RESOLUTION RE: ACTION OF THE BOARD CONCERNING SHOW CAUSE HEARING TO CONSIDER REVOCATION OF -USE -BY SPECIAL REVIEW #686 ISSUED TO BERNARD AND CHERYL HOOGLAND WHEREAS , the ward of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 16 , 1986 , a Show Cause Hearing was conducted to consider revocation of Use by Special Review #686 , issued to Bernard and Cheryl Hoogland, -and WHEREAS, at said hearing, the Department of -Planning Services informed the Board that necessary documentation has been provided indicating that Bernard and Cheryl Hoogland are now in compliance with the Development Standards of said Use by Special Review, and WHEREAS , the Board deems it advisable to dismiss said Show Cause Hearing without prejudice. The animal waste storage pond (lagoon) , as shown herein, shall be installed in accordance with the Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas as issued by the Colorado Department of Health. The owner or operator shall be responsible for complying with any additional applicable directives or guidelines -issued by the Colorado department of Health. The owner or operator shall construct the animal waste storage pond (lagoon) , 25-year, 24-hour precipitation runoff facilities within 30 days from the date of approval by the Board of County Commissioners. The owner or operator shall provide the Department of Planning Services with written documentation that the Colorado Department of Health, Water Quality Control Division, has approved the animal waste storage pond, 25-year, 24-hour precipitation runoff containment pond, and any associated waste management facilities as constructed within 45 days from the date of approval by the Board of County Commissioners. The 25-year, 24-hour precipitation runoff containment pond is not complete and the Department of Planning Services staff have not received the written documentation that is required. 6. The owner or operator shall be responsible for preparing, implementing, and maintaining an Agricultural Waste Management P1-an on the property. The owner or operator shall provide the Department of Planning Services with written documentation that the Longmont Soil Conservation District has approved the Agricultural Waste Management Plan. The plan shall be approved within 30 days from the date of approval by the Board of County Commissioners. :2 aaa r' The Department of Planning Services staff has not received documentation that the Longmont Soil Conservation District has approved an Agricultural Waste Management Plan. 11. The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld county Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the -Permit by the Weld county Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. The stated standards are not in compliance and no amendments to the standards have been requested. 12. The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. Standards Number 2, 6, 11 are not in compliance at this time. A letter requesting compliance of the Operation Standards within 30 days was mailed to Mr. and Mrs. Hoogland. January 3, 1986 The property was reinspected. Operation Standards 2, 6, 11 and 12 are still not in compliance. January 6, 1986 A notice of the January 22, 1986 probable cause hearing was mailed. January 20, 1986 A copy of the January 22, 1986 probable cause hearing was hand delivered to Cheryl Hoogland. January 21, 1986 Received a letter from Paul Gallegos, Soil Conservation Services Longmont. The letter states that the waste storage pond has been satisfactorily completed and that the runoff storage pond requires some fine grading. January 22, 1986 A probable cause hearing was held and it was determined by the Board that there is probable cause to schedule a show cause hearing on February 26, 1986. January 31, 1986 A letter was received from Mr. Paul Gallegos, Soil Conservation Services stating that both the retention pond and the runoff pond have storage volumes in excess of what is required. The letter also states that the runoff storage pond requires fine grading to be acceptable. February 13, 1986 Notice of the Show Cause Hearing was published in the Johnstown Breeze. DATE: February 25, 1986 TIME: 12:49 p.m. CASE NUMBER: ZCH-19:85:19 The property was reinspected to determine if it i-s now in compliance with the operation standards for USR-686:85:30. Operation Standards #2, 6, 11, and 12 are still not in compliance. The berm along the southwest side of the solid waste separator needs to be moved further west. The 25 year 25 hour percipitation run-off pond still requires final grading on the interior slopes. The proper written -documentation that is required from the Colorado Department of Health, Water Quality Control Division, and from the Longmont Soil Conservation District have not been submitted. Mr. Hoogland has made an effort to bring the property into compliance. This is noticed in she work that has been completed on the berms and the run-off retention pond. Keith A. Schuett Zoning Inspector C INSPECTOR'S REPORT NAME: Bernard Hoogland LEGAL DESCRIPTION OF PROPERTY: Part of the E} E}, Section 17, T3N, R68W of the 6th P.M. , Weld County, Colorado DATE: November 25, 1985 TIME: a.m. CASE NUMBER: USR-686:85:30 An inspection of USR-686 revealed that several of the Operation Standards are not being complied with at this time. - The -25 year, 24 hour precipitation run-off containment pond and berm have not been fully completed. The pond is very near being complete. The major problem is with the berm that will -divert the run-off precipitation into the retention pond. A manure pumping line needs to be completed from the northeast corner of the cow yard to the main lagoon. After this line is laid, the berm may be completed around the cow yard. The Department of Planning Services has not received a -letter from the Longmont Soil Conservation District approving the completed waste management plan. Mr. Hoogland stated that if the weather breaks for about 5 days, he would be able to complete the necessary requirements. I was able to talk to Mr. Bernard Hoogland as he was making repairs to the pump on the manure separator . Mr Hoogland stated that he has not completed the berm along the south side of the property for the waste water runoff, or the 25-year 24-hour precipitation runoff containment pond. I also observed that they were not completed. Mr. Hoogland stated that the Longmont Soil Conservation District and the Health Department would not approve his Agricultural Waste Management Plan until it was completed and in operation. He also stated that he would have had it completed, but the weather was not cooperating. He states that all that is needed is a few good days of weather and he could have it all completed. I informed Mr. Hoogland that I would be scheduling a probable cause hearing and mailing him a notice of the date. Standards # 2, 6, 11, and 12 are not in compliance. #2 The waste storage pond, the 25 year 24 hour precipitation runoff containment pond and associated waste management facilities have not been completed. #6 The agricultural waste management plan has not been approved by the Longmont Soil Conservation District. #11 The Department of Planning Services staff has not received an amendment to the operation standards as stated. The system as designed and built meets our requirements for runoff retention from a 25 year-24 hour precipitation event. Per Federal law (40 CFR 412. 13) , once this requirement has been met no discharge permit is required. Mr, Hoogland is of course still responsible for ensuring that no discharge occurs from his facility into state waters (creek, stream, ditch, etc.) unless a 25 year-24 hour precipitation event is exceeded.
