RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (DECORATIVE
ROCK SALES AND DITCH CLEANING BUSINESS) IN THE A
(AGRICULTURAL) ZONE DISTRICT - THOMAS AND PEGGY FISHER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 22nd of November, 1989, at the hour of 10 : 00 a.m.
in the Chambers of the Board for the purpose of hearing the
application of Thomas and Peggy Fisher, 20525 Weld County Road 50,
LaSalle, Colorado 80645, for a Site Specific Development Plan and
Special Review Permit for an agricultural service establishment
(decorative rock sales and ditch cleaning business) in the A
(Agricultural) Zone District on the following described real
estate, to-wit:
Part of the Si SE* , Section 33, Township 5
North, Range 65 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Thomas Fisher, one of said applicants was present,
and
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows:

a. The proposed Special Review Permit area is located
within the Urban Growth Boundary Areas of the City
of Evans and the Town of LaSalle. Both
municipalities reviewed the request and have no
objections to this proposal. The location of the
Special Review Permit area and attached Conditions
and Development Standards make the proposed use
consistent with the Urban Growth Boundary Area
Goals of the Weld County Comprehensive Plan.
b. The proposed use is consistent with the intent of
the A (Agricultural) Zone District and is provided
for as a Use by Special Review.
c. The uses permitted will be compatible with the
existing surrounding land-uses and with the future
development of the surrounding area as permitted by
the A (Agricultural) Zone District.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development. Plan and Special Review Permit for an
agricultural service establishment (decorative rock sales and
ditch cleaning business) in the A (Agricultural) Zone District on
the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the Weld County Clerk and
Recorder' s office within 15 days of approval by the
Board of County Commissioners .
2 . No building or electrical permits shall be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.

3 . Prior to recording the Special Review Permit plat map, a
screening plan for the equipment and parts storage area
shall be submitted to Department of Planning Services
for review and approval. The approved screening plan
shall be incorporated into the application materials and
shown on the Special Review plat map.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
November, A.D. , 1989 .

1 . The Site Specific Development Plan and Special Review Permit
is for an agricultural service establishment (decorative rock
sales and ditch cleaning business) as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . Waste oil, waste paints, anti-freeze, and other associated
liquid and solid wastes, shall be stored and removed for
final disposal in a manner that protects against surface and
groundwater contamination.
4 . An Air Emissions Permit shall be obtained from the Colorado
Department of Health, Air Pollution Control Division, for
control of fugitive dust and odors if required.
5. No permanent disposal of wastes shall be permitted at this
site.
6 . All rock materials shall be handled, stored, and transported
in a manner that controls fugitive dust, blowing debris, and
other potential nuisance conditions.
7. Fugitive dust must be confined on this site.
8 . The maximum permissible noise level shall not exceed the
industrial limit of 80db (A) , as measured according to
25-12-102, Colorado Revised Statutes.
9. Employee toilet facilities shall be installed according to
the Weld County Individual Sewage Disposal Regulations.
10. All noncommercial junkyard materials stored outside of the
buildings shall be screened from public rights-of-way and
adjacent properties.
11 . The approved screening plan shall be maintained at all times.

12 . The property shall be maintained at all times in compliance
with SARA Title III .
13 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
14 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
15 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
16 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
17 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
18 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated October 30, 1989, and
duly published November 9, 1989, in The New News, a public hearing was
conducted to consider the request of Thomas and Peggy Fisher for a Site
Specific Development Plan and Special Review Permit for an agricultural
service establishment (decorative rock sales and ditch cleaning
business) in the A (Agricultural) Zone District. Lee Morrison,
Assistant County Attorney, made this matter of record. lanell Curry,
representing the Planning Department, entered the favorable
recommendation of the Planning Commission into the record. Tom Fisher,
one of the applicants, came forward to answer questions of the Board.
He said he has no objections to the Conditions and Development
Standards contained in the Planning Commission's recommendation.
Commissioner Lacy moved to approve the request of Thomas and Peggy
Fisher for a Site Specific Development Plan and Special Review Permit,
subject to the recommended Conditions and Development Standards.
Seconded by Commissioner Kennedy, the motion carried unanimously.
This Certification was approved on the 27th day of November, 1989.

