no Weld County Clerk and Recorder based upon the petition of owners
� ,._, of forty-four of the seventy-eight lots in the "developed"
portions of said Indianhead Subdivision. The petition has. been
filed with the Clerk to the Board to construct certain
improvements on Weld County Road 15 , as described in this
Resolution , and
WHEREAS , notice of a public hearing concerning creation of
the District and the construction and installation of the
improvements therein has been given by publication in one issue of
the Johnstown Breeze , a newspaper of general circulation in the
County, not less than thirty days prior to the date of hearing , in
addition , a notice was delivered or mailed by first class mail to
each property owner within the proposed district not less than ten
days prior to the hearing, and
WHEREAS, at the time and place set forth in the notice, the
Board of County Commissioners met in open session for the purpose
of hearing and considering any objections and protests that might
be made against the proposed district or the improvements to be
constructed or installed, and

finds and determines that there exists a necessity for the

designated as Weld County Indianhead Local improvement District

certain improvements , said improvements are in the best interest:;
of the inhabitants of the area .
w a NOW, THEREFORE, BE IT RESOLVED by the Board of County

A. That a local improvement district for the construction
and installation of street improvements, to include
compaction , grading, paving and culverts, together with
any necessary incidentals on certain streets as
co w hereinafter described, is hereby created and established
in accordance with the laws of the State of Colorado,

z and shall be known and designated as "Weld County
o Indianhead Local Improvement District No. 1987-1 . " All
proceedings heretofore taken by the Board of County
w Commissioners and the County staff and then adopted in
connection with the district are hereby ratified,
co r--- approved and confirmed. This proposal to create said
N N district was initiated by the Board of County
'" '" Commissioners by Resolution of May 13 , 1987 , upon a
w riq petition, proper in form, subscribed by a majority of
the owners of property who will bear the cost of more
than 1/2 of the total proposed assessment in the
district and notice duly given as heretofore stated .
B. That the Engineer' s reports, together with all of the
details , specifications , estimates , maps and schedules
thereto attached or appended , are hereby approved and
adopted.
C. That the area to be included within the district
includes a portion of Indianhead Subdivision located in
the NEq of Section 18 , Township 5 North, Range E7 West
of the 6th P.M. , County of Weld , State of Colorado, more
particularly described as Lots 1-16 inclusive, Block 1;
Lot 1-9 inclusive , Block 2; Lots 1-16 inclusive , Block
3; Lots 1-8 inclusive, Block 4; Lots 1-14 inclusive,
Block 5; Lots 1-7 inclusive & Lots 18-25 inclusive,
Block 6; of Indianhead Subdivision as recorded at Book

E. That the construction and installation of the

plans , specifications and maps thereof, prepared by the
r m Weld County Engineer and approved by the Board of County
Commissioners of Weld County, and now on file in the
office of the Clerk to the Board , he, and the same arc

in the construction of said improvements to be in
z accordance with such maps , plans , and specifications .

a Probable cost of the improvements to be assessed to
a property within the District, based upon best
information available to this Board and formulated in
co o good faith , is $6 , 766 . 00 . Based on the findings and
c-2 r determination of this Board, each of the lots described
H �' in Paragraph C is to be specifically benefitted and each
ma lot shall be assessed equally on a per lot basis the
costs for materials and labor for the paving in the
amount of $86 . 54 per lot. The County contribution wi1:.
be in the form of installation of base course , culvert ,
grading, engineers and administrative fees.
F. That the assessment to be levied for the improvements
shall be due and payable within thirty (30) days after
the effective date of the assessing Resolution or
Ordinance. However, all such assessments may be paid at
the election of the owner, in ten equal , annual
installments of principle with installments of interest
on unpaid installments at an interest rate of ten
percent (10%) simple interest per annum. The first of
said installments of assessment shall be due and payable
prior to May 1 , 1988 , or at such time as map be
indicated in the assessing Resolution or Ordinance . The
remainder of the annual installments or assessments and
annual payments of interest shall be due and payable
successively on the same day each year thereafter until
all are paid in full.

G. That the Board of County Commissioners, pursuant to

NO. 1987-1 , FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING STREET
IMPROVEMENTS TO INCLUDE COMPACTION, GRADING, PAVING, AND CULVERTS, TOGETHEk
WITH ANY NECESSARY INCIDENTALS, IN CERTAIN ROADS THEREIN, AND OF A PIJBLL+
HEARING THEREON.

