CARIASO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of July, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Catherine W. Cariaso, 0750 Highway 60 , Loveland, Colorado 80537 , for a Use by Special Review for a pottery studio on the following described real estate, to-wit: Part of the NE4, Section 6 , Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4 . 2 of the Weld County Zoning Ordinance as follows: 8s0t.a1 04ay Page 2 RE: USR - CARIASO a. The proposal is consistent with the Comprehensive Plan and is consistent with the intent of the Agricultural Zone District. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The use is both compatible with existing agricultural activities and with any future agricultural use as identified in the Comprehensive Plan. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a pottery studio on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The applicant shall comply with the State Division of Highways recommendation to improve width and turning radius of the existing driveway which accesses State Highway 60 . 3 . The applicant shall satisfy the concerns of the Berthoud Fire Protection District regarding the kiln. The use permitted shall be a pottery studio as described in the application materials on file in the Department of Planning Services. 2 . The applicant shall operate the kiln in accordance with the Berthoud Fire Protection District regulations. 3 . The applicant shall maintain recommended improvements to the driveway for improved accommodation of two-way traffic. 4 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 5 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 6 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated herein and all applicable Weld County Regulations. 7 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8. The liquid petroleum gas container shall be moved to a minimum distance of 25 feet from the kiln. Page 2 OPERATION STANDARDS - CARIASO 9 . All combustible material shall be kept a minimum of ten feet from the liquid petroleum gas container. 10 . Two 2A10BC portable fire extinguishers shall be mounted on the wall next to each exit. 11 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Cariaso for a Use by Special Review for a pottery studio. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. Ms. Dunn stated that eight Operation Standards were recommended by the Planning Commission and the Planning staff would like to recommend three additional Operation Standards, which were recommended by the Berthoud Fire Protection District. She then read the three additional Operation Standards into the record. Catherine Cariaso, the applicant, was present to answer questions of the Board. She stated that she would comply with all of the proposed Operation Standards. No comments were made by members of the audience concerning this request. After discussion, Commissioner Lacy moved to approve this request for a Use by Special Review, subject to the Conditions and the Operation Standards as recommended. She uses an old barn that is on the property for her pottery business and there has been no changes to the land. She holds two shows a year on the property: one in the spring and another one at Christmas. These are usually held on the week-end. Most of her work is sold on consignment and in bazaars. Her kiln is an outdoor kiln and none of her firing is done inside. The Chairman asked Ms. Cariaso if she had read the recommendations, conditions, and operation standards as outlined by the staff. My commission expires_ - Description of Proposed Operation POTTERY STUDIO BY CARIASO The main use will be as a pottery studio for the production of creative and artistic functional and non-functional stoneware and porcelain, hand-thrown by Dodie Cariaso. Ms. Cariaso supports herself by full-time operation of her pottery business, as sole-proprieter . There are no employees . She sells her pottery through galleries and gift stores, and also to a few patrons who like to visit her in her rural -country studio. The maximum number of customers that might be out to visit the studio at one time would occasionally be 5-6 cars . The access is from State Highway 60. There is ample parking space and room to turn around so that departing cars enter the highway straight forward. Ms . Cariasopicks up her own supplies and delivers all her orders herself , so there is no large delivery truck traffic. The pottery studio sits 150 feet to the south of the house and 250 feet south of Highway 60. Most of the surrounding area is all agriculture, as is Ms. Cariaso ' s property . The house sits about 1 /4 mile from the home of neighbor Dean Hanes , 1 /2 mile from the home of Ted Shrague, and 3/4 mile from Floyd Hale. Ms . Cariaso also raises and shows paint horses and has a decorative duck and goose pond. Water used in the studio is from the Little Thompson , and a septic system is in use. There is no waste, stockpile, or storage involved in the operation of the pottery business . An outdoor kiln is used that meets all fire code regulations , and is enclosed by a privacy fence. The Loveland Rural Fire District handles calls in this area . The operation of the business causes no noise or pollution of any kind. It is , quite simply, a quiet artist-pottery studio, solely owned and operated by Dodie Cariaso. This proposal is consistant with the Weld County Comprehensive Plan in that it will not ,be using any prime agricultural land already in existance. All the buildings were present when the property was purchased by Ms Carioso in 1981. She will not be building any new buildings for this proposal. Her pottery business provides adequate protection of health and safety of the inhabitants of the neighborhood and the county. Since this pottery studio sits -4 mile from the nearest residence, there is no noise, pollution or hinderance to the neighbors. It is therefore compatable with existing land uses (agricultural) and with future develop— ment of surrounding area.