APPEARANCE:
Stephen Janssen, -Attorney, Boulder, Colorado, represented DCS Construction,
Inc. The applicants have reviewed the recommendation, conditions, and
Development Standards prepared by the Department of Planning Services'
staff. They are in concurrence with these. They have else reviewed the
screening requirement and will comply with these. They have met vith the
surrounding property owners and there has been no -opposition to their plan.
Larry Addison, Panhandle Eastern Pipeline Company, stated they are not
against this proposal, -but they -do have a gasline running -through the
property. Prior to any beginning any construction, they -would appreciate
being motified so they can review the location of any proposed structures.
The Chairman asked that the recommendation, conditions, and -development
standards prepared by She Department -of Manning Services staff' be filed
with -the summary as a permanent :record these proceedings.

1 . The Site Specific Development Plan and Special Review permit is for an
agricultural service establishment (decorative rock sales and ditch
cleaning business) as submitted in the application materials on file in
the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Article -68 of Title 24 C.R.S. , as amended.
3. Waste oil, waste paints, anti-freeze, and other associated liquid and
solid wastes, shall be stored and removed for final disposal in $
manner that protects against surface and groundwater contamination.
4. An Air Emissions Permit shall be obtained from the Colorado Department
of Health, Air Pollution Control Division, for -control of fugitive dust
and odors if required.
5. No permanent disposal of wastes shall be permitted at this site.
6. All rock materials shall be handled, stored, and transported in a
manner that controls fugitive -dust, blowing debris, and other potential
nuisance conditions.
7. Fugitive dust must be confined on this site.
8. The -maximum permissible -noise level shall not exceed the industrial
limit of 80db(A) , as measured according to 25-12-102, Colorado Revised
Statues.
9. Employee toilet facilities shall be installed according to the Weld
County Individual Sewage Disposal Regulations.
10. All noncommercial junkyard -materials -stored outside of the buildings
shall -be -screened from public rights-of—way and adjacent properties.
11. The approved screening plan shall be maintained at all times.
12. The property shall be maintained $t all times in compliance with SARA
Title III.
13 . All construction on the property shall be in accordance -with the
requirements of the Weld County Building Code Ordinance.

14. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.

16. Personnel from the Weld County Health Department and Weld County
Department of Planning Services -shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development St-andards
stated -hereon and all applicable Weld County-Regulations.

In reviewing the application from Thomas and Reggy Fisher. I find no
conflict with our operation. I would request that Thomas and Peggy Fisher
review the chemicals listed in the Superfund Amendment and Reauthorization
Act, SARA, Title III on a periodic basis to verify they have no chemicals
that require reporting. The proposal states there will be no chemicals so
this is only an awareness item at this time.
There is also a mention of "fuel storage tanks" on the proposal. SARA Title
III does require reporting of any fuels stored in excess of 10,000 lbs. or
about 1250 gallons. There are also reporting requirements for fuel storage
in below ground tanks.

Planning Commission on Tuesday, October 17, 1989, at 1:30 p.m. This meeting
will take place in the County Commissioners' Rearing Room, first floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado. It is

