ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT , made and entered into this 14th day of
October , 1987 , by and between the COUNTY OF WELD , STATE OF
COLORADO, hereinafter called "County" and ASSOCIATED NATURAL
GAS , INC . , hereinafter called "ANGI" .
WHEREAS , ANGI has been issued a Use by Special Review
Permit to add a Fractionation Unit to the existing gas plant
located in the SESW of Section 25 , Township 5 North, Range 66 w
West of the 6th Principal Meridian , and J U,

WHEREAS the addition will increase truck traffic to the .z• py
plant and increase dust and x C)
WHEREAS the County Commissioners have requested the paving z w
a portion of Weld County Road 52 ( 49th Street) z o

NOW, THEREFORE , in consideration of the mutual covenants c N
and conditions hereinafter set forth , the County and ANGI t�
mutually agree as follows : En F,

1 . Accesses onto Weld County Road 52 from the new property z L
shall be limited to two.
n
2 . Truck traffic shall be limited to the west on Weld t
County Road 52 or north on Weld County Road 35 ( 35th NI-,
Avenue) when leaving or returning to the site. 2-

3 . Weld County Road 52 shall be improved from ANGI ' s east '.y ~
property gate west to existing pavement at the n
intersection of County Road 52 and County Road 35 . The
improvements shall consist of a 4" thick by 24 foot m -
wide hot bituminous asphalt . Per verbal agreement with o
Drew Sheltinga ( 10/ 13/87) , decision as to whether or [g o0
not base material will be required will be made by the e-
Weld County Engineering Department before the paving is d
installed . In any case the base will not be more than n
6" thick and shall be #6 agrigate. o

4 . ANGI , through the paving contractor yet to be named , ow
O
will warranty and maintain the improved portion of
County road 52 for a period of one year , after such
time the County shall be responsible for maintenance.
5 . All construction and materials shall be in accordance
with the State Department of Highways , Division of
Highways , State of Colorado , Standard Specifications
for Road and Bridge Construction , latest edition .

6 . The County will provide testing and inspection for the
construction .
7. ANGI will improve the above mentioned portion of County
Road 52 after the Fractionator Unit is installed .
Construction of road to be completed by 1 , October „yc,
1988 .

-Subject:
I have reviewed the proposed Road Improvement and Maintenance Agreement
submitted by Associated Natural Gas. They have agreed to add gravel to
Weld County Road 123 from State Highway 14 to their plant gate. Also, they
agreed to pave the access when they generate ten semi-trailers per day.
Their proposed agreement is sufficient to mitigate the impact of the
proposed oil and gas facility.
