. The water and oil fluid recycling and disposal site granted by
this Special Use Permit on the hereon described parcel is limited
to the facilities hereon.
- The brine water disposal facility was approved with
specific standards for lining the main lagoon and
emergency lagoon with bentonite. An inspection and
ground water test by the Weld County Health Department
on March 18, 1985, indicated that the bentonite liner
has deteriorated to a state that seepage of brine water
is occurring into the ground water.
3. All phases of the operation shall comply with all County and State
health standards and regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
- The groundwater tests completed by the Weld County
Health Department in March of 1985, indicated that the
ground water is being contaminated with brine water and
is in violation of the Colorado ground water quality
regulations.
7. Construction of the lagoons and bentonite blanket embankment shall
be in accordance with the designs as shown on the Special Use
permit plat.
- The results from the groundwater tests indicated that
the emergency lagoon and the main lagoon linings have
deteriorated and are leaking. The present condition of
the lining in both lagoons is not in accordance with the
approved Special Use Permit. .ii

11. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards shall be reason for revocation of the Special Use permit
by the Board of County Commissioners.
14. All pits, lagoons, and other excavations containing water at any
time shall be lined with bentonite or other impervious material as
per State and County Health Department guidelines to prevent
seepage to the ground water.
Ground water tests performed by the Weld County Health
Department indicate that seepage from the bentonite
lined lagoons is occurring and that the groundwater in
the area is being contaminated with brine water.
The Department of Planning Services staff recommends that the Board of 0J)1 1y4
County Commissioners schedule a "Show Cause" public hearing on DettA,cr-31,
1985, to consider revocation of SUP-427:80:17. This recommendation is
based, in part, upon a review of the approved application materials for
SUP-427:80:17, a field inspection of the site on November 7, 1985, along
with comments and observations by the Weld County Health Department and
information submitted by the owner and operator of 31 Disposal.

After allowing Mr. Rech the additional 56 days of time as granted by the Board
of County Commissioners' resolution, to bring 31 Disposal into compliance,
Wes Potter, of the Weld County Health Department and I inspected the
property.
Mr. Rech notified us that he voluntarily closed his operation on October 26,
1985.
During the inspection we observed that no sign or gate prevented anyone from
going to the site and that there appeared to be fresh tire tracks from a
tanker truck on the access road.
Mr. Potter and I observed that the north pond was filled with brine water.
Previously this pond was drained and was to receive the first liner in order
to repair the deteriorated liner. The lagoons have not been repaired as was
the purpose of the 56 day extension. Mr. Potter and I both observed a
receipt filled out by Flint Trucking that they delivered brine water on
November 5, 1985. this receipt was observed in a shack where the haulers
complete their delivery receipts. After these observations, we talked to
Vicki Taylor who assists in the management of 31 Disposal.
Mrs. Taylor stated that all of the haulers were notified by a letter that
was mailed to them. Mrs. Taylor also stated that she was unaware of the
delivery on November 5, 1985.
Mr. Potter asked Mrs. Taylor to close and lock the gate that accesses to the
disposal since they have voluntarily closed the facility.
In conclusion, none of the work had been completed by Mr. Rech on the
emergenc r main lagoons to correct the deteriorated liners.

After reviewing the operation standards for 31 Disposal, I conducted an
on—site inspection.
Upon entering 31 Disposal, I met Mr. Jim Taylor, the operations manager who
showed me around the premises.
31 Disposal is in need of an overhaul of the entire premises. After looking
at the tanks I observed the settling ponds, Mr. Taylor admitted the settling
ponds needed to be cleaned and I agreed. The netting protecting the
settling ponds from wildlife, were actually touching the pond and had gaping
holes in them. Mr. Taylor then showed me the evaporating ponds and the
emergency pond. All of the ponds were very questionable as far as the
quality of the bentonite and the protection it is supposed to serve.
Hydro Search, Inc. is doing a study on the property as far as effectiveness
of the evaporation ponds. There are 7 new ground water testing wells on the
property. The result of the tests show that there is brine water in the
ground water. There may be a question of the integrity of the bentonite
liner in the evaporation ponds. This information was confirmed by the Weld
County Health Department.
In summing up my report, I determined that 31 disposal is in violation of
development standards 1, 3, 7, 9, 13, and 14. I would highly recommend a
total evaluation of the special use permit.