Re: Use By Special Review
Gentlemen:
Ditch Cleaning Specialists, Inc. , dba D C S Construction, lne. has been in business
for ten years. We specialize in ditch, canal, and drainageway maintenance and
construction. Our area of work is in about a 100 mile radius of LaSalle, Colorado.
The five acre tract of land that this 'Use By Special Review' is for is used primarily
for our office headquarters. During the Spring of each year we clean and maintain
agricultural ditches and canals in Weld County. wring this period we use this
property for construction equipment maintenance and parking during downtime. When
the agricultural work slows in early summer we move our men -and equipment to a shop
and yard in Henderson, Colorado so we can be closer to drainageways in and around the
Denver area that we work on. Our office staff remains in the LaSalle office year
round. The office :,gaff consists of two to three girls and one to two rock salesmen,
depending on the time of year.
Since our construction equipment and personnel arc in Henderson eight to nine months
a year our LaSalle lot is standing vacant during this same time. With the equipment
we have we doe large amount of riprapping on canals and drainageways so we are
familiar with most of the rock quarrys in the front range and we decided to sell
decorative rock in the bulk and store the decorative rock at the -LaSalle yard. We
have cleaned up the five acre tract and have arranged the stockpiles and bins to be
very pleasing to the eye from the county road. The majority of material we store is
decorative rock or stone products which do not blow in the wind or create dust. Our
driveway and yard are graveled to keep down dust from vehicles and to keep from track—
ing mud onto the county road. 11ds past year we averaged three walkin customers per
day. Since we are a bulk sales company the majority of our sales is over the phone
and we deliver the material or we have it delivered directly from the supplier. This
past year only 19$ of material sold was hauled away by our customers. The average,
over a six month period, of material delivered to our yard was two (2) trucks per
week.
We do no rrnnufacturing of materials so there is no noise pollution, air pollution or
hav,)nlous material pollution. All of our material is natural, i.e. , stones, rock,
gravel, boulders, timbers, woodchips, etc.

The surrounding properties are agriculturally oriented with animals,
residences, farm equipment and crops. The residential structures in the
vicinity of our yard are noted on the enclosed nap.
At present, we have twenty two Full time employees, which is normal for
summertime activity. Only three of the employees work at the Ta:Salle
yard daily. The rest report to and work out of the Henderson yard.
All of our employees are residents of Weld County, and drive their
personal vehicles back and forth to the Henderson yard.
The LaSalle yard office is open from 7:00 A.M. to 6:1)0 P.M. , weekdays
and from 9:00 A.M. to 4:00 P.M. , on Saturdays during the summer.
We have Central Weld water at our-place -of business and are on a septic
tank and leach field system.
The access routes for the property are as marked on the attached map and
are all on Weld County Road 50.
We arc in the LaSalle Fire Protection District and are apporximately 1
3/4 miles from the Fire Station. We have fire extinguishers in the shop,
office _and all pickups and trucks. There is also a. well behind the -office
for added water if needed and an irrigation well on the SW corner of our
property if needed to draft into fire trucks.
We do not deal in or store any hazardous material or wastes, other than
our diesel fuel and gas for our company vehicles only. Besides the
decorative rock stockpiles mentioned before, we store some construction
materials to the back (North end) of the lot -that have teen removed from
projects or waiting to be used on a project, i e: irrigation pipe, PCP,
form lumber, rebar, etc. We also keep equipment that is not being used
at the back (north end) of the lot.
We have not changed the water run off from the way it has always been_and
will not because we will not be constructing any large areas on concrete
or asphalt slabs.
Most ail debris and waste from projects are -transported directly to -the
dump as part of the project and not brought to the yard. Materials that
do find their way to the yard are disposed of, as the office and -shop
trash are, in a dumpster at our yard that is emptied by -the trash company
once a. week. Other construction related items i.e: broken or old form
lumber, rebar waste, etc. , are -hauled to the dump by us a couple times
a. year.
The Weld County _Comprehensive: Plan and the intent of the District is to
maintain productive agricultural land. We have not removed any productive
agricultural land from production and our business is very agriculturally
related in that the work we do allows Ditch Companies and farmers to get
the water to the crops.

Also, our drainageway work is -extermely important in stopping or controlling
land -erosion and property damage. The decorative rock sales portion of our
business helps offset the overhead of the La-Calle yard that is so important
to us during the busy spring months of the ye.r when we are trying to keep
up with the needs -of the farmers and ditch companies in -getting ready to
run water.
All our jobs are off site and therefore, pose no health, safety or welfare
problems. We are not in a flood plain, geologic hazard area or airport
overlay area.
Attached please find a copy of Central Weld Water Districts tap permit
and a. copy of our Deed identifying the property.
Tom and Sue Fisher are the owners of -the property and are also the owners
of Ditch Cleaning Specialists, Inc.
We have attached letters from the majority of our neighbors and as you
can see they have no objection to our operation. In fact, most of them
feel our business adds -clot of color and neatness -to the -area.
We feel we are providing a. good living for -several Weld County_families
and by working during the summer, fall, and winter in the Denver area,
all our Weld County employees are bringing back monies made from that
area and spending them in Weld County.
We feel D C S Construction, Inc. and the decorative sock bulk sales are
an asset to Weld County and not at all -a -determent. We hope that after
careful consideration you will agree with us and look upon this request
favorable.