All owners of real estate and property hereinafter described an( all
persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has adopted a Resolution declariog
its intention to create a local improvement district withir as
unincorporated area of Weld County, Colorado, to be designated as Weld
County Indianhead Local Improvement District No. 1987-1 , for the purpose o;"
constructing and installing street improvements to include compac:fon,
grading, paving, and culverts, together with any necessary incidentals , and
to assess the cost of certain of said improvements against the property
specifically benefited by the improvements as proposed by petition of owners
of the property who would bear more than one-half of the total proposed
assessments within the district, all in accordance with the laws O1 the
State of Colorado.
1. Ail persons are further notified that the kind of improvenerts
proposed and the streets to he improved are as follows:
Weld County, Colorado, plans to widen, grade, and pave
Weld County Road 15 adjacent to the Subdivision from
U.S. Highway 34 through the intersection with Algonquin
Road. The improvements include grading, paving, and
ocher appurtenances.
The major construction quantities include approximately
490 tons aggregate base course, 37f tons of hot
bituminous pavement, 60 linear feet of corrugated steel
pipe.
2. The area to be included within the district includes a portion of
:[ndianhead Subdivision located in the NE} of Section 18, Township 5 Nortt,
Range 67 West of the 6th P.M. , County of Weld, State of Colorado, more
particularly described as Lots 1-16 inclusive, Block 1; Lots 1-9 inclusive,
Block 2; Lots 1-16 inclusive, Block 3; Lots 1-8 inclusive, Block 4; Lots
1-14 inclusive, Block 5; Lots 1-7 inclusive & Lots 18-25 inclusive. flock 6 ,
of Indianhead Subdivision as recorded at Book 758, Reception ?/1680236 on
January 30. 1976, in the records of the Weld County Clerk and. Recorder .
3. The assessments for said improvements may be paid in ten ( ( )
equal annual installments of principle with installments of interest on
unpaid installments at an interest rate of ten percent (107) simple interest
per annum.
4. The assessment will be due and payable without demand aith:n
thirty (30) days from and after the final publication of a resolution cr
ordinance assessing the cost of said improvements, against the real prcperty
described as the described lots in Indianhead Subdivision. In the evert any
owner of real property shall fail to pay the whole of such assessment
against his or her property within said thirty (30) days, then the whole
cost of the improvements so assessed against such property shall be payable
in not more than ten (10) equal, annual installments of principle with
interest on the unpaid installments, as aforesaid. The first of such
installments shall be due and payable at such time as may be determined an
and by the assessing resolution or ordinance and the remainder of said
installments shall be due and payable successively on the same day in each
year thereafter, unless otherwise determined by the Board of County
Commissioners, until are paid in full.
5. As shown by the estimates of the Engineer, the total cost cf the
street improvements to he assessed against the property within the district
will not exceed six thousand seven hundred fifty dollars ($6,750.001 . This
represents the cost of labor and materials for installation b) County
personnel of the hot bituminous pavement. The remaining improvements w:LJl
be installed by Weld County as its contribution to the local improiemr_rt
district and will not be assessed against the properties. The Board cf
County Commissioners, pursuant to CRS, 30-20-606, has found and determined
that each and every described lot in Indianhead Subdivision will specially
benefit from the proposed improvements based on the following facts:
a. The market icalue of each of the properties will increase ; and
b. The proposed improvements will adapt the property to a mole
profitable use; and
c. The proposed improvements will facilitate access to each cf
the properties and thereby increase the convenience of the use of said
property.
Based on the findings and determinations of the Board of County
Commissioners, it is intended that all of the costs of the street
improvements will be assessed equally against all of the lots within
Indianhead Subdivision listed at paragraph 2 herein.
Property owners are specifically referred to the schedule of estimated
proposed assessment on file in the office of the Clerk to the Board from
which the approximate amount to be assessed against any particular lot ca
parcel of property may be determined.
6. It is anticipated that special assessment bonds will not le
issued.
7. Upon completion of said improvements, or as soon as the total cost
thereof is definitely ascertained, the cost, of the improvements shall le
apportioned equally to each of the described lots in Indianhead Subdivision.
Notice of such apportionment shall be given and a hearing will be held prior
to the adoption of a resolution or ordinance assessing such cost, all as
provided by law.
8. Not less than thirty (30) days after the publication cf this
Notice, a resolution authorizing said improvements will be considered bi the
Board of County Commissioners, to-wit: June 24, 1987, at 2:00 P.M. , or at an
adjourned meeting thereafter, in the meeting room of the Weld Count,/
Centennial Center, 915 10th Street, Greeley, Colorado.
9. A map, estimate, and schedule showing the approximate amount to be
assessed and all resolutions and proceedings are on file and can be sewn and
examined by any person at the office of the Clerk to the Board of County
Commissioners at any time during business hours on or before the date
referred to in paragraph 8.
10. All complaints and objectiot.s that nay be made in writing
concerning the proposed improvements by the owner or owners of any real
property to be assessed will be heard and determined by the Board of Cmurty
Commissioners at the meeting specified above, or at some adjournment
thereof, before final action shall be talen.
All estimates include costs of inspection and collection and ather
incidental costs to be assessed to the District.