Subject: Maintenance of Lagoon Liners at 31 Water Disposal
Dear Stan and Linda:
This letter outlines recommended lagoon liner maintenance activities at the
31 Water Disposal site near Ft. Lupton, Colorado.
In order to ensure that the lagoon liners control seepage as required by
your Use by Special Review permit, we recommend that the existing bentonite
liners be covered by a flexible polymeric membrane liner. The synthetic
membrane and the bentonite admix liner combine to form a "composite" liner
that takes advantage of the positive features of each individual liner to
provide a high degree of seepage control . The membrane liner controls
seepage by virture of its very low permeability, while the bentonite
restricts seepage at any small discontinuities that may exist in the
membrane (e.g. , pinholes , small seam gaps, etc.) .
Installation of the membrane liner will require drying out of the lagoons,
dressing up the existing bentonite liner surface, placement and seaming of
the membrane, and coverage of the membrane with 12 inches of on-site sandy
soil . The soil on side slopes of the lagoons should be further protected
by six inches of gravel .
It may be necessary to excavate a perimeter trench around the east, north,
and south sides of the lagoons to draw down the natural water table.
Discing and recompaction of the lagoon bottom may be necessary to dry out
the surface and prepare it for liner installation. Once free liquid is
pumped from the lagoons , it may require one to two weeks of dry weather,
plus discing, to dry out the bottoms.
We suggest transferring brine from the north lagoon to the south lagoon,
and working on the north lagoon first. Once the north lagoon is finished,
brine can be transferred to the north lagoon, and any water remaining in
the south lagoon will have to be allowed to evaporate. For this reason,
you may wish to consider receivinging less brine during the repair period.
The evaporation time required for the south lagoon will depend on the
amount of water remaining after transfer of the maximum amount possible to

the north lagoon (with adequate freeboard) , and the subsequent rate of
evaporation. Note that as the brine level decreases, total dissolved
solids will increase, decreasing the rate of evaporation by about one
percent for each one percent increase in salt content.
In order to allow for the soil cover placed over the liner and provide two
feet of freeboard with three feet of brine, the lagoon berms should be
raised by about three feet. is as

Mr. Taylor informed me that the contractor should begin work during the
first full week of August. Weather permitting.

TECHNICAL SPECIFICATIONS FOR EARTHWORK LAGOONS 1 AND 2
1. Work Covered
The work covered by these specifications includes supply of
all equipment, materials, and labor necessary to carry out
the work; stripping, regrading, and compacting the interior
of Lagoons 1 and 2; stripping vegetation and topsoil from
the exterior slopes of Lagoons 1 and 2; raising the existing
berms to the lines and grades shown on the drawings; prepara—
tion . of the finished lagoon interiors for liner placement;
excavation and backfill of the anchor trenches; placement of
sand and gravel cover materials over the PVC liner; top—
soiling and seeding the berm exterior slopes ; drying and
piling any stripped material from the lagoon interiors into a
regularly shaped mound, covering the mound with topsoil, and
seeding the mound with grass.
The work on Lagoon 2 (north lagoon) shall commence first.
Lagoon 1 shall be drained and allowed to dry out when Lagoon
2 work is completed. However, work can commence on the
exterior slopes of Lagoon 1 prior to completion of Lagoon 2
work-
2. Preparation of Lagoon Interiors
The interiors of Lagoons 1 and 2 shall be prepared for
installation of the PVC liners as shown on the drawings.
Two options are available, as described below:

2.1 Option A
The interior sideslopes and bottoms of the lagoons shall be
dried, regraded to a uniform surface, and compacted to a
minimum dry density of 90% of the Standard Proctor Dry
Density (SPD) , using smooth drum compactors. It is antici—
pated that, at a minimum, it will be necessary to work the
material with light equipment on wide tracks, and to mix the
muck and existing bentonite clay liner (see Section 2.2) with
the subgrade material, e.g. , by discing, to promote drying.
2.2 Option B
The lagoon interiors are currently lined with a bentonite
liner approximately eight inches thick. The bentonite liner
is highly plastic and wet. and is overlain by a few inches
to a foot of oily muck. It may be very difficult to dry
this material, particularly during rainy periods. Therefore,
an option is to strip the bentonite and muck from the
lagoons, and to dispose of the material outside the lagoons.
Stripping shall not go below the bottom of the bentonite
liner, in order to maintain the maximum height possible
above the local ground-water table. The stripped interior
of the lagoons shall be regraded to a smooth, uniform
surface, as shown on the drawings . The regraded surface
shall be compacted to a minimum dry density of 90% SPD,
using smooth drum compactors.
Stripped material shall be spread to dry on an area of the
property that is on high ground, outside of any drainage
channels or depressions that might collect water during rain
•
storms . The drying area shall be slightly sloping to
promote drainage and shall be cleared of vegetation. A small
ditch shall be excavated around the drying areas to collect