4—Aquolla and Armenia, flooded. This nearly level
map unit is in depressions in smooth plains and along the
bottoms of natural drainageways throughout the survey
area. Aquolls, which have a dark colored surface layer,
make up about 55 percent of the unit. Aquepts, which
have a lighter colored surface layer, make up about 25
percent. About 20 percent is soils that are well drained
and soils that have sandstone or abate within 48 inchesaf
the surface.
These are deep, poorly drained soils that formed In
recent alluvium. No one pedon is typical. Commonly the
soils have a mottled, mildly to-moderately alkaline loamy
or clayey surface layer and underlying material that ex-
tends to a depth of 60 inches or more. In places they have
a gleyed layer in the underlying material.
Most of the acreage is subject to excessive runoff. The
water table is at or near the surface in spring and_during
the peak of the irrigation season.
These soils are used for rangeland and wildlife habitat.
Someamall areas are irrigated pasture.
The potential native vegetation is dominated by
switchgrass, prairie cordgrass, saltgrass, alkali sacaton,
big bluestem, indiangrass, western wheatgrass, slender
wheatgrass, sedge, and rush. Cattails and bullrush grow
in the swampy spots associated with these range sites.
Potential production ranges from 4,000 pounds per acre in
favorable years to 3,000 pounds in unfavorable years. As
range condition deteriorates, the tall and mid grasses decrease, production drops, and saltgrass, sedge, and rush
increase.The farming and irrigation in adjacent areas has .•
increased the amount-ofaalts on much of the acreage.
Management of vegetation on this soil should be-based
on taking half and leaving half of the total annual produc-
tion. Switchgrass, big bluestem, indiangrass, western
wheatgrass,-pubescent wheatgrass, intermediate wheat-
grass, tall wheatgrass, and tall fescue are suitable for
seeding. The plants selected should met the seasonal
requirements of livestock. For successful xteeding,-a firm
prepared seedbed is needed. A grassslrillshould be used.
Seeding early in spring has proven most successful. Til-
lage is needed to eliminate the undesirable vegetation.
Wetland wildlife, especially waterfowl, utilize this unit.
The wetland plants provide-nesting and protective cover
as well as some food. The nearby irrigated cropland,
where wildlife obtain-much-of their food and find protec-
tive cover, makes this unit valuable to both wetland and
openland wildlife.
Openland wildlife, especially pheasant, use this unit for
cover and nesting. Deer find excellent cover in some
areas. These valuable wildlife areas should be protected
from fire and fenced to prevent encroachment and
overuse by livestock. Theyahould not be drained. Capa-
bility subclass Viw; Aquolls in Salt Meadow range site,

Gentlemen:
Please be advised that we have been neighbors of D C S Construction, Inc. since.
their inception ten years ago. During this time we have not found this company
to be a detriment to our community.
We are aware that they have started selling decorative rock, but do not feel
this addition to their business puts an excess traffic load on Weld County Road
50, where the business is located.

To Whom it May Concern:
Let it be known that I, Jim Highly have resided at the
residence 20270 Weld County Road 50, LaSalle, -Colorado
since May of 1976. During this time, I haven't noticed any
more than normal traffic growth. Any increased traffic, in
my estimation is from normal growth of the residence that
have resided a number of years in the area. Whereas, area
residents that have reached driving age are now on the road.
Also , the oil fields have increased traffiic and farm traffic
is also heavy during summer months.
I haven 't noticed excessive traffic since the addition
of the gravel business at DCS Construction Inc. , 20525 Weld
County Road 50 , LaSalle, CO.