surface run-off from the stripped material. Collected water
shall be pumped into the lagoon currently in operation.
The stripped material shall be allowed to dry to the extent
that when mixed with no more than an equal volume of native
soil. the material can be pushed into a stable mound with 3
(horizontal ) to 1 (vertical) sideslopes, of a maximum
six-foot height. The material shall be pushed into a mound
as soon as possible- covered with six inches of native
topsoil, and seeded with native grasses. The surface of the
mound shall be sloped at all points to promote run-off and
prevent ponding of water on the surface.
The two options for preparation of the lagoon interiors may
be combined; that is, portions of the lagoon interiors may
be disked and dried in place. such as on the sideslopes, and
wetter areas may be stripped. However, the final regraded
interiors of the lagoons shall be uniform, and the lagoon
bottoms shall be level.
3. Raising of Berms
The existing berms around Lagoons 1 and 2 shall be raised so
that the final berm crests are six feet above the bottom
elevations of the lagoons, as shown on the drawings. The
present berm crests are approximately three feet above the
bottom elevations of the lagoons. Therefore, if the lagoon
interiors are prepared by the Option A method described in
Section 2 .1 of these specifications, the berms will have to
be raised approximately three feet. If Option B (Section
2.2) of the specifications is followed, then the lagoon
bottoms will be lowered, and the berms will have to be raised
by a lesser amount to achieve a six-foot overall depth.

The berms shall be raised to the dimensions shown on the
drawings and according to the following specifications:
3.1 Stripping of Berm Exterior Slopes and Top Surface
The exterior slopes of the berms and all areas to be covered
by the final berms shall be stripped of vegetation and
topsoil to remove the potential plane of weakness that this
material would create if left in place. The vegetation shall
be wasted on site in an area designated by the Owner, and
topsoil shall be stockpiled for later use.
The top ( road) surfaces of the berms shall be stripped of
any vegetation, topsoil, or otherwise objectionable material.
It is suspected that the road surface is underlain by
bentonite. This material shall be stripped, as specified in
Section 2.2 of the specifications, or reworked, as specified
in Section 2 .1 , as required so that the surface can be
compacted to a minimum dry density of 95% of SPD.
Drainage ditches around the existing berms that will be
covered by the final raised berms shall be cleaned of any
vegetation, mud, and other soft, compressible materials.
3.2 Fill Material for Berm Construction
The berms shall be raised using on-site native sandy fill,
borrowed from high ground areas to the west of the lagoons.
The fill shall be free of organics , topsoil, debris, mud,
and snow.

3.3 Fill Placement and Compaction
Fill material used to raise the berms shall be placed in
uniform, horizontal lifts of six inches maximum thickness .
The fill shall be placed in a direction parallel to the
longitudinal axis of the berm, and shall be brought up at
the same rate on all sides of the lagoons.
Placed fill shall be compacted to a minimum of 95% of SPD
using smooth drum vibratory compactors. Water shall be
added to the fill as necessary to achieve the required level
of compaction. Lagoon water shall not be used for this
purpose.
Fill material shall not be placed in a frozen state, and
shall not be placed on a surface which is frozen or on snow
or ice-
4. Final Preparation of Lagoon Interiors
The final graded surfaces of the lagoon interiors shall be
smooth. uniform, and free of gravel, large lumps of soil,
sharp objects, and any sudden changes in grade. The lagoon
interiors shall be prepared to these standards immediately
prior to installation of the PVC liner by the Owner. The
Contractor is cautioned that the surface may have to be
re—worked to meet these standards if rain causes deteriora—
tion of the surface before placement of the PVC liner. The
Owner shall arrange to install the PVC liner the day after
the lagoon interior is prepared to these standards. The
Contractor shall wait until the Owner indicates he is ready
to install the liner.

5. Anchor Trenches
The Contractor shall excavate anchor trenches around the
lagoon crests just prior to installation of the PVC liner,
as snown on the drawings. Material excavated from the anchor
trenches shall be stockpiled away from the lagoon sideslopes.
Once the liner is installed, the Contractor shall backfill
the anchor trenches, taking care not to damage the liner, and
shall compact the anchor trench backfill with several passes
by the wheel or track of the excavating equipment.
6. Soil Cover
The Contractor shall place a sandy soil cover over the
installed liner as shown on the drawings . The sandy soil
used for the cover shall be borrowed on-site, and shall be
free of gravel or other sharp objects. The sandy soil cover
material shall be placed by light equipment on low-pressure
tracks or tires. The cover shall be placed on the bottom of
the lagoon first and then pushed up the sideslopes. Cover
material shall not be placed in a downwards direction on the
sideslopes, as this will adversely tension the liner. A
minimum of 12 inches of cover material shall be maintained
below the placement vehicle (s) . The placement vehicle (s)
shall avoid sharp turns on the cover, as such turns may
damage the liner - Access to the pond interior shall be on a
ramp of cover material, built in a corner of the lagoon.
The ramp shall be built from the bottom up using a backhoe
to place the sand. The sandy soil cover shall be, in turn,
covered by a six-inch depth of pit run gravel on the side-

7. Topsoil and Seed
The exterior slopes of the finished berms shall be covered
with four to six inches of topsoil obtained from the stock—
piles and shall be seeded with native grasses.
8. Observation and Testing
The work covered by the specifications shall be observed by
a representative of the Owner on a periodic basis. If it is
observed that these specifications are not being met, the
representative shall inform the Owner and Contractor, and
the Contractor shall act to bring the work within the
specifications. This shall not relieve the Contractor of
the responsibility of ensuring that his work meets these
specifications.
Observations made by the Owner 's representative may include
field density tests to determine whether tested areas are
compacted to the standards of these specifications. The
Contractor shall adjust his compaction procedure as necessary
to meet the compaction requirements. The Contractor shall
be provided with the results of Standard Proctor tests for
the materials subject to compaction as soon as possible
after work commences.

Notice is hereby given that on November 27, 1985, at 9:00, or as soon
thereafter as the agenda of the Board of County Commissioners permits, the
Board of County Commissioners of Weld County will hold a Probable Cause
public hearing pursuant to Section 81 of the Weld County Zoning Ordinance.
This meeting will take place in the Commissioners' Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado.
The purpose of this public hearing will be to review case number ZCH-7:85:7
for compliance with the Development Standards as approved by the Board of
County Commissioners on October 31, 1979, to determine if probable cause
exists to hold a hearing on revocation of SUP-427.
Inspection by representatives of this office have identified that you are
not in compliance with Development Standards #1, 3, 7, 11, and 14 of
SUP-427.
If it is determined at the public hearing that there is probable cause that
you are not in compliance with Development Standards #1, 3, 7, 11, and 14
the Board of County Commissioners will schedule a Show Cause public hearing
to consider revocation of the Use by Special Review permit.

This USR is to be presented to the Planning Commission on February 4, 1986.
The Board of County Commissioners would then hear the case on February 26,
1986.
Due to this new application the show cause public hearing scheduled for
January 8, 1986 for USR-427:80:80 should be continued until February 26,
1986.
31 DISPOSAL CLOSURE AND RECLAMATION PLAN
In order to comply with the requirement of Development Standard #4 of the
Special Use Permit, 31 Disposal will accomplish the following:
1. The disposal ponds will sit undisturbed so that the brine liquid can
evaporate totally from the pits. This will take approximately 6
months or until August, 1986.
2. At such time as the pond beds are dry enough to allow equipment to
drive through, any excess salt and salt laden soil will be removed
to a designated landfill. Material to be removed will be tested for
EPA toxcity levels at Health Department Laboratory. At the
completion of this phase, the site will be inspected by the Health
Department staff to insure that no material is left to potentially
leach into the ground water table.
3. Upon approval from the Health Department, the remainder of the pond
structures will be pushed in and the site graded to a farmable
condition.
4. The site will be seeded to wheat or rye as a cover crop to control
fugitive dust.
5. The ground water quality will be monitored for two (2) years after
this closure to evaluate impact.
